Greenpeace $660mn damages ruling shocks global NGOs

Civil society groups on Thursday condemned a US court order that Greenpeace pay over $660 million in damages to an oil pipeline company as a chilling attack on climate action around the globe.
Environmental defenders rallied behind Greenpeace after the shock ruling by a North Dakota jury fuelled concerns that courtrooms were increasingly being used to smother critics.
"It sends a dangerous message: that fossil fuel giants can weaponize the courts to bankrupt and silence those who challenge the destruction of our planet," said Anne Jellema, executive director of advocacy group 350.org.
The judgement "is not only an attack on Greenpeace -- it is an assault on the entire climate movement, clearly intended to chill the resistance to fossil fuels", she added in a written statement to AFP.
Energy Transfer (ET), the Texas-based pipeline operator awarded the damages, has denied any attempt to stifle free speech by suing Greenpeace.
The company had accused the environmental advocacy group of orchestrating violence and defamation during the construction of the contentious Dakota Access Pipeline project nearly a decade ago.
The jury awarded more than $660 million in damages across three Greenpeace entities, citing charges including trespass, nuisance, conspiracy, and deprivation of property access.
Brice Bohmer from Transparency International, a global corruption watchdog, said the lawsuit was "unconscionable" but evidence of a much wider problem.
"This kind of activity is becoming increasingly common across climate action, with fossil fuel actors undermining progress wherever possible," he said.

ET initially sought $300 million in damages through a federal lawsuit, which was dismissed.
It then shifted its legal strategy to North Dakota's state courts -- one of the minority of US states without protections against so-called "Strategic Lawsuits Against Public Participation" or SLAPPs.
Throughout the years-long legal fight, ET's billionaire CEO Kelcy Warren, a major donor to President Donald Trump, was open about his motivations, saying in interviews that he wanted to "send a message".
Matilda Flemming, director of Friends of the Earth Europe, said she was "appalled" by the verdict but warned it was not an isolated case.
"The right to protest is under threat across the world, from big corporations and self-interested politicians who threaten our democracies," she said.
Greenpeace has vowed to continue its advocacy and its international body is counter-suing ET in the Netherlands, accusing the company of nuisance lawsuits to stifle dissent.
Rebecca Brown, president and CEO of the Center for International Environmental Law (CIEL), said the fight for environmental justice would go on.
"No abusive company, lawsuit, or court decision will change that," she said in a statement on Wednesday after the verdict was handed down.

Tabitha Turner, the team reporter for the Atlanta Hawks and Atlanta Dream, was picked up from Hartsfield-Jackson Atlanta International Airport on Saturday by driver Nicole Smith. 'I just wanted to go home from work and see my daughter. I've got threats,' Turner told reporters Wednesday at a press conference. Smith turned around and pepper-sprayed her passenger in the face, according to video captured by Turner and obtained by the outlet. Investigators, using both Turner's and the witness's footage, determined Smith was the aggressor. An arrest warrant was issued for Smith. She faces charges of battery and simple battery. 'To pull over on the expressway suddenly, in the emergency lane with vehicles flying by, and to decide you're going to tell the passenger, 'You need to get out with your bags on the side of the expressway,' is not a reasonable request by any stretch of the imagination,' Dominquez said. A new report has urged the UK government to adopt a legally binding target for 30 percent of consumer packaging to be reusable by 2035, in a bid to curb waste and reduce the environmental impact of single-use packaging. The study, titled A 30% Reuse Future for the UK, was published by Reuse and Refill, a coalition of environmental groups, retailers, and packaging innovators, including Greenpeace, WRAP, Abel & Cole and the Ellen MacArthur Foundation. It outlines a roadmap for scaling reusable packaging systems across sectors including grocery, personal care, e-commerce and food service. The report estimates that a national 30 percent reuse target could cut annual carbon emissions by over 2.5 million tonnes—the equivalent of taking 1.6 million cars off the road. This shift would also eliminate over 1.5 million tonnes of plastic and cardboard packaging waste each year. Campaigners argue that reuse systems could generate cost savings for retailers over time, compared with continually sourcing new single-use materials. At present, only 1–2 percent of consumer packaging in the UK is reusable. The report suggests scaling this to 10 percent by 2030 and reaching 30 percent by 2035. They call for clear government policy to encourage industry-wide adoption of reuse systems and suggest integrating reuse targets into extended producer responsibility (EPR) schemes. Consumer interest in refillable and returnable packaging has been growing, particularly in the grocery and personal care sectors. Retailers such as M&S, Co-op and Tesco have trialled reuse schemes, while delivery platforms including Abel & Cole and Loop have explored circular packaging models. Despite early trials, uptake has been slow without regulatory backing. The report argues that stronger legislation could create a level playing field and accelerate business investment in reusable packaging systems, ultimately reducing reliance on single-use plastic and improving the UK's waste management outcomes.
