A Key Fight Over the Most Infamous Police Project in the Country Is Coming to a Head

Last week, Dave Wilkinson, CEO of the Atlanta Police Foundation, took the witness stand in an Atlanta courtroom and argued that a local media outlet had no right to request his organization's records under Georgia's Open Records Act. Why? Because, he claimed, their coverage of the controversial police training facility known as 'Cop City' would be used to turn the public against the project and 'terrorize' the companies building it. In other words, the highest-paid police foundation executive in the country essentially argued that journalism is a form of terrorism.
Wilkinson was in court responding to a lawsuit filed by the Atlanta Community Press Collective, a small nonprofit newsroom, and Lucy Parsons Labs, a transparency-focused research organization. The case represents more than just a fight over meeting minutes: It's a battleground for the future of transparency in public-private partnerships, where private actors are increasingly embedded in state functions—and using that status to shield themselves from public scrutiny.
At the heart of the lawsuit is a critical question: Can the actions of the Atlanta Police Foundation—a private nonprofit—be considered public for the purposes of Georgia's Open Records Act? The plaintiffs argue yes, pointing out that APF runs nearly two dozen programs on behalf of the city of Atlanta, including the construction of Cop City—a sprawling, militarized police training facility in a metro Atlanta forest—and the development of the city's surveillance infrastructure. These are not peripheral projects; they are central to how public safety in the city is shaped and enforced. As such, they should be subject to the same transparency standards that govern public agencies. If the court sides with the foundation and allows its refusal to comply with records requests to stand, it could set a dangerous precedent—paving the way for governments to outsource core public functions to private entities shielded from public scrutiny.
The story of Cop City is both deeply local and intensely emblematic of national trends. From its inception, the facility faced widespread public opposition, including mass protests, forest defense occupations, and hundreds of hours of oppositional public comment. It also faced accusations of secrecy and deception, thanks in large part to its funding model: a public-private partnership, or P3. The proliferation of P3s across the U.S.—from transit to housing to policing—has accelerated over the past decade. These partnerships are often sold as 'innovative,' but in practice they obscure decision-making, shift risk onto the public, and prioritize profits over public good. In infrastructure, that might mean a toll road built to maximize fees rather than access. In policing, it means a militarized force bankrolled by the private sector to protect capital, not communities.
Originally, the city of Atlanta promised to contribute $30 million in public funds, with the remaining $60 million to come from private donors, funneled through the Atlanta Police Foundation. So, what is a police foundation?
The short answer: a slush fund for police departments. The longer answer: Police foundations are the preferred vehicle for corporations and wealthy donors to bankroll the expansion, militarization, and surveillance capacities of police—outside of public budgets and beyond public oversight. Found in most major U.S. cities, police foundations fund everything from the very serious (the construction of training centers and surveillance networks and the purchase of military-grade equipment) to the kind of inane (sponsoring a police horse, or buying police dogs bulletproof vests, or, in St. Louis, funding the integral work of Operation Polar Cops, an ice cream truck run by police officers.) The donors are often a who's who of local corporate elites, often with business before the city. So while police already consume the lion's share of most municipal budgets, they also enjoy a second funding stream that comes with even fewer strings attached.
Independent outlets in Atlanta like ACPC have stepped into a local reporting vacuum during the lengthy Cop City showdown. The city's flagship newspaper, the Atlanta Journal-Constitution, showed little interest in investigating the project. The reason may be structural: The AJC is owned by Cox Enterprises, a major donor to the Atlanta Police Foundation through the James M. Cox Foundation. Its CEO at the time, Alex Taylor, was directly involved in APF fundraising. Despite claiming editorial independence, the AJC failed to disclose this conflict while publishing favorable coverage and opinion pieces supporting Cop City.
ACPC, by contrast, used Georgia's open records law to uncover critical facts about the project's ballooning cost and secretive planning process. Its reporting revealed that the city quietly introduced an ordinance—later passed—that would increase public spending on Cop City to at least $51 million. That included a $31 million payment to the APF, plus a lease-back agreement worth another $20 million over 20 years. These revelations likely wouldn't have come to light without records obtained through Georgia's transparency laws.
ACPC had initially accessed APF board meeting minutes by requesting them from the Atlanta Police Department—a public agency that was receiving the minutes from the foundation. But when APF stopped sending those minutes to the Atlanta Police Department, ACPC began requesting them directly from the foundation. APF refused. That stonewalling landed them in court.
This might seem like a narrow skirmish over bureaucratic documents, but the implications are wide. In court, the Atlanta Police Foundation argued that it is a private entity, separate from the Atlanta Police Department, and therefore not subject to Georgia's open records laws. But the APF's role in the construction of Cop City—raising the funds, helping select the contractors, crafting communications strategy—looks very much like a public function cloaked in private legal status.
This case echoes a troubling national trend: private actors increasingly exercising public power while avoiding public accountability. Consider Elon Musk's involvement in everything from federal transportation contracts to national security satellites. His companies shape policy and infrastructure in ways that affect millions, but as private enterprises, they operate outside of most transparency laws. That kind of shadow governance, enabled by P3s, friendly legislators, and a gutted regulatory state, is not a bug of modern governance. It's becoming the system itself.
At the same time, across the country, state legislatures are quietly but deliberately weakening the open records laws that make investigative journalism possible. Lawmakers are introducing bills that narrow what qualifies as a public record, extend response times, raise fees for requesters, or exempt entire categories of information from disclosure. In some states, public agencies are allowed to simply ignore requests without consequence. In others, journalists have been sued or even criminally investigated for pursuing records. These efforts don't usually make national headlines, but they are part of a sustained erosion of the public's right to know—death by a thousand paper cuts to the First Amendment. The result is a chilling effect on accountability reporting and a growing opacity in the very institutions meant to serve the public. In the era of Trump 2.0, as power is increasingly concentrated and privatized, the deliberate dismantling of transparency laws isn't just a bureaucratic issue, it's a democratic crisis.
Without access to documents, data, and deliberations, journalism becomes guesswork, speculation, or PR. Reporters can't hold power to account if they're forced to work in the dark. If journalism is democracy's rough draft, as the saying goes, transparency is the paper it's printed on. This case is about much more than a few withheld emails or board minutes. It's about whether the public has a right to know how power operates—and who is paying for it—when that power wears both a badge and a corporate logo.

Last month 31 men at Bluebonnet Detention Center in Anson, Texas, positioned their bodies in the shape of the letters 'SOS,' a cry for help, as journalists flew overhead. Much has been written about the state of deportations under the Trump administration and the flouting of the Supreme Court's orders, as well as the court's temporary blocking of removals of Venezuelan migrants to a notorious prison complex in El Salvador. However, less has been said about how human rights violations are pervasive at detention centers all over the United States, including Bluebonnet. Nearly nine years after its construction to house state prisoners, Bluebonnet Detention Center, operated by the Management and Training Corporation, signed a $145 million contract with Immigration and Customs Enforcement in 2019 to house a maximum of 1,000 detainees on any given day. Located approximately 200 miles west of Dallas-Fort Worth, Bluebonnet provides a strategic site for discreet detention, nestled in a remote area yet accessible for transport to the airport. Despite its newer status with ICE, Bluebonnet had one of the largest COVID-19 outbreaks among ICE detention centers in the U.S. in 2021, and the American Civil Liberties Union listed the facility among 38 recommended for shut down because of its dangerous operations. It is no surprise that Bluebonnet's detention conditions continue the practices of gross human rights violations that plague the entirety of ICE operations. The conditions inside ICE detention centers are so untenable that people are self-deporting to avoid being detained. This is not an accident. ICE's poor conditions are adapted tactics of the 'Prevention Through Deterrence' policy implemented in 1994 that makes it more difficult for immigrants to fight their deportation orders. This is exactly what the Trump administration desires. At the peak of the COVID-19 pandemic, Bluebonnet was inspected at least seven times by ICE's Office of Detention Oversight and by Nakamoto Group, a private independent company that has since lost its contract with the federal government. Notably, inspections by Nakamoto Group relied heavily on telemonitoring and planned visits, asking detention facilities before monitoring them for a list of preapproved detained individuals to interview. This raised many ethical issues that were reported by the ACLU. Even despite offering this advance opportunity for detention officials to clean up their acts before inspection, our data (which we obtained via the Freedom of Information Act) shows Nakamoto still found dangerous environments at Bluebonnet. All Bluebonnet detention inspections occurring between 2020 and 2024 documented recurring concerns regarding medical treatment, extended isolation, detainee reports of sexual violence, recorded instances of force, and problematic approaches to suicide prevention and interventions. Although 45 percent of detainee statements in Bluebonnet inspections reported issues with medical care, facility detention inspectors rarely found detainees trustworthy about their complaints. For example, in 2021, Bluebonnet detainees stated that medication requests were rarely followed up on, while another detainee who had received medical attention was placed in solitary confinement that had unsanitary conditions without explanation. The inspectors in each case failed to believe detainees because they were unable to verify their claims. In our analysis of Bluebonnet inspections, we discovered dangerous practices that placed detainee well-being at risk. During February 2021, the Office of Detention Oversight found that Bluebonnet staff did not follow proper procedures to calculate use-of-force incidents and video documentation of incidents was not properly assessed by ICE. That same document also revealed hunger strikes and issues with medical care that captured a troubling environment at Bluebonnet for detainees. The most recent Bluebonnet inspections also harbor a similar sense of turmoil. In 2024, the Office of Detention Oversight revealed that detainees were exhibiting suicidal behavior because of long wait times and delays at Bluebonnet. These ruminations on suicide due to the escalating deportation procedures and extended court delays are not unplanned, but rather an indicator of how ICE operates as a whole. For those in the know, violence is as synonymous with ICE as the Big Mac is with McDonald's. ICE provides financial backing and branding to correctional institutions—we would call them franchises—that are notoriously dangerous to incarcerated individuals. These prisons and jails lack motivation for reform because ICE rarely withdraws funds or ends contracts. Make no mistake, the SOS is not an isolated event but a symptom of a greater problem. Right now, Cuban detainees at Krome detention center in the Miami-Dade area in Florida are protesting under similar conditions to those at the Bluebonnet ICE facility. Across these ICE detention centers, detainees are resisting prolonged detention, inadequate food, a lack of medical care, and recurring abuse. The violence experienced in these facilities is slow violence, and slow violence leads to 'undue process.' For example, at Bluebonnet, people's limited access to correspondence and other mail has inhibited their ability to correspond with their families and legal teams to defend themselves. Slow violence is intentional, diminishing individuals' ability to defend themselves and receive legal due process. It results—predictably and intentionally—in undue process and self-deportation. Notably, the level of violence in ICE detention facilities is higher than in jails or prisons. U.S. citizens who commit crimes and are convicted of them are protected by law from experiencing violence during their incarceration. That is not to say that violence doesn't still occur in prisons, but that there are constitutional protections to guard against it. These same protections do not seem to exist for individuals in immigrant detention. Our collective level of outrage does not match the gross human rights violations happening daily to immigrant detainees—persons who have not been convicted of a crime but who are in the process of being removed from the country. While we pretend that we are protecting the sanctity of America, we are undermining our core values by denigrating 'the huddled masses' that have come to our shores seeking freedom. Instead, we place them in peril in our ICE detention centers. We know this is the America that some have fought hard to create. Is this the America that we will accept?

I Can't Help It: I'm on Trump's Side in the Musk Rift

I suppose I need to make it clear up front that I'm not much of a fan of Donald Trump. I don't think I need to explain why either. There's a good chance you reflexively understand the particularities of my distaste: the naked corruption, the antipathy for governmental function, the consistency with which he pays lip service to the darkest and strangest contingencies in the right-wing underworld. Mostly, though, I've just never loved the way Trump talks to, and about, other people. There is just something insecure about his approach. His macho barbs are always expressed via iPhone, and all carry the unmistakable stench of a guy coming up with what he wanted to say in an argument hours later, while stewing in the shower. With all that said, these past few days have opened my eyes to some elements of Trump's appeal. It turns out I can actually like the president—so long as he's making fun of Elon Musk. The ongoing Trump–Musk breakup has brought to light a truth lingering deep in my subconscious. You know when you watch the Super Bowl as a neutral fan and you can feel your brain tugging your body toward one side or another? That mysterious biophysical phenomenon that makes you a temporary Eagles fan? That sinister whisper in your ear? It's happening right now. I want Trump to punk this dude. Shove him in a locker. Make him humble. Can we deport him? We should probably deport him. For the one and only time in my life, I have become MAGA—and it feels amazing. Here's a quick recap of the feud as it currently stands. Musk, after haphazardly dismantling countless organs of the federal government without even saving all that much money, exited his role in the White House to return to his business concerns. Reborn as a private citizen, Musk began criticizing the major Republican spending bill working its way through the bowels of Congress—specifically in regards to the trillions of dollars it will add to the national debt, obliterating what was DOGE's raison d'être. (One sample post: 'This spending bill contains the largest increase in the debt ceiling in US history! It is the Debt Slavery Bill.') When those complaints were ignored, Musk's attacks grew more personal and less centered on an ostensibly good-faith intraparty debate about monetary policy. Finally, in a fit of petulance on Thursday, Musk went below the belt: He claimed that the president wouldn't have won the election without his financial assistance and that absent his sallow presence on the campaign trail, Democrats would have held on to their congressional majority too. That was the kiss of death for Musk's D.C. welcome. I genuinely cannot think of anything that will more effectively inspire the ire of Trump than the insinuation that he needed someone else's help to succeed. So, yesterday, the president claimed that Musk had gone 'crazy' and, with his classic knack for messy gossip, asserted that the tech baron had already worn out his welcome in the Oval Office by the time he scurried back to his Tesla duties. (The president also not so subtly threatened to rescind Musk's government contracts, Harvard-style. Funny how DOGE never considered that idea?) Musk—as he often does—retorted by making a truly astonishing number of posts on X directed at the president, culminating with the charge that the reason his administration hasn't released the illusory 'Epstein files,' which almost certainly don't exist, is because Trump was an associate of the disgraced financier, a fact we've long known. Hilariously, that allegation evoked a rare nondenial from the Trump camp; when confronted with Musk's Epstein imputation, White House press secretary Karoline Leavitt instead filibustered about how the president is committed to 'making America great again.' Curious! The breakup then simmered a bit, at least publicly. Politico reported that the two men might be brokering a ceasefire, and, my God, recovering a political alliance after playing the child molestation card is definitive proof that we all live in Bravoworld—and also in hell. But as of this morning, Trump hasn't let up the attack, again saying that the CEO has 'lost his mind' and that he isn't interested in talking to him. Unbelievable. I've never seen an inner-circle mainstay get relegated to Zelensky status faster. Five months ago, Musk was proclaiming that he was literally in love with Trump! And I think that's why I've found it so easy to root against him: Musk should have known better. Trump never changes. He is who he is, and that is terrible news for our country. Musk, however, thought he could be the one to change Trump. He assumed his skills were up to the task—but he merely possesses a craven instinct to bend to the contours of power, a third grade understanding of the legislative process, and, most crucially, a ridiculously amplified estimation of his own likability. And, reader, it is those kinds of men that I love watching eat shit. Imagine being Elon Musk and believing that Trump was keeping you around for your scintillating personality and bureaucratic acumen, and not because you are the richest man on the planet. Imagine being confronted with that uncanny laminated face in the mirror every day and still trusting that you have the verve and charisma to fire up a campaign rally. Imagine making the least funny tweets in the world, at all hours of the day, and thinking you could go toe-to-toe with Donald Trump, who—no matter what else I can say about him—is without a doubt one of the greatest posters in human history. (Elon's tweets go viral because he owns the platform they're on!) For months, Trump had to reassure this weird man, with shit vibes, that he was a crucial fixture of his government. Now he is gone, and I want the president to rain hellfire upon him. (The sooner he brings up the ketamine addiction, the better.) For the past eight years, I have watched Trump deploy his prickly, petty rage upon the most vulnerable members of society, harnessing the country's latent fury for the cruelest political objectives. So I must concede that it does feel great to draft in the glorious power of Trump's disrespect when it serves my own interests. I finally get it, and that should be a teaching moment for the Democrats. Can't someone in the party emerge as the locus for all of our haughty anger? Let me feel like this more often—I am begging you.

Filling Parks and Rec director opening next for council
Jun. 6—Parks and Recreation director is next on the lengthy list of job openings for the Decatur City Council to fill, and 73 people have applied for the position. Just this week, a new police chief took office and the council made an offer to a planning director candidate. City Council President Jacob Ladner said Wednesday that the priority for the next agenda is its midyear review of the fiscal 2025 budget, and then Parks and Recreation director is next. The City Council, which is responsible for hiring directors, is seeking to replace former Parks and Recreation director Jason Lake, who retired in February. In response to a request based on the state's Open Records Act, city Human Resource Director Richelle Sandlin released the applications for Parks and Recreation director and an email containing her recommendations to the council, Mayor Tab Bowling and Chief Financial Officer Kyle Demeester. In the email, she recommended the council interview five applicants: —William Collins, statewide trails coordinator, Alabama Department of Conservation and Natural Resources, Montgomery. He previously served as athletic programs director, city of Bessemer; director of parks program, Red Mountain Park; and athletics coordinator, city of Orange Beach. —Stephanie McLain, interim operations manager and Point Mallard Park superintendent; previously Point Mallard marketing and group sales after starting as aquatic facilities operator. —Joseph Rodecker, former recreation superintendent, Canton, Ohio; previously assistant parks and recreation director, Montgomery County, Tennessee; athletic division, Franklin, Tennessee; and assistant property manager, CNA. —Jerry Smith, director of parks and grounds, Boynton Beach, Florida; previously county parks director, Bexar County, Texas; and deputy director of parks and recreation, North Miami Beach, Florida. —Todd Strubhart, golf and street services, University City Parks, Illinois; previously director of Parks and Recreation, Godfrey, Illinois; recreation supervisor, Belleville, Illinois; managing partner, Midwest Team Training LLC; vice president of select sports operations, Belleville Select Youth Sports. Sandlin listed a second group of four applicants who she writes, "are minimally qualified and recommended for hold pending consideration of Group 1 candidates." She writes that a third group of 63 applicants "did not meet the minimum requirements for consideration and further review is not recommended." — DYS director The City Council is also looking for a new leader of Decatur Youth Services after Brandon Watkins resigned in March. Retired DYS Director Bruce Jones stepped in to run the department on a part-time basis. The city received 70 applications, but Sandlin has not made a recommendation on how the council should proceed. Ladner said that's OK with him. He said he prefers "to let Bruce guide us on how he wants to proceed," especially since the department seems to be running smoothly.
