Indian court finds police volunteer guilty of rape and murder of trainee doctor

The Guardian18-01-2025

A police volunteer has been found guilty of the rape and murder of a trainee doctor who was on duty in Kolkata, a crime that sparked protests across India amid concern for women's safety.
The killing of the 31-year-old physician in August drew nationwide attention to the issue of violence against women and girls in India. Such was the outcry surrounding the case, the trial was fast-tracked through the country's legal system.
Judge Anirban Das said the sentence for Sanjay Roy, 33, will be announced on Monday. His punishment could range from life imprisonment to the death penalty.
Police discovered the body of the woman at Kolkata's RG Kar medical college and hospital's seminar hall on 9 August. An autopsy found she had been strangled and that a sexual assault had taken place.
Roy was arrested a day after the crime. He has consistently maintained his innocence and told the court that he was not guilty.
The case was initially investigated by the Kolkata police but later the court handed it to federal investigators after state government officers were accused of mishandling the investigation.
After the attack, doctors and medical students across India held protests and rallies demanding justice and better security. Thousands of women also protested on the streets, demanding justice for the victim as they participated in Reclaim the Night marches. Some protesters called for the perpetrator of the crime to be given the death penalty.
The attack prompted India's supreme court to set up a national taskforce to suggest ways to enhance safety measures in government hospitals.
Many cases of crimes against women go unreported in India due to the stigma surrounding sexual violence, as well as a lack of faith in the police. Women's rights activists say the problem is particularly acute in rural areas, where people sometimes shame the victims of sexual assault and families worry about their social standing.
The number of recorded rape cases in India has increased in recent years. In 2022, police recorded 31,516 reports of rape – a 20% jump from 2021, according to the National Crime Records Bureau.
In 2012, the gang-rape and killing of a 23-year-old student on a New Delhi bus galvanised huge protests across India. It inspired lawmakers to order harsher penalties for such crimes, as well as the creation of fast-track courts dedicated to rape cases. The government also introduced the death penalty for repeat offenders.
The rape law amended in 2013 also criminalised stalking and voyeurism and lowered the age at which a person can be tried as an adult from 18 to 16.

Man arrested after German woman alleges rape by driver in India

Police in south India 's Hyderabad city have arrested a man for allegedly raping a German tourist after offering her a drive. The woman and her local friend were on their way to a nearby vegetable market late on Monday evening when they were approached by the suspect, 25, in a vehicle, police said. The man, reportedly riding with five minor friends, offered to take the tourist and her friend for a drive. He took them to different locations and eventually to Mamidipally on the city's outskirts. There he told the others to take selfies while he drove the German to a secluded spot about 100 metres away, where he threatened her life and sexually assaulted her, police said, adding she had been sent for a medical examination. Police said the suspect then drove back to where he had dropped the others off and, as he slowed down, the woman jumped out and ran to her friend. The friend, after learning what had happened, filed a complaint at the Pahadishareef police station. Police said they had launched an investigation and seized the vehicle. India has reported several incidents of sexual assault involving foreign visitors in recent years, sparking concerns about the safety of tourists, especially women. Last month three men attacked a female Israeli tourist and her two local companions, a man and a woman, close to a popular Unesco World Heritage site in southern India's Hampi. Police say they killed the man and gang-raped the Israeli woman and her friend. In another widely reported incident from March last year, Indian police arrested seven local men for assaulting a travelling Spanish couple and gang-raping the woman in the eastern state of Jharkhand. According to the latest data from the National Crime Records Bureau, India recorded 31,516 rape cases in 2022, a 20 per cent increase over the previous year.

British woman allegedly raped by man in Delhi hotel room

A man has been arrested on suspicion of raping a British woman at a hotel in Delhi, Indian police have said. Officers have also arrested a second man who is accused of trying to silence the woman when she resisted the alleged rape and molesting her. The woman, from London, is said to have met up with the alleged rapist, named in India as Kailash, after making friends with him online a few months ago. The alleged victim was on holiday in the western state of Goa when the 24-year-old suspect, from Vasundhara in east Delhi, is said to have told her he was unable to travel and invited her to meet him. The woman is then reported have travelled around 1,200 miles to Delhi and checked into a hotel in the village of Mahipalpur on Tuesday night before arranging to meet with Kailash. The rape suspect is said to have arrived with his friend Wasim before the three of them had dinner. They are then reported to have headed to her hotel room. Kailash is then accused of raping her while Wasim is alleged to have tried to silence her when she resisted. Wasim is also accused of molesting the woman. The alleged victim has told police Kailash struggled to speak and English and used Google Translate to communicate with her. Both of the men have since been taken from a police station in Vasant Kunj, New Delhi, to appear before a magistrate. Police in Delhi have said: "A man was arrested on charges of rape with a British woman in a Mahipalpur hotel in Delhi. His accomplice was arrested on charges of molestation." A UK Foreign Office spokesperson said: "We are supporting a British woman in India and are in touch with the local authorities." It comes after an Israeli and Indian woman were allegedly raped in the town of Koppal in the southwest Indian state of Karnataka. The women and three male friends, an American and two Indians, were stargazing when three men on a motorbike approached them and asked for money, according to police. An altercation took place before the men who were on the bike are said to have pushed the male tourists into a canal. The three attackers are then accused of raping the two women. Meanwhile, one of the Indian men in the canal drowned while the other two managed to swim to safety. Police have arrested two suspects in connection with the alleged gang rape. India's problem with sexual violence According to the National Crime Records Bureau in India, police recorded 31,516 rape cases in India in 2022, a 20% increase from 2021. The real numbers could be far higher due to the stigma surrounding sexual violence and victims' lack of faith in police. Rape and sexual violence have been under the spotlight in India since the 2012 gang-rape and brutal murder of a 23-year-old student in Delhi. The crime shocked the nation and mass protests took place across the country against the dangers women face. The protests forced the government to enact new laws, change old ones and make the punishment for rape more severe. Special courts have been established to try such cases in a timely period. Meanwhile, the age at which people could be tried for rape as an adult was lowered from 18 to 16. In 2018, the Indian government approved the death penalty for people convicted of raping children under age 12.
