Dunmore councilwoman raises landfill concerns to Shapiro, criticizes DEP

A Dunmore councilwoman sent Gov. Josh Shapiro a letter Wednesday urging him to add stricter penalties to the Keystone Sanitary Landfill's remanded Phase III expansion while also raising concerns over the role of a state Department of Environmental Protection supervisor who concluded the expansion's benefits outweigh its harms.
Dunmore council President Janet Brier, who emphasized she wrote the letter as a Dunmore citizen and not as a representative of council, sent Shapiro the letter in response to the Pennsylvania Environmental Hearing Board's decision Tuesday to send the landfill's 42.4-year Phase III expansion permit approval back to the DEP to potentially address issues with odors and leachate generation. As the culmination of a nearly 4-year-old legal battle brought by grassroots landfill opposition group Friends of Lackawanna, environmental judges ruled Tuesday that the department erred in issuing the Louis and Dominick DeNaples-owned landfill's Phase III expansion permit in June 2021, which allows the landfill in Dunmore and Throop to triple its volume of waste through the 2060s by hauling in just over 94 million tons of additional garbage, or about 188 billion pounds.
'The Environmental Hearing Board's order confirms the DEP knew that KSL could not contain the leachate that it was already producing, yet they approved the permit for 94 million more tons of garbage to be dumped on our region,' Brier said in a phone interview Thursday. 'One can only conclude that DEP is either grossly negligent or that political influence prevailed over science.'
The DEP did not respond by press time Thursday to emailed requests for comment on Brier's letter. Brier did not include her council title in her letter.
In their 74-page decision, the five judges who make up the Environmental Hearing Board said the landfill has experienced challenges controlling offsite odors and excess leachate generation at its facility for several years, and the DEP knew about those issues prior to approving the expansion.
'The Department erred in issuing a permit that does not sufficiently control or mitigate these issues,' the judges wrote. 'The Department must assess on remand whether additional measures to control odors and leachate, some of which have been required by a recent Consent Order and Agreement, warrant inclusion in the landfill's permit or changes to the landfill's operating plans.'
Harms vs. benefits
Brier took issue with the Environmental Hearing Board's findings regarding a July 2019 environmental assessment by the DEP that weighed 15 known and potential harms, with accompanying mitigation measures, of approving the landfill's Phase III expansion against eight benefits.
The harms included visual impacts, odors, litter, noise, vectors/birds, traffic, runoff, air quality and groundwater impacts. The benefits were: environmental education, continuation of recycling and cleanup programs, goods and services, continued employment for 145 full-time workers, tax revenue, participation in Pennsylvania's Adopt a Highway Program and financial benefits for Dunmore and Throop from their host agreements.
A section titled 'Excess Leachate Generation' under groundwater impacts determined that 'it is apparent KSL continues to have an issue with either excessive leachate generation and/or infiltration into the leachate conveyance system.'
'KSL continues to have current flow amounts not only higher than what was predicted for the current landfill, but also higher than what was predicted as a maximum peak flow for the proposed Phase III expansion,' according to the analysis.
In its ruling, the Environmental Hearing Board wrote that Erika Bloxham, a facility specialist in the DEP's waste management program in the Northeast region who was tasked with completing the analysis, concluded that the benefits did not outweigh the harms, primarily because, in her opinion, Keystone had not mitigated the excess leachate production to the fullest extent possible.
Her supervisor said otherwise.
'However, Ms. Bloxham's supervisor, Roger Bellas, the waste program manager for the Northeast region, disagreed and authored the conclusion of the analysis for the Department,' the judges wrote.
The analysis concluded, 'DEP has determined that KSL has demonstrated that the benefits to the public from the project clearly outweigh the known and potential harms.'
In her analysis, Bloxham pointed to the landfill resorting to hauling excess leachate offsite and adding temporary leachate storage. She said the landfill's excess leachate flows increase the potential for it to have overflows and other incidents that could impact groundwater, though on Wednesday, landfill consultant Al Magnotta said Keystone has never been close to overflowing.
Despite Bloxham's concerns, the judges said, 'The Department concluded that Keystone's current and proposed efforts to isolate and mitigate excessive leachate generation were expected to limit the number, duration, and intensity of future excessive leachate flows.'
The landfill is required to keep its leachate below 25% of its maximum 9.7-million-gallon capacity, but from May 2021 through April 2024, it exceeded that at least 20 out of 36 months, according to the ruling. The DEP cited Keystone last year for exceeding the maximum limit every month from October 2023 through June.
The landfill's leachate generation is also more than double what it predicted, averaging 282,676 gallons per day, and nearly 8.2 million gallons per month — enough leachate to fill about 12 Olympic-sized pools each month.
Brier's letter
Brier criticized Bellas' role in her letter.
'Throughout its existence, KSL has never been able to mitigate the excess leachate production for any length of time, yet the order remands the permit back to the very people who overrode the waste management facility specialist's conclusion that the benefits do not outweigh the harms,' Brier wrote. '(Roger Bellas) still holds the position of Environmental Program Manager in the Waste Management Department in the Northeast Regional Office. I think it is fair to say that his mind is made up.'
Brier contended Northeast Pennsylvania has been 'subjected to malodors, insufficient leachate containment, methane flare offs, out-of-state truck traffic and indifference to all of this by the Department of Environmental Protection.' She said conditions have worsened at the landfill since its expansion approval, and the DEP's response was inadequate.
Brier also criticized the department's odor reporting process, describing an after-hours voicemail that tells callers to 'stay on the line if it is an emergency.' She asked the DEP to remove 'emergency' from the message to avoid callers hanging up because they don't consider an odor an emergency.
'The whole process places the burden of reporting on the very people who are suffering from pervasive odors in their homes, their schools, playgrounds, churches, athletic facilities and in their children's bedrooms,' she wrote.
She contended there are minimal consequences for noncompliance. Last year, in March 2024, the DEP levied its largest fine for the landfill at $575,000. The civil penalty was the culmination of 14 odor-related violations since January 2023, close to 1,000 odor complaints in seven months and at least 70 instances of DEP staff detecting offsite landfill gas and leachate odors attributed to Keystone.
'There needs to be substantial penalties for noncompliance,' Brier wrote. 'Otherwise, the result will be the same harmful decisions.'
Brier also called for a reduced duration of the expansion, bringing it from 40 years to 10 years, calling four decades absurd.
The expansion approval was an 'egregious transgression,' Brier said, adding that the responsibility rests on past administrations.
'My only hope is that the Shapiro administration will permanently reverse DEP's prior decisions and finally put the people's health and well being before politics,' Brier said. 'The Environmental Hearing Board's remand order presents a tremendous opportunity for Gov. Shapiro to reverse the mistakes of the past.'

President Trump's new travel ban has sparked widespread outrage and fear in New York's sprawling Haitian community, by far the biggest local diaspora group impacted by the edict aimed at 12 nations. Pastors, shopkeepers and community leaders worried out loud that their community would seek to stay out of sight to avoid any contact with authorities for fear of being arrested or possibly deported. 'We did nothing wrong,' said Rev. Wesley Joseph, 55, of the Jerusalem Church of Christ in Brooklyn, a U.S. citizen who immigrated from Haiti two decades ago. 'We work for America. We help America … You have doctors, you have lawyers. We contribute to the economy.' Waving at a sparse lunchtime crowd, Jolly Fleury, 62, said business has fallen off at his J & C Haitian Restaurant and Bakery on Clarendon Road since Trump launched his latest anti-immigrant crackdown. 'Customers [are] scared. ICE hasn't come over here yet. But some other restaurants I know, they come,' said Fleury, referring to Immigration and Customs Enforcement agents. 'A lot of people are worried. That's the reason I don't make enough money.' Stephanie D. Delia, an immigration lawyer and executive director of the Little Haiti BK advocacy group, said the impending ban is hurting Haitian-owned small businesses like the small groceries along bustling Flatbush Ave. selling stacks of ripe mangoes, ginger root and cassava. 'There's a lot of fear. There's a lot of confusion,' Delia said. Trump last week said citizens of Haiti and 11 other countries would be banned from even visiting the United States unless they already possess visas or permanent residency, a sharp blow to the Haitian community that numbers hundreds of thousands in the New York metro area, especially in central Brooklyn and southern Queens. Haitian leaders and Democratic lawmakers lashed out at Trump for the move, which they said was motivated by racism and hatred of immigrants. 'This is horrific for the people of my district, many of whom have family members who are in Haiti right now,' Rep. Yvette Clarke (D-Brooklyn) told the Daily News. 'They see their family living in the U.S. as a lifeline. It's just more of the cruelty, especially when it comes to the Haitian diaspora.' Clarke ticked off a laundry list of immediate problems New York Haitian families and businesses would face when the ban goes into effect as soon as Monday. 'It could be grandma coming for life-saving medical treatment or a niece or nephew coming for a wedding or going for a funeral,' she said. 'It's all the things that we as families do. It's unjust, and for what?' Vania Andre, editor and publisher of The Haitian Times newspaper, said her staff is documenting huge problems in the community stemming from the ban, which comes on top of Trump's broader crackdown on immigrants. She said an earlier Trump order revoking Temporary Protective Status for Haitians turned the Little Haiti neighborhood in Flatbush into a 'ghost town' as legal and undocumented immigrants alike lay low. 'People are not sending their kids to school, not going to places where immigrants gather or congregate,' Andre said. 'They're afraid it's going to be: Round up first and ask questions later.' Haiti avoided being included in a chaotic travel ban imposed during Trump's first term. It is not on the government's terror watch list, Clarke noted. The White House says Haiti was included in the new ban as punishment for high rates of overstaying legal visas and and large numbers of Haitian nationals who come to the U.S. illegally. Haitians on the island face chronic poverty, political instability and gang violence, with armed men controlling at least 85% of the capital of Port-au-Prince. The ban takes effect Monday at 12:01 a.m., a lag that may help avoid the worst of the chaos that unfolded at airports nationwide when a similar measure took effect with virtually no notice in 2017. Official estimates say close to 500,000 people of Haitian descent live in the New York metro area, and the 2010 census counted about 200,000 in New York City alone. Trump tied the new ban to Sunday's anti-Israel terror attack in Boulder, Colorado. He says the attack underscores the dangers posed by some visitors who overstay visas, even though the suspect in the attack is from Egypt, a country that is not on Trump's restricted list. Some, but not all, 12 countries were included in a similar ban in Trump's first term. The new ban includes Afghanistan, Myanmar, Chad, the Republic of Congo, Equatorial Guinea, Eritrea, Haiti, Iran, Libya, Somalia, Sudan and Yemen. Several other countries will face new heightened restrictions including Burundi, Cuba, Laos, Sierra Leone, Togo, Turkmenistan and Venezuela. Including Haiti in the travel ban is only the latest attack on the community by Trump. In his first term, Trump derided immigrants from 's—hole countries' including Haiti, the poorest nation in the Western Hemisphere. During the presidential campaign, he repeated false claims that Haitian immigrants in Springfield, Ohio were eating neighbors' pets. His administration has moved to end a federal program that gave permission to temporarily live and work in the United States to 532,000 people from Haiti, Cuba, Nicaragua and Venezuela. The Supreme Court last week approved the move, clearing the way for those immigrants to potentially be deported.

The global intifada is here. Hamas-aligned networks brought terror to US soil and we need to stop it

For decades, "Globalize the Intifada" chants have rung throughout Europe and the Middle East, a blatant and unmistakable call for violence and terrorism against Israelis and Jews. But over the past two years, those chants have only intensified and multiplied, now making their way west to our United States. What started with campus protests has now turned to vigilante violence. This week in Boulder, Colorado, a man yelling "free Palestine" threw Molotov cocktails at peaceful protestors hosting an event to bring home the Israeli hostages, setting them ablaze. Two young staff members of the Israeli Embassy were murdered outside the Jewish museum, after which the shooter said, "I did it for Palestine, I did it for Gaza." Pennsylvania Governor Josh Shapiro's home was set on fire with his family inside because of "what [Shapiro] wants to do to the Palestinian people," given that he's Jewish. These are not isolated incidents. They are all organized and linked to one group: Hamas. The same terrorist ideology behind these attacks was on display on college campuses over the past two years in the form of violent anti-Israel and anti-Semitic encampments. Let's be clear, these are not the protests of the 1960s. Contrary to what the media may have reported, these were not student-driven "protests" at all. New lawsuits, filed by my organization, expose how the violent takeover of Columbia University's Hamilton Hall and the weeks-long encampments at UCLA were part of an organized, choreographed effort by career professionals to carry out Hamas' plans of violence, terror, and the eradication of Jews and Israelis. At UCLA, a rabbi, a doctor, and a law student sued National Students for Justice in Palestine and other anti-Zionist groups over encampments that were manned with a sword and "human phalanxes." Designated teams of security personnel surrounded the area armed with wooden planks, makeshift shields, pepper spray and tasers. Members of the groups involved in the lawsuit coordinated via social media and Google Docs ways in which to plan, fund, execute, and reinforce the encampment. And just a few days after the first encampment was dispersed by police, more than 40 protestors were found with metal pipes, bolt cutters, chains and padlocks, and manuals for "occupying" campus buildings. At Columbia University, a highly coordinated mob used violent, masked tactics reminiscent of the Ku Klux Klan to storm the campus' Hamilton Hall. Armed with rope, zip ties, and crow bars, the masked invaders smashed their way through the doors and windows, and when they came across two people in their way – janitors, neither of whom were Jewish – they terrorized them, battered them, and mocked them. These two janitors sued the group behind the occupation, the People's Forum, for the assault, during which the assailants berated the janitors as "Jew lovers" for their employment. These aren't doe-eyed kids with signs calling for a more loving and peaceful world. These protestors are part of an expansive terrorist network taking advantage of those same doe-eyed students, using them to stoke violence and create chaos. This is an attempt to legitimize the terrorization of an entire group of people. This is the use of guerrilla warfare tactics against students and faculty in an environment that is supposed to be safe. What we are dealing with now is a highly organized, generously-funded, professionally managed campaign that has all the attributes of a military engagement – from detailed planning to careful mapping to precise logistical elements. This new realization requires a shift in strategy in how we fight back against these attacks. Up until now, most cases against universities were based on a single strategy: to hold taxpayer-funded colleges accountable for the hate that they allowed to become pervasive at their institutions. The goal of this strategy is two-fold. First, colleges should not be permitted to use taxpayer money to fund discrimination, especially when that discrimination prevents students from attending classes. Second, colleges should be incentivized to deal appropriately with the problems on their own campuses, so that neither the government nor lawyers have to handle them one-by-one. These previous cases that held universities accountable for their deliberate indifference to anti-Semitism have worked when they have forced these schools to admit to and confront the rampant anti-Semitism on their campuses. I developed this strategy during my time as the Assistant Secretary for Civil Rights at the United States Department of Education twenty years ago. It underlies the ongoing congressional investigations and enforcement activities by the Office for Civil Rights, and it's similar to the strategy used by the Trump Task Force on Anti-Semitism to root out anti-Semitic harassment in schools. But a lot can change in twenty years, and this is no longer enough. To address this current reality, it is necessary to adopt new strategies to deal with it. We must hold perpetrators accountable for their criminal actions on campus, including both criminal prosecution and civil litigation. But that alone won't be enough. We must also disrupt the perpetrators' support and resources that are helping them to carry out these calculated, coordinated campaigns. In other words, we were previously addressing the symptoms of anti-Semitism by holding universities accountable. Now, we're also getting to the root of the problem by addressing those who fund, support, plan, and enable the anti-Semitic activity. Like the Muslim Brotherhood, which the Colorado attacker supported; the Council on American-Islamic Relations (CAIR), who praised the October 7th attacks; and Students for Justice in Palestine, who continually promote violence on campus and incite "the student intifada." Our protests have changed, just as our reality has. We must be ready to change with it. Kenneth L.
