
The judge's data dilemma in the Google search case
Data played a starring role in the government's successful antitrust suit against
accusing it of illegally protecting its monopoly in online search. Now, steps to force Google to unlock its data trove could figure prominently in a ruling on how to address the tech giant's dominance, antitrust experts say.

On Friday, the federal judge overseeing the case, Amit P Mehta, heard closing arguments in federal court in Washington on what corrective measures, known as remedies, he should order to restore competition. The government's requests include forcing Google to share its search engine results and advertising data with rivals.
Justice Department lawyers have repeatedly described data as "the oxygen" for search engines.
And in his ruling against Google in August, Mehta recounted in detail how the company harvests vast amounts of data from user searches and web crawling, then stores and analyzes the data to rule the lucrative market for internet search.
Google, he noted, collects nine times as much user search data every day as all its rivals combined. And as more data is fed into Google's software, the results that the search engine returns on everything from biology to bluejeans become more accurate and relevant to the person seeking information.
Better search performance, in turn, attracts more users and more advertisers, Mehta wrote. It's a flywheel that steadily enhances Google's search and acts as a barrier to competition.
"At every stage in the search process," the judge wrote, "user data is a critical input that directly improves quality."
His decision on how to fix Google's monopoly has the potential to reshape competition on the internet, particularly as a new age of generative artificial intelligence takes off and is expected to overhaul the way people search for information online.

Tech companies are racing to win consumers over with chatbots and other tools that can answer more sophisticated questions, drawing from vast pools of data.
Mehta has already indicated that AI may factor into his deliberations, noting during a recent hearing the rapid development of the technology since the lawsuit went to trial in the fall of 2023.
To fix Google's search monopoly, the Justice Department and the group of states that brought the case have recommended a range of sanctions, from simply prohibiting anticompetitive deals with companies that Google pays to make it the automatic search engine to forcing the company to sell off its market-leading Chrome browser.
The government's data-related proposal falls somewhere in between. It includes requiring Google to share user search information and license its search index, a database of hundreds of billions of webpages scored by popularity, quality and relevance.
In late April, Mehta said he looked at his job as weighing actions across a "remedy spectrum." At one end was a breakup order, he said, while at the minimalist end was a ban on illegal deals with browser and smartphone companies.
In the middle were "forward-looking remedies," he said, without elaborating on his thinking.
Given the evidence in the case, a data-sharing order would be "a conceptually appropriate remedy," since the exclusive deals increased Google's data advantage, said Douglas Melamed, a former senior official in the Justice Department's antitrust division and now a visiting fellow at the Stanford Law School.
Still, a data-sharing project raises its own set of questions.
In court testimony, Google emphasized the privacy concerns of passing user search data along to other companies.
The government's data proposal also calls for access to software that uses data as an ingredient but was built by Google's engineers.
"It looks like an administrative headache -- how much data, how often, and access to Google's crown jewel?" said John Yun, an economist at the Antonin Scalia Law School at George Mason University.
Google has described the government's data-sharing plan as the equivalent of a breakup -- a forced surrender of its intellectual property, allowing competitors to reverse-engineer its technology.
"The proposal on data sharing is so far-reaching, so extraordinary," that it "feels like de facto divestiture of search,"
, CEO of Alphabet, Google's parent company, testified in court last month.
The history of forced asset sharing as a solution for monopolistic behavior is mixed.
In 1956, as part of an antitrust settlement with the government, AT&T agreed to license its patents, including for transistors, the tiny switches that are the building blocks of electronic circuitry. That opened the door to an independent semiconductor industry in what became Silicon Valley.
But the Telecommunications Act of 1996, which was intended to increase competition for local telephone service by mandating that companies share network capacity, didn't result in much innovation.
Eventually, genuine competition emerged, but it came from mobile wireless and cable broadband companies, said Jon Nuechterlein, a telecom expert and former general counsel of the Federal Trade Commission. Landline voice service has fallen from nearly 100% of households in 1996 to about 25% today.
"Outside competition emerged independent of all the regulatory churn," said Nuechterlein, a distinguished scholar at George Washington University's Competition Law Center.
Today, AI is the big unknown in search. Chatbots like OpenAI's ChatGPT and Anthropic's Claude, the AI-powered search engine Perplexity, and others are potential Google disrupters. Google itself is investing heavily in AI-enhanced search, which Pichai recently described as "a total reimagining of search."
While Mehta has more recently acknowledged the rapid advance of AI, his ruling in August noted that the technology had yet to overtake traditional search.
"AI has not supplanted the traditional ingredients that define general search," he wrote. "Importantly, generative AI has not (or, at least, not yet) eliminated or materially reduced the need for user data to deliver quality search results."
Some antitrust experts say Mehta's decision could affect search and AI.
"The explosion of AI makes it even more important to have strong data-sharing remedies," said Gene Kimmelman, a former senior official in the Justice Department's antitrust division. "AI and search overlap, and both ride on data."

Unfortunately, the most obvious one is advertising — the web's most successful business model. AI builders are already exploring ways to plug more ads into their products, and while that's good for their bottom lines, it also means we're about to see a new chapter in the attention economy that fueled the internet. If social media's descent into engagement-bait is any guide, the consequences will be profound. One cost is addiction. Young office workers are becoming dependent on AI tools to help them write emails and digest long documents, according to a recent study, and OpenAI says a cohort of 'problematic' ChatGPT users are hooked on the tool. Putting ads into ChatGPT, which now has more than 500 million active users, won't spur the company to help those people reduce their use of the product. Quite the opposite. Advertising was the reason companies like Mark Zuckerberg's Meta Platforms Inc. designed algorithms to promote engagement, keeping users scrolling so they saw more ads and drove more revenue. It's the reason behind the so-called 'enshittification' of the web, a place now filled with clickbait and social media posts that spark outrage. Baking such incentives into AI will almost certainly lead its designers to find ways to trigger more dopamine spikes, perhaps by complimenting users even more, asking personal questions to get them talking for longer or even cultivating emotional attachments. Millions of people in the Western world already view chatbots in apps like Chai, Talkie, Replika and Botify as friends or romantic partners. Imagine how persuasive such software could be when its users are beguiled. Imagine a person telling their AI they're feeling depressed, and the system recommending some affordable holiday destinations or medication to address the problem. Is that how ads would work in chatbots? The answer is subject to much experimentation, and companies are indeed experimenting. Google's ad network, for instance, recently started putting advertisements in third-party chatbots. Chai, a romance and friendship chatbot, on which users spent 72 minutes a day, on average, in September 2024, serves pop-up ads. And AI answer engine Perplexity displays sponsored questions. After an answer to a question about job hunting, for instance, it might include a list of suggested follow ups including, at the top, 'How can I use Indeed to enhance my job search?' Perplexity's Chief Executive Officer Aravind Srinivas told a podcast in April that the company was looking to go further by building a browser to 'get data even outside the app' to track 'which hotels are you going [to]; which restaurants are you going to,' to enable what he called 'hyper-personalized' ads. For some apps, that might mean weaving ads directly into conversations, using the intimate details shared by users to predict and potentially even manipulate them into wanting something, then selling those intentions to the highest bidder. Researchers at Cambridge University referred to this as the forthcoming 'intention economy' in a recent paper, with chatbots steering conversations toward a brand or even a direct sale. As evidence, they pointed to a 2023 blog post from OpenAI calling for 'data that expresses human intention' to help train its models, a similar effort from Meta, and Apple's 2024 developer framework that helps apps work with Siri to 'predict actions someone might take in the future.' As for OpenAI's Sam Altman, nothing says "we're building an ad business' like hiring the person who built delivery app Instacart into an advertising powerhouse. Altman recently poached CEO Fidji Simo to help OpenAI 'scale as we enter a next phase of growth.' In Silicon Valley parlance, to 'scale' often means to quickly expand your user base by offering a service for free, with ads. Tech companies will inevitably claim that advertising is a necessary part of democratizing AI. But we've seen how 'free' services cost people their privacy and autonomy — even their mental health. And AI knows more about us than Google or Facebook ever did — details about our health concerns, relationship issues and work. In two years, they have also built a reputation as trustworthy companions and arbiters of truth. On X, for instance, users frequently bring AI models Grok and Perplexity into conversations to flag if a post is fake. When people trust AI that much, they're more vulnerable to targeted manipulation. AI advertising should be regulated before it becomes too entrenched, or we'll repeat the mistakes made with social media — scrutinising the fallout of a lucrative business model only after the damage is done. Its purpose is to provide a "sneak preview of our upcoming devices pre-release." Who can attend the Pixel Penthouse event Interestingly, Google is extending this exclusive opportunity to 25 "lucky Superfans." These chosen individuals will attend the 90-minute event in London on June 27, where they are expected to get a first look at the Pixel 10 series and likely the Pixel Watch 4 . The invitation promises "hands on with pre-release Pixel devices and features," along with a Q&A session with Google employees. Attendees will presumably be required to sign a non-disclosure agreement (NDA). The cover image accompanying the invitation reportedly displays a generic Pixel phone, tablet, watch, and Buds – likely old stock imagery, though the designs are generally expected to remain consistent. Apple's alleged powerful AI models could be hallucinating more than the company would like, report says
The reception surrounding Apple Intelligence on the iPhone 16 series phones, as well as iPhone 15 Pro models and other compatible iPads and Macs, has been somewhat of a mixed bag. While many have praised the intelligent suite for its quality, many have said that the experience is bare-bones and not up to the mark, certainly compared to offerings by Google and others. This has led to the common belief that Apple may be lagging in terms of artificial intelligence. However, a Bloomberg report has now come out that says Apple is consistently working on improving its on-device AI systems. It is currently working on AI systems that are much more capable and powerful than the on-device capabilities it currently ships on an iPhone. But not all has been smooth sailing for the company. Here are the details. Bloomberg's Mark Gurman reports that Apple is currently working on different AI models, with much more power compared to the current AI suite, and is reportedly testing models with 3 billion, 7 billion, 33 billion, and 150 billion parameters. The report also adds that in order to ship on devices like smartphones, Apple needs to make its on-device models smaller. The more complex tasks are on the cloud, and this is why the company could be working on a cloud-based model as well. The report further says that the primary concern for Apple at this point has to be hallucinations with its AI models, and this is why the company may have delayed releasing its most advanced AI capabilities. Another reason which could have influenced the delay of Apple's cloud-based AI model, and a more refined Siri, could be internal debate about the models. So, as things stand, it remains to be seen what AI-related announcements Apple will make at WWDC and whether they relate to these recent AI developments. What we do know so far is that Apple might keep a low profile when it comes to AI announcements, possibly to avoid a repeat of last year's situation, where it showcased several features but was only able to deliver a few. Barring that, users can expect major redesigns across iOS, macOS, and other platforms like iPadOS, at least in terms of aesthetics. These updated platforms are expected to feature translucent AI elements, similar to those in Apple's visionOS, which powers the company's latest mixed-reality headset.
