‘Not fair and reasonable': Hospital worker acquitted of filming girl in shower wins two years' back pay from employer
A Queensland hospital has been ordered to reimburse an employee nearly two years of lost wages after he was suspended without pay while facing criminal charges that he was ultimately acquitted of.
Brian Arthur Campbell Mathers, a cook supervisor at Redcliffe Hospital, was initially charged by police with possessing and making child exploitation material back in February 2022. Police alleged that he had filmed a teenage girl in the shower of a home in Newport, north of Brisbane, allegations he denied.
The Office of the Health Ombudsman informed the Metro North Hospital and Health Service (MNHHS) of the charges – resulting in Mr Mathers being suspended with pay that same month.
An order from the Ombudsman was then issued a month later, forbidding him from providing any health service 'in either a paid or unpaid … clinical or non-clinical capacity'.
Because of this, Mr Mathers was then suspended without remuneration from March 21, 2022 until May 2024.
A jury in May 2024 ultimately found Mr Mathers not guilty on two charges of making child exploitation material and one count of possessing child exploitation material and he was acquitted.
After Mr Mathers wrote to the hospital informing them of the verdict, the Ombudsman's order was revoked and he returned to work in August 2024, requesting reimbursement for the period of his unpaid suspension.
But Queensland Health refused this, with correspondence from MNHHS chief executive Jackie Hanson determining the Ombudsman's order was 'justified'.
'These restrictions prevented you from engaging in any work capacity, including alternative duties, transfers or other work arrangements with any health service. As a result, you were not available to work for Metro North Health during the period of suspension without remuneration for reasons other than your suspension,' Professor Hanson wrote in her correspondence to Mr Mathers.
'The order remained unchanged during your suspension without remuneration, preventing you from working in any capacity.'
In submissions to the Queensland Industrial Relations Council, Mr Mathers argued that the order was part of his suspension and he remained 'at hand' and available to work.
He sought a full reimbursement of the pay for the duration of the two years he was on suspension.
In a bombshell move, QIRC commissioner Christopher Gazenbeek in May allowed the appeal and ordered the hospital to reimburse Mr Mathers of the amount he was deprived.
Part of the Ombudsman's order involved Mr Mathers being 'required to remain willing, ready and able to attend work if required', the published judgment states.
'Throughout his period of suspension, the appellant received several reminders of the requirement that he 'remain ready, willing and able to attend work if required',' Mr Gazenbeek said.
'In my view, the terms of that condition further support that the appellant was available for work throughout his suspension without remuneration, notwithstanding the effect of the interim prohibition order.'
Mr Gazenbeek said the decision to suspend Mr Mathers without remuneration
was 'not fair and reasonable'.
In a separate QIRC matter, Mr Mathers failed to overturn a reprimand by Queensland Health after he did not inform his employer of the charges and that he had appeared in court.
Commissioner John Dwyer said he had some degree of sympathy for Mr Mathers due to the 'unique dilemma' of wanting to protect his privacy in circumstances where he had not been convicted of the charges.
'He believed (apparently correctly) that he would not be convicted and, given the matters did not arise in the context of his employment, he elected to conceal them,' Mr Dwyer wrote.
'The stigma of merely being charged with criminal offences can have a lasting detrimental impact on professional and personal relationships.
'(But) I do not consider that he took all steps reasonably open to inform himself of his obligations. Even if I am wrong about that, I do not consider that the legal advice or the absence of policy specific training relieved him of his obligation to comply with the policy.
'While I accept that his noncompliance was not a deliberate act of deceit, and that his failure to comply with the policy was not entirely his fault, I am unable to be satisfied that these factors render the decision unfair and unreasonable.'

Amazon Australia removes machetes after landmark Victoria ban
Amazon has removed the sale of all machetes from its online Australian marketplace after a landmark ban in Victoria. The Victorian government announced a statewide ban on the sale of machetes following a violent brawl at a Northland shopping centre. After September 1, retailers will be able to apply for an exemption to sell machetes for legitimate use, and will be listed on a police register. A three-month amnesty will also come into affect from September 1, allowing anyone already possessing a machete to hand them in. The ban is the first of its kind in Australia, and comes after the brawl at Northland shopping centre, which sparked a lockdown. Four males have since been charged over the alleged rival gang fight. They remain before the courts.

Trade Minister Don Farrell says meeting with US Trade Rep Jamieson Greer was ‘friendly,' not ‘difficult'
Trade Minister Don Farrell has detailed the discussion he had with his US counterpart Jamieson Greer, revealing he had the 'greatest confidence' in Anthony Albanese during an expected meeting with Donald Trump next weekend. Senator Farrell spoke to the US Trade Representative while in Paris last week and characterised the talk as 'friendly'. Despite this, he maintained the tariffs were 'simply unjustified', highlighting Australia's trade surplus with the US. Figures indicate Australia buys about $70bn worth of goods from the US, compared to the $30bn of exports Australia sells to America. 'It wasn't a difficult discussion in terms of the relationship between us, and I am certainly of the view that we have the opportunity to continue to talk with Jamieson and Commerce Secretary Lutnick to put our case across,' he said. Senator Farrell also said he was still determined to get the trade barriers slashed. 'It's only by open discussion, honest discussion, with our allies in the United States that I think we can do that, but I certainly haven't given up on the prospect of getting these tariffs removed,' he said. 'And every opportunity I get, I'll continue to pursue that argument with the United States.' However, Senator Farrell said the decision will be ultimately made by Donald Trump, putting increased pressure on Mr Albanese's upcoming meeting with the US President. He said that while there were a 'range of ways' in which Australia communicates with the US, the 'most important … relationship between our prime minister and the president of the United States'. 'Look every meeting, I think, between an Australian Prime Minister and the US president will always be a critical meeting and I have the greatest confidence in our prime minister to push the Australian point of view on this.' Mr Albanese has also ruled out changes to the Pharmaceuticals Benefit Scheme, News Media Bargaining code and incoming ban on social media for under-16s, while highlighting Australia's critical minerals industry as a potential bargaining chip. 'If things can be sorted out in a way that protects our biosecurity – of course, we don't just say no, we don't want imports in here for the sake of it,' he told ABC radio on Friday. 'But our first priority is biosecurity and there'll be no compromise on that.' Mr Albanese said Australia would not have a 'subservient relationship to any nation'. 'We're a sovereign nation that stand on our own two feet,' he said. Senator Farrell also said he was 'confident' Australia can secure a new trade deal with the European Union, with EU President Ursula von der Leyen expected to visit Australia in July or August. 'We've got lots of things that we can sell to the to the Europeans. I believe now that there's an appetite to reach an agreement on both sides,' he said. 'The world has changed, those countries that believe in free and fair trade have to work together.'

Andrea and Darrel North are preparing to farewell the Ferntree Gully house they transformed from a rundown residence into a beloved family home. The couple purchased 3 Stockton Ave while living in a unit located directly behind the property, almost three decades ago. After extensively renovating and extending the house, they are now selling with plans to buy a smaller place and travel. Three bidders attended Saturday's auction for the abode, but it ended up passing in on a $1.45m bid. @realty principal Luciano Marcuzzi said that in addition to negotiating with a buyer who is waiting upon finance, he and his vendors would likely either list the home for private sale or set another auction date. 'The house would suit a family with two or three kids who like nature and want a commute to the city or to use the area's public transport,' he said. The Norths bought the home after their first son Justin was born. Ms North said that although the abode was 'pretty derelict', the 1069sq m block and potential they saw in the circa-1950s house won them over. 'We went, 'It suits all our needs, and it's exactly where we live and we love where we live',' she said. Not long after moving in, Ms North discovered she was pregnant with their future daughter, Megan. Nowadays, the husband and wife live at the home with their third child, Cody, 22. Much of their renovation work was completed by Ms North's sister Narelle and builder brother-in-law Chris, who run Frerker Homes in Lysterfield. Once, while painting the house, five-year-old Justin decided he want to help. 'I gave him a bucket of water mixed with glitter and a paintbrush,' Mr North said. 'He painted the dog kennel and the front gate for me, in his little blue Thomas the Tank Engine jumper and his gumboots and he was having a ball.' Today, the five-bedroom house features three living areas, two bathrooms and a UK-manufactured Falcon double oven in the kitchen, a room that was renovated two years ago. An outdoor pool, barbecue and undercover deck with motorised blinds proved the ideal spot to host 120 guests for Megan's 21st birthday. 'I spend lots of time cooking, and you can sit out there in the courtyard with a beer and look at the kids in the pool, and it's just a great space,' Mr North said.
