Karen Read's out-of-court statements, including in popular true-crime TV programs, will play a key role in her second murder trial in the death of her Boston police officer boyfriend, John O'Keefe, according to new court filings.
Read is accused of backing her Lexus SUV into O'Keefe just after midnight on Jan. 29, 2022, then leaving him to die on the ground as a blizzard swept through New England.
They had argued that morning, then spent hours drinking together and were allegedly involved in a fight outside another officer's house where an after-party was underway. She pleaded not guilty, and jurors couldn't agree by the end of her first trial last year, clearing the way for a new trial.
Hank Brennan, a prominent Massachusetts defense attorney who was brought in to take charge of the case after the first trial ended in a mistrial, had previously requested subpoenas for unpublished transcripts of interviews with Read that included her statements, including remarks left on the cutting room floor for both TV and print publications.
"The defendant has made numerous statements to witnesses, first responders, medical providers, family members, and journalists, as well as recorded statements on John O'Keefe's cellphone," prosecutors wrote in a court filing unveiled Monday. "These statements range from the defendant's immediate impressions and state of mind in the minutes and hours surrounding John O'Keefe's death to crafted narrations, sometimes in the presence of counsel that recount for the defendant's version or impressions of events months and years after the murder."
Read made waves with multiple public interviews after the jury deadlocked last July, giving a magazine writer access to her former home for a weekend and sitting for multiple local and national TV interviews in which she alleged that she was being framed for O'Keefe's death by his law enforcement colleagues. More recently, she said she would've "cheered" the O.J. Simpson verdict if it were handed down today.
Critics, including the relatives of the lead investigator who Massachusetts State Police fired over misconduct allegations stemming from her case, call her media tour an "unrelenting propaganda" campaign and an attempt to draw attention away from evidence against her.
A separate discovery filing shows some of the Read elements that Brennan's team has turned over to her defense: They include "Dateline" and "20/20 episodes", a transcript of Read's interview for "A Body in the Snow" on HBO Max and interviews with her parents for the same true-crime docuseries.
Brennan's team turned over 41 audio or video clips of interview statements but did not go into specific details about each one.
Prosecutors also included a copy of the recent audit of the Canton Police Department, resumes for expert witnesses and other discovery documents.

Both sides have agreed not to call a Boston Magazine editor to the witness stand, even though her reporting may be introduced at trial. This would exempt her from rules sequestering witnesses before they testify and allow her to continue covering the trial.
She has a petition before the U.S. Supreme Court asking it to toss two of the three charges against her, arguing that while jurors never announced a verdict at the end of her first trial, they had cleared her of both second-degree murder and leaving the scene of an accident but got stuck on the third, manslaughter.
Read faces up to life in prison if convicted on the top charge she currently faces. Jury selection continued Monday, and opening statements could happen any day once the full 12 jurors and six alternates are chosen.
As of the end of the day on Monday, two spots were open.

On Friday, Daniel Michael Wolfe showed jurors crash-test videos he created to simulate how Read's Lexus could have struck O'Keefe and what damage his body would have caused to the vehicle at different speeds. Wolfe said that the shattered plastic patterns created on the car's taillight during the tests did not match the cracks found on Read's car. Prosecutors accuse Read, 45, of backing into O'Keefe, her Boston police officer boyfriend, in a drunken rage and then leaving him to die in the snow outside the home of another cop after a night drinking with friends. She has been charged with second-degree murder, vehicular manslaughter while intoxicated and leaving the scene of a collision resulting in death. Read's defense team maintains that she was framed for O'Keefe's 2022 death. They say O'Keefe was beaten by law enforcement officers who were having a house party inside the home, then bitten by a dog and thrown outside in the middle of a blizzard. The defense's case largely rests on accusations that the investigation into O'Keefe's death was mired by deceit, incompetence and bias. A jury will soon deliberate over Read's fate – again. Her first trial ended in July 2024 in a mistrial after the jury could not come to a unanimous verdict. Read told local media the defense in this case could wrap up its testimony by Tuesday, June 10. Jury instructions filed by Read's lawyers suggest that the Massachusetts woman may not testify in the retrial. They include a section informing the jury of Read's Fifth Amendment right not to testify, telling them they 'may not hold that against her.' Christopher Dearborn, a law professor at Suffolk University in Boston who has followed the case closely, said the instructions are likely a 'harbinger' that Read's attorneys are not going to call her to the stand, though he noted that they could change their mind. 'Frankly, I don't think it would make a lot of sense to call her at this point,' Dearborn said, noting the number of public statements Read has made that could be used against her. The court has already heard from Read in the trial through clips prosecutors played of interviews conducted in which she questioned whether she 'clipped' O'Keefe and admitted to driving while inebriated. Dearborn told USA TODAY that there are two schools of thought around whether to include a section on a defendant's right not to testify in jury instructions. Some defense lawyers don't include the section because they don't want to "draw a bull's eye" around the fact that the defendant didn't testify and cause jurors to "speculate," Dearborn said. Other times, he said, it is the "elephant in the room" and the specific instructions telling the jury they can't hold the defendant's lack of testimony against them are necessary. (KRON) – A head-on car crash killed one man and left three people hospitalized, according to the California Highway Patrol in Napa. Around 4:38 p.m. on Friday, CHP was alerted to a two-vehicle collision involving a 2024 Toyota Venza and a 2011 Lexus RX450 on California Highway 121, north of CA Highway 37 near the Sonoma Raceway. According to CHP, multiple witnesses observed a solo male driver of the Toyota traveling southbound on Highway 121, and a female driver of the Lexus with two minor passengers driving northbound. The Toyota crossed over the double-yellow lines and crashed into the Lexus in a head-on collision, CHP said. The driver of the Toyota was a man who was pronounced dead at a Napa hospital at 5:36 p.m. on Friday. The driver of the Lexus was a mother with her two children, a 15-year-old son and an 11-year-old daughter. According to CHP, only one child was wearing a seatbelt. The mother was transported to a Napa hospital for major injuries. The children were transported by helicopters to the Oakland Children's Hospital for major injuries.
