Man arrested for sending obscene message to Minister Pankaja Munde

Maharashtra Cyber Police arrested a man from Pune for allegedly making obscene phone calls and sending inappropriate messages to State Cabinet Minister Pankaja Munde.
According to Cyber Police, Nikhil Bhamre, 26, who works as a social media coordinator at the Maharashtra BJP office in Mumbai, filed the complaint on April 29, as stated by DCP Sanjay Shintre. BJP's State-level social media coordinator, Prakash Gade, informed Mr. Bhamre that an unknown man had been making offensive calls to Ms. Munde and advised him to approach the police and file a complaint. The case also involves defamatory and obscene content about Ms. Munde on YouTube and other social media platforms.
Sections 78 (stalking and contacting despite disinterest) and 79 (prohibiting words, gestures, or actions intended to insult a woman's modesty) of the Bharatiya Nyaya Sanhita (BNS), along with the Section 67 (publishing obscene content online) of the Information Technology Act, have been invoked.
The accused, identified as Amol Kale, 25, was detained from Bhosari in Maharashtra's Pune district after police traced his location through the mobile number used for the calls. After the accused admitted to making the calls during interrogation, he was brought to Mumbai and formally arrested last night. Further investigation is under way in the case.

We direct that the petitioner be released in the FIR subject to conditions imposed by the trial court,' the bench said. The bench further instructed Rao not to make any derogatory statements on his show or permit any guest to do so in future broadcasts. Court convicts man in child sexual exploitative material case

New Delhi [India], June 13 (ANI): The Rouse Avenue court has convicted a man in a child sexual abuse material (CSAM) case. It was alleged that the Convict was involved in child sexual abuse through the collection, browsing, downloading and distribution of material through the internet, depicting children in sexually explicit acts. The Central Bureau of Investigation (CBI) had registered a case under the Information Technology (IT) Act in 2016. Additional Chief Judicial Magistrate (ACJM) Jyoti Maheshwari on Wednesday Convicted Anurag Sharma. The court said, 'It is evident that the prosecution has successfully proved the commission of the alleged offence by the accused, beyond reasonable doubt.' 'Accordingly, the accused Anurag Sharma is convicted of the offence under section 67 B (b) of the Information Technology Act, 2000,' ACJM Jyoti Maheshwari said in the judgement passed on June 11. The matter has been listed for the hearing arguments on sentence on July 3. CBI had registered a complaint alleging that one person, namely Anurag Sharma, indulged in the collection, browsing, downloading and distribution of material, depicting children in sexually explicit acts, in electronic form using internet/ computer resources on 27.09.2015, by using the internet. On this basis, on 27.10.2016, a case under Section 67 B of the Information Technology Act, 2000 was registered. The court said that the factum of collection is proved by the presence of 183 files, containing child sexual exploitative and abuse material (CSEAM) material and the factum of browsing and download of such CSEAM material can be ascertained from the full path of the files. The fact that these files were stored in the E drive of the hard disk of the laptop, which was exclusively used by the accused, proves the factum of download of such content and thus, all the ingredients of Section 67 B(b), IT Act, 2000, have been fulfilled in the present case, the court held. During the investigation, the CBI recovered a laptop and an internet modem from Anurag Sharma's residence. The laptop was sent for examination at the Centre for Development of Advanced Computing (CDAC). The CBI had concluded that during the years 2015 and 2016, the accused Anurag Sharma collected, browsed and downloaded CSEAM material, in electronic form and thus, committed the offence under Section 67B, IT Act. A chargesheet was filed against the accused Anurag Sharma on 02.05.2017. During the hearing the court rejected the defence arguments that the destination IP of the various URLs and the sexually explicit material, involving children, was neither investigated upon by the IO nor was mentioned in the Centre for Development of Advanced Computing (CDAC) report. 'However, section 67 B of IT Act, does not mandate any investigation or recovery of the destination IP and only requires that the accused should have browsed, collected or downloaded the material, in electronic form, involving children in sexually explicit acts,' the court said in the judgement. 70-year-old Mohali woman duped of ₹1 crore in ‘digital arrest' fraud

In yet another case of 'digital arrest' fraud targeting a senior citizen, a 70-year-old retired government official lost ₹1.03 crore after falling prey to cyber criminals who kept her under 'arrest' for three days. A resident of Phase 6, Mohali, the victim received a phone call from an unknown person, claiming that her KYC number had been linked to a money laundering case. The caller told her that she would be placed under 'digital arrest' and monitored continuously. The fraudsters, posing as police personnel, instructed her not to speak with anyone and remain connected over video call. To avoid legal trouble, the woman said, she was told to settle the matter by transferring money. Out of fear, she followed the instructions and sent money in multiple instalments through RTGS. Over three days, she ended up transferring a total of ₹1.03 crore into various bank accounts, as directed by the scammers. The victim said she remained under constant contact with the fraudsters during this period. After the calls ended, she realised she had been cheated and reported the matter to the cyber cell. Following her complaint, a case under Sections 308(2), 318(4), 127(7), 61(2) of the Bharatiya Nyaya Sanhita (BNS) and Section 66 of the Information Technology Act was registered at the Cyber Crime police station. Police have launched an investigation into the case, and are trying to trace the bank accounts used for transfers and the origin of the calls. Police have advised residents to remain cautious and not transfer money based on threats or unverified legal claims made over phone calls. DSP Rupinder Kaur Sohi said, 'Residents must not fall prey to such traps. If anyone threatens you with 'digital arrest', consider it a fraud, as no such concept exists in the Indian legal system. Further, contact your local police station and report it.'
