"This team is studying the transcript, and the three other relevant decisions that were handed down in the course of this trial and will provide a memorandum of advice and opinion on the appeal ability of the judgment," said Mhaga. "The NPA will announce its decision, taking into account the memorandum of advice from the NPA team, and the opinion from Senior Counsel."
NPA national spokesperson advocate Mthunzi Mhaga said the decision to consider appealing the Omotoso case is based on the gravity and complexity of the case, as well as the fact that the state can only appeal an acquittal under Section 319 of the Criminal Procedure Act.
The National Prosecuting Authority (NPA) has announced that it has appointed a Senior Counsel to evaluate and advise on the possibility of appealing the Timothy Omotoso judgement.
The 66-year-old Nigerian national was acquitted after spending eight years in jail. He was acquitted alongside his co-accused, Lusanda Sulani, and Zikiswa Sitho.
Mhaga went on to say that the recent judgement has harmed efforts to combat sexual and gender-based violence (GBV) and eroded trust in the criminal justice system. This has serious consequences for the victims, he said.
The Commission for the Promotion of the Rights of Cultural, Religious, and Linguistic Communities (CRL Rights Commission) is one of several groups who condemned the NPA following the Nigerian televangelist's acquittal by the High Court in Gqeberha, Eastern Cape.
"All we can say is, the NPA let us down. The NPA let these witnesses (the victims) down. There are hundreds, if not thousands of victims out there who were waiting to see how this case goes. If it was not a matter of not cross-examining the accused appropriately, as the judge said, then we are leaving it at the door of the NPA," said chairperson of the CRL Rights Commission, Thoko Mkhwanazi-Xaluva.
The NPA added that it is considering all avenues to ensure justice is served within the law.

In an interview this week, Batohi had said: 'The NPA has been infiltrated by people who do not have the rule of law at heart. 'We are having internal challenges; some prosecutors may not be aligned with the vision of really fighting for the rule of law in this country.' Calls for Batohi to be summoned to Parliament to provide explanations follow a difficult period for the NPA during which the authority has bungled a number of high-profile cases. The latest was the Free State High Court declaring the extradition of former Free State premier and ex-ANC secretary-general Ace Magashule's personal assistant, Moroadi Cholota, from the US unlawful as it did not have a valid and lawful request by the Justice Ministry. As a result of Judge Phillip Loubser's ruling, Cholota cannot face trial in the controversial R255 million tender to audit and replace asbestos roofs in the province alongside her former boss and several other individuals and companies. The NPA plans to appeal against the judgment. Another recent prominent case that intensified pressure on Batohi, who is reportedly due to retire when she turns 65 in January, was the acquittal of Nigerian televangelist Timothy Omotoso of multiple charges of rape, human trafficking, and racketeering in April. On Friday, the EFF wrote to National Assembly Speaker Thoko Didiza and Xola Nqola, chairperson of the Portfolio Committee on Justice and Constitutional Development, demanding an urgent parliamentary debate on Batohi's allegations of infiltration in the NPA. Additionally, the EFF wants the portfolio committee to schedule an urgent meeting and was not calling for punitive or reactionary action. 'This is not a casual institutional complaint. It is a constitutional red flag of the highest order. An assertion from the NDPP herself that the NPA has been infiltrated should send shockwaves throughout every organ of state,' the party said. The EFF warned that the assertions have direct consequences for the rule of law, the integrity of South Africa's criminal justice system, the fight against corruption and gender-based violence, and public trust in the country's democracy. The urgent meeting should be held on Tuesday, June 10, and also requested Justice and Constitutional Development Minister Mmamoloko Kubayi to be invited to attend, provide policy-level responses and inform the committee of the department's position and possible interventions on the matter, according to the EFF. It requested Didiza to exercise her authority under the National Assembly's rules to approve an urgent debate on 'the implications of the NDPP's public statement regarding infiltration of the NPA and the threat it poses to South Africa's justice system, rule of law, and constitutional democracy'. ActionSA parliamentary leader Athol Trollip said the party was alarmed and called on President Cyril Ramaphosa to remove Batohi immediately. He said the NPA has failed to prosecute Ramaphosa for not declaring foreign currency stolen at his Phala Phala farm in 2020, which was later stolen, fugitive self-proclaimed Malawian prophet Shepherd Bushiri, and secure the extradition of the fugitive Gupta brothers, among others. 'The NPA has become a refuge for politically connected individuals, a place where accountability is avoided, justice is delayed, and prosecutions collapse with shocking regularity. Under Batohi's leadership, the NPA reels from one scandal to the next,' added Trollip. This is despite criticism of failed prosecutions and extradition. In an interview with Newzroom Afrika on Friday, Batohi said work was being done to ensure that the brothers were brought to justice. 'The NPA is working very hard, and I don't want to give a time frame, but I am certainly hoping that within the next couple of months, they will be able to put together a new extradition with additional charges,' she said. Batohi said that the previous application failed without any explanation on why their numerous notes sent to the United Arab Emirates (UAE) had not been responded to. However, Batohi stressed that they would still face the same challenges because they didn't know what was the cause of the delay initially. 'We certainly don't want to experience the same fate with the new extradition application when we don't have some of the reasons from the UAE court denying the first application,' she said. AFU obtains confiscation order against ex-rangers who killed two rhinos
The Skukuza regional court has granted a confiscation order in favour of the National Prosecuting Authority's Asset Forfeiture Unit (AFU) in Mpumalanga against two convicted former field rangers who killed two rhinos in December 2018. 'The order, made on Thursday, compels Lucky Mkanzi and Nzima Joel Sihlangu to pay R836,600, plus 11% interest accruing from the date of the poaching of two rhinos,' NPA spokesperson Monica Nyuswa said. The court further directed that R41,820 being held in the SAPS Absa suspense bank account be paid to SANParks to support anti-rhino poaching efforts. Mkanzi and Sihlangu were each sentenced to 20 years' direct imprisonment last year for offences committed between December 25 and 30 2018 in the Skukuza section of the Kruger National Park. At the time of the offences, both were on day shift and had no authorisation to work during the night. During their trial, the prosecution presented evidence showing that the vehicle used in the poaching incident was stationary at the location where the rhinos were killed. Their supervisor testified that neither of the accused had permission to be on night duty. A tracking expert confirmed the movements of the vehicle, placing them at the crime scene, and a police officer testified about a raid on Sihlangu's residence where cash from the sale of rhino horns was found. Both accused were convicted of conspiracy to commit an offence and the illegal killing of two rhinos. 'The AFU plays a vital role in ensuring that criminals do not benefit from their unlawful actions. Through the AFU, the NPA continues to reinforce accountability, uphold the rule of law, and demonstrate that crime has serious financial and legal consequences,' Nyuswa said. TimesLIVE
