
Swimming in Naini lake? HC reviews ban, seeks suggestions

Uttarakhand high court
(HC) on Tuesday deliberated a review petition concerning the revocation of a previously enforced ban on swimming in Nainital Lake. The petitioner contended that apart from the District Sports Authority, Nainital lacks adequate infrastructure for the physical development of children and residents. Moreover, recreational sports options remain limited to cricket and football.
The court noted that due to Nainital's climatic conditions, swimming in the lake is feasible for only about two months each year. It also observed that swimming in natural water bodies differs significantly from swimming in pools, requiring separate considerations.
The petition argued that the lack of sporting alternatives for children not interested in mainstream sports deprives them of opportunities for physical activity — a potential violation of their rights. Swimming, an Olympic discipline that brings national recognition and gold medals, demands proper infrastructure in the region, the petitioner said.
The original case dates back to 2001 and was settled in 2019, resulting in a ban on both swimming and laundering in Naini Lake.

During Tuesday's proceedings, a division bench comprising Chief Justice G Narendar and Justice Alok Mahra heard submissions from senior advocate Mahendra Singh Pal, president of the Uttarakhand Bar Council, who advocated lifting the ban. He suggested that allowing swimming would boost athletes' motivation, given the health and fitness benefits of aquatic sports.
The court has now sought suggestions for the next hearing and indicated it may consult hydrologists and representatives from swimming sports associations to obtain detailed data on the lake's water temperatures and suitability for swimming.
