The Madhya Pradesh high court has ruled that forcing unnatural sex on one's wife, along with physical assault and cruelty, amounts to an offence under Section 498A of the IPC, The Times of India reported on Friday.
However, it clarified that the husband cannot be prosecuted under Sections 377 or 376, since 'marital rape' is not a punishable offence under current Indian law.
The court upheld the FIR filed by a woman against her husband.
The police had earlier charged the husband under Sections 377 (unnatural offences), 323 (voluntarily causing hurt), and 498A (cruelty by husband or relatives).
The husband challenged the FIR, arguing that unnatural sex with one's wife is not a crime under Indian law.
He also claimed that Section 498A should not apply, as the complaint did not include any dowry-related allegations.
Justice GS Ahluwalia of the Gwalior bench observed in his order that while unnatural sex with one's wife doesn't amount to an offence under IPC sections 376 or 377, it can still constitute cruelty if accompanied by violence and physical abuse.
"Committing unnatural sex with a wife against her wishes and on her resistance, assaulting and treating her with physical cruelty will certainly fall within the definition of cruelty. It is not out of place to mention here that demand of dowry is not sine qua non for cruelty." The TOI quoted the judge as saying.
The order further explained that, "From a plain reading of IPC section 498A, it is clear that any wilful conduct which is of such nature as is likely to drive the woman to commit suicide or cause grave injury or danger to life, limb, or health, whether mental or physical, to the woman, would amount to cruelty."
While the court quashed the charge under Section 377, it held that there was enough evidence to proceed under other provisions.
'However, since there are specific allegations that whenever the wife resisted the unnatural conduct of petitioner, she was assaulted and treated with physical cruelty, this court is of the opinion that offence under section 498A IPC is made out,' the court said.
'Accordingly, this application is partially allowed. Offence under section 377 is hereby quashed. However, FIR in relation to offence under Section 498A and 323 stands,' it added.
In a February ruling, the Chhattisgarh high court held that a husband cannot be prosecuted for rape or unnatural sex for engaging in sexual activity with his adult wife, regardless of her consent, Live Law reported.
Justice Narendra Kumar Vyas, presiding over a single-judge bench, stated that the wife's consent is irrelevant in such cases of sexual or unnatural intercourse within marriage.
The case involved an incident from December 11, 2017, in which a man allegedly forced his wife into unnatural sex against her will. Following the act, the woman was hospitalised and later died. In her dying declaration, she accused her husband of forceful sexual intercourse. Doctors later found that she died due to peritonitis and rectal perforation.
Despite this, the court noted that under Indian law, sexual acts with a wife who is not under 15 years of age do not qualify as rape. As a result, it ruled that unnatural sex in marriage cannot be treated as a criminal offence.
The husband, who had been sentenced to 10 years in prison by a trial court, was ultimately acquitted of all charges.

The brothers have been booked under relevant sections of the Bharatiya Nyaya Sanhita (BNS), including for threatening the sovereignty of India. They have been accused by the Delhi Police of providing Indian SIM cards to PIOs and sensitive military inputs. New Delhi: A 42-year-old man, identified as Haseen, was arrested Saturday from Rajasthan's Deeg, days after his younger brother Kasim was taken into custody by the Special Cell of the Delhi Police, for allegedly being part of an espionage racket run by Pakistan Intelligence Operatives (PIOs) in India. Haseen had started visiting Pakistan about 15 years ago and developed contacts with the Inter-Services Intelligence over the last four-five years, sources said. 'After Haseen's passport expired, he sent SIM cards through his younger brother. In August, 2024, he sent a SIM card to Pakistan through Kasim, one which was in his name, which was used by the PIO,' a source told ThePrint. 'Haseen has accepted in his interrogation that he sent pictures of Army establishments to PIOs, and received money in lieu of that. He also provided OTP to activate WhatsApp in Pakistan. His ISI handlers also helped him get Pakistan visas for his younger brother Kasim, his jeeja (brother-in-law) and sister, when they had gone to Pakistan in August 2024,' another source said. Both brothers had received training on how to gather military intelligence, and also built more contacts in India, sources added. They had also allegedly been trained to identify friend circles of officials in military intelligence and DRDO. They said that in September, an input was received about Indian mobile numbers being used by PIOs for espionage activities in India. Probe revealed that Kasim had visited Pakistan twice, first in August 2024, and for the second time in March 2025, when he stayed there for about 90 days, and also met ISI operatives. 'By using these SIMs on WhatsApp, PIOs were communicating with Indians for extracting sensitive information of installations related to Army and other government offices. Further investigation is underway to unearth this conspiracy,' the first source said. Noida: A liquor salesman in Greater Noida was allegedly slapped and pelted with a belt by an excise inspector for overcharging customers. The district excise officer has initiated a departmental inquiry. Manish Kumar (29) of Dadri, who works as a salesperson at a model shop in Jagat Farm, claimed he sustained severe injuries on his limbs and chest after he was brutally assaulted by excise inspector Chandra Shekhar. His family staged a protest outside the DM's office on Saturday after cops refused to register a complaint. The victim claimed Shekhar and a constable came to the model shop around 8.30 pm on Friday and accused him of overcharging customers. "When I told the officer that I did not overcharge, the inspector slapped me multiple times. He removed the CCTV camera's DVR and then put me into his vehicle and took me to the excise office in Greater Noida's Sector Delta 3. Once in the office, he assaulted me with a belt and left me there in a severely bruised state," Manish claimed. The salesman claimed he was left in the excise office for hours before his brother, Rohit, who also works at the model shop, got to know about the assault later that night and came to pick him up around midnight. The family subsequently tried to submit a formal complaint on the emergency helpline, Dial 112, and then at several police posts, but in vain. On Saturday, they gathered outside DM's office in Greater Noida. The district excise officer, Subodh Kumar, told TOI their team had received a complaint against the salesman for charging customers Rs 10 more than MRP for beer bottles on Friday. "Excise inspector Chandra Shekhar and a constable were sent to the shop for an inspection. In his initial statement, the inspector said that when he reached the shop, the salesperson was drunk and misbehaved with them. The two officials took the salesperson to their car to impose a challan, but the latter fled from the spot," the DEO said, adding that it was possible that Manish may have hurt himself later. "A departmental inquiry has been initiated. Appropriate action will be taken based on the findings of the inquiry," the DEO said.

TGCSB targets Indian recruiters working for Chinese Cyber Criminals with LOCs

Hyderabad: As part of a multi-pronged approach to curb cases of cyber slavery, the Telangana Cyber Security Bureau (TGCSB) has so far issued six Look Out Circulars (LOCs) against Indian agents wanted in connection with such cases. This year, 24 cases of cyber slavery have been registered in the state, with officials arresting 14 accused, including local agents. While nabbing these local agents poses a significant challenge, a greater difficulty lies in establishing the true identities of Indian touts operating from Myanmar, Laos, or Cambodia, and bringing them to justice. For instance, in the case of Kolanati Nagashiva, aged 36, a resident of Jeedimetla, he is wanted in three cyber slavery cases filed at the TGCSB police station in Nizamabad and the Armoor police station in March 2025. In collusion with local job consultants from Metpally and Jagtial, Nagashiva posed as 'James' and conducted fake job interviews for the victims, deceiving them into travelling to cyber crime hubs in Laos under the pretext of data entry jobs in Thailand. Acting on complaints from the victims, TGCSB sleuths established the real identity of James as Kolanati Nagashiva through the arrest of local touts and subsequently issued a LOC against him. Unaware of the LOC, Nagashiva arrived at Kolkata airport from Laos on 19 May, where immigration officials detained him based on the LOC and handed him over to the TGCSB. The accused is currently in judicial custody. In another case, a victim from Nalgonda was duped by his friend from Hyderabad and forced to work in a cyber crime centre in Myanmar. Tired of too many ads? go ad free now The TGCSB arrested a local offender who acted as a conduit between two other Indian nationals suspected to be operating from Myawaddy in Myanmar. "My friend worked in Myanmar for over a year and returned to India due to ill health. Despite being fully aware of the cyber crime operations and appalling conditions, he still referred me there and demanded $1,500 as commission from the Indians in Myanmar who had previously worked with him," the victim stated. TGCSB is also focusing on such Indian offenders operating from Myanmar, Laos, and Thailand who recruit for Chinese cyber criminals, and to date this year, has issued six LOCs against them. Of the 24 cyber slavery cases registered in Telangana this year, 10 are being investigated by TGCSB police stations, while the remaining 14 are being handled by police departments in other districts, including Hyderabad, Jagtial, Jayashankar Bhupalapally, Karimnagar, Nizamabad, and Nirmal. In these 24 cases, 14 individuals have been arrested, including Kolanati Nagashiva of Jeedimetla, Hithesh Arjana Soumya of Porbandar in Gujarat, and local agents Abhishek Gajula from Nagole and Basheer Ahmed from Bahadurpura.
