RIP: Bills that didn't survive the WA Legislature's first major deadline

Bills dealing with cow burps, the state flag, and changes to police traffic stop standards are among the first to land in the legislative graveyard this year in Olympia.
This session, lawmakers in the state House and Senate have introduced nearly 1,800 bills. To stay alive, much of that legislation needed to get voted out of policy committees by Friday.
Next week, more bills will join the cemetery as a Feb. 28 deadline arrives for legislation to pass out of fiscal committees. From there, bills have to pass more checkpoints, including floor votes, to remain in play. The session is scheduled to end April 27.
Bills deemed 'necessary to implement the budget,' like those that include new taxes, are immune from the deadlines.
Here's a rundown of some of the measures that didn't make it past the first cutoff.
This won't be the year for police accountability advocates seeking to restrict when officers can pull over drivers.
House Bill 1512 would have barred police from stopping people solely for nonmoving violations like a broken headlight or expired tabs. Supporters argued this would free up time for police to focus on other enforcement, like drunk and speeding drivers, while also limiting stops that disproportionately impact people of color.
But the Democrat-backed bill ran into opposition from police groups that argued it was coming at a bad time with traffic deaths rising over the past decade. Advocates plan to continue working on the bill and revive it next year.
The runway was cut short for a bill focused on environmental fallout from so-called fast fashion — inexpensive clothing that tends to have a limited lifespan before getting discarded.
Rep. Sharlett Mena, D-Tacoma, proposed that the Department of Ecology collect information about the fashion industry's environmental and labor practices, a step toward possible future policymaking. Companies that failed to provide this information could have faced penalties.
Business groups opposed the legislation, saying compliance costs would be passed to consumers and that it could end up limiting what clothing products are available in the state. Supporters said the requirements are manageable and the information businesses would have to share is already covered in reports that companies like Nike produce.
The Department of Ecology remained neutral on this bill.
Immigrant advocates threw their weight behind House Bill 1482, which called for an expansion of Medicaid coverage for people without legal immigration status. The bill, sponsored by Rep. My-Linh Thai, D-Seattle, never received a hearing. Funding for the idea could re-emerge as a proviso in the budget, similar to previous years.
Rep. Lisa Parshley, D-Olympia, introduced House Bill 1630, which proposed collecting data on methane emissions from cows. It drew a burst of adverse reactions from farmers and Republicans who argued it was a step toward taxing cow burps and farts and adding cumbersome clean air regulations for dairies and cattle operations. The bill, which received a hearing but no vote, will remain bottled up for this year.
Rep. Strom Peterson's House Bill 1938 outlined a process to redesign Washington's state flag by 2028. But it won't be flying this year. Peterson, D-Edmonds, criticized the state's current flag as too plain and said the redesign could help foster state pride. Republicans slammed the idea, particularly the possibility of removing George Washington's image from the flag.
House Bill 1031, sponsored by Rep. Kristine Reeves, D-Federal Way, was an attempt to deal with rising temperatures in public schools due to climate change.
The bill, which didn't receive a hearing, would have directed the Washington Office of Superintendent of Public Instruction to develop indoor temperature standards, including a maximum temperature recommendation, and rules related to school districts' cancellation of school days due to excessive heat.
One of a suite of bills aiming to tackle the rise in traffic deaths, House Bill 1426 would have created a new type of civil protection order focused on impaired driving. The court orders could have required drivers to have ignition interlock devices in their cars or stop drinking entirely.
The bill had sponsors from both sides of the aisle, and had broad support from interest groups. But the prime sponsor, Rep. Lauren Davis, D-Shoreline, said the House Civil Rights and Judiciary Committee 'felt there was more work to be done to hash out the implementation logistics.' She plans to bring back a revised version next year.
A bill with Republican support to prohibit puberty blockers, hormone therapy and surgery for minors seeking gender-affirming care never had a chance in the Democrat-run Legislature.
But earlier this month, House Bill 1038 drew an impassioned rebuke from Democratic leaders who said they'd fielded numerous calls from the parents of transgender youth worried about this legislation.
'People are petrified for their kids, and for themselves,' House Speaker Laurie Jinkins, D-Tacoma, told reporters. 'I can certainly sit here and say those bills are not going to get a hearing, they're not going to move forward, and that's what I tell these parents, but it doesn't stop the concern that they feel for their children.'
Senate Majority Leader Jamie Pedersen, D-Seattle, said his office had gotten over 500 emails and calls from constituents about the bill, which didn't get a committee hearing.
A Democrat-backed bill would have established new requirements for grocery stores using self-checkout stands.
While workers supported House Bill 1739, grocers argued the regulations were too restrictive. Under the legislation, grocery stores could only have self-checkout stations if an employee was dedicated to monitoring them and a traditional checkout lane was open.
The lead sponsor, Rep. Mary Fosse, D-Everett, said she plans to fine-tune the policy in the interim and revive debate on it next session.
And last, but certainly not least, Washingtonians will have to live another year without a state clam.
Dueling measures seeking to shell out that honorable title both cracked under pressure.
Lawmakers didn't bite on legislation to name either the Pacific razor clam or the Pacific geoduck as the Washington state clam. Despite the name, geoducks are the world's largest burrowing clam.

Yet the following morning, Trump took to Truth Social to say that 'of course' Paul and his family could come. 'He's the toughest vote in the history of the U.S. Senate, but why wouldn't he be?' Trump wrote. 'Besides, it gives me more time to get his Vote on the Great, Big, Beautiful Bill, one of the greatest and most important pieces of legislation ever put before our Senators & Congressmen/women. It will help to, MAKE AMERICA GREAT AGAIN! I look forward to seeing Rand. The Party will be Great!' Trump's aside Thursday may also have had to do with Kentucky Rep. Thomas Massie, who has long been a thorn in Trump's side from the right, most recently with his vote against the GOP's budget which passed the House by a single vote. On Thursday morning, Massie claimed the White House had withheld his invitation. 'Incredibly petty & shortsighted of Trump's staff to exclude Republicans from the annual White House picnic while inviting Pelosi and every Democrat,' Massie posted on X, a few hours before Trump cleared the air regarding Paul. 'I always give my few tickets to my staff and their kids, but apparently this year my tickets have been withheld as well. Low class.' It wasn't immediately clear whether Massie ultimately attended the picnic. The White House did not respond to a request for comment from the Daily Beast, nor did Massie's office.

Trump's DHS ‘report all foreign invaders' poster stokes hatred, not safety
The Trump administration escalated its anti-immigrant campaign by promoting a poster calling on Americans to report 'all foreign invaders' to authorities, only days after sending the National Guard and Marines to quell largely peaceful protests against immigration raids in Los Angeles. It may be no coincidence that President Donald Trump's latest anti-immigration offensive comes at a time when the World Bank and major U.S. financial institutions are predicting an economic downturn, fueled by his tariff wars. The new immigration moves seem designed to distract from the country's economic slowdown. The Washington D.C-based World Bank issued a report on June 10 forecasting that the U.S. economy will grow by only 1.4% this year, or half of last year's rate of 2.8%. It cited Trump's trade wars as one of the main culprits. Just days earlier, Elon Musk — the world's richest man and until last week a top Trump adviser — warned that the president's tariffs 'will cause a recession in the second half this year.' Musk later apologized for some of his posts and deleted several of them, including that one, after being warned of potential administration retaliations against his companies. The Morgan Stanley investment bank projects that the U.S. economy will grow at a meager 1.5% this year, and 1% in 2026. Trump may also be seeking to distract from his 'One Big Beautiful Bill' tax legislation, now pending in the Senate. The non-partisan Congressional Budget Office warns it would strip millions of Americans of Medicaid health coverage and could increase the deficit by $2.4 trillion over the next decade. Granted, Trump and his hard-line immigration adviser, White House Deputy Chief of Staff Stephen Miller, have a long history of lashing out against immigrants. Trump famously said in 2023, and has repeated several times since, that immigrants 'are poisoning the blood of our country.' In recent days, Miller has labeled the Los Angeles demonstrators are an 'insurrectionist mob' and a 'threat to civilization.' This, despite the fact that — as of this writing — not a single death has occurred during the Los Angeles protests. By comparison, Trump hailed the violent Jan. 6, 2021 Capitol rioters as 'patriots,' even though their rampage left at least seven dead and more than 150 police officers injured. The poster urging Americans to rat on 'all foreign invaders' appeared June 11 on the Department of Homeland Security's official X (formerly Twitter) account, and was quickly shared by Miller on his own social media. The poster, reminiscent of World War II propaganda, depicts Uncle Sam wielding a hammer as he hangs a sign reading: 'Help your all foreign invaders.' Below, it lists an ICE hotline for reporting the so-called 'invaders.' In smaller print, the DHS post urges Americans to 'help your country locate and arrest illegal aliens' and invites them to report 'criminal activity' to the ICE hotline. Aaron Reichlin-Melnick, an immigration attorney and senior fellow at the American Immigration Council, noted that the poster was originally created by a white supremacist known for spreading anti-Jewish and anti-black propaganda, who took credit for it. Regardless of its origin, the DHS-endorsed call to report 'foreign invaders' echoes tactics used by authoritarian regimes — as happened in Nazi Germany, or still happens in Communist China or Cuba. The government telling you to inform on your neighbors is profoundly un-American. It contradicts America's respect for the rule of law, equal rights for all and a professional civil service, Reichlin-Melnik said. 'The bigger issue is the use of the word 'invaders,' because undocumented immigrants are not invaders,' he told me. 'No invasion in history has involved people crossing the border to work as dishwashers, or to pick crops, and who entered the country legally.' Even the hundreds of thousands of Temporary Protected Status (TPS) and humanitarian parole holders from Venezuela, Cuba, Haiti and other countries — whom Trump now seeks to deport — cannot be described as 'illegals,' as the administration insists. By definition, someone approved by the U.S. government to enter and work legally is not an 'illegal alien,' critics say. 'The biggest danger is that this kind of rhetoric is dangerous, because people believe it, and it can lead to violence,' Reichlin-Melnik told me. 'The El Paso shooter in 2018 drove hundreds of miles to massacre people at a Walmart because he sincerely believed that Latinos were invading the United States.' Indeed, we're treading a perilous path. First, Trump administration officials claimed their anti-immigration crusade would target mainly 'illegal criminals' — a stance many Americans support. Then, the net widened to include 'illegal aliens' in general. Now, the goalpost keeps shifting, and the rhetoric targets 'all foreign invaders.' The DHS-publicized poster is not funny. This leap is a leap too far, too fast, and in the wrong direction.

The Assault on Good-for-You TV: C-SPAN and PBS Teeter as Trump Attacks
When money flowed more freely in television, public-service programming was seen as a means of giving back. From educational TV and supporting public broadcasting to cable operators providing C-SPAN, spaces existed where ratings weren't the yardstick — instead, this was TV intended to be good for you. On Thursday, Congress took a major step toward undermining all of that, as the House narrowly approved a rescission bill that would claw back $1.1 billion in funding to the Corp. for Public Broadcasting, which helps support PBS stations, in addition to cuts to other programs. The bill passed by the slimmest of margins, 214 to 212, with a few GOP legislators switching their votes to get it through. The funding was part of a larger $9.4 billion allocation that lawmakers had already approved for foreign aid and public broadcasting. Senate still has to weigh in on the matter, and has five weeks to decide. With PBS and NPR besieged by the political right, with C-SPAN's funding via cable and satellite fees strafed by cord cutting, higher-minded alternatives have been hit by hard times. The whole point of PBS and National Public Radio was that they would be unfettered by commercial demands, allowing them to offer programming — from children's programming like Mr. Rogers and 'Sesame Street,' devoid of toy commercials, to lower-key news, documentaries and public affairs — that didn't have to justify its existence on a balance sheet. Ditto for C-SPAN, which cable operators carried for a small licensing fee simply because of the perceived value in allowing subscribers to see what their elected representatives were doing and saying, unfiltered and unedited. Public broadcasting has found itself swept up in the Trump administration's war against the media, with the perception that any unflattering reporting about the president — whether from PBS' 'NewsHour' or 'Frontline' or NPR's 'All Things Considered' — reveals 'invidious' bias and a liberal agenda, to use FCC chairman Brendan Carr's favorite word. Conservatives have long argued that public broadcasting represents an unnecessary expense given the abundance of choices available to most consumers. But in its latest incarnation, 'Defund PBS' overtly translates into being less about fiscal responsibility than leveraging the government's underwriting role to silence otherwise-independent media voices by labeling them progressive propaganda. On the left, the response was unambiguous. The Writers Guild of America East (WGAE) condemned the House vote as 'a radical right-wing ideology that aims to destroy a non-partisan public service despite all evidence of its wide benefits.' The group quickly turned its attention to pleading with the Senate, which holds a GOP majority but has exhibited a bit more restraint than the House in prosecuting the MAGA agenda. The CEO of PBS, Paula Kerger, remained silent in the wake of Thursday's vote, but she has been lobbying intensively to save PBS, warning that Trump's push to defund public broadcasters would spell the end for a number of local stations, and the service they provide to their communities. In a recent interview with Katie Couric, Kerger contemplated the end of public funding for the network, which only relies on the government for a portion of its funds. 'I think we'll figure out a way, through digital, to make sure there is some PBS content,' she said. 'But there won't be anyone in the community creating local content. There won't be a place for people to come together.' Kerger was referring to the fact that the campaign against PBS and NPR disproportionally harms smaller and more rural communities that voted for Trump (even if many listeners and viewers didn't), which lack the same menu of local-media options as major markets. In a sense, Sesame Workshop — the entity behind 'Sesame Street' — has provided an unlikely poster child for the financial pressures on public TV, having undergone layoffs before losing its streaming deal with Warner Bros. Discovery's Max. Netflix has since stepped into the breach, joining with PBS Kids in providing access Elmo and his pals. As for C-SPAN, its challenges stem primarily from evolving technology, which has dramatically undercut the financial model upon which the network was founded in 1979. With viewers shifting to streaming and dropping cable and satellite subscriptions, the number of homes receiving C-SPAN has sharply dropped to a little over 50 million, meaning the nonprofit enterprise — which costs operators just $7.25 a month, a fraction of what they pay for channels like Fox News and CNN — is running at a significant deficit. One proposed solution would be for entities with streaming subscribers, like YouTube or Hulu's live-TV package, to carry C-SPAN. Indeed, YouTube's 8 to 10 million subscribers alone would provide enough income to offset most of the shortfall in its roughly $60 million annual operating expenses. Thus far, however, those companies have balked, prompting a rare bipartisan push in the Senate on C-SPAN's behalf, with Republican Chuck Grassley and Democrat Amy Klobuchar among those joining in a resolution calling upon streaming services to carry the network. 'For tens of millions of Americans who have cut the cord and get their content from streaming services, they should not be cut off from the civic content made available by C-SPAN,' the senators stated. It's a welcome development for C-SPAN CEO Sam Feist, who joined the network a little over a year ago from CNN. Feist noted that 'cord cutting' doesn't accurately characterize what's transpired — since old cable subscribers have generally moved to new delivery systems — meaning the case for carrying the network remains as simple as the public-service ideal that inspired its launch. 'We're the only network that provides what we provide, which is this unfiltered view of American government,' Feist told TheWrap, adding in regard to the streamers, 'It is good for the country for their customers to have access to our product.' The campaign regarding C-SPAN carriage has seemingly gained some momentum over the last year, with former Federal Communications Commission chairman Tom Wheeler and the Washington Post's Karen Tumulty among those joining the aforementioned senators in taking up the cause. Wheeler called YouTube's decision not to carry C-SPAN 'baffling and anti-democratic,' writing in The Hill that the company is depriving viewers of 'an unfiltered window into the goings-on in Congress, the White House and other parts of the government.' As Sen. Ron Wyden told Tumulty, carrying the network would only cost YouTube about $6 million a year — 'crumbs,' he suggested, for a streamer that rakes in billions in ad revenue. YouTube has stated that its subscribers 'have not shown sufficient interest in adding C-SPAN to the YouTube TV lineup to justify the increased cost' to their monthly bills, although as Wyden noted, that would amount to a relative pittance of 87 cents a year per household. The two situations aren't completely analogous, especially with the fate of PBS and NPR having become embroiled in politics, as opposed to corporate stubbornness. More fundamentally, though, both situations speak to the question of civic responsibility, and whether the government and private interests acknowledge such obligations. Because even if C-SPAN and PBS reach smaller audiences in a fragmented world, certain things are worth keeping around not because everybody watches them, but rather for what they offer, symbolically as well as tangibly, thanks to the staid sobriety they provide by being available to the people that do.
