Kerala HC orders continuance of existing language policy in Lakshadweep till a study is conducted

A Division Bench of the Kerala High Court has ordered that the earlier language policy of studying Mahl and Arabic shall continue in schools in Lakshadweep as the court felt that the order on the three language formula has been issued by the Lakshadweep administration without conducting any study or consulting the stakeholders.
The Bench comprising Chief Justice Nitin Jamdar and Justice Basant Balaji passed the order recently when a writ petition challenging the decision to exclude Arabic/Mahl as an optional language from the Three-Language Formula (TLF) implemented in schools on the islands. The petitioner contended that the decision was hastily taken by the Director of Education without consulting the stakeholders and conducting any proper study on its implications on the education system on the islands. The education system prevalent in the Union Territory for the past 70 years had the option of Arabic/Mahl as a third language.
The court observed that the order is a mere office order, which is ordinarily issued for routine matters and not for purposes that would have a fundamental impact on local conditions. 'We are not guided by the impugned order as to how the decision was arrived at or what its implications would be, particularly since there is a change from the existing position prevailing for the last 70 years.'
Observing that its earlier interim order deferring the implementation of the order on the three language policy will remain in force, the court said that it was open to the Union Territory to conduct a study on the local conditions in the context of the prevailing education policies and engage with all the stakeholders through a meaningful process of consultation. If such studies and consultations are carried out, it will be open to the administration to apply for appropriate orders, the court added.

The court was hearing an appeal by Angels Nair, general secretary of NGO Animal Legal Force Integration, Ernakulam. Nair's appeal raised concerns regarding the 2018 shoot of the Malayalam film Unda, including soil dumping in a reserved forest in Kasaragod. Responding to the petition, the forest and wildlife department's under secretary filed a counter-affidavit enclosing a GO that revises entry fees and security deposits for filming in protected areas. The order sets separate fee schedules for commercial, documentary and educational films. After examining the documents, the court questioned whether commercial shoots should be allowed at all in such areas. At the special govt pleader's request, the matter was adjourned to Jun 23 for instructions, and Manu Vyasan Peter was appointed amicus curiae.

The Kerala High Court on Wednesday slammed the Vigilance and Anti-Corruption Bureau (VACB) for repeatedly seeking adjournments on an anticipatory bail petition filed by Shekhar Kumar, Assistant Director of the Enforcement Directorate, in a case relating to the alleged demand of ₹2 crore as bribe from a Kollam-based cashew businessman to save him from an ED case. When the anticipatory bail petition came up for hearing, Justice A. Badharudeen orally observed that the petition seemed to have been filed on May 26, almost three weeks ago. Now the prosecution wanted to file an objection. 'How can an anticipatory bail plea be kept pending for several weeks, that too due to the lapses of the prosecution.' The court asked the VACB to file a statement, if any, on or before June 17 in response to the bail petition.

The Kerala High Court on Tuesday sought Congress MP Priyanka Gandhi Vadra's response to an election petition filed by Bharatiya Janata Party leader Navya Haridas, reported PTI. Haridas, who had contested against Vadra in the 2024 bye-elections to the Wayanad Lok Sabha constituency, has challenged the validity of the Congress leader's victory. She has accused the Wayanad MP of hiding details about several investments and movable properties of her husband, Robert Vadra. In her petition, Haridas said the omissions amount to 'suppression of material facts' and violate mandatory disclosure norms under the Representation of the People Act, 1951. She also claimed that the alleged non-disclosures misled voters and can be deemed corrupt practices, Business Standard reported. Justice K Babu admitted the petition after hearing arguments from Haridas' counsel and scheduled the matter for further hearing in August, Bar and Bench reported. Priyanka Gandhi Vadra had won the Wayanad Lok Sabha seat by a margin of more than four lakh votes over Communist Party of India candidate Sathyan Mokeri. Haridas finished third with just over one lakh votes.
