Madras High Court grants bail to expelled DMK member in ED money laundering case

The Madras High Court on Monday granted conditional bail to expelled DMK functionary Jaffer Sadiq, who was arrested by the Enforcement Directorate (ED) in a money laundering case linked to a major drug smuggling operation.Justice Sunder Mohan also granted bail to Sadiq's brother, Mohamed Saleem, observing that further incarceration would violate their right to life and personal liberty under Article 21 of the Constitution.advertisementThe ED had arrested Sadiq on June 26, 2024, from Tihar Jail, where he was in judicial custody following his March arrest by the Narcotics Control Bureau (NCB). The NCB had accused him of involvement in the smuggling of 3,500 kg of pseudoephedrine, estimated to be worth over Rs 2,000 crore.
Granting them bail, the court noted that the investigation in the ED case was complete, the properties allegedly acquired through crime had been attached, and the complaint had been filed. 'Prolonged pre-trial detention is anathema to the Constitution,' the judge remarked, adding that the trial was unlikely to conclude anytime soon due to pending summons and multiple accused.The court laid down strict bail conditions: both Sadiq and Saleem must execute bonds of Rs 5 lakh each with two sureties of like amount, surrender their passports, and regularly appear before the trial court. They were barred from contacting witnesses, tampering with evidence, or changing mobile numbers without prior intimation.advertisementThe judge further noted that there were 20 accused in the case, and 19 witnesses had been cited by the prosecution.'Even according to the ED, the alleged offences date back to 2015. The petitioners have been in custody since June and August 2024, and the trial is nowhere near completion,' the court observed.Quoting the Supreme Court's ruling in the KA Najeeb case, the judge said the constitutional courts could dilute the rigours of bail restrictions when there was a clear infraction of Article 21.Must Watch

Patil on Thursday reaffirmed India's position that it will not lift the suspension of the Indus Waters Treaty with Pakistan, stating that the water under the treaty will not go anywhere. Addressing a press conference in New Delhi, Paatil said, "The water won't go anywhere. He mentioned, "Under PM Modi's leadership, our country has been growing... This is the first government that thinks for all sections of society... Our farmers are getting direct transfer benefits." Patil also spoke about the government's efforts to conserve and effectively use water for the country's benefit, stating that a Rs 501 crore grant has been received for the Jal Jeevan Mission and the ministry is actively working on its implementation. Earlier, an important source told ANI that the Indian government has decided to divert water meant for Pakistan under the Indus Waters Treaty for use in four Indian states, Rajasthan, Haryana, Himachal Pradesh, and Delhi. The Jal Shakti Ministry is working on infrastructure development at a war-footing level to implement this decision. The ministry aims to ensure that not a single drop of water meant for Pakistan goes to waste. Instead, it will be utilised to meet the water needs of four states, Rajasthan, Haryana, Himachal Pradesh, and Delhi. These states will benefit from the diverted water, addressing their water shortages, sources added. This initiative aligns with Prime Minister Narendra Modi's statement that "Desh ka pani desh ke haq me bahega ("India's water will flow in India's favour")". The Jal Shakti Ministry has been working towards this goal under the guidance and supervision of Home Minister Amit Shah. Kurukshetra: Leaders of HSGMC, from the dissident group of Shiromani Akali Dal (SAD), and RSS ideologues were seen sharing the same platform during an event at Kurukshetra University (KU) to mark the 50th anniversary of the Emergency as a 'Black Day'. It was organised by HSGMC. Led by its chief Jagdish Singh Jhinda, the event honoured individuals who endured political persecution during the 1975 Emergency imposed by the then Indira Gandhi-led Congress govt. Among the attendees were former MP Prof Prem Singh Chandumajra, who was among the youngest to be jailed during the Emergency, former Punjab cabinet minister Parminder Singh Dhindsa, both from the dissident SAD group, Kanwarpal Singh Tohra, grandson of former SGPC president Gurcharan Singh Tohra, KU's former vice-chancellor (VC) DDS Sandhu, 48 Kos Pilgrimage Monitoring Committee chairman and RSS ideologue Madan Mohan Chhabra, advocate Mahinder Singh Tanwar, and others. Distinguished guests were honoured with a model of Sri Darbar Sahib, a portrait of Baba Banda Singh Bahadar, and shawls. Chandumajra recounted his personal experience during the Emergency, describing the repression by then PM Indira Gandhi 's govt. "In her desperate bid to cling to power, she imprisoned many prominent leaders, including top Akali and RSS members. I was one of the youngest prisoners at the time," he said, sharing the harsh conditions political prisoners faced. Madan Mohan Chhabra said, "Congress is the only party which has made a joke of the Constitution the most in the country, whether it comes to amendment or imposing Emergency on the people. The Emergency period was a terror on the people by the Indira Gandhi govt, which was strongly resented by the people of Punjab, especially the RSS, Jan Sangh, and Akali leaders." Other speakers, including Parminder Singh Dhindsa, Dr DDS Sandhu, and Kanwarpal Singh Tohra, reflected on the suppression of democratic voices during the 21-month-long Emergency and emphasised the need to preserve democratic values. Thanking the attendees, Jhinda emphasised that the objective of commemorating the Emergency as a 'Black Day' was to honour those who suffered and to remind the nation of the oppressive chapter in Indian history. Lucknow: In a significant crackdown on financial misconduct, Sitapur police have registered an FIR against 14 employees from seven educational institutions, including three madrasas, for their alleged involvement in a scholarship scam amounting to over Rs 48 lakh. The funds, intended for minority students under the Minority Welfare Ministry's central scholarship schemes for the fiscal years 2021–22 and 2022–23 were reportedly misappropriated. The FIR was initiated following a complaint by Naresh Kumar, the district minority welfare officer of Sitapur. This action comes in response to directives from the director of the minority welfare department, Uttar Pradesh, after verification reports from block education officers highlighted fraudulent activities within these institutions. Naresh Yadav, the district minority welfare officer, revealed that the investigation centres on irregularities in the central govt's scholarship scheme for minorities, were managed by the Ministry of Minority Affairs. During a comprehensive verification drive, several institutions that had either received scholarships or submitted new applications were found to have provided dubious records.
