Eight migrants thought to be lost at sea after a boat capsized off the coast of California on Monday were found alive, authorities announced in a news release.
Witnesses spotted a panga boat overturned at a beach in Del Mar, 22 miles from San Diego. Lifeguards and bystanders participated in rescue efforts, the Justice Department said. Law enforcement officials recovered three bodies from the water, including a 14-year-old boy from India. His 10-year-old sister remains missing at sea and is presumed dead. The incident resulted in the deaths of three people.
The children's father is in a coma and their mother is hospitalized. Nine others were initially unaccounted for.
On Monday, officials arrested two Mexican nationals believed to be involved in the event, identified as Julio Cesar Zuniga Luna and Jesus Juan Rodriguez Leyva. The two were taken into custody at the beach on Monday and charged with bringing in aliens resulting in death and bringing in aliens for financial gain.
While conducting operations that evening, Border Patrol agents in Chula Vista identified a vehicle that had been observed at the scene of the smuggling incident. The driver of the vehicle fled the scene.
Border Patrol agents identified two other vehicles during the investigation and managed to stop and arrest the drivers of the vehicles, locating eight of nine people who had initially been reported missing.
In that instance, Melissa Jenelle Cota, Gustavo Lara and Sergio Rojas-Fregosa, all Mexican nationals, were arrested and charged with transportation of illegal aliens. Rojas-Fregoso was in the country without authorization and had previously been deported in 2023.
' Human smuggling, regardless of the route, is not only illegal but extremely dangerous,' said Shawn Gibson, special agent in charge of HSI San Diego. 'Smugglers often treat people as disposable commodities, leading to tragic and sometimes deadly consequences, as we saw in this case.
'Yesterday's heartbreaking events are a stark reminder of the urgent need to dismantle these criminal networks driven by greed. The HSI along with the U.S. Border Patrol, U.S. Coast Guard, and other partners from the Marine Task Force, remains firmly committed to holding those responsible accountable for these senseless deaths.'
Department of Homeland Security Secretary Kristi Noem said in a written statement that she will seek the death penalty against the alleged criminals.
'I will be formally requesting that the attorney general ensure that these two suspected smugglers are swiftly prosecuted to the fullest extent of the law,' she said. 'I will also be urging the Attorney General to seek the death penalty in this case. The Department of Homeland Security will not tolerate this level of criminal depravity or reckless disregard for human life.'

A man who was mistakenly deported to El Salvador by the Trump administration has been returned to the US to face criminal charges. Kilmar Abrego Garcia was charged in an indictment filed in federal court in Tennessee with conspiring to transport illegal immigrants into the US, Attorney General Pam Bondi said on Friday. The indictment was filed on 21 May, more than two months after he was deported from the US, court records have shown. In a statement, Abrego Garcia's lawyer Andrew Rossman said it would now be up to the US judicial system to ensure he received due process. "Today's action proves what we've known all along - that the administration had the ability to bring him back and just refused to do so," he said. Abrego Garcia was deported from Maryland despite an immigration judge's 2019 order granting him protection after finding he was likely to be persecuted by gangs if he was returned there. The indictment alleges that Mr Garcia worked with at least five co-conspirators to bring immigrants to the US illegally and transport them from the border to other destinations in the country. On Friday, Ms Bondi outlined the charges at a news conference: "The grand jury found that over the past nine years, Abrego Garcia has played a significant role in an alien smuggling ring. "He made over 100 trips the grand jury found - smuggling people throughout our country... MS-13 [international criminal gang] members, violent gang terrorist organisation members... throughout our country. "He will be prosecuted in our country, sentenced in our country if convicted and then returned after completion of his sentence." Ms Bondi said Salvadoran President Nayib Bukele agreed to return Mr Garcia to the US after American officials presented his government with an arrest warrant. Critics of Donald Trump have pointed to the deportation of Mr Garcia as an example of the excesses of the Republican president's aggressive immigration policies. US District Judge Paula Xinis has opened a probe into what, if anything, Mr Trump's administration has done to secure his return, after his lawyers accused officials of stonewalling their requests for information. Officials responded by alleging that Mr Garcia was a member of the MS-13 gang - something his lawyers have strongly denied. In a separate statement, Pam Bondi also attacked what she called the "Fake News Media" and repeated the - yet unproven - allegations against Mr Garcia. "The Justice Department's Grand Jury Indictment against Abrego Garcia proves the unhinged Democrat Party was wrong, and their stenographers in the Fake News Media were once again played like fools. "Abrego Garcia was never an innocent 'Maryland Man'- Abrego Garcia is an illegal alien terrorist, gang member, and human trafficker who has spent his entire life abusing innocent people, especially women and the most vulnerable."

THIS is the horror moment a jiu-jitsu student was left paralysed from the neck down after being slammed by his black belt instructor. Jack Greener, a beginner white belt, was seen receiving horrific injuries after his instructor put on a move that struck his neck. 4 4 Footage shows Greener pitting against his instructor, dubbed "Sinistro", inside a training facility. The beginner was on all fours when his instructor flipped him forward before twisting his head and neck. Greener immediately lost control over his body and fell to the ground. He was rushed to the hospital - just days before he was supposed to graduate from college in 2018. The horrific accident crushed his cervical vertebrae, effectively paralysing his entire body below the neck. Greener was forced to spend months in the hospital, recovering from multiple strokes as a result of his injuries, according to the New York Post. He then sued Del Mar Jiu Jitsu club in San Diego for the injuries and blamed his instructor, Iturralde, for his 'dynamic, aggressive grappling style". Greener, now a mountain climber and a popular motivational speaker, was first awarded $56 million by a San Diego jury in 2023. Rahul Ravipudi, one of Greener's attorneys, said: "[The judgement] cements a critical legal victory not only for our client, but also for injured athletes across California by reaffirming that sports instructors and facilities may be held accountable when they unreasonably increase risks beyond those inherent in the sport." BJJ legend Rener Gracie, who was called as an expert witness in the case, said: "The black belt instructor did a technique that placed his entire body weight on Greener's neck, causing him to instantly fall limp and lose all function of his limbs." It comes after a champion martial artist tragically died after a horrific collapse in the ring. Mohit Sharma, 21, was fighting in the second round of a university wushu tournament on Monday in India. People immediately rushed to provide assistance, and medics were called. Sharma, though, could not be revived after a reported suspected heart attack. The sportsman reportedly "always had one" before going to the gym or an MMA session, as well as a "pre-workout" - a supplement designed to enhance energy.
