A reformed effort by the state Office of Hawaiian Affairs to permit housing on land it owns in Kakaako has come up short at the Legislature.
Two Senate committees on Friday indefinitely deferred a bill that proposed to partly repeal a ban on residential development in Kakaako, makai of Ala Moana Boulevard, for the benefit of OHA.
The decision sidelines further consideration of Senate Bill 534 this year.
OHA has been trying for more than a decade to convince a majority of state lawmakers to allow residential development on at least some of the 31 acres OHA accepted from the state in 2012 to partially settle claims against the state over unpaid revenue generated from former Hawaiian crown lands, referred to as ceded land.
In several prior years, the Senate passed OHA-backed bills to allow residential development in the area known as Kakaako Makai. Those prior bills were defeated in the House, where they were opposed by then-Rep. Scott Saiki, who represented Kakaako and during that time was House speaker or majority leader with great power over legislation.
Saiki lost his bid for reelection in August.

This year 18 representatives in the 51-member House expressed early support for OHA's proposed legislation. SB 534 was introduced by 11 of 25 state senators.
In early February three Senate committees—Housing, Hawaiian Affairs, and Water and Land—advanced SB 534 in unanimous or near-unanimous votes after a three-hour public hearing where more than 400 pages of written testimony were submitted.
Supporters of the legislation outnumbered opponents by more than 3-to-1.
Two more Senate committees—Judiciary and Ways and Means—intended to take action on the bill Feb. 26. Instead, Judiciary Committee Chair Sen. Karl Rhoads announced Feb. 26 that a new draft of SB 534 was being proposed by the two committees and that a public hearing was scheduled for two days later, Friday, because proposed amendments were pretty substantial.
Yet on Friday, Rhoads (D, Nuuanu-Downtown-Iwilei ) recommended deferring the bill indefinitely without the planned hearing because some senators didn't support the new draft.
'We were scheduled to take testimony, but we have not found a way forward on this bill, ' he announced. 'Several proposals have been put out there, and we don't have a consensus on them.'
Sen. Donovan Dela Cruz, Ways and Means chair, added that the chairs of the three committees that previously advanced the bill did not agree with the proposed new draft.
'We couldn't reach agreement with the subject-matter chairs, so we'll be deferring, ' Dela Cruz (D, Mililani-Wahiawa-Whitmore Village ) said in the hearing room.
New provisions in the proposed draft included a different way for the Hawaii Community Development Authority, the state agency regulating development in Kakaako, to fund area infrastructure improvements, and forming a working group to help transfer regulation of Kakaako development from HCDA to the city.
OHA expressed support for the proposed draft in written testimony. Some opponents of earlier versions of SB 534 opposed the proposed draft.
Kai Kahele, who spearheaded the push for SB 534 as OHA's board chair, said Monday in a statement that he was disappointed by the outcome but respects the legislative process and accepts the decision.
'I am proud of the way Team OHA presented the case for affordable workforce housing in Honolulu's urban core, and we remain committed to addressing the needs of our beneficiaries, ' said Kahele, a former state and federal lawmaker who was elected to the agency's board of trustees in August. 'As for the future of our lands in Kakaako Makai, the Board of Trustees will determine the best path forward in alignment with our mission and responsibilities.'
Some opponents of SB 534 suggested that the state swap other land for the nine parcels that OHA accepted in lieu of $200 million.
'It would make sense if the State wants to help OHA develop affordable housing to offer additional, more appropriate land elsewhere, ' Jonathan Lott said in written testimony for Friday's anticipated hearing. 'Perhaps the State could take back the Kakaako Makai ceded lands in exchange.'
Sherry Broder told the Senate Judiciary and Ways and Means committees in written testimony that the current housing prohibition in Kakaako Makai is unfair to Native Hawaiians.
'OHA should be allowed to maximize this asset just as Howard Hughes (Corp.) and other developers have been doing in Kakaako, ' she said. 'OHA's plan is excellent and will bring benefits to everyone : more housing, attractive development and an income stream to OHA for the benefit of Native Hawaiians.'
Through SB 534, OHA sought to allow towers rising up to 400 feet, twice the current limit, on two of its parcels fronting Ala Moana Boulevard. The bill also mandated that more than 50 % of all resulting homes on these two parcels be reserved for Hawaii resident households that don't earn over 140 % of Oahu's median income.
Furthermore, buyers of these reserved homes would have to be owner-occupants, and a preference would be given to those who work within 5 miles of the area in 'essential ' fields that include education, health care, law enforcement, hospitality and construction.
Kahele framed the objective as helping the state address a chronic affordable- housing shortage.
'We are not building homes for out-of-state investors, ' he said during a community meeting in January.
The three Senate committees amended the original version of the bill to require that the reserved homes have perpetual price limits keeping them affordable for all future owners with the same income restriction.
On three other OHA parcels, the agency proposed market-priced housing within existing height limits and for only Hawaii residents with an owner-occupant restriction, or perhaps a hotel or condo-hotel on one parcel.
Proceeds from market -priced housing were intended to help fund OHA programs that benefit Hawaiians and to allow the agency to pay for other planned improvements on its Kakaako land, including a Hawaiian cultural center and public waterfront promenade along the Ewa edge of Kewalo Basin Small Boat Harbor.
The Legislature banned residential use of land in Kakaako Makai in 2006 to block HCDA's plan to have a developer create a mix of housing, commercial uses and recreational public spaces after project opponents argued that it was a bad use of public land and would curtail public access to the waterfront.
Today the area includes a mix of warehouses, car dealerships, office buildings, parking lots, a marine research lab, a waterfront restaurant, a ship repair facility, a children's museum, the University of Hawaii medical school and Kakaako Waterfront Park.

Senate GOP unveil long-awaited SNAP proposals for Trump bill
Senate Republicans on Wednesday rolled out a suite of proposed changes to the Supplemental Nutrition Assistance Program (SNAP) as a key component of President Trump's 'big beautiful bill' – but it dials back some of the proposals sought by the House that drew intraparty concerns. The new legislative text from the Senate would require states to cover some of the cost of SNAP benefits, which are currently completely funded by the federal government, if they have a payment error rate above 6 percent beginning in fiscal 2028, while allowing states with rates below that level to continue paying zero percent. It also proposes states with higher payment error rates cover a greater share of benefit costs. If the error rate is 6 percent or higher, states would be subject to a sliding scale that could see its share of allotments rise to a range of between 5 percent to 15 percent. The House, by contrast, called for all states to cover 5 percent of the cost of allotments in its agricultural proposal passed as part of a broader plan to advance Trump's tax agenda last month, with states that had higher payment error rates having to pay anywhere between 15 to 25 percent. The softened proposal comes as Senate Republicans expressed concerns about how the House pitch would have impacted states. 'This bill takes a commonsense approach to reforming SNAP-cutting waste, increasing state accountability, and helping recipients transition to self-sufficiency through work and training,' Senate Agriculture Chairman John Boozman (R-Ariz.) said in a statement on Wednesday. 'It's about being good stewards of taxpayer dollars while giving folks the tools to succeed.' 'At the same time, our farmers and ranchers are facing real challenges,' he said. 'This legislation delivers the risk management tools and updated farm bill safety net they need to keep producing the safest, most abundant and affordable food, fuel, and fiber in the world. It's an investment in rural America and the future of agriculture.' Like the House bill, the Senate bill would also decrease the administrative cost the federal government is required to pay to help cover program operations in the states by 25 percent, but beginning in fiscal year 2027. The proposals in both chambers also seek to limit the federal government's ability to increase monthly benefits in the future and beef up work requirements, as well as farm provisions that GOP leaders have argued will make it easier to craft a bipartisan farm bill in the months ahead – although Democrats have said otherwise. Republicans on the Senate Agriculture Committee estimated the recent legislation would generate $144 billion in net savings in the years ahead as the party looks to ramp up cost-cutting measures in Trump's plan amid concerns about the overall deficit impact of his tax priorities. Exclusive-China-backed militia secures control of new rare earth mines in Myanmar
By Naw Betty Han, Shoon Naing, Devjyot Ghoshal, Eleanor Whalley and Napat Wesshasartar BANGKOK (Reuters) -A Chinese-backed militia is protecting new rare earth mines in eastern Myanmar, according to four people familiar with the matter, as Beijing moves to secure control of the minerals it is wielding as a bargaining chip in its trade war with Washington. China has a near-monopoly over the processing of heavy rare earths into magnets that power critical goods like wind turbines, medical devices and electric vehicles. But Beijing is heavily reliant on Myanmar for the rare earth metals and oxides needed to produce them: the war-torn country was the source of nearly half those imports in the first four months of this year, Chinese customs data show. Beijing's access to fresh stockpiles of minerals like dysprosium and terbium has been throttled recently after a major mining belt in Myanmar's north was taken over by an armed group battling the Southeast Asian country's junta, which Beijing supports. Now, in the hillsides of Shan state in eastern Myanmar, Chinese miners are opening new deposits for extraction, according to two of the sources, both of whom work at one of the mines. At least 100 people are working day-to-night shifts excavating hillsides and extracting minerals using chemicals, the sources said. Two other residents of the area said they had witnessed trucks carrying material from the mines, between the towns of Mong Hsat and Mong Yun, toward the Chinese border some 200km away. Reuters identified some of the sites using imagery from commercial satellite providers Planet Labs and Maxar Technologies. Business records across Myanmar are poorly maintained and challenging to access, and Reuters could not independently identify the ownership of the mines. The mines operate under the protection of the United Wa State Army, according to four sources, two of whom were able to identify the uniforms of the militia members. The UWSA, which is among the biggest armed groups in Shan state, also controls one of the world's largest tin mines. It has long-standing commercial and military links with China, according to the U.S. Institute of Peace, a conflict resolution non-profit. Details of the militia's role and the export route of the rare earths are reported by Reuters for the first time. University of Manchester lecturer Patrick Meehan, who has closely studied Myanmar's rare earth industry and reviewed satellite imagery of the Shan mines, said the "mid-large size" sites appeared to be the first significant facilities in the country outside the Kachin region in the north. "There is a whole belt of rare earths that goes down through Kachin, through Shan, parts of Laos," he said. China's Ministry of Commerce, as well as the UWSA and the junta, did not respond to Reuters' questions. Access to rare earths is increasingly important to Beijing, which tightened restrictions on its exports of metals and magnets after U.S. President Donald Trump resumed his trade war with China this year. While China appears to have recently approved more exports and Trump has signalled progress in resolving the dispute, the move has upended global supply chains central to automakers, aerospace manufacturers and semiconductor companies. The price of terbium oxide has jumped by over 27% across the last six months, Shanghai Metals Market data show. Dysprosium oxide prices have fluctuated sharply, rising around 1% during the same period. CHINESE INFLUENCE A prominent circular clearing first appears in the forested hills of Shan state, some 30 km (18.6 miles) away from the Thai border, in April 2023, according to the satellite images reviewed by Reuters. By February 2025 - shortly after the Kachin mines suspended work - the site housed over a dozen leaching pools, which are ponds typically used to extract heavy rare earths, the images showed. Six km away, across the Kok river, another forest clearing was captured in satellite imagery from May 2024. Within a year, it had transformed into a facility with 20 leaching pools. Minerals analyst David Merriman, who reviewed two of the Maxar images for Reuters, said the infrastructure at the Shan mines, as well as observable erosion levels to the topography, indicated that the facilities "have been producing for a little bit already." At least one of the mines is run by a Chinese company using Chinese-speaking managers, according to the two mine workers and two members of the Shan Human Rights Foundation, an advocacy group that identified the existence of the operations in a May report using satellite imagery. An office at one of the two sites also had a company logo written in Chinese characters, said one of the workers, who spoke on condition of anonymity in order to discuss sensitive matters. The use of Chinese operators in the Shan mines and transportation of the output to China mirrors a similar system in Kachin, where entire hillsides stand scarred by leaching pools. Chinese mining firms can produce heavy rare earth oxides in low-cost and loosely regulated Myanmar seven times cheaper than in other regions with similar deposits, said Neha Mukherjee of London-based Benchmark Mineral Intelligence. "Margins are huge." Beijing tightly controls the technology that allows for the efficient extraction of heavy rare earths, and she said that it would be difficult to operate a facility in Myanmar without Chinese assistance. The satellite imagery suggest the Shan mines are smaller than their Kachin counterparts but they are likely to yield the same elements, according to Merriman, who serves as research director at consultancy Project Blue. "The Shan State deposits will have terbium and dysprosium in them, and they will be the main elements that (the miners) are targeting there," he said. STRATEGIC TOOL The UWSA oversees a remote statelet the size of Belgium and, according to U.S. prosecutors, has long prospered from the drug trade. It has a long-standing ceasefire with the junta but still maintains a force of between 30,000 and 35,000 personnel, equipped with modern weaponry mainly sourced from China, according to Ye Myo Hein, a senior fellow at the Southeast Asia Peace Institute. "The UWSA functions as a key instrument for China to maintain strategic leverage along the Myanmar-China border and exert influence over other ethnic armed groups," he said. Some of those fighters are also closely monitoring the mining area, said SHRF member Leng Harn. "People cannot freely go in and out of the area without ID cards issued by UWSA." Shan state has largely kept out of the protracted civil war, in which an assortment of armed groups are battling the junta. The fighting has also roiled the Kachin mining belt and pushed many Chinese operators to cease work. China has repeatedly said that it seeks stability in Myanmar, where it has significant investments. Beijing has intervened to halt fighting in some areas near its border. "The Wa have had now 35 years with no real conflict with the Myanmar military," said USIP's Myanmar country director Jason Towers. "Chinese companies and the Chinese government would see the Wa areas as being more stable than other parts of northern Burma." The bet on Shan's rare earths deposit could provide more leverage to China amid a global scramble for the critical minerals, said Benchmark's Mukherjee. "If there's so much disruption happening in Kachin, they would be looking for alternative sources," she said. "They want to keep the control of heavy rare earths in their hands. Bunge nears China ruling for $8.2 billion Viterra merger, Bloomberg News reports
(Reuters) -U.S. grains merchant Bunge is close to getting a ruling from Chinese regulators on its $8.2 billion purchase of Glencore-backed Viterra with a verdict expected within days, Bloomberg News reported on Wednesday. The merger, first announced in 2023, would create a global crop trading and processing giant closer in scale to chief rivals Archer-Daniels-Midland and Cargill. Regulatory approval in China remains among the last remaining hurdles to the deal's closing. Bunge and Viterra said in two separate, similarly worded statements to Reuters that the companies were in the final stage of regulatory approval and thanked Chinese officials for "constructive dialogue throughout the review process." China's commerce ministry did not immediately respond to a Reuters request for comment. The deal has secured most global approvals required for the merger, including from the EU and Canada. The completion deadline, originally scheduled for mid-2024, has been extended multiple times, with the current date set for June 13.
