Ayodhya: The SC/ST court of Ayodhya has ordered the arrest and presentation of 10 cops, who had allegedly detained, beaten up, and robbed a Dalit trader for refusing to supply free food items for a police event in 2012.
The cops, including the then station house officer (SHO) Jung Bahadur, have been told to be present in the court on June 20.
The arrest order has been issued as the accused cops failed to surrender even after the High Court dismissed the relief petition filed by them.
On Aug 21, 2012, Rajkumar Sonkar was tortured after he refused to supply food items for free for an event scheduled at the police station.
Sonkar was forcibly brought to the station and assaulted, said Martand Pratap Singh, his counsel.
The victim has filed a complaint in the SC-ST Court, leading to a prolonged legal battle. Despite multiple NBWs issued by the court, no arrests were made, counsel said.
The accused police men sought relief from the High Court, which was denied, with an order to surrender within three weeks. This order was also ignored. Now, the SC-ST Court has directed Ayodhya's IG to arrest all 10 police men and present them in court on June 20.

Tired of too many ads? go ad free now Allowing the man's plea to quash the FIRs lodged against him by Cyberabad police in 2022 on the woman's complaints accusing him of establishing a physical relationship with the promise of marriage, a bench of Justices Vikram Nath and Sandeep Mehta said, "The facts on record clearly establish the vindictive and manipulative tendencies of the complainant and these aspects have a great bearing on the controversy." Writing the judgment, Justice Mehta said allowing the man's prosecution would be nothing but gross abuse of the process of law and the complaints were "nothing but a bundle of lies full of fabricated and malicious unsubstantiated allegations levelled by the complainant (woman)". The court was informed about a similar complaint the woman had lodged against an assistant professor at Osmania University in 2021, where she was studying. What rescued the man in the present case was the chats of the woman, who went by the name 'Muffin' on social media. In the chats, she admitted to being manipulative and her desire to "get a green card holder". "At one point of time, she also stated that it would not be difficult for her to trap the next one. In the very same breath, she mentions that she would not waste time with the accused appellant and needs to 'invest on the next victim'. She also mentions that she would irritate her victims to the extent that they dump her, and she could happily start with the next one. She also stated that she was using the accused appellant," the bench recorded in its judgment. "These chats depict the stark reality about the behavioural pattern of the de-facto complainant who appears to be having manipulative and vindictive tendencies. Quashing the FIRs, the SC said, "Hence, even assuming that the accused appellant retracted from his promise to marry the complainant, it cannot be said that he indulged in sexual intercourse with the de-facto complainant under a false promise of marriage or that the offence was committed by him with the de-facto complainant on the ground that she belonged to the Scheduled Castes/Scheduled Tribes community."

NEW DELHI: SC has ruled that a married woman cannot accuse a man of rape on promise of marriage while her own marriage is still subsisting, and quashed a rape case filed by her against a man. The case involved a Muslim woman, mother of a four-year-old, residing at her parents' home in Maharashtra's Satara. She developed a relationship with her 23-year-old neighbour, a BSc student. In her police complaint alleging rape on the promise of marriage, she claimed that the man maintained a physical relationship with her from June 8, 2022, to July 8, 2023, assuring her repeatedly that he would marry her after her divorce. She obtained a 'khulanama' (divorce) from husband only on Dec 29, 2022. After FIRs were lodged, the man approached HC for quashing the case, but failed. He moved SC, where a bench of Justices B V Nagarathna and Satish C Sharma found inconsistencies in the woman's narrative and conduct. "The complainant alleged the appellant had physical relations with her without consent. However, she not only sustained the relationship for a year but also visited him at lodges on two occasions. Her conduct does not corroborate her allegations," court said. The bench highlighted that the woman was still married during part of the relationship. Writing the judgment, Justice Sharma noted, "Khulanama was executed on Dec 29, 2022. It is inconceivable she entered a physical relationship with the appellant on promise of marriage while still married. Such a promise was illegal & unenforceable." The court observed that the complaint seemed to have been filed after the man graduated, returned to his hometown Ahmednagar, and a visit by the woman led to a confrontation with his family. Quashing the police cases, SC said, "No reasonable possibility exists that a married woman with a four-year-old child would be continuously deceived or maintain a prolonged association with someone who sexually assaulted her. A consensual relationship turning sour cannot invoke state's criminal machinery."

New Delhi [India], June 3 (ANI): Parliamentary Affairs Minister Kiren Rijiju has started speaking with various political parties for an impeachment motion against High Court judge Yashwant Varma in the next Parliament Session, government sources said on Tuesday. The Supreme Court had constituted an inquiry committee following allegations of 'burnt cash' found at a storeroom of Justice Varma's residence when he was a Judge of the Delhi High Court. The in-house inquiry committee submitted its report on the issue last month, which has since been forwarded to the Prime Minister and the President of India. 'The Parliamentary Affairs Minister has started speaking to all parties for impeachment motion against HC judge Yashwant Varma,' a source said. On May 4, a panel of judges tasked with conducting an internal inquiry into allegations of cash being discovered at Justice Yashwant Varma's official residence submitted its report to the then Chief Justice of India, Sanjiv Khanna. According to an official communication from the Supreme Court, the three-member committee, comprising Justice Sheel Nagu, Chief Justice of the High Court of Punjab and Haryana, Justice GS Sandhawalia, Chief Justice of the High Court of Himachal Pradesh and Justice Anu Sivaraman, Judge of the High Court of Karnataka concluded its investigation and presented its findings in a report dated May 3. The Chief Justice of India constituted this committee on March 22 to examine the allegations against Justice Yashwant Varma, a sitting judge of the High Court of Delhi. On April 5, Justice Yashwant Varma was sworn in as a judge of the Allahabad High Court under unusual and contentious circumstances. CPI general secretary D Raja had said on Wednesday that credibility of judiciary needs to be restored and his party will support the action against Justice Varma. 'Let them bring the impeachment motion. The Judiciary should understand that it has to work within the framework of the Constitution... To restore the credibility of our judiciary, there must be some strong action. We will support the impeachment motion. But the point is, when will it be brought? We raised several critical questions about the money found in the judge's residence, but concrete action has been delayed... Our party will participate in the debate before the Parliament when this issue is discussed,' Raja told ANI. Vice President Jagdeep Dhankar had last month referred to the cash-discovery row, saying there is no FIR to date. 'We're confronted with the jarring reality. A judge's residence in Lutyens Delhi had burnt notes. There is no FIR to in the country is now thinking whether this will be washed off or fade with time, and they are really concerned. How come the criminal justice system was not operationalised as it would have been done for every other individual?... This issue for which people are waiting with bated breath, the money trail, its source, its purpose,' Dhankhar said at an event in the national capital. 'Did it pollute the judicial system? Who are the bigger sharks? We need to find out. Already two months have gone by. An investigation is required to be conducted with expedition. So is the case with the registration of an FIR. I do hope and believe that the Supreme Court acted the very best so far because it had a legacy issue of judgments imparted in the nineties,' he added. He lauded some of the steps taken by the Supreme Court. 'But now is the time to take a call. Partly the confidence has been restored by Justice Khanna. When you put in public domain documentation which people thought will never be shown to them. That was a big step by him to project accountability and transparency. If democratic values have to prosper, I am sure this is a test case. There must be a swift investigation by those concerned with the investigation,' the Vice President said. (ANI)
