Lack of progress moving younger people from nursing homes slammed as 'completely unacceptable'

THE OMBUDSMAN GER Deering has criticised the lack of progress made by the HSE to move younger people out of nursing homes, and called for additional government funding to tackle the issue.
According to the Ombudsman Annual Report for 2024 – which examined complaints and reports from the Ombudman last year – the HSE has insufficient funding to continue to assist hundreds of young people to move out of nursing homes and into more appropriate accommodation.
The Ombudsman in Ireland is a public official who investigates complaints from individuals who believe they have been treated unfairly by certain public service providers.

more than 1,200 people under the age of 65 in Ireland are living in nursing homes designed for much older people, leaving them frustrated and calling for alternatives

A 2021 Ombudsman investigation found that these people face a number of issues, including isolation from family and friends, a lack of any meaningful social engagement and residing with elderly patients – many of whom suffered from dementia.
Since 2021, 102 people have been supported to move to homes of their choosing in the community where this is their wish, as part of a HSE-led 'Under 65 programme'.
The Enhanced Quality of Life Supports (EQLS) scheme established in 2021 also improved the lives of those who could not transition out of nursing homes.
While the Ombudsman would like to see an increase, the HSE has since said that there is not enough funding to continue to aid many young people in moving out of nursing homes.
Deering said in an Ombudsman report that he had received an update from the HSE in November 2024, which made clear that the Under 65 programme 'will falter' this year without additional funding.
'This means that many of those identified for moves to more suitable accommodation will not now be able to do so. This is a major setback and disappointment for the people concerned and their families,' Deering said.
'It is completely unacceptable that this excellent programme, which brought hope and independence to people with disabilities cannot be delivered because of a lack of funding,' the Ombudsman said.
He added that progress on transitioning people out of the nursing home system ha, to date, been 'unquestionably slow'.
In a report, the Ombudsman called on the government to provide 'sustainable and annual funding' to support younger people in nursing homes through the EQLS scheme, and, where appropriate, funding to move to more suitable accommodation.
Recalled payment to deceased carer's account
Later in the report, the Ombudsman detailed a number of cases which were flagged with his office and upheld last year.
One such case saw the Department of Social Protection recall a payment of over €2,700 it incorrectly believed it had paid to the bank account of a carer who had passed away.
Anne* contacted the Ombudsman after the Department recalled a payment it believed had been deposited into her late son Martin's account. Martin had been Anne's carer before his death.
Anne and her family repeatedly contacted the Department over a 12-month period to explain the situation and request a refund, but the Department refused to act.

It later emerged that although Anne had notified the Department of Martin's death, payments for Carer's Allowance and the Carer's Support Grant had continued to be issued to his account.
Since the account had been closed, the bank automatically returned the funds to the Department.
However, the Department failed to update its records to reflect the returned payments and mistakenly believed Martin had received the funds.
As a result, it recalled the payment, which led to the money being withdrawn from Martin's closed account in error.
The Department has since apologised to Anne and refunded the incorrectly retrieved payment.
It also agreed to pay €1,850 to Anne's family in the form of a Carer's Support Grant, acknowledging that Martin would have qualified for it prior to his death.
Dentures and shoes stolen from hospital patient
In another case, Andrew* contacted the Ombudsman after his mother's personal belongings, including her dentures and shoes, went missing during her stay at St Vincent's University Hospital in Dublin.
Hospital staff initially claimed there was no record of the items being with the patient at the time of admission.
However, the Ombudsman uncovered documentation indicating otherwise.
An early report from a speech and language therapist noted that Andrew's mother had no difficulty eating. A later report, however, recorded that she was struggling to eat and missing some teeth.
Additionally, a therapist's note mentioned she had trouble 'putting on her shoes,' further suggesting the items were with her during her hospital stay.
The hospital has since apologised to Andrew and his mother and reimbursed them for the missing items.
Ombudsman complaints
According to the Ombudsman's annual report, there was a continued increase in complaints about public bodies received by the Ombudsman.
The Ombudsman's team dealt with 4,673 complaints last year – an increase of nearly 5% on the 2023 figure.
In 2024, 1,497 complaints were made to the Ombudsman about local authorities, with 218 received about Dublin City Council and 150 about Cork City Council.
1,397 complaints were received about Government Departments and Offices with the
Department of Social Protection being the subject of 604 complaints.
There were also 887 complaints about public bodies in the health sector, with 705 involving the HSE and 149 involving Tusla.

Mr Gloster, along with other representatives from the HSE, was before the Disability Committee on Wednesday to discuss disability services. During the meeting, Mr Gloster told committee members that the law around AONs needed reform. Specifically he said reform should focus on the purpose of the assessments rather than amending timelines or the AONs themselves. 'My contribution to that conversation has been more about ensuring that the legislation defines the purpose of the assessment and enables access to it, rather than it being a catch-all for everything in the state,' Mr Gloster said. He added that the way the law is currently means the HSE cannot comply with current legislation and that the health service needed to be honest with families. 'We have to accept and be honest with people,' Mr Gloster told the committee. 'The way the issue has evolved over the years, the way demand has changed, the way other things have happened and other things haven't happened, we haven't a hope of being compliant with the law the way it currently stands.' The HSE chief said that he believed a third of children referred for an AON should not have been referred and that parents and children were being pushed into these assessments. 'I have no doubt that despite the fact there might be a policy position that people don't need an assessment of need for certain things, they are being told they do, or they are led to believe they'll get it faster if they do,' Mr Gloster said. 'I believe about one-third of referrals to assessment of need are actually quite inappropriate.' 'At the moment, we see about one third of assessments when they're concluded that there's no sign or indication of a disability, and that would suggest people are being pushed into accessing assessment for accessing other things which they shouldn't need an assessment of need for.' ADVERTISEMENT Long waiting lists for AONs have resulted in scores of families applying to the High Court to try to force the HSE to carry out assessments on their children. The committee was told that in quarter one of this year, the HSE received 3,131 new referrals for an assessment with 1,412 referrals closed out in the same period. This, the committee heard, represented an increase in the HSE's overall capacity of 65pc based on quarter one of the year before. The HSE chief told the committee that the health service would introduce a 'single door' system for applying for assessments and that this would be introduced in October, though he expected pushback. 'I'm around an awful long time to know that it's not going to be easy. I think I'll meet professional objection to it in parts, because people will feel the system isn't ready for it. But if we don't press on with it, we'll be talking about it forever,' Mr Gloster said. Currently, families attempting to access support are often required to try multiple different services before accessing the correct supports, with parents being told they are trying the 'wrong door' Mr Gloster said. This new approach would see a triage-like system in place, where a child's application would be assessed and then they would be directed to the correct service. We're changing it to one front door, and there's no wrong door,' Mr Gloster said. 'Whether it's a GP, a teacher or a family, a child will be referred, and the combined efforts of CAMHS, disability and primary care will decide what's at least the best chance or the quickest pathway for that child to receive an appropriate response, and that will include the autism protocol.'

HSE chief executive Bernard Gloster pledged reform of the assessment of need (AON) system is not code for removing children's right to this at the Oireachtas Disability Committee on Wednesday. Waiting lists in Cork and Kerry were also raised and he is concerned about long delays facing children there in particular. Families nationally should see faster access to services by October with a 'no wrong door' system in place, he also said. This means if the first service a family encounters is not the best place, they can be referred to a more suitable service instead of starting over each time. Mr Gloster was answering questions on Progressing Disability programmes. 'Assessment of need, I believe, needs reform, that's not code for taking away people's right to it and it's not code for changing the timeline but it has actually become something it was never intended to be,' he said. 'Every single need across public services and across Ireland Inc is now being tagged to assessment of need either because people are led to believe they need it or they form the belief that they'll get something faster.' That's leading to children who really need it being delayed and children who don't need it being put through it. I have concerns about both. Labour spokeswoman on disability, Laura Harmon, said in the first three months of this year 'just 7% of assessment of needs were completed within the timeframes of the Disability Act itself". Mr Gloster said his focus is on 'ensuring that the legislation defines the purpose of the assessment and enables access to it". He is not aware of plans to change the requirement AON should be done within six months of referral. Ms Harmon said of Cork City waiting lists for primary care assessment for autism 'we're seeing 30 months waiting lists'. Mr Gloster responded: 'I have a particular concern about Cork', saying he has discussed with the regional team the need for better focus on children's services there. 'No wrong door' He described meeting GPs during the Irish Medical Organization AGM, saying they talked of how time-consuming it can be to match children to the most appropriate service. 'We're changing it to 'one front door' and there is no wrong door,' he said, saying this will take effect from October. Teachers, parents, and GPs are among those who can refer to a central system for assessment. 'They will decide what's at least the best chance of the quickest pathway for that child to receive an appropriate response. That will include the Autism protocol,' he said. Social Democrats TD Liam Quaide raised delays with primary care, saying this is 'deep in crisis' in addition to stresses facing Camhs and children's disability network teams. For primary care psychology, the waiting list for children is now over 6,500 'and that's for Cork and Kerry alone,' he said. Children might wait four to five years for help and then only get seven sessions, he added. Mr Gloster met 600 staff online this week from disability, primary care and mental health services for children to discuss staffing plans. HSE HR officials set out plans for recruitment to the committee, saying there is a global shortage of therapists and there are plans to increase training places. THE MATER MISERICORDIAE University Hospital has launched Ireland's first ever in-hospital AI centre. The hub is developing and in some cases already using AI tools that will do everything from selecting patients for cancer clinical trials, to detecting fractures in scans, and even creating synthetic MRI scans from CT scans. The work on synthetic MRI scans is aimed at speeding up the diagnosis of spinal injuries that require treatment within an urgent timeframe. Paul Banahan, the Mater's Senior AI Research Fellow is leading the project. 'This is the first time something like this has been developed alongside medical professionals in a hospital setting, so I'm getting feedback in real time. It's already clear that this can be a real way to help with barriers to MRI scan access, especially in emergency out of hours settings,' he said. AI tools are already being used for fracture detection in the Mater, by assisting clinicians when it comes to reading scans. HSE funding needed Banahan's work has been chiefly funded by Enterprise Ireland. At the end of a two year project funded by the agency, the hospital then decided to keep him on. He believes that the HSE should be investing in AI research across clinical settings. 'Things are changing with the HSE and its interest in AI. There are a lot of people working in the health technology and AI sector, and funding is needed to help with that. I'm on my own doing a lot of this work in the hospitals, and the academics I work alongside want to know about a lot of specific points… it would be great to see a whole team of researchers in place,' he said. Advertisement Banahan said that the regulations around the use of AI in public and private healthcare settings needs to be developed, and fully understood by lawmakers and treatment providers. 'There's a lot of work that can be done with AI, but it needs to be done in the right way. 'There's research ethics and risk assessment, and it's still evolving. What we're launching here is the start of the process, and we want to be transparent in what we are doing,' he said. AI can help detect blocked arteries Prof Joe Galvin, Consultant Cardiologist at the Mater, is seeking to run a pilot project that will develop AI that can assist clinicians working with patients experiencing chest pain, coronary blockages, and arrhythmias. 'AI is most useful in medicine when it's used to help us interpret tests. In cardiology we have ECGs, they give us a lot of information about the heart. 'In emergency situations when someone comes into the hospital with chest pain we're trying to figure out: Is this their heart? Are they having a heart attack or not? AI can help us to do that,' he said. Prof Galvin explained that clinicians are looking for tell-tale signs of patients presenting with chest pain having a fully blocked artery. 'AI can look at an ECG and see things that human eyes cannot see because it has looked at so many scans in high resolution,' he said. The Mater doesn't have approval or funding yet to initiate the study, which will work as a pilot project for the entire country. Prof. Joe Galvin believes that the technology may potentially save lives. Erin Daly, the Operations Manager of the Pillar Centre, says that Ireland and other countries are at a 'tipping point' when it comes to the integration of AI into health treatments 'I think we are going to get to the stage where patients really are going to be looking to go to hospitals that are AI enabled. They are going to want to know that that double-check is there, and that safety net is there. That's the future,' she said.
