No Brand Names, Prescribing Generic Drugs Should Be A Must: Supreme Court

Doctors should only prescribe generic medicines and not any particular brand, as has been ordered in Rajasthan, the Supreme Court remarked today while hearing a petition seeking regulation of unethical marketing practices by pharmaceutical companies.
"If this directive is implemented across the country, it will bring about a huge change," said Justice Sandeep Mehta, who was part of a three-judge bench including Justices Vikram Nath and Sanjay Karol.
The petition contended that pharmaceutical companies are bribing doctors so they prescribe excessive or irrational drugs and push for over-priced brands. Not only does it bring up medical costs for the common man, it ca also lead to overuse of drugs which has negative effects, or create drug dependence.
The petition also said pharmaceutical companies should be held accountable for providing freebies to doctors.
In an earlier hearing, the lawyer representing Federation of Medical and Sales Representatives Association of India (FMRAI) cited what he said was a Central Board of Direct Taxes press release to contend that the manufacturer of Dolo 650, a popular fever drug, had spent Rs 1,000 crore in freebies.
The court remarked that the issue of pharmaceutical companies allegedly bribing doctors will be resolved if there is a statutory mandate for doctors to prescribe generic medicines.
"This will follow in line with what you are praying. In Rajasthan, there is now an executive instruction that every medical professional will have to prescribe generic medicine. They can't prescribe by any company name. That should take care of the things," the court said.

In the seven-minute video, Shoaib shared Dipika is out of the ICU and is recovering in the hospital. Sharing details about Dipika's surgery, Shoaib said that the doctors removed a small portion of Dipika's liver because of the tumour. She also underwent a gall bladder surgery. 'Nothing to worry, as liver is an organ that can regenerate itself', he shared in the video. He also shared that after the surgery, Dipika had to stay in the ICU for three days. 'Dipika will stay in the hospital for another three to five days, as advised by doctors. The surgery was major, she was in OT for 14 hours. It was a difficult time,' he said. As the surgery went on for fourteen hours, it created panic among her family members. Shoaib shared, 'I was with Dipika till 8:30 am before her surgery started. At 11:30 pm, she was shifted to the ICU. Though the doctors informed me that the surgery would take time, post 6-7 pm, my family members and I started to panic. We had never experienced a long surgery such as this. It was normal to be a little scared.' In his video, Shoaib also said that Dipika was on liquid diet for three days after her surgery. 'Now, she is back to eating normal food. She has been showing great signs of recovery as she has started walking and her blood reports are also normal.' However, he was brought to hospital to see his mother when he started to miss her post her surgery. On May 27, Dipika had taken to her official Instagram handle to share her diagnosis. Dipika shared a note that read, 'As you all are aware last few weeks have been quite difficult for us… walking into the hospital for a pain in the upper area of my stomach… and then finding out its a tennis ball size tumour in the liver and then finding out that the tumour is second stage malignant (cancerous)… it has been one of the most difficult time we have seen, experienced!' She added, 'I am all positive and determined to face this and walk out stronger Inshallah! With my entire family being by my side… and all the love and prayers pouring from all of you I will sail through this too!' Dipika, who was previously married to Raunak Mehta, tied the knot with her Sasrual Simar Ka co-star Shoaib Ibrahim in 2018. In 2023, they welcomed their baby boy, Ruhaan.

Rs 5,000 as aid to those caring for differently abled likely soon in Delhi
A financial assistance of Rs 5,000 to caretakers and attendants of people suffering from over 80% or above disability is likely to be provided soon by the Delhi government in a first-of-its-kind initiative, officials have said. 'This is going to be the first such scheme in the Capital where the caretakers will also receive financial assistance from the government…,' Delhi Social Welfare Minister Ravinder Indraj Singh said. 'A proposal has been prepared in this regard, and it was already discussed in the Cabinet meeting once… Some changes are being made. Once it is ready, the proposal will be presented before the Cabinet again for approval and further implementation,' he added. The Capital, the Minister said, has 1,000 such families with people having 80% or above disability, and who are completely dependent on their family members and others. For an accurate figure, however, the department is also planning to conduct a survey so that only those eligible can avail the benefits under the proposed scheme. 'This is a first-of-its-kind proposal not only in Delhi but across the country,' a senior official said. The Social Welfare Department's existing pension scheme provides persons with over 40% disability a monthly aid of Rs 2,500. As per official data, about 1.5 lakh specially-abled people are availing this pension scheme. However, no assistance is provided to their caregivers. 'The aim behind this scheme is to ensure that there is no negligence in the care of such persons with disabilities, especially those from economically weaker sections. Also, the attendants receive some financial support… because well-to-do families have separate nurses or caretakers to take care of such persons…But the case is different in poor families, so this scheme will help them financially,' the senior official added. Officials said the caretakers can be parents, siblings, or anyone who is taking care of the differently abled. Meanwhile, on Friday, the Social Welfare Minister also inspected the under-construction building for mentally challenged individuals in Narela on Friday. Once completed, individuals currently residing in overcrowded shelter homes like Asha Kiran Home in Rohini will be relocated here. The building, located within the Nursing College Hostel premises and the Primary Urban Health Centre campus in Narela, will accommodate 220 differently abled residents. This facility is expected to be operational within three months. The Minister directed the officials to ensure the building is wheelchair-friendly and there is no encroachment around the premises, so that ambulance movement does not face any obstruction. Indraj also said that multiple facilities are being developed across the city for differently abled people. Once the facilities in Mamurpur and Dallupura are completed, they will significantly improve access to services, safety, and healthcare for the differently abled, he added.
