Delta must face passenger lawsuit over massive computer outage
DELTA Air Lines must face a proposed class action by passengers who said it refused to offer full refunds after delaying or cancelling their flights following a massive computer outage last July, a federal judge ruled on Tuesday.
US District Judge Mark Cohen in Atlanta said five of the nine plaintiffs may pursue breach of contract claims based on Delta's failure to refund.
The judge allowed a different group of five plaintiffs to pursue claims related to delayed and cancelled flights under the Montreal Convention, a multilateral treaty.
Cohen dismissed the remaining claims, including those he said were preempted by federal law.
The July 19, 2024 outage stemmed from a flawed software update from cybersecurity company CrowdStrike that crashed more than 8 million computers and affected many Microsoft customers.

'This ruling is a major step forward for Delta passengers seeking accountability,' Joseph Sauder, a lawyer for some of the plaintiffs, said in an email.
Neither Delta nor its lawyers immediately responded to requests for comment.
The Atlanta-based carrier had sought the dismissal of all claims, aside from one refund claim and international travellers' claims under the Montreal Convention.
Passengers accused Delta of failing to provide automatic refunds following the outage, and providing partial refunds only if they waived further legal claims.
One plaintiff, John Brennan of Florida, said he and his wife missed a US$10,000 anniversary cruise after Delta stranded them in an Atlanta layover, yet the carrier offered just US$219.45 in compensation.
Another plaintiff, Vittorio Muzzi of the Netherlands, said he spent 5,000 euros (S$7,324) and his luggage was delayed 15 days after Delta scrapped his flight to Florida from Amsterdam, yet the carrier offered just 588 euros (S$862) in compensation.
Delta has estimated that the outage cost US$550 million in lost revenue and added costs, while saving US$50 million of fuel. REUTERS

Still more room for growth for decarbonisation in Apac economies: MSCI
[SINGAPORE] Despite the reliance on fossil fuels, 837 Asia-Pacific corporations have disclosed their climate-transition plans, doubling the commitment growth from 25 per cent in 2023 to 50 per cent in 2025, a report by investment research firm MSCI showed. This demonstrates a 'growing momentum towards adopting transition plans and advancing technological innovation to support corporate decarbonisation efforts', MSCI added. It noted that the doubling of the number of companies that have committed to the Science Based Targets initiative standard indicated a strategic focus on real economy decarbonisation. There are 3,874 constituents in the MSCI AC Asia Pacific Investable Market Index (IMI). Twenty-two per cent (or 837) of the companies disclosed transition plans in 2024, with the information technology sector being the highest with 27 per cent having transition plans, followed by industrials at 26 per cent, and materials sectors at 23 per cent. Internationally, Japan had the highest disclosures at 45 per cent, followed by South Korea at 33 per cent, and Taiwan at 30 per cent, with an increase of disclosed transition plans from 12 per cent in 2022 to 22 per cent in 2024 in Apac. MSCI added that companies with transition plans were more likely to disclose key climate metrics than those without. They were also more likely to report their Scope 1, 2 and 3 emissions as well as set climate targets. As the global average temperature surpassed the threshold set by the Paris Agreement, reaching a record high of 1.5 degrees Celsius above pre-industrial levels in 2024, MSCI examined corporate transition plans across 13 Apac markets, with a focus on clean-tech investment. The research firm noted that corporate disclosure of transition plans may drive clean-tech demand by signalling the need for emissions reduction technologies. The speed and scale at which Apac corporations can decarbonise will depend not only on their ambition, but also on their technology road map, capital allocation, and access to commercially viable clean technologies. To better understand how transition plans can drive clean-tech demand in Apac, MSCI analysed the transition plans in areas such as energy, utilities and materials sectors. The effects of these policies are reflected in the energy sector. Of the 90 companies in the energy sector in the MSCI AC Asia Pacific IMI, 18 per cent (or 16 companies) of them disclosed their transition plans, planning to invest in hydrogen, renewable energy and electric vehicles (EVs) to diversify their revenue streams towards clean energy. They have also integrated hydrogen fuels into their transition plans, reducing greenhouse gas emissions across all modes of operations. In addition to the 16 energy companies, 200 companies or 5 per cent of the MSCI AC Asia Pacific IMI constituents hold hydrogen-related patents, with technologies that demonstrate hydrogen's potential to fully replace other less-sustainable choices such as fossil fuels. The emerging technologies may demonstrate hydrogen's potential as a low-carbon energy carrier. But MSCI noted that 'scaling up hydrogen production and balancing supply and demand may face significant challenges due to high production costs and infrastructure requirements'. Electric and hybrid vehicles in transition plans However, the market penetration of the policies in electric and hybrid vehicle companies is not as successful. Of the constituents of the index, only 4 per cent (or 150) of the companies provide clean transportation solutions. Despite the low disclosure rate, 4% of companies, such as Zhejiang Leapmotor and LG Energy Solution, posted a compound annual growth rate of over 150% in total sales from 2020 to 2023. CREDIT: MCSI ESG RESEARCH However, MSCI said that makers of these vehicles can capitalise on market growth and the rising demand for clean transportation solutions. EV solutions providers and EV component makers such as Zhejiang Leapmotor and LG Energy Solution posted a compound annual growth rate of over 150 per cent in total sales from 2020 to 2023. Success in utilities sector More than 80 per cent of the 23 Apac utilities constituents indicate transition plans involving the use of clean fuels in their road maps, such as hydrogen-fired generation, reflecting the success and growing priorities for sustainability in the sector. The diversification of low-carbon power generation can be attributed to research reflecting that renewable powers surpassed 50 per cent of the electricity market share. Waaree Renewable and KPI Green, which derive most of their revenues from renewable energy solutions, reported a compound annual growth rate of more than 100% between 2020 and 2023. Despite the success and expansion, certain countries and market dynamics are not as promising due to slower phase-outs of coal-fired power plants, such as China, Indonesia and India; other countries such as Japan still provide petrol subsidies, which slow decarbonisation efforts. Growth in materials sector According to the report by MSCI, more than 90 per cent of companies in the materials sector disclosed their transition plans, developing low-carbon steels. A common challenge faced in this sector is the intense heat required for operations, making fossil fuels the most practical option. Despite the heavy use of fossil fuels, less than half of the companies considered adopting carbon capture and sequestration, which involves capturing the carbon produced to store them underground. The success of companies disclosing their transition plans are reflected in steel industries such as Tianqi Lithium, Chifeng Jilong Gold Mining and LB Group, growing the low-carbon patent quality for their materials by 70 per cent from 2020 to 2023. Room for growth in carbon credits However, only 2 per cent of the carbon projects are rated 'A' or 'AA', with 65 per cent of projects falling into 'B' to 'CCC' ratings. This indicates a shortage of high-quality options for credible transitions. It also raises concerns about their environmental impact and the reputational risks for companies.

Hedge funds reap cash from investors ‘starved' of Japan exposure
[HONG KONG] Nick Bird's OQ Funds Management opened a Japan quantitative hedge fund in September. Within weeks, it raised the maximum US$250 million and had to turn away additional money, the former Macquarie Group veteran said. Meanwhile, Sengu Capital's hedge fund tapping improving corporate management in Japan has tripled assets to US$450 million after trading began in early October, said sources familiar with the Hong Kong-based firm. A multi-strategy Japan fund that York Capital Management spinoff Management opened to external clients in early 2023 and now oversees about US$700 million. Their pace of asset gathering, impressive for Asia hedge funds of any stripe these days, highlights how Japan's deepening corporate governance reforms and exit from more than a decade of deflation have rekindled global investor interest in the world's fourth-largest economy. It also underscores the dearth of Japan-dedicated funds that have good track records and are able to take sizable amounts of money from large institutions. 'Despite the increased interest in Japanese hedge funds, allocators have been starved of institutional-quality, scalable managers,' said Michael Garrow, chief investment officer of HS Group, a provider of strategic capital to fledgling hedge funds, including Sengu. Japan was once a magnet for hedge funds, drawn by opportunities as wide-ranging as currency and rates to convertible bonds and stock index rebalancing. By the early 2000s, there were more multibillion-dollar hedge funds focused on the country than anywhere else in Asia. Then it fell out of favour, hurt by crackdowns on insider trading, the global financial crisis and the 2011 earthquake and tsunami. Sign Up Sign Up Now the stars are aligned for Japan hedge funds again. Inflation is back, along with wage growth. Through the turmoil triggered by the Trump administration's tariff policies, Japanese stocks have largely held onto gains in recent years. In US dollar terms, the benchmark Topix index chalked up an annualised 8.4 per cent return in the past five years, against the 0.1 per cent loss of the MSCI China Index. A net 22 per cent of respondents to a BNP Paribas survey last year expected to allocate more money to Japan, the second-most sought-after geography. This year, 20 per cent indicated similar plans. The foremost beneficiaries of the renewed Japan interest have been funds that have taken a page from their activist predecessors, engaging with companies to push for improved shareholder returns, governance reforms and capital efficiency. Seth Fischer's Oasis Management is now approaching US$9 billion in assets, the majority of which is in its Japan engagement strategy. Effissimo Partners, 3D Investment Partners Pte and Ichigo Asset Management International Pte have also gathered billions of US dollars. Engagement funds often offer returns that are choppy in the short run, while tying up investor capital for years. Because of that, they tend to attract long-term investors such as endowments. Now that the corporate governance overhaul is so entrenched, there is hope that capital will trickle down to the rest of the hedge fund space. 'Well-run companies are also embracing corporate reforms, not just the weak, vulnerable ones that do it under duress,' said Garrow. 'That means good things are happening at all levels of the market-cap spectrum.' The paucity of in-depth broker research on Japanese companies leaves hedge funds ample space to mine hidden gems. Nearly one-third of the 1,684 companies in the Topix are not known to be covered by analysts, compared with under 5 per cent of those in the similar-sized S&P 1500 index, according to data compiled by Bloomberg. 'Japan has a lot of value-unlock opportunities with under-managed companies and very, very low-cost leverage in abundant supply to private equity funds,' said Garrow. He cited the potential for hedge funds to bargain-hunt cheap stocks before buyout firms make higher offers. Some veterans are seeking to capture the renewed interest. Convertible bond trader Chris McGuire shut down his 15-year-old hedge fund in 2020 when new issuances plunged. In September, he returned with a new Japan fund with Neal Berger's Eagle's View Capital Management. Former Soros Fund Management trader John Zwaanstra's Penta Investment Advisers has also been trying to capitalise on the demand for Japan expertise, said sources with knowledge of the matter. Keita Arisawa morphed his then six-year-old Seiga Asset Management from an Asia hedge fund firm into a Japan specialist in 2023. There are also signs of a reviving startup scene, with more varied products on offer. Rogers Investment Advisors has seen 17 new Japan-focused hedge fund firms springing up in the past 18 months, said its chief executive officer Ed Rogers. Still, many traders have instead flocked to multistrategy, multimanager hedge funds. Global and regional pod shops such as Millennium Management, Point72 Asset Management and Hong Kong-based Polymer Capital Management have scores of Japan-focused teams between them, each numbering one to multiple employees, industry executives estimated. Such pod shops have absorbed the bulk of new money flowing into the global industry since 2017. For their clients, it marks a safer way to tap into opportunities without having to spend time researching managers in different time zones with language barriers and a cultural gap. Lack scale Investors wanting pure Japan exposure or trying to sidestep the higher fees charged by pod shops have often been stumped because independent hedge funds lack scale. Large international investors tend to allocate at least US$50 million to firms specialising in publicly traded securities, according to a 2024 survey by That makes it difficult to invest in smaller firms without accounting for a large portion of their assets under management, a level of exposure that many allocators prefer to avoid. Having spent months or even years monitoring candidates, institutions also prefer managers who can potentially take larger amounts of capital from them over time. As managing partner of Sussex Partners, Patrick Ghali has seen around 100 teams that traded Japan over 20 years. He reckons the typical Japan funds oversee US$50 million to US$80 million, often with only two or three employees. Most would stop accepting fresh cash by the time assets hit US$300 million, given the risk of diminishing returns if the investment opportunity is finite, or because they focus on smaller, less liquid companies. Since late 2023, Japan's Financial Services Agency has been encouraging domestic banks and insurers to allocate money to fledging money managers, as part of a drive to promote the country as an asset management centre. Still, local investors, especially institutions, have almost no interest in parcelling out money to small Japan-focused hedge funds, Rogers said. Meanwhile, regulatory hurdles make it impossible to access mass-affluent Japanese clients, he added. To bridge the gap, Ghali set up a new Japan multistrategy, multimanager hedge fund with local veteran Masahiro Koshiba, an early member of Japan Advisory, which once oversaw billions of US dollars. The objective of the project – which is separate from Sussex – is bringing together teams that are, on their own, too small to get on the radar screen of larger international investors. Their new fund Susanoh started trading in mid-November with 10 teams employing various strategies, each led by someone with 10 to 35 years of experience in the market. Susanoh cherry-picked half of them from those on the platform of United Managers Japan (UMJ). Koshiba set up UMJ in late 2004, initially to incubate new hedge funds. Over the years, it morphed into more of a provider of support, such as regulatory licensing, office space and trading, Ghali said. Susanoh is also working with one team each from Nikko Asset Management, Sparx Group and Tokai Tokyo Financial Holdings. 'Japan is one of the best, if not the best, hedge fund alpha markets,' Ghali said, referring to market-beating performance. 'You have all these talented traders, but a lot of them are sub-scale. Livingstone Health's strategy rooted in patient care and steady growth
[SINGAPORE] Livingstone Health is not in a rush to grow. Much like the lithops – a hardy succulent also known as a living stone, from which the company takes its name – the Singapore-based healthcare group is taking a slow and steady approach to expansion. The Catalist-listed company, which went public in 2021, operates 20 clinics in the Republic, staffed by 22 medical specialists and practitioners. It also runs a health-screening centre, two medical aesthetics clinics, a podiatry clinic, and provides healthcare consultancy services within the region. 'We're at a stage where we don't want to grow for the sake of growing,' said chief commercial officer Dax Ng in an interview with The Business Times, alongside chief executive officer Wilson Tay. Both are executive directors on Livingstone's board. While rapid expansion is often seen as a way to get investors excited, Dr Tay believes the group's philosophy is better captured by its botanical namesake. 'No doubt, the growth, if you look at those succulents, can be a little bit slow,' he said. 'But given the correct conditions, they can flourish and flower.' After listing in 2021, it completed its first major acquisition just three years later. It acquired the remaining 49 per cent of Phoenix Medical Group (PMG) in 2024, after having first taken a 51 per cent stake in 2019. The acquisition of the healthcare provider, which has seven clinics across Singapore, has been both an 'accretive investment' and also a way for Livingstone to grow its primary healthcare segment through PMG's network. Livingstone's pace also reflects lessons from its early years as a listed company. Ng pointed to the importance of alignment and communication, especially when working with a relatively young team with an average age of around 40. 'A lot of times when you try to work in a team, people have thoughts and ideas that they try to keep to themselves,' he said. 'Over time, that's not healthy.' He added: 'When you go through experiences together with certain people, you realise there are a lot more things you can achieve. Once you have that trust and go through hardship together, you can have tougher conversations, which become easier because they're (more focused and constructive).' That trust enabled more open discussions on practical issues, including how to streamline operating expenses. The results showed up in its financial statement released on May 29: Livingstone swung back to profitability with a net profit of S$0.4 million for the second half-year ended Mar 31, reversing a net loss of S$2.9 million a year prior. Livingstone closed at S$0.023 on Friday (Jun 13), with a market capitalisation of around S$14.1 million. Recognition, relationships and rising needs Even without aggressive expansion, Livingstone caught the attention of RHB Singapore, which included it in the bank's Top 20 Small Cap Jewels 2025 report in May – the only healthcare group on the list. RHB's investment case for Livingstone was that it 'offers exposure to the ageing population and rising affluent trends in Singapore'. The bank also noted that Livingstone's performance is recovering, and anticipates its net profit to be on an uptrend moving forward. Ng called the recognition 'a good add to the group's profile' and noted that it came as a surprise. Dr Tay acknowledged that smaller healthcare companies such as Livingstone may be perceived as less capable than larger players. But he argued that in healthcare, value is not purely about scale. 'Of course, larger players may be able to manage some costs better – like lab tests or imaging,' he said. 'But it doesn't mean smaller healthcare groups can't deliver care that's meaningful. What matters most is the patient-doctor relationship.' That view is core to Livingstone's approach. Ng said the group's ethos is to ensure that patients who come through its general practitioner (GP) services are well taken care of – from seeing the right specialists, to recovery and follow-up if needed. To that end, it maintains a patient-care team that coordinates referrals between GPs and specialists, and works only with trusted external doctors vetted by its internal panel. Ng also pointed to the 'eminent concern' surrounding Singapore's ageing population – a demographic shift that Dr Tay said will accelerate over the next 10 to 20 years, and drive rising demand for healthcare services. To prepare for this, Livingstone has been using patient data to track rising incidences of chronic conditions such as diabetes. In response, the group added an endocrinologist – a specialist that treats diseases such as diabetes, as well as other hormonal and metabolic disorders – to its team in June. Dr Tay said Livingstone 'sees value' in having specialist disciplines that focus on managing chronic conditions, especially as the population ages, as it reflects on-the-ground needs. Looking outward In its latest financial update, Livingstone also outlined plans to diversify its revenue streams, including efforts to attract more international patients to its specialist healthcare segment through business development and marketing initiatives. When asked if this meant a push into medical tourism, Ng demurred, and suggested that the sector may be 'dying' in Singapore due to cost pressures and competition abroad. While the team recognises that Livingstone has limited control over the broader healthcare landscape, Ng believes the group can compete on quality. 'We can attract the right medical talent, and groom them with the right patient ethos and care standards,' he said. 'From there, we can build a brand to attract good international patients who are still willing to pay the extra dollar for quality.' On the future of healthcare, Dr Tay noted that even as the sector increasingly looks to technology for efficiency, the human element remains irreplaceable. 'We treat the patients, not just the disease,' he said. 'We treat their emotions and we (seek) to understand them…Things that a computer cannot do.'
