Madurai: Taking a serious view of the fact that a woman convicted in a disproportionate assets case was allowed to continue in govt service,

directed the chief secretary and additional chief secretary/vigilance commissioner to furnish details of the convicted public servants in service, irrespective of rank.
Justice K K Ramakrishnan directed that the report on the action taken against them under 17(c)(i)(1) of the Tamil Nadu Civil Service (Discipline and Appeal) Rules, 1955, be submitted in a month.
Allowing the convicted public servant to continue in govt service is not only deplorable but also shows apathy on the part of the state govt, the court said. "Rule 17(c)(i)(1) of the Tamil Nadu Civil Service (Discipline and Appeal) Rules contemplates that an employee who is convicted by the competent court of law shall be dismissed from service without any further enquiry.
In this case, the petitioner was convicted and sentenced to undergo imprisonment.
It is shocking to the conscience of the court that no appropriate action is taken against the public servant who was convicted under the Prevention of Corruption Act, and no order of punishment was passed under the said Rules," observed Justice Ramakrishnan.
Petitioner J Amala Jessi Jacquillin joined as an assistant engineer in the rural development and panchayat raj department in 1998 and was promoted as assistant executive engineer, Tuticorin sub-division.

In Sept 2020, disciplinary proceedings were initiated against her following registration of a case for offences under Prevention of Corruption Act. She was accused of accumulating disproportionate assets to the tune of Rs25.40 lakh in her name and her husband's name between Dec 1, 1999, and Mar 31, 2009.
The trial court convicted and sentenced her to three years of rigorous imprisonment. Subsequently, the HC granted her interim suspension of sentence.
In 2022, another charge memo was issued to her. While the proceedings were pending, a promotion list was published without her name, challenging which she filed the present petition.
The judge observed that the petitioner has no right to continue in employment as she was convicted in a disproportionate assets case in 2024. However, she managed to work in the department. The HC had only suspended the petitioner's sentence.
Two charge memos are pending against her. The relief sought in the petition is misconceived, and the petitioner is not entitled to any relief.
Hence the judge dismissed the petition and imposed a cost of Rs50,000 on the petitioner, payable to the credit of the headmaster of Sethupathi govt higher secondary school in Tiruchuli in Virudhunagar district. The case was posted on July 18 for reporting compliance.

"A judge contesting an election for a political office can lead to doubts regarding the independence and impartiality of the judiciary, as it may be seen as a conflict of interest or as an attempt to gain favour with the govt." He said, "The timing of post-retirement engagements could undermine public's trust in judiciary's integrity, as it could create a perception that judicial decisions were influenced by the prospect of future govt appointments or political involvement." Prayagraj: The Allahabad high court has set aside Deoria district magistrate's order dated May 3, whereby he had denied arms licence to sportsperson Gaurav Gupta , who had required it for training and competition purpose. In the decision dated Jun 2, Justice Piyush Agrawal also remanded the matter to Deoria district magistrate, for deciding afresh application of the petitioner for grant of arm licence for sports training and competitions by passing a reasoned and speaking order, after giving due opportunity to the petitioner to cure the defect, if any, as well as to provide all documentary evidence/material, as required under the aforesaid rules, within a period of 15 days from date of production of certified copy of the order. Through the present writ petition, the petitioner, a sportsman, assailed the order dated May 3, passed by Deoria district magistrate, whereby his application for arms licence was rejected. The counsel for the petitioner submitted that in pursuance to the order dated Feb 27 of this court, the licensing authority had rejected the application of the petitioner for grant of arm licence by holding some defects in the sports certificate attached by him. The certificate has been issued to the petitioner as a junior shooter and since the petitioner's category of shooting was not defined well and no affidavit with regard to the same had been filed, as per Arms Rules, 2016, the arms licence to the petitioner could not be granted. Counsel for petitioner further submitted that with regard to the said defect, if any, no opportunity was given to the petitioner to cure the same. He further submitted that since the petitioner had to participate in the upcoming pre-Uttar Pradesh state shooting championship competition, to be held in beginning of July, the petitioner shall be disqualified from participating in absence of a fire-arm licence. He also stated that the above said ground on which the application of the petitioner had been rejected, could be cured. On the other hand, state govt's counsel supported the DM's order, which was under challenge, submitting that since the petitioner had failed to provide necessary documentary evidence in support of his application, the application of the petitioner had rightly been rejected. He submitted that in the said application for grant of arms licence, the petitioner had not disclosed details as required under the Arms Rules, 2016. After hearing the parties, perusal of the said application showed that no column had been framed as per aforesaid rules as to the detailed information/evidence of the petitioner as a 'Junior Shooter'. Further, the impugned order (the order under challenge) did not refer to any opportunity being granted to the petitioner to cure the defect as pointed out in the impugned order. "In view of peculiar facts and circumstances of the case as stated, the impugned order dated May 3, cannot be justified in the eyes of law and the same is hereby set aside," the court added.

Ludhiana: Anganwadi workers staged a four-hour-long protest against the central and state govts in front of Gate No.1 of Punjab Agricultural University (PAU), pressing for their demands, including regularisation of jobs. The protesters also carried out a rally on Malhar Road and raised slogans against the govts. There are around 54,000 anganwadi workers in Punjab and about 4,500 workers in Ludhiana district alone. Usha Rani, president of the workers' union, said before the AAP came to power in the state, the party had promised to double the wages of Anganwadi workers and helpers. However, despite these commitments, no such changes have been implemented. "Even in today's time of soaring inflation, anganwadi workers earn only around Rs 10,000 a month, while helpers are paid just Rs 5,350," she said. She added that the workers, most of whom come from economically weaker sections, have been surviving on these meagre wages for years. "It is frustrating that the govt has continued to ignore our long-pending demands. They suggested that, following the Karnataka govt's model, nursery and LKG education should be conducted through anganwadi centres, and an Anganwadi Leaving Certificate should be made mandatory for admission to primary school. Additionally, they demanded that, in line with the New Education Policy, anganwadi workers and helpers be given the status of Nursery Teacher Training (NTT) teachers for their role in pre-primary education. They also demanded that on the lines of the govt of Karnataka and Gujarat, Anganwadi workers in Punjab, should also be given gratuity upon retirement. The anganwadi workers said the Centre has been monitoring their performance through the Poshan Tracker app, which tracks data related to children aged 0 to 6, including growth monitoring and pre-school education. Though the Centre allocated funds twice since 2016 for mobile phones to aid this work, the workers said the state govt has not released the money. "Most of us belong to economically weaker sections and cannot afford smartphones, which are essential for completing digital tasks," said Anita, an anganwadi worker. "Those who have smartphones had to buy them on their own. The govt must release the funds so we can purchase the required devices." Union president Usha Rani added that the funds should be used to provide laptops or tablets to simplify data entry. The workers also demanded that the mandatory KYC and facial recognition requirements be scrapped immediately. They further called for better infrastructure and supply of pre-school kits at Anganwadi centres. "Anganwadis should be upgraded and made state-of-the-art to match the services we're expected to deliver," said Amarjit, another worker.
