
In depth: Law Society private client conference
One topic dominated this year's private client conference at Chancery Lane – the Law Commission's long-awaited report on wills reform, which was published a few days earlier.
The report has been long in the making, as law commissioner Professor Nick Hopkins (pictured) explained during the day's final session.
The commission was asked in 2015 to do a scoping report. Following a consultation, the government asked it to pause work and concentrate on weddings. Wills was picked up again post-Covid with a supplementary consultation paper in 2023. 'At the risk of making virtue out of vice, that pause has ultimately been beneficial because attitudes to electronic wills and marriage revoking a will changed in that period of time,' Hopkins said.
The commissioner talked through some of the report's key recommendations. Electronic wills should be permitted. The rule that marriage revokes a will should be abolished. The age for making a will should be lowered from 18 to 16. Only the Mental Capacity Act test should apply to the question of testamentary capacity. The courts should be allowed to deem a will valid where the formality requirements have not been fully met but the deceased's intentions are clear. The commission's draft Wills Bill repeals the 1837 act.
Most private client practitioners agree that the 1837 act should be replaced with new legislation. However, Stephen Lawson, chair of the Law Society's wills and equity committee, predicted many more court battles if, per the commission's recommendations, judges are empowered to infer undue influence. 'It is one of the most common allegations clients make but one of the most difficult to prove,' he told the conference.
On marriage no longer revoking a will, 'you have got to consider the role of cohabitees', Lawson noted.
The conference covered other important ground. With probate and estate administration generating the third-highest volume of reports to the Solicitors Regulation Authority, and some of the largest and most frequent payments from the compensation fund, the regulator shared examples of best and poor practice during its most recent thematic review.

Shortcomings in law firm communications were a big driver of client dissatisfaction, SRA regulatory managers Mel Lothbrok and Siobhan Fennell said. The regulator was surprised to find significant variations in written information given to clients about the estate administration process, given that many people will know little about it. Some firms were providing written information too late in the day, while some regularly exceeded cost estimates without warning clients.
Lothbrok and Fennell said clients should receive the best possible information at the outset and firms should have efficient processes for managing costs, with clients being updated right through to the end of the retainer.
The regulator is also concerned about compliance with accounts rules. The conference heard that one firm obtained a qualified accountant's report but failed to submit it to the SRA. Another firm did not obtain one for several years. A tip for firms: consider asking your accountant for feedback on the strength of your financial controls to address issues and prevent problems down the line.

The conference also covered key changes to personal taxation, the complexities of farming families, understanding the Official Solicitor's role in Court of Protection applications, mental capacity assessments and revoking deputyships, and AI.
The key takeaway from a session on 'advising modern families' was undoubtedly the fact that in surrogacy, the mother or father are not the legal parents of their child in the jurisdiction of England and Wales if they do not have a parental order.
Gender has become another important consideration, the conference heard. James Lister, head of private wealth disputes at Stevens & Bolton, said solicitors are used to drafting and advising on will documents that define beneficiaries by reference to their gender. But 'when you're using protected characteristics to define your beneficiaries, you trespass into dangerous territory'.
Lister added: 'We're not just called on to be advisers about the law anymore. There is a huge element of counselling, ethics and morality that pervades the decisions our clients want to make. They do not care about the legals.' If clients are tied to a set of values they do not ascribe to, 'we're creating a large set of problems'.
Electronic wills may not arrive soon – the government's full response is expected within 12 months – but as the conference showed, private client specialists have plenty of other issues to focus on in the meantime.

The leadership of Johns Hopkins University announced on Monday that it was implementing several belt-tightening measures as it tries to address the financial pressures brought on by the Trump administration's cutbacks in research support and other changes in higher education policies. In a letter to the campus community, Johns Hopkins President Ron Daniels, Provost Ray Jayawardhana, and Executive Vice President for Finance and Administration Laurent Heller identified the financial strains the university had already suffered, and they outlined additional challenges they anticipated were yet to come. Referencing 'a steady stream of research grant terminations, suspensions, and delays,' the leaders wrote that the university had sustained losses of more than $800 from USAID grant terminations. In addtion, since the start of the year, 90 grants have been terminated by other federal agencies, resulting in the reduction of more than $50 million in research funding, 'with more terminations arriving nearly every week.' New federal research grants awarded to Hopkins investigators are down by almost two-thirds since January, compared to the same period last year, and Hopkins leadership said they "fear that this downward trend may be laying the groundwork for deep cuts to the extramural research programs at the NIH, NSF, DOD and DOE…significantly curtailing Hopkins' capacity to undertake our core academic and research mission and to sustain the people who allow us to realize it.' Hopkins had previously taken steps to provide limited bridge funding to researchers whose grants had been suspended or cancelled, but officials acknowledged at the time that they would not be able to 'make up the full measure of recent or potential federal research cuts.' The leaders also pointed to recent attempts by the Trump administration to revoke or withhold visas from international students and scholars as another threat, claiming that 'our international community has always been critical to our research mission, and we are deeply concerned about the toll of this uncertainty on our students and on our university as a whole.' According to the most recent figures from the Institute of International Education's Open Doors report, 10,054 international students were enrolled at Johns Hopkins in the 2024-2025 academic year, representing more than a third of its total enrollment. According to the letter, several other actions 'are gaining steam in Congress" that will impair its ability to carry out its mission. Included among those policies are plans to: As a result of these reductions, JHU leadership identified four steps it would take immediately to stabilize its finances: Hopkins officials did not indicate how much money these four steps might save, but they did write that they expected to make further 'moderate but meaningful" expense reductions in next academic year's budget and were also exploring 'more aggressive actions down the road if needed to safeguard our core mission.' The reductions by Johns Hopkins are just the latest illustration of the mounting financial difficulties that major research universities are facing and the extraordinary steps they are taking to address current or anticipated shortfalls. In just the past month alone, Duke University, Columbia University, Rice University, Michigan State University, the University of New Hampshire, the Catholic University of America and Princeton University have all announced some combination of layoffs, buyouts, hiring freezes and other cost reduction measures. But there is a particular, almost poignant, significance to the cutbacks at Hopkins. It was, after all our nation's first research university, cast in the mold of its European predecessors by its inaugural president, Daniel Coit Gilman. And year in and year out, it ranks first among all institutions in the U.S. for the amount of money it spends for research and development. We can debate the reasons why the Trump administration is targeting leading research universities across several fronts, but there is little question that these institutions— and their mission of discovering and disseminating new knowledge — are being diminished. The immediate consequences of that strategy are now being felt. The long-term damage is likely to be much greater.

Overtime period appears nearly done as budget deals materialize
The Brief Legislative leaders expect this to be the last week to start without a special session announced to vote on final budget deals. Legislators have agreements on every necessary omnibus budget bill. They're still working out policy issues in some cases. The health bill isn't finalized, but a spreadsheet shows MN Care cuts that seem to match an agreement to drop undocumented adults from the healthcare program. The education bill is written out and includes a steady budget for the next two years, but large cuts for 2028-29, mainly to special education. ST. PAUL, Minn. (FOX 9) - The finish line might finally be visible for Minnesota's drawn-out budget deal. 'The end is near' Week three of overtime is here, and leaders expect it to be the last one. Lawmakers tell FOX 9 a special session could happen as soon as Wednesday. Leaders still have some heavy lifting to do in their policy negotiations, but there's an agreement now on the money in every bill, and the details are starting to become public. For example, the health bill isn't written out yet, but a spreadsheet includes major cuts to Minn-Care, which matches an agreement to remove undocumented adults from the program. Steady for now The biggest slice of Minnesota's budget pie is essentially done and Democrats protected some of the changes they made during their trifecta two years ago. "An education formula that is still indexed to inflation," said Rep. Cheryl Youakim (DFL-Hopkins). "And a bill that does not repeal unemployment insurance for our hourly, valuable hourly workers." But Republicans warn this budget could serve as a canary in a coal mine. It leaves funding steady for the next two years — without cuts even to private schools, as the governor had suggested. Cuts coming But in the next budget, this agreement calls for $420 million in cuts that will undoubtedly hit school districts hard. "You look at the declining enrollment, you look at the special ed costs coming up," said Rep. Ron Kresha (R-Little Falls). "I hope that people and school boards and superintendents and teachers alike are looking at this going how are we going to mitigate the risks that are in front of us." Some of the cuts are already laid out — including $48 million in transportation funding for special ed students. "I know the decisions around what programs would receive reductions was not easy," said Education Commissioner Willie Jett. "The hardest one was in special education." Blue Ribbon scalpel Jett will head up a Blue Ribbon commission to chop another $250 million from special education, almost 10% of the entire special ed budget for 2028-29. What's left? And at least one policy issue may still be up in the air. "If any of you have strong opinions either for or against them, seclusion rooms are that issue if you will," said Sen. Steve Cwodzinski (DFL-Eden Prairie). "We're still working on it." The expansion of seclusion rooms that passed in the Senate is not in the fully written education bill, but working group members tell us it's possible this isn't the final version of the bill that'll be up for a vote during the special session.

NRC approves NuScale's small modular reactor plant design

The U.S. Nuclear Regulatory Commission has approved NuScale Power's design for a 462-MW small modular reactor power plant, the U.S. nuclear regulator said on Thursday. NRC completed its technical review of NuScale's US460 in less than two years, ahead of schedule and under budget, it said. The US460 is based on NuScale's 12-module, 600-MW US600 design, which NRC approved in 2020 after more than three and a half years of review. The newly-approved design's larger modules will help NuScale power plants more effectively serve hyperscale data center customers, CEO John Hopkins told investors in November. Data centers represent a key segment for the company as it looks to lock down its first U.S. customer this year. The NRC approval came earlier than expected, according to estimated completion timelines provided by NRC and reiterated by Hopkins on several recent investor calls. NuScale had anticipated a final decision by July, Hopkins said on May 12. The approval could be crucial as NuScale moves through 'advanced commercial dialogue with major technology and industrial companies, utilities and national and local governments,' Hopkins said in March. 'Once we get finalization' for the 77-MWe design, 'we're off to the races,' Hopkins said. NuScale has not announced a binding customer deal. But in its first-quarter investor presentation, the company said it expected a 'firm customer order' by the end of this year. NuScale manufacturing partner Doosan has 12 modules in production now at its South Korea foundry and could deliver up to 20 per year in the near term, Hopkins said on May 12. Its first power plant could be operational by the end of 2030 if it gets a finalized deal soon, he added. For now, NuScale is acting as the nuclear technology subcontractor to Fluor Corp. on a 462-MW power plant project in Romania that could reach a final investment decision early next year. Though it has decreased its stake over time and has said it will continue to do so, Fluor remains a major shareholder in NuScale. NuScale previously had an agreement with Utah Associated Municipal Power Systems for a 462-MW commercial power plant at Idaho National Laboratory. Known as the Carbon Free Power Project, that plant — like the design NRC approved on Thursday — would have used six 77-MW modules. But it was canceled in November 2023 as NuScale's target power price rose toward $90/MWh and interest from UAMPS members failed to materialize. Thursday's approval means the US460 meets 'applicable agency safety requirements' and can be referenced in future reactor construction permit, operating license or combined license applications, NRC said. But before building and operating a US460 plant, NuScale, its development partner ENTRA1 Energy or another entity would still have to apply for one or more of those permits or licenses. That process can take 30 months or longer at present, NRC says. Still, NRC's approval positions its technology as 'the most near-term American SMR power solution,' NuScale said on Thursday. In addition to being the only SMR with NRC design approval, NuScale's SMR technology is one of the few that runs on conventional low-enriched uranium rather than more scarce high-assay, low-enriched uranium. The approval boosts NuScale amid broader momentum for U.S. advanced nuclear companies. On May 23, the Trump administration issued four executive orders to expand reactor deployments, ease regulation and shore up domestic fuel and equipment supply chains. One order would require NRC to review new reactor applications within 18 months, significantly shorter than current timelines. Another would expand the roles of the departments of Energy and Defense in reactor licensing and deployment, potentially creating new pathways for design approvals and expedited siting of power plants on federal land. The GOP budget proposal that passed the House on May 22 gutted most clean energy tax credits while sparing the nuclear industry. Though the Senate is likely to change the bill before it comes up for a final vote, the House-passed version allows reactor projects that begin construction by 2028 to qualify for the full value of the Inflation Reduction Act's technology-neutral investment and production tax credits.
