MMDA files complaints vs over 50 motorists over covered license plates

The Metropolitan Manila Development Authority (MMDA) has filed complaints against over 50 motorists for covering their license plates to avoid getting caught under the No Contact Apprehension Policy (NCAP).
In Joseph Morong's Monday report on '24 Oras,' the licensed plates of motorists were seen covered with various objects including a face mask, paper plate, leaves, and underwear.
A motorist was also caught using the EDSA busway without a license plate, but upon inspection, authorities found that he had hidden it in the compartment of his motorcycle.
'Hindi lang po mga motorcycles, but now to the extent even four-wheel vehicles. Deliberately tinatakpan po ang mga plaka just to escape the mere apprehension of the NCAP,' said Gabriel Go, head of MMDA special operations group.
(We also filed a complaint not just against motorcycle riders but also four-wheeled vehicles. They deliberately cover their license plates just to escape the mere apprehension of the NCAP.)
Meanwhile, the Land Transportation Office (LTO) will send a show cause order to the violators to hear their explanations.
The MMDA and LTO warned motorists that they may face criminal charges for covering their license plates.
They may face a fine of P5,000 for violating the Motorcycle Crime Prevention Act.
'May pagkakulong po ito na six months and one day to two years. Sumunod na lang po tayo sa batas para po hindi lumaki ang problema ninyo,' LTO executive director Greg Pua said.
(They may be imprisoned for six months and one day to two years. Just follow the traffic rules to minimize your problems.)
He added that motorists cannot use the excuse that they have yet to receive their license plate since there is no backlog.
'Kung wala pa silang nakuha na plaka, dapat nakalagay sa likod nila yung MB file number. Without the plate po, we can also apprehend para malaman bakit wala ka pang plaka,' Pua said.
(If they don't have the license plate yet, the MB file number should be placed on the back of the motorcycle. We can apprehend them to know why they don't have their license plate yet.)
Motorists may also check the plate number tracker if their plates are already available. The license plates can be delivered to their homes.
Since the implementation of NCAP last May 26, about 700 motorists a day have been caught violating traffic rules.
However, none have been given a notice yet since MMDA personnel are still validating the cases.
Meanwhile, the Stop NCAP Coalition held a protest to call for its suspension until roads and signage are fixed.
They will file a temporary restraining order against NCAP before the Supreme Court.
In a petition filed before the Supreme Court, the petitioner is seeking clarification on where the NCAP should be implemented. — Mariel Celine Serquiña/BAP, GMA Integrated News

DICT Secretary Henry Aguda said the Cybercrime Investigation and Coordinating Center (CICC), which is under DICT, has yet to establish any guidelines in place to identify red-tagging posts and threats. 'The CICC has a threat monitoring center, but right now, we don't have a strict monitoring on that one [red-tagging],' Aguda said during the House TriCom probe into the proliferation of false information online. 'If we're given guidelines and monitoring, we will include it in the threat monitoring center. And if it's mandated by Congress to act on it, we will act on it immediately po,' he added. Gabriela Party-List Representative Arlene Brosas then said that red-tagging is also a form of peddling false and harmful information, as a Supreme Court decision already defines red-tagging as a threat to life and liberty in 'the act of labeling individuals or organizations as subversives or terrorists, regardless of their actual political beliefs and affiliations.' Likewise, Brosas said the same Supreme Court ruling also states that red-tagging 'is a type of harassment that has pernicious effects on its targets.' 'Supreme Court Associate Justice Rodil Zalameda defines red tagging, vilification, labeling, and guilt by associatio as acts that threaten a person's constitutional right to life, liberty, and security, which may justify the issuance of a rate of amparo [protection]. It means, it is really a form of disinformation and human rights violations that we need to address and taken seriously,' she said. Aguda then said that CICC's priority is monitoring illegal gambling, financial scams, where there are clear guidelines on which posts need to be taken down. 'We don't have any guidelines yet on red tagging, so it's hard for us to monitor all the news except for ones wherein the posts gets flagged [by others] or because there is a certain violation, then we coordinate with the [social media] platform immediately,' Aguda said. — BM, GMA Integrated News

A lawyer on Wednesday asked the Supreme Court (SC) to annul a circular of the Department of Justice (DOJ) that raised the standards of evidence. In an 8-page petition for certiorari, Hazel Meking challenged the DOJ circular dated July 2024 before the court, saying she was filing the petition on behalf of victims whose complaints have been dismissed and other lawyers. Under DC 15, dated July 2024, the standard of proof was raised from probable cause to prima facie evidence with reasonable certainty of conviction. 'Paano maging certain ang conviction, diba? Wala pang ebidensya, wala pang witness, wala pang trial. So napakahilaw pa ng kaso para i-dismiss,' Meking said in an ambush interview. (How can the conviction be certain, right? There's no evidence yet, no witnesses, no trial. So the complaint is still too premature to be dismissed.) Meking said that each prosecutor's office had a different way of implementing the circular. ''Yung iba, ang ginagawa nila, pagkakita pa lang nila, ah, walang certainty of conviction. 'Yung iba, nire-refer sa investigating prosecutor. 'Yung iba, nire-refer naman nila sa committee. Tapos doon nila tinitingnan, sila-sila lang, walang hearing. Tapos kino-close na 'yung kaso,' she said. (What others do is, upon seeing the case, they already conclude there's no certainty of conviction. Some refer it to the investigating prosecutor. Others refer it to the committee. Then they assess it among themselves, without any hearing. Then they just dismiss the complaint.) 'Yung iba, binabalik na agad sa mga impact nito sa mga biktima ng krimen dahil hindi ka makapush. Hindi makakaakyat sa korte,' she added. (Some complaints are returned to the victims. This has a huge impact on crime victims because they can't push forward. The complaint can't reach the court.) She expressed concern that some prosecutors may be using the circular as an excuse to not do their jobs. 'Kasi yung—pwede nating sabihin eh, walang certainty of conviction. 'Yun pala, nag-aayaw lang sila, dahil ayaw na lang ang trabaho nila,' she said. (Because—what we could say is, there's no certainty of conviction. 3 auto shops raided in Davao for illegal importation, rebuilding of right-hand vehicles

Authorities raided three auto surplus shops in Davao City for allegedly illegally importing and rebuilding right-hand-drive vehicles. In a statement on Wednesday, the Land Transportation Office (LTO) said initial investigation revealed the surplus shops are not accredited to import, rebuild, or deal in right-hand drive motor vehicles. LTO said it found employees engaged in rebuilding right-hand drive motor vehicles in the backyard of their premises. 'This is part of our sustained operations since the raid we conducted in Quezon City last month against these kinds of illegal activities. We are conducting an investigation and charges will be filed,' LTO chief Vigor Mendoza II said. 'The importation of right-hand drive motor vehicles is also illegal itself,' he added, citing Republic Act 8506, which has a penalty of imprisonment and a fine of P50,000. The law states that, 'It shall be unlawful for any person to import, cause the importation of, register, cause the registration of, use, or operate any vehicle with its steering wheel right-hand side thereof in any highway, street or road, whether private or public or of the national or local government.'
