SC asks Jharkhand HC to reconsider plea of single parent judicial officer for child care leave

New Delhi, The Supreme Court on Friday asked the Jharkhand High Court to reconsider the plea of a single parent woman judicial officer challenging the denial of her child care leave request.
A bench of Justices Prashant Kumar Mishra and Augustine George Masih said the high court would consider the plea of a judicial officer without being influenced by the previous rejection of her plea.
The Jharkhand high court counsel was ordered to seek instruction within three days as the bench posted the matter next week.
"It was suggested to the respondent high court that the prayer for grant of child care leave be revisited without being influenced by earlier rejection," the top court said.
The bench told the high court counsel that it was only appropriate if the high court revisited the issue as the top court's directions could set a precedent.
On May 29, the top court sought responses from the Jharkhand government and the high court registry on a plea of a single parent woman judicial officer challenging the denial of her child care leave request.
It had taken note of the plea of the additional district judge rank judicial officer from the scheduled caste category, alleging that she was denied six months of leave.
The judicial officer sought the leave between June and December in view of examination of her child.
The CJI-led bench had initially issued a notice on her plea, asking why she did not move the Jharkhand High Court first.
The judge's lawyer said keeping in mind the summer vacation schedule of the high court, it was possible that the plea wouldn't have been considered with due urgency.
"She is a single parent from the lowest strata of society," the lawyer said, underlining an "impressive" service record in which she had disposed of over 4,000 cases in over two-and-a-half years.
According to the Child Care Leave Rules applicable to the judicial officers, the ADJ is entitled to up to 730 days of leave during her service tenure and she sought merely six months of the entitlement, the plea argued.

Referring to the central agency Enforcement Directorate (ED), Mr. VIswam remarked: 'Everybody has realised that Modi regime's investigative agencies go after money. But regardless of whether the ED comes or not, we must stay true to our path.' He reminded that those involved in cooperative sector must walk the path of transparency and inspire others to do the same. 'There are some who behave as if they have a license to do anything. That mindset is dangerous and unacceptable. We must remember that this sector is essential for our existence,' he pointed out. KCEC State President B. M. Anil hoisted the flag. KCEC State Secretary P. A. Sanjeev presented the martyr's resolution, while State vice president Bindu K. S. moved the condolence motion. Union home minister and Bharatiya Janata Party (BJP) leader Amit Shah on Sunday asserted that the NDA would form governments in Tamil Nadu and West Bengal next year. Amit Shah suggested that Tamil Nadu chief minister might be correct in saying "Amit Shah cannot defeat DMK", but it is the 'people of Tamil Nadu who will bring about that change.' Addressing party office bearers in Madurai, Shah reminded them of the party's performance in the Delhi assembly elections and vowed to repeat it in the two states. 'In 2025, we successfully formed the government in Delhi, and in 2026, it will be Tamil Nadu's turn to witness a new government under our leadership. In the same year, the BJP and NDA are set to establish governments in both West Bengal and Tamil Nadu,' Shah said. He also targeted the MK Stalin-led ruling Dravida Munnetra Kazhagam (DMK) government in Tamil Nadu, saying that the Karyakartas Sammelan (workers' meeting) would mark the beginning of the DMK government's decline. Welcoming Union Home Ministry's decision to hand over investigation of the murder of Hindutva activist and murder accused Suhas Shetty to the National Investigation Agency (NIA), Dakshina Kannada MP Capt. Brijesh Chowta on Sunday, June 8, said Dakshina Kannada district wants freedom from anti-national elements that are active in the district and become an active part of Prime Minister's vision of Viksit Bharat. In a statement here, Capt. Chowta said he wrote a detailed letter to Union Home Minister Amit Shah on May 2 expressing the need for an NIA probe following Shetty's murder in full public view in Bajpe on May 1. He had expressed the need of a comprehensive and impartial investigation as there was suspicion of involvement of members of banned Popular Front of India (PFI) in the murder. The nation cannot afford to allow radical, anti-national, and jihadi forces to fester in any part of the country. One month into the letter, the Union Home Ministry decided to hand over probe of Shetty's murder to NIA. Shetty's murder was a larger pattern of growing lawlessness, emboldened Islamic radicalism, and anti-national elements that continue to operate in coastal Karnataka. Following targeted killing of BJP cadre Praveen Nettaru in July 2022 by members of banned PFI organisation, life of Suhas Shetty, another young Hindu, was extinguished in a similar manner. The NIA probe will bring to light how radical, anti-national, and jihadi forces were silently operating in Dakshina Kannada and other parts of the country. This was the first step by the Prime Minister Narendra Modi to root out anti-national forces from Dakshina Kannada, he said. A delegation led by State BJP president B.Y. Vijayendra had met the Governor Thaawarchand Gehlot and placed the request to the State government to hand over investigation of Suhas Shetty murder to NIA. The BJP has no confidence in Siddaramaiah-led Congress government rendering justice to murder victim's family as the State government has continued with its appeasement politics. The government has political understanding with Social Democratic Party of India, which is extended form of banned PFI, the MP alleged. VHP reacts Vishwa Hindu Parishad Dakshina Karnataka joint secretary Sharan Pumpwell, in a statement, said with NIA investigation the VHP has all confidence that all those who were involved in Suhas Shetty's murder, those who conspired and financed the act, will be booked and justice will be delivered to victim's family members. By handing over to NIA, the Union Home Ministry has rightly answered demand of lakhs of Hindus and it was a moral victory to the fight of Hindus. In response to the murder, the VHP had given a bandh call on May 2 across Dakshina Kannada. A massive protest meet was held on May 25 in Bajpe demanding NIA investigation into the murder. Mr. Pumpwell was arrested on May 27 for allegedly giving inciting statements on the night of May 1, which led to damage of public property, communal tension and public peace on May 2 and subsequent days.
