No better time to reform RTE Act implementation

A recent furore over delay in opening the admission portal for Right to Education Act for the academic year 2025-26 has not only informed people about the existence of such an Act but it has also opened up a discussion for the regulation of the Act and its implementation.
The Right to Education (RTE) Act, enacted in India on August 4, 2009, guarantees free and compulsory education for children aged 6 to 14.
While the portal would usually be opened by mid-April and the admission process would end by May, the unusual delay of over a month has put the parents waiting for admission under RTE, at a crossroads.
Despite facing dilutions, under RTE, a considerable number of students looking for education in private schools benefited, but the recent developments in the centre-State conflict in releasing fund meant for school education have directly affected the admission processes.
Though the School Education Minister Anbil Mahesh Poyyamozhi recently said that he had written a letter to the Centre seeking details about the pending dues under the RTE Act, the State announced that it would bear the Centre's dues too.
As the Madras High Court was hearing a case pertaining to the delay in admissions under RTE Act, based on a petition filed by V. Eswaran, an administrator of the Coimbatore-based organisation Marumalarchi Iyakkam, the court has directed the Union Government to submit details of funds due to Tamil Nadu under the 25% reservation quota mandated by the RTE Act.
Anand Raj, a social activist based in Madurai, said that a Right to Information Act reply from the State government regarding the fund released by the Union government for the RTE Act from 2009-10 till 2018-19 revealed that while ₹20,300 crore was to be released, only ₹8,446 crore was released.
He noted that the issue of Union holding back the funds meant for the Act was not a new one but had been in practice for several years.
Apart from the political motivations which affected the implementation of the Act, the actual admission practice, on several occasions, has come under criticism, owing to the prevailing gaps in implementation.
S. Umamaheshwari, an education activist, said that citing very minor differences, the private schools, awaiting reasons to reject applications under RTE Act, abruptly reject admissions.
'Though the State government reimburses the schools, private schools, wanting to escape other expenses for a student like books, uniforms, extra activities, find all ways to reject an application,' she alleged.
While the Act has framed certain rules like location of the student's house within one km radius of the school, the same technicality was being armed to reject students, she added.
With such technicalities in practice, rejections become much simpler for them, Ms. Umamaheshwari stated.
Not just the rejection, but the harsh attitude of school administration towards students admitted through RTE and the discriminatory practices towards them force the parents to remove their wards from the school, she said.
Subbaiah, a parent, whose son studied under RTE in a private school at Chrompet in Chennai from class 1 to 3, due to the demand for half payment of fees from the school, moved his son to a nearby government school.
He said, as they demanded him to pay half the actual fees citing additional spending on school events, they could not afford to pay the fees.
'In the mid academic year, I had to remove him from that school,' he added.
As he was uninterested in fighting with the school administration, he said he did not resist.
Mr. Anand Raj, listing down the troubles the parents have to face from the schools, said that the school administrations degrade the students studying under the Act by identifying them in a classroom by calling out their names.
While it would morally destabilise the students, exorbitant fees demanded for extra-curricular activities, workshops and study materials would eventually stress parents who mostly could not afford to pay them, he added.
A School Education Department Government Order 173 section 8(2) dated January 8, 2011, clarified that textbooks, library, uniform, information and communication, technology, sports equipment among others should be provided for free of cost and no difference should be shown towards permitting students to access them.
Citing the order, he alleged that most of the schools were not adhering to the G.O.
'Even many well-established schools frequently charge students for various reasons. After a certain time, the parents would have to stop questioning to safeguard the children's education,' he noted.
A School Education Department official- private school wing said that the rejection of RTE applications for technical reasons has been reduced with the direct involvement of officials during the admission process.
But he agreed that schools were charging the students under the RTE Act for various reasons.
'As the administrations say they were not paid by the government for the extracurricular activities and sports, we have to let them collect the fees unless it does not affect the students,' he stated.
However, the official said that they were instructing schools not to exclude RTE students from any school activities and they have also been warned of actions that would follow.

Several Union ministers and many VVIPs are likely to visit Puri during the Rath Yatra as Chief Minister Mohan Charan Majhi has invited many Union ministers and chief ministers of NDA-ruled states to visit Puri during the Rath Yatra. Last year President Droupadi Murmu had witnessed the Rath Yatra festival in Puri. The DGP also directed to ensure smooth traffic movement, barricade arrangements, and quick resolution of various problems in collaboration with the district administration. The meeting also discussed the issue of dealing with emergency situations, the official said. Installation of CCTV at various important places in the city, road dividers, traffic zones for traffic management, adequate parking arrangements at various places in the city, maintenance of an orderly traffic system and others were discussed in the meeting. Similarly, patrolling by police on the sea beach and opening of temporary police outposts there were also discussed in detail. The Odisha police expect a congregation of lakhs of devotees during the Rath Yatra festival which is celebrated for about a fortnight. While the Lord's bathing ceremony 'Snan Yatra' will be observed on June 11, the Rath Yatra and chariot pulling is scheduled on June 27. Devotees in large numbers also congregate in Puri on 'Naba Jouban darshan' day on June 26, a day before chariot pulling. The Hera Panchami festival will be held on July 1 followed by Sandhya Darshan on July 4 and Bahuda Yatra on July 5. The Suna Besha on July 6, Adharpana ritual on July 7 and finally Niladri Bije on July 8, will mark the end of the Rath Yatra festival.

Hoax bomb call triggers panic at Jammu railway station

A hoax call of a bomb triggered panic and put security forces on their toes at the busy Jammu railway station on Sunday evening, officials said. However, the unidentified call later turned out to be a false alarm. 'A hoax call was received from an unknown caller, who claimed that a bomb has been planted at Jammu railway station. A swift and thorough check of the station was carried out but no suspicious object was found,' a police officer said. However, the process to identify the caller was underway. Security has been stepped up across the Jammu region ahead of Prime Minister Narendra Modi's visit to inaugurate the Vande Bharat train from Katra to Kashmir on Friday. 'PM Modi is likely to visit the world's highest railway arc bridge over the Chenab and address a public gathering at Katra stadium,' said a state government official. A senior railway official said: 'We were prepared for the train's inauguration on April 19 but inclement weather followed by the Pahalgam attack on April 22 and Operation Sindoor on May 7 delayed the event.' Union home minister Amit Shah had visited Jammu and Poonch on May 29 and 30 to assess the security situation in the region and meet people affected by the recent Pakistani shelling. The Parliamentary standing committee on rural development flagged blatant violations of the Land Acquisition Act of 2013 in cases where land was acquired by undermining the authority of gram sabhas, people familiar with the May 28 proceedings in New Delhi said . Underhanded techniques, such as using forged signatures to manufacture consent, remained a key focus of the panel, which discussed land acquisitions for infrastructure development and industrial purposes, such as for mining bauxite and iron ore, without the mandatory clearances of gram sabhas. The committee discussed in depth at least nine cases from Odisha involving serious violations affecting the forest rights of Scheduled Tribes and Other Traditional Forest Dwellers (OTFDs) in the implementation of the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement (RFCTLARR) Act, Land Acquisition Act and the Forest Rights Act intersect in several cases involving land acquisition in forested areas. 'In the last two-three years, many arbitrary decisions were taken on giving leases for bauxite mining in Kalahandi, Koraput, Rayagada districts and iron ore mining in Sundargarh and Keonjhar districts in Odisha. In all cases, the Land Acquisition Act 2013 was violated, where the governments had forcefully and fraudulently acquired lands across Fifth Schedule areas in the Constitution without the knowledge and consent of gram sabhas,' said a person part of the meeting. The standing committee recorded oral evidence from representatives of the department of land resources under the ministry of rural development on May 28, as well as from experts and other stakeholders, on the implementation and effectiveness of the Land Acquisition Act. The Act mandates prior and informed consent of the affected families, a social impact assessment before any rehabilitation, and importantly, the protection of the rights of vulnerable groups: members of Scheduled Tribes (STs) and OTFDs. The committee discussed at least nine instances of such violations across five districts in the state, including in Rairangpur in Mayurbhanj district, where in March this year, 43 tribal families' houses were bulldozed for an airstrip expansion project. '43 tribal families are living their daily life without proper rehabilitation. The district administration had issued a notice giving one month's time to vacate homes, but within six days of serving the said notice, their houses were bulldozed. A notice was issued to conduct a gram sabha, but it wasn't held. The land in question is grazing land where the villagers have been staying for more than 35 years…PMAY houses were constructed [in that land]…the villagers could have been consulted, and rehabilitation and proper compensation could have been offered till they agreed to shift for the expansion of one Air strip,' said a person part of the meeting, wishing anonymity. The person added that various Members of Parliaments (MPs) also pointed out that gram sabhas' consent was not taken as a norm across the country. The committee also discussed the fake gram sabhas allegedly held on December 8, 2023, for the diversion of forest lands for non-forest purposes in Rayagada and Kalahandi districts for bauxite mining in 10 villages. Another person part of the meeting said: 'None of villages where gram sabhas were allegedly held had any prior information about the proposals for forest diversion for the bauxite mines. However, we were told that the resolutions were fake, and it was shocking that gram sabhas were allegedly held on the same date and time across all the 10 villages and that the sarpanch or other government officials who have signed in gram sabha documents were also present in ten different places on the same time and date.' Officials present at the meeting told HT that the Ministry of Tribal Affairs had also sent a letter on this issue in March this year to the state government for a thorough examination. People aware of the matter said that inadequate compensation and rehabilitation under the Land Acquisition Act were also discussed in the meeting. 'The need for an immediate action from the central government for the implementation of all the special provisions under RFCTLARR Act 2013 for the rights of STs and other forest-dependent communities were also discussed,' said another official.
