Cal HC grants bail to murder accused citing Article 21 of Constitution over trial delay

Hindustan Times4 days ago

Kolkata, The Calcutta High Court has granted bail to two murder accused undertrials on the ground of right to life under Article 21 of the Indian Constitution as they have been incarcerated for more than 12 years.
The two - Munna Dhali and Nabu Dhali, along with two others, are accused of murder of four persons in 2012 at Thakurpukur police station area in West Bengal's South 24 Parganas district and have been awaiting completion of trial in the case.
"Without touching the merits of the case and solely on the anvil of Article 21 of the Constitution of India, prayer for bail is allowed," Justice Suvra Ghosh said in the judgement delivered on May 15.
While one other accused Rajesh Das was granted bail on similar grounds earlier, other accused Sattar Mondal had been refused bail on the ground of gravity of the offence and earlier rejection of bail.
They were accused of murdering their employer Dipak Bhattacharya, owner of a local cable television business, his mother and two maids on September 6, 2012, at their residence at Biren Roy Road under Thakurpukur police station area.
All the four accused were arrested on September 9.
Justice Ghosh noted that the petitioners Munna Dhali and Nabu Dhali approached the court with a prayer for bail for the first time after being incarcerated for more than 12 years.
The judge also noted that though the prosecution undertook to examine five more witnesses within the next two months from February 24 this year, there has been no further progress in trial since then.
Justice Ghosh directed that the petitioners be released on bail upon furnishing bonds of ₹10,000 each, with two sureties of like amount each, one of whom must be local.
She also directed accused Munna Dhali and Nabu Dhali to appear before the trial court on every date of hearing and not to intimidate witnesses or tamper with evidence in any manner whatsoever.

Jafrabad murders: 55 days on, charge sheet names 13, blames ‘mosque attack, firing by forces' rumours

1 2 Kolkata: The April 12 violence in Murshidabad which led to the deaths of a septuagenarian and his 44-year-old son in Jafrabad was engineered by a mob after a rumour was spread deliberately that a nearby mosque had been attacked and that security personnel had resorted to firing, says the Bengal police SIT charge sheet filed on Friday. The 983-page charge sheet, filed 55 days after the murders, names 13 persons and mentions that some of the perpetrators had a feud with the victims — Harogobindo Das and his son Chandan — over a piece of land. The 13 accused have been arrested from Bengal, Odisha and Jharkhand. All of them are in judicial custody. The Das family has already moved the Calcutta High Court seeking a CBI probe into the incident. ADG (law & order) Jawed Shamim said: "We collected enough evidence against each accused, and we are confident of securing a conviction." The SIT probe was led by DIG (Murshidabad) Syed Waquar Raza. T he charge sheet says the father and son duo had reasoned with the rampaging mob twice and delayed the attack. The third time, however, the two were dragged out of their home and hacked to death infront of their families. Even after the murders, the perpetrators did not leave the locality and went on to vandalise and burn more houses in the area before fleeing. The SIT has charged the 13 accused of murder, armed robbery, rioting, and has also slapped smaller charges of criminal trespass, housebreaking and criminal mischief. The accused have also been charged of illegal possession of firearms under Sections 25 and 27 of the Arms Act. Conviction for murder leads either to a life behind bars or death. Armed robbery can also lead to a life term, if convicted. Police have cited 60 witnesses, and several statements were recorded before a magistrate under BNSS 183. The evidence also includes CCTV footage and telephone intercepts. Police sources said they would try to ensure an in-custody trial in the case. Bengal govt has appointed special prosecutor Bivas Chatterjee — who has successfully argued in four rape murder trials leading to death sentences last year — for a quick trial. Law student Sharmishta Panoli walks out of Kolkata jail. ‘Wiser, learnt her lesson,' says her father

Kolkata Police arrested the 22-year-old influencer, Sharmishta, based on a 15 May FIR against her at the Garden Reach Police Station over a social media video. Panoli who was arrested on 31 May from Gurugram by Kolkata Police was released from jail Friday, a day after the Calcutta High Court granted her bail. New Delhi: A day before law student Sharmishta Panoli walked out of the Alipore Women's Correctional Home, her father had said she 'has learnt her lesson and will come out wiser'. Speaking to ThePrint over a call Thursday evening, only hours after her bail was granted, the father said, 'We tried to remain very low key on this and stayed away from politics, but after what happened in Gurgaon (Sharmishta's arrest), we think there is definitely a political undertone to this.' Sharmishta stands accused of hurting religious sentiments, promoting enmity on the grounds of religion, and intentional insults while talking about Operation Sindoor in a video she posted on her Instagram page. Following massive outrage over her post, she issued an unconditional apology on social media on 15 May. Attempting to explain what was at the root of the video posted and subsequently taken down by the young law student, her father pointed to the charged environment created by celebrity politicians on social media. 'Look at Kangana Ranaut, what does she say? Some Gen Z kids will talk like Kangana Ranaut. They need to draw a line somewhere—on what may be acceptable and what may not be,' Prithviraj Panoli said. 'Sharmishta has learnt her lesson and will come out wiser.' Before Sharmishta's arrest, the Kolkata Police said her family, along with her, was 'absconding'. The police claimed they sought an arrest warrant for Sharmishta from court after failing to locate her to serve her notices. Prithviraj Panoli, however, refuted the police claims. 'Visited Lalbazar multiple times pre-arrest' 'She made the post on 7-8 May and deleted it soon after. However, some people downloaded it and continued sharing it. She received a lot of threats online. People she did not know started calling her. They issued threats to me, as well. So, on 14 May, I asked her to come to Kolkata from Pune, where she is studying,' he said. 'On 15 May morning, she reached Kolkata at 8.30 am. How can the police claim that she was missing from Kolkata then? How do they know where she was or not?' From 15-19 May, the Panoli family, multiple times, visited Lalbazar, the Kolkata Police headquarters, and the Anandapur police station, Prithviraj Panoli said. The family—he added—was attempting to lodge a complaint over threats Sharmishta was receiving. However, the police, according to him, did not inform them of any FIR against Sharmishta. 'We submitted printed copies of all the threats against us. So, there is documented evidence that we had been approaching the police,' said Panoli. The Panoli family is from Bangalore and currently lives in Kolkata. On the sequence of events before the arrest, Prithviraj Panoli told ThePrint, 'On 18 May, I was constantly in touch with the cops at both police stations, sharing all information, along with online threats we got. We approached a different police officer in the evening of 18 May, informing him that we feared for our safety and security.' Giving an instance of the chain of troubles the family has been facing since the video post, Sharmishta's father said, 'On my way back home, I saw seven to 10 people standing inside my society, looking at our tower.' According to the father, Sharmishta left Kolkata for Gurugram for a scheduled internship, starting 22 May, travelling, over the next few days, to her office in Delhi from her hotel inGurugram. Soon after the scare in the society, Prithviraj Panoli, along with other family members, also booked flight tickets to Gurguram. 'Till 25 May, I was in touch with the Lalbazar police,' Prithviraj Panoli said. 'I, at the same time, had asked her (Sharmishta) not to look at anything. We all had switched off our phones, but I was in touch with the police over WhatsApp. How can they say we were absconding?' 'We even asked the police if any FIR had been registered. By then, I had received threats via mail. If the police wanted to get in touch with us, they had our email IDs,' Prithviraj Panoli added. In the early morning of 31 May, the Kolkata Police arrested Sharmishta from her hotel in Gurugram. 'We could not do anything as there was a warrant,' said the father.
