McGovern charged with murder after extradition from UAE

A senior figure in the Kinahan Organised Crime Group, who was extradited to Ireland from the United Arab Emirates, has been charged with murder at a special sitting of the Special Criminal Court.
Sean McGovern, aged 39, and originally from Drimnagh in Dublin, was arrested shortly after 6.30pm yesterday evening after an extradition flight landed at Casement Aerodrome.
The Irish Air Corps Airbus C295 plane was met by detectives investigating the murder of Noel Kirwan, who was shot dead three days before Christmas in 2016 outside his home in west Dublin.
Armed gardaí supported the transport of Mr McGovern and dozens of detectives and uniformed officers attended court 11 for a late sitting of the Special Criminal Court. He was then brought from the cell area into the dock.
The arresting garda, Detective Sergeant Donal O'Daly, said Mr McGovern was arrested at 6.38pm at Casement Aerodrome, where the charges were explained to him.
He was then charged before the three-judge court with five separate charges, including the murder of Christopher Noel Kirwan on 22 December 2016.
He is also charged with directing the activities of a criminal organisation in connection with the surveillance of James Gately in preparation for the commission of an indictable offence between 17 October 2015 and 6 April 2017.
He was further charged that between 20 October and 22 December 2016 he had directed activity that led to the murder of Mr Kirwan, as well as with a charge relating to the participation in a criminal organisation contrary to section 72 of the Criminal Justice Act.
Ciara Vibien, a solicitor for the Director of Public Prosecutions, applied to have Mr McGovern tried before the three-judge, non-jury court on five charges, including one charge of murder.
Ms Justice Karen O'Connor, sitting with Her Honour Judge Elma Sheahan and Judge Grainne Malone, agreed to the application.
Before the State's application, Olan Callanan BL, for Mr McGovern, said he has spoken to his client and has seen the charges. Counsel said the defence is reserving its position on the lawfulness of the arrest and the jurisdiction of the court.
Mr McGovern was remanded in custody to appear again before the Special Criminal Court next Thursday - which is anticipated to be a brief hearing via videolink.

McGovern – who survived being shot during the Regency Hotel attack in 2016 in which David Byrne was killed – fled to Dubai in 2017 with innocent partner Anita Freeman, just months after the murder of Noel 'Duck Egg' Kirwan. The couple's extensively renovated home on Kildare Road in Crumlin was later seized by the Criminal Assets Bureau (CAB) and sold on to Dublin City Council. Anita Freeman is the partner of Sean McGovern However, sources informed the Sunday World yesterday that Freeman – who has been in a relationship with McGovern since the two were teenagers – remains in Dubai. Should she remain there, a source said McGovern will be able to arrange video calls to her on a once-a-week basis from the A5 landing in Portlaoise Prison. 'On the basis that she has no previous criminal convictions and is not suspected of involvement in her husband's alleged crimes, she would be accorded the status of a family member and would have the same entitlement to video visits as any other prisoner's partner,' the source said. Freeman, who has two children with McGovern and who has maintained a far lower profile than the likes of Daniel Kinahan's partner, Caoimhe Robinson, has frequently returned to Ireland for visits since joining her exiled partner in 2017. Ahead of his trial on murder and gangland charges, McGovern is being kept on 23-hour lockdown in the State's only maximum-security prison. He is being housed in a single cell on A5, where his neighbours include double murderer Youssef Palani and treble killer Andy Cash, who murdered his innocent siblings Lisa (18), Christy and Chelsea (both aged eight). 'There are eight cells on the landing, and it normally houses very disturbed individuals,' the source said. 'But it is also the optimal location for someone with McGovern's risk profile. McGovern's former house, which was seized by CAB 'He is kept in his cell 23 hours a day and gets one hour exercise in the yard. 'It's referred to as a yard but it is more like a cage really, as it has advanced netting overhead, meaning nothing at all can be dropped in from above.' McGovern's extradition this week is being seen as a major coup for the Gardaí. On Wednesday, after flying out to Dubai on board an Irish Air Corps CASA aircraft, the Gardaí finally got their man. He was transported back to Ireland on Thursday and formally arrested by police investigating the activities of the Kinahan crime gang when the aircraft landed at Casement Aerodrome in Baldonnel. From there he was taken in a Garda convoy to the Courts of Criminal Justice in Dublin, where he appeared before the Special Criminal Court. Dressed in a grey T-shirt, grey tracksuit bottoms, white socks and black sliders, he spoke only once to confirm his name. The court heard that McGovern also faces two additional charges relating to a plot to murder James 'Mago' Gately, an associate of the Hutch gang, more than eight years ago. No application for bail was made as this can only be sought before the High Court on charges of murder or organised crime offences. A number of Garda units were dispatched to the scene and the vehicle was subsequently located in the Clonard area of Parteen where it had crashed into a ditch A teenager has been arrested after a woman in her 70s was injured when a car was stolen in Firhill, Parteen in Co. Clare yesterday evening. The woman was taken to University Hospital Limerick for treatment of 'non-life threatening injuries' following the incident that at happened at approximately 6.15pm. A number of Garda units were dispatched to the scene and the vehicle was subsequently located in the Clonard area of Parteen where it had crashed into a ditch. The woman was brought to University Hospital Limerick News in 90 Seconds - May 31st A male juvenile teen was subsequently arrested and taken to a Garda station in Limerick where he was detained under Section 4 of the Criminal Justice Act. He has been referred to the Youth Diversion Programme and a file will be prepared for the DPP. Gardaí are now appealing for witnesses to come forward. Any road users who may have camera footage (including dash-cam) and were travelling on the R464 near Parteen Village and the Clonard area of Parteen are asked to make this footage available to investigating gardaí.
