Lawsuit filed over Florida deputy's shooting of U.S. airman who was killed in his own home

FORT WALTON BEACH, Fla. — Prominent civil rights attorney Ben Crump filed a federal lawsuit Tuesday against a former Florida sheriff's deputy and others for the May 2024 shooting death of 23-year-old U.S. Senior Airman Roger Fortson.
Former Okaloosa County Sheriff's Deputy Eddie Duran shot and killed Fortson, who was Black, at the door of Fortson's apartment. Duran has pleaded not guilty to manslaughter. That criminal case is pending.
Crump outlined the lawsuit during a news conference Tuesday afternoon with Fortson family members in Fort Walton Beach, Fla.
Crump says his lawsuit contends that Duran used 'excessive and unconstitutional deadly force' in the shooting. It also outlines what it calls failures of training and supervision at the sheriff's office and claim the apartment complex where Fortson was shot provided 'misleading, unverified information' that led to the violent response.
Authorities say Duran had been directed to Fortson's Fort Walton Beach apartment in response to a domestic disturbance report that turned out to be false. After repeated knocking, Fortson opened the door while holding his handgun at his side, pointed down. Authorities say Duran shot him multiple times before telling Fortson to drop the gun.
Duran, 39, began his law enforcement career as a military police officer in the Army. An Oklahoma police department hired him in 2015 after his military discharge. He joined the Okaloosa County Sheriff's Office in 2019, resigned two years later and then rejoined the sheriff's office in 2023.
Okaloosa Sheriff Eric Aden fired Duran after Fortson's death because an internal investigation concluded Duran's life was not in danger when he opened fire.
Duran identifies as Hispanic, according to his voter registration.
Fortson grew up in Atlanta and joined the Air Force in 2019, the year he graduated from high school.
The apartment complex where Fortson lived is about 8 miles from Hurlburt Field. He was assigned to the 4th Special Operations Squadron as a special missions aviator, where one of his roles was to load a gunship's 30 mm and 105 mm weapons.
His death was one of a growing list of killings of Black people by law enforcement in their own homes. It also renewed debate over Florida's 'stand your ground' law.
The case is in the pretrial hearing phase, with a hearing on motions set for May 20. Duran is out of jail on bond.
Crump, 55, is a well-known Black attorney based in Tallahassee, Fla., who has worked on numerous high-profile civil rights cases and wrongful death lawsuits. His cases have included those involving other Black people who have been killed by law enforcement, including Breonna Taylor, George Floyd and Michael Brown.

Tacoma teen facing vehicular assault charge after wreck in Lacey injures 11, police say
A 19-year-old Tacoma man was arrested Saturday on suspicion of vehicular assault after Lacey police say he caused a four-vehicle crash on Ruddell Road. Eleven people were injured, including five, ages 16 to 67, who were taken to an area hospital with minor injuries or broken bones, according to police. The 19-year-old was booked into the Thurston County Jail about 4 p.m. The jail log identifies his occupation as 'Army.' About 3:20 p.m. Saturday, a Lacey police officer witnessed a Dodge Charger being driven recklessly on northbound College Street Southeast. The officer attempted to catch up to the driver to make a traffic stop, but the driver turned left onto 14th Avenue Southeast and fled at a high speed onto Ruddell Road Southeast 'where he caused a four-car injury collision,' a news release reads. The Charger burst into flames and had to be extinguished by firefighters from Lacey Fire District 3. The incident closed Ruddell Road between 15th Avenue Southeast and Lacey Boulevard for more than three hours, according to police. Police thanked the city's public works department with helping with traffic control and cleaning up the scene. The 19-year-old driver also was booked on suspicion of reckless driving.

California lawmakers, immigrant advocates denied entry to Adelanto ICE facility
A coalition of California lawmakers and immigrant advocates were denied entry to the U.S. Immigrations and Customs Enforcement facility in Adelanto, where many immigrants detained during recent raids in Los Angeles are being held. U.S. Rep. Gilbert R. Cisneros Jr. (CA-31) traveled to the Adelanto ICE Processing Center with Rep. Judy Chu (CA-28) and Rep. Derek Tran (CA-45) and members of the Coalition for Humane Immigrant Rights (CHIRLA) and the American Civil Liberties Union (ACLU) on Sunday morning, according to a media release from Rep. Cisneros' office. Heavy military presence seen in downtown Los Angeles after days of immigration protests 'I attempted to conduct Congressional oversight at the Adelanto ICE facility…they locked the gate, ignored our calls and denied us entry,' Rep. Cisneros said. 'At Trump's direction, ICE and DHS agents are harassing our community, questioning our neighbors and disregarding the law by preventing us from conducting oversight.' 'Trump is deliberately manufacturing chaos and inciting fear,' he added. 'I will continue to press for answers as our community is under attack.' Cisneros' constituency encompasses much of the San Gabriel Valley and contains many of the area's predominantly Hispanic communities. Rep. Chu represents much of northeastern Los Angeles County in the 28th District, and Rep. Tran represents the 45th District, which covers parts of L.A. and Orange counties. Another local member of Congress, Rep. Jimmy Gomez (CA-34), told KTLA on Saturday that he was denied entry to the facility where detained immigrants were being held in downtown Los Angeles. Gomez, whose 34th District includes many of Los Angeles' most prominent ethnic enclaves, said the Trump administration was 'operating outside the bounds of the law' by not letting members of Congress into the detention facilities to conduct oversight.
