Plantation worker escapes the gallows
TAIPING: An oil palm plantation worker escaped the death penalty after the High Court here today sentenced him to seven years in prison on an amended charge of manslaughter of a detainee at Taiping Prison, six years ago.
Judge Noor Ruwena Md. Nurdin sentenced Mohd Nizam Shah Shahruddin, 40, to seven years in prison without a fine after the accused pleaded guilty to the amended charge from Section 302 of the Penal Code to Section 304b of the same code, which is manslaughter.
The prison sentence on the accused was set to start from the date of his arrest, which was on August 29, 2019, after he was suspected of causing the death of Chua Teng Wooi, 41, at the Taiping Prison Remand Cell, here, at 9.30 pm the same day.
Noor Ruwena said the sentence was handed down after examining the facts of the case and the arguments of the prosecution and defence as well as the statements of the accused and witnesses called in relation to the case.
He said the court found that Mohd Nizam had succeeded in raising a reasonable doubt that he did not intend to kill the victim but was angry with the victim's actions and only wanted to teach a lesson.
According to Noor Ruwena, from the testimony of the accused and several other witnesses, the victim was beaten up by a mob while in the remand cell because he often defecated everywhere due to diarrhoea.
He said the doubts raised included whether the actions of the accused and other detainees caused injuries to the victim's lungs, which was the cause of death.
This was because there was witness testimony that the injuries may have occurred when the victim fell in the prison toilet due to the dark conditions of the detention cell.
'The accused's statement was not challenged that he woke up other inmates to help the deceased who fell in the toilet and also lifted the deceased, the affidavit that there were (other) people who also beat the deceased was not challenged,' he said.
The prosecution was conducted by deputy public prosecutor Sally Chay Mei Ling, while counsel Rajit Singh Tara Singh represented the accused.

"The accused's statement that he had awakened other inmates to help the deceased after the fall, and had carried the deceased, was not disputed. The affidavit stating that other detainees had also assaulted the victim was similarly unchallenged," said Noor Ruwena. Deputy public prosecutor Sally Chay Mei Ling led the prosecution, while counsel Rajit Singh Tara Singh represented the accused.

Engineer duped of over RM1.5m in online investment scam
GEORGE TOWN: A 40-year-old engineer working in the Middle East has lodged a police report after allegedly losing more than RM1.5 million to an online investment scam. Seberang Prai Tengah district police chief Datuk Hamzah Ahmad said the man claimed he was cheated in a non-existent investment scheme, resulting in total losses of RM1,532,563. According to Hamzah, the victim's ordeal began in November last year, when he became acquainted with a woman over the phone and later developed a romantic relationship with her. "The suspect then persuaded the victim to join an investment platform called GoldenCrimson, which offered various packages — Junior Room, Intermediate Room, Superior Room, and Supreme Room — with returns depending on the package selected. "The victim was given a customer service number and a website link, to register," he said in a statement today. Hamzah said the victim initially invested RM90,510 and received returns amounting to RM108,611. "Believing the investment was profitable, the victim proceeded to make 103 transactions into 31 different accounts between Dec 2 last year and Mar 8 this year, totalling RM1,532,563. "He realised he had been scammed when he was unable to withdraw the supposed profits of RM4,131,671 via the application. The suspect even asked for additional capital contributions to facilitate the withdrawal," he added. The case is being investigated under Section 420 of the Penal Code for fraud. Hamzah urged the public to be cautious and not fall for investment offers not recognised by authorities such as Bank Negara Malaysia, the Securities Commission Malaysia, and the Companies Commission of Malaysia. He advised the public to verify the legitimacy of such schemes with relevant agencies or consult the nearest police station before committing to any investment, especially those offered online.

Md Khairul Rosli, 32, pleaded guilty before Judge Musli Ab Hamid to a charge under Section 392 of the Penal Code, which provides for imprisonment of up to 14 years, and a fine or whipping, upon conviction. He committed the offence by the roadside near Lorong Semariang Batu 12, Kampung Semariang Pinggir here at about 12.04am on May 29, 2025. According to the facts of the case, the victim and a friend had arranged to meet a man, later identified as Md Khairul, for the purpose of selling a used mobile phone. At the scene, the victim was coerced into surrendering not only the phone intended for sale but also his personal mobile phone. The victim believed that the accused had pressed a sharp object against his lower back to threaten him into handing over the items. A police report was subsequently lodged, leading to the arrest of the accused the next day. Investigations revealed that the accused had committed the robbery without the use of a weapon. Although the victim initially believed a sharp object was pressed against his back, it was later determined that the accused had used his finger to simulate the threat. An identification line-up was conducted and the victim positively identified the accused. The victim also identified the stolen phone, which was recovered and accessible using the correct password. He further recognised a blue jacket worn by the accused when executing the crime. Eyewitness testimony corroborated the victim's account and confirmed the accused's identity.
