The SNP instead landed a 59-58 win — while experts claimed the amendment bungle could see home-buyers left high and dry if their solicitor goes bust.
Last night, a Holyrood source said: 'Brian dropped the baton — and unfortunately it means the rules are now a complete mess.'
Labour MSP Paul O'Kane hit out: 'The amendment was very clearly not in interests of consumers when undertaking what can be an extremely stressful action like buying a house.
It shouldn't have been passed and it wouldn't have, had Brian Whittle read his whip sheet properly.
'It's very disappointing.'
MSPs had been deciding if the profession's governing body could step in on behalf of clients to ensure work is completed if a solicitors' firm goes bust.
Nats wanted to give flop companies the right to appeal.
Nats justice minister Siobhan Brown said it was 'important such matters can be tested by the court'.
But critics claimed that risked clients being left in limbo and could lead to homes sales falling through.
Ex-Olympian Mr Whittle's Tory colleague Tess White told of legal experts' 'concerns' that the move would 'weaken public protections'.

But the South of Scotland MSP then failed to follow instructions from party whips and backed Nats' amendment.
Further chaos came when he then voted as instructed on a linked measure.
The Law Society of Scotland claimed the muddle could create a two-tier system, with larger firms able to appeal but not self-employed solicitors.
A Tories spokesman said: 'This was a genuine mistake from Brian while voting on a vast number of amendments.
'He recognises concerns surrounding these proposals. This vote was made in error.'

Yes Berwickshire sent a letter to every sitting MSP as well as every prospective candidate for the party on Monday, May 19, titled 'together for independence'. The group believe 'a lot of Yes groups are raring to go but are looking for a lead', writing in the letter that there are 'thousands of us out here who are not SNP members but are passionate about Scotland's independence and are more than willing to lend a hand and work hard' as part of the 2026 campaign. The group were invited to a recent Berwickshire SNP branch meeting and local candidate, John Redpath, is coming to the next Yes Berwickshire meeting. From the list of 2026 candidates, just one other than Redpath has responded – after The National questioned them on their lack of reply. 'There's an arrogance about it to me to not even get a reply from so many folk – as if we don't have a contribution to make,' they added. Yes Berwickshire has recently joined the coalition titled 'Liberate Scotland'. Indy4Indy, ISP, Salvo, Scottish Sovereign Research Group, and Independence Forum Scotland have all signed up to come under the umbrella. The letter sent to SNP MSPs and candidates states: 'As we are now less than 12 months until the 2026 Holyrood elections, we at Yes Berwickshire (YB) are gearing up to a period of much more regular activity in pursuit of Scottish independence. "For the last 16 years YB have been active with street stalls, extensive leafleting, bridge events, letters to the local and national press and more general activity and support for the cause of independence. YB has some members from political parties, but most do not belong to any party but are passionate about fighting for independence. 'YB have approached the local SNP branch and intend also to contact Alba, the Greens, and any other organisation promoting independence in Berwickshire with a view to pooling our resources in the hope of creating a more cohesive and organised campaign in our area. "With such a large and sparsely populated area, cutting down on double or treble campaign coverage by different parties seems a sensible way forward. We have had a very good response from the local SNP and joint meetings are proposed for the near future. The strategic defence review, which will be published on Monday, will state that school pupils should be educated on the importance of the Armed Forces and taught about career opportunities, according to The Telegraph. It comes as the Ministry of Defence (MoD) has suffered from a recruitment and retention crisis in recent years. Defence is a reserved matter but education is devolved to the Scottish Government, which has been approached for comment and confirmation as to whether these plans will impact Scottish children. As that wartime generation leaves us, we need to keep the message and spirit of what they fought for alive.' They added: 'Learning the history of what happened before is important, but it's also about seeing what people do now to keep us safe, while providing young people with an opportunity for careers within the military.' It is also planned to be rolled out at a comprehensive national level from primary through to secondary education.

Single use vape ban in Scotland to take effect from Sunday amid 'litter emergency'
The Record led the campaign for a crackdown on disposable vapes which littered our streets and got youngsters hooked. Single use vapes will finally be banned in Scotland this weekend in a move that could be transformative for public health and the environment. An estimated 26 million disposable e-cigarettes are thrown away by Scots each year, with more than half not recycled and 10 per cent dumped on the street. The Record joined environmental activists in calling for an end to sale and supply of single use vapes in a bid to clean-up our communities. It's also hoped the ban on throwaway e-cigs - which takes effect from June 1 - will discourage more youngsters getting hooked on the brightly-coloured, sweetly-flavoured vapes and impacting their health. A quarter of 11-15-year-olds have admitted they have tried the devices at least once. The ban on the sale of disposable vapes will apply UK-wide after agreement was reached between Westminster and the devolved governments. SNP ministers announced in February 2024 they would commit to a crackdown in a victory for the Record's campaign. Barry Fisher, chief executive of Keep Scotland Beautiful, said: "We first became aware of the impact single-use vapes were having on our environment back in 2022 when members of the public and our volunteers were noticing them more often and asked what could be done. "I'm proud of the effort we have made, alongside our partners, to see this product banned in Scotland – it shows what true collaboration can achieve. "Our surveys and supporters have made it clear that this product was becoming more and more common, spoiling our environment and causing danger to wildlife. "We are dealing with a litter emergency and the last thing we need is single-use products coming to market that can end up discarded harming our environment. "This ban will help remove the fastest growing litter item from our streets, parks and beaches and is a welcome step in the right direction, but everyone must dispose of their waste in the correct way." ASH Scotland, which campaigns against the harms caused by tobacco products, said there had been an "alarming" upsurge in vaping among children. Sheila Duffy, the charity's chief executive, said: "We celebrate the ban of cheap recreational disposable e-cigarettes, which are the starter vaping product for most youngsters who vape, as a vital first step towards halting the alarming upsurge of children vaping in Scotland during the last few years. "Although we warmly welcome these regulations coming into effect, government must take further, stronger actions to restrict the advertising and promotion of all e-cigarettes as well as banning vape flavours, colours, descriptors and branding on device designs and packaging to reduce the attractiveness of the products to children. "The tobacco and nicotine industries must be halted in their attempts to attract children to use their addictive and health harming products, generating huge profits at a considerable cost to the health of our young people now and future generations."
