Former police sergeant's life sentence for rape reduced to 20 years
A former police man who raped a 40 year-old woman has had his life imprisonment sentence reduced.

A former police Sergeant has had his life sentence for rape reduced to 20 years by the Kimberley High Court citing that the cop is capable of rehabilitation.
The former cop, Luzoko Wayne Mbayeka, who had been in the SAPS for 16 years, was sentenced by the Regional Court in Kimberley on January 26, 2022, for raping a 40-year-old woman. He came to this court to appeal his conviction and the life imprisonment sentence.
The victim said Mbayeka raped her on November 9, 2019 after her aunt asked the former cop to give her niece a lift. The victim said she did not know Mbayeka, but her aunt assured her that it would be safe to travel with him.
She said Mbayeka was with his friend Thabo (last name not provided), and he first dropped him off and told her that he had some livestock to attend to in the outskirts of town, and after that, he would take her home.
However, she said Mbayeka drove to a shack where he asked her to come with him inside so they could talk. She said that upon entering the shack, Mbayeka pushed her, and she found herself stuck between a bed and the wall of the shack. At this stage Mbayeka helped her to get up and then pushed her on top of the bed where he raped her twice.
She said she was helped by the people who had her loud screaming, asking for help, and they came to the shack to knock. She said that when Mbayeka eventually opened the door, she ran out dressed in only her bra, and she fainted.

Defending himself, the former cop said they had drunk together while traveling with his victim, and they both agreed to have sex. He pleaded not guilty.
Judge Cecile Williams said the trial court correctly convicted Mbayeka in his two rape charges. Judge Williams said at the time of sentencing, Mbayeka was 45 years old, had a minor child who was two years old, and 11 other minor children. The Judge also said Mbayeka had been living with a woman for six years and had been in custody for over two years.
'The appellant has one previous conviction for driving while his blood alcohol concentration exceeded the legal limit, for which he was sentenced to a fine in 2015. This previous conviction is not relevant for purposes of sentencing,' said Judge Williams.
Additionally the Judge said there was no doubt that rape was a repulsive crime and that rape incidents was escalating in the country. However, the trial court erred in over-emphasising the prevalence of the crime at the expense of Mbayeka's favourable personal circumstances.
'The trial court also erred by finding that the fact that appellant (Mbayeka) raped the complainant twice was an aggravating factor,' she added.
Moreover, she also said the fact that Mbayeka pleaded not guilty, which led the trial court to believe that he had no remorse for his actions did not mean that he was not capable of being rehabilitated. Judge Williams considered 22 years imprisonment for Mbayeka but took into account that he had already spent two years pre-sentence and said 20 years would be proper.

Four killed in separate Cape Town mass shootings hours apart
Two mass shootings in less than 24 hours have plunged Cape Town's communities into mourning and highlighted the persistent scourge of violent crime across the region. In the first incident, gunmen shot and killed three men and injured a fourth in a targeted attack in Philippi East late Sunday night, 15 June 2025. In the second, on Monday night, 16 June 2025, shooters opened fire in Nyanga, killing one person and wounding four others. According to a SAPS media statement, the attack occurred at approximately 23:15 on 15 June at a residence on 18083 Road in the Better Life area. The victims were reportedly drinking together when unknown assailants stormed the home and opened fire. The victims, aged between 28 and 39, died at the scene as emergency services declared them dead and rushed a fourth man to the hospital with gunshot wounds. Detectives from the Provincial Serious Violent Crime Unit are investigating three counts of murder and one of attempted murder. No arrests have been made, and the motive for the attack remains unclear. Just hours later, on Monday evening, 16 June 2025, another deadly shooting erupted in the Siyajlala informal settlement in Nyanga. At around 17:00 on 16 June, gunmen entered a premises allegedly searching for someone before unleashing a hail of bullets. Emergency responders found a 47-year-old man dead at the scene. They took four injured men, aged 30 to 40, to a medical facility. Police are probing a case of murder and four attempted murder charges in the Nyanga incident. Image: Video screengrab AN INVESTIGATION has been launched by the organisers of the Gas Motor Show after a viral video captured an altercation involving three women and a man, which raised serious concerns about safety and gender-based violence at the event. The footage shows two women hitting each other. One of them falls to the ground. A third woman then helps the woman get back up. The woman who had fallen, then attacks a man in the crowd and the woman who had helped her, then hits her. The man then punched the woman and she fell to the ground. The show's head of safety and security, Percy Govender, said preliminary investigations revealed that the group were under the influence of alcohol and the altercation stemmed from jealousy. The woman in the video had seen her ex-boyfriend with another woman at the show. She hit the man and cussed at him. He walked away but then he came back and punched her during the altercation. 'They should take responsibility for their behaviour. If she saw her boyfriend or former boyfriend with another person, and she got angry, there is a place and time to sort it out. She hit him in front of all his friends or people at the event. That exacerbated the anger in him. 'No matter the situation, it is not right to raise your hand for a woman. Crimes against women and children are taken seriously. But are we suggesting that it is acceptable for a female to assault and embarrass a male. They were not underage, they were adults. 'There were over 100 police officers at the event. We were told that intoxicated people had gone to the police station to open cases, but they were told to return when they were sober, as police cannot open cases where the complainants are intoxicated. It is unclear if they had returned to open cases,' Govender added. He said the event was controlled by private security, as well as 90 SAPS officers and 30 metro police officers. 'Safety and security is our primary concern, and the event was well controlled and policed. There was no compromise in the deployment of safety and security personnel. With crowd dynamics, it is totally impossible to have police everywhere when people are dancing. 'Nobody came to the event's operational centre to report they were assaulted. It is shocking that people will video gender-based violence incidents and not intervene or do something about it. Over the weekend, about 20 000 people flocked to the event, and this was the first case of this nature that we have dealt with,' Govender added. Yash Ori, marketing manager for the show, said they were conducting this investigation with the thoroughness and seriousness it deserved. 'Once our findings are complete, we will share the full details of what occurred and the steps we are taking to prevent similar incidents. An internal investigation is currently underway to determine exactly what transpired, and we are committed to ensuring that those responsible are held accountable. 'We take a zero-tolerance stance on all forms of violence, particularly gender-based violence. The safety and wellbeing of our patrons remains our highest priority,' she added. Ori said due to them taking all safety matters into consideration, they had escalated this year's event to a medium-risk classification, which enabled a substantial metro police and SAPS presence throughout the venue. 'We had strict security measures and are deeply saddened and troubled by the incident. We will provide regular updates on the progress of both our internal investigation and any related legal proceedings. We believe in complete transparency because we have nothing to hide, and our primary concern is ensuring our patrons and guests have a safe, enjoyable experience. 'Our event had sold out for three consecutive years and has become one of South Africa's premier entertainment experiences.
