
The actual cost of non-compliance with Fica
'Any accountable institution, whether in property, legal, crypto or lending, is at risk if compliance lapses occur.'
In the past 18 months, institutions in banking, legal, and financial services have faced steep penalties for non-compliance with the Financial Intelligence Centre Act (Fica).
Some South African commercial banks have been sanctioned with fines ranging from R7.7 million to more than R50 million. These are not outliers, they reflect a clear regulatory shift toward stricter enforcement.
Sameer Kumandan, MD of SearchWorks360, said that while much has been said about Fica obligations, less attention is paid to what happens when businesses fall short.
'The penalties are not limited to financial institutions. Any accountable institution, whether in property, legal, crypto or lending, is at risk if compliance lapses occur.'

How Fica penalties are determined
He said the type of punishment depends on the severity of the violation. Regulators apply a structured framework that considers both mandatory and discretionary factors.
'These include the nature, duration, seriousness and extent of the contravention, as well as whether the conduct was intentional, reckless or negligent.
'The regulator will also assess whether the entity gained any financial or commercial benefit from the non-compliance and if there was any remedial action taken once the issue was identified.'
A business's compliance history matters too.
Institutions with prior contraventions or those seen as repeat offenders can expect harsher sanctions, as can those found to have obstructed investigations or withheld key information.
Fica sanctions
Kumandan said sanctions range from a written caution or public reprimand to a remediation directive, restriction or suspension of business activities, and administrative fines of up to R10 million for individuals and R50 million for companies.
For more serious breaches, particularly those involving an element of intent, criminal charges may be brought, with potential fines of up to R100 million or imprisonment up to 15 years.
Senior managers, directors and employees involved in the breach may be held personally liable.

Common non-compliance issues
'Most Fica penalties stem from recurring failures such as inadequate or generic risk management and compliance programmes (RMCPs), poor customer due diligence, incomplete recordkeeping, failure to submit reports like cash threshold reports and insufficient training,' said Kumandan.
'These are not technicalities – they are central to the act and form the basis of most enforcement actions. In one case, a legal firm was fined R7.7 million for failing to implement an RMCP or train its staff.
'A financial services provider was penalised for failing to report suspicious transactions in a timely manner. These are the kinds of 'basic' oversights that now carry serious consequences.'
The pressure is industry-wide
He added that the uptick in enforcement isn't limited to large financial institutions. In recent months, law firms, insurers, financial advisers and crypto platforms have all faced enforcement actions.
'Fica applies across sectors and smaller firms are not immune. If you deal with money, you are accountable.'
Avoiding penalties requires more than good intentions
Fortunately, regulated entities have access to automated compliance platforms that facilitate the prevention of fraud, money laundering and regulatory breaches.
He said these tools reduce manual oversight, simplify regulatory reporting and ensure Popia-compliant data handling.
They also automate Know Your Customer (KYC)/Know Your Business (KYB) verification processes and can generate suspicious transaction and compliance reports as requested by regulators.
'One of the big selling points of automating Fica compliance is ongoing monitoring. Often, a business will conduct its due diligence at the start of a relationship with a client, only for that client to engage in illicit and illegal activities down the line.
'Ongoing monitoring helps accountable institutions to assess and manage risks continuously, during the onboarding process and throughout the business relationship.
'By tracking client profiles daily, accountable organisations keep tabs on all transactions as they happen and they are alerted to any changes that might indicate a compliance risk.'

JOHANNESBURG - The office of the Gauteng Premier has received an additional R50 million in funding, earmarked for the second phase of the Nasi Ispani programme. This is a mass recruitment drive launched by Premier Panyaza Lesufi, creating job opportunities for unemployed youth. The funds for the programme come from the R1.8 billion that was not spent in the previous financial year.

WhatsApp group linked to July 2021 unrest lands four in court
The Hawks confirmed that more arrests are imminent. The Roodepoort Magistrates Court has granted R1 500 bail each to four suspects who appeared for incitement to commit public violence in connection with the July 2021 unrest. Bekuyise Cebekhulu, 58, from KwaZulu-Natal; Jimmy Sibeko, 44; Busisiwe Skhosana, 52; and Bogadi Mahisa, 49, from Gauteng, made their first appearance before the court on Tuesday morning. The Director of Public Prosecutions (DPP) authorised arrest warrants for the suspects, who then handed themselves over through their legal representatives. Bail for suspected instigators of July 2021 unrest The Directorate for Priority Crime Investigation (Hawks) said they arrested the four suspects in connection with the unrest that took place in July 2021. The unrest in 2021 resulted in more than 350 people losing their lives and cost R50 billion in damages. The protests, violence, and looting erupted across the KwaZulu-Natal (KZN) and Gauteng provinces following the imprisonment of former president Jacob Zuma. 'They'd post inciting messages which it is believed to have led to the public violence as well as the looting of retail stores in Gauteng and KwaZulu-Natal at the time,' Mogale said. The Hawks' Serious Organised Crime, Crimes Against the State (CATS) in Gauteng carried out extensive investigations. Accused of fuelling the unrest through WhatsApp messages Upon completion of the investigations, the DPP decided to prosecute those who posted messages which led to the unrest. The Roodepoort Magistrates Court granted Cebekhulu, Sibeko, Skhosana and Mahisa bail of R1 500 each. The suspects are expected to appear in court again on 2 July. Provincial Head of the Directorate for Priority Crime Investigation, Major General Ebrahim Kadwa, welcomed the arrests and commended the investigating team. Duduzile Zuma-Sambudla charged with terrorism The former president's daughter and uMkhonto weSizwe (MK) party MP Duduzile Zuma-Sambudla is also a suspect. She appeared at the Durban Magistrate's Court in January. In January last year, the South African Human Rights Commission (SAHRC) found there was no discernible connection between Zuma's incarceration and the violent unrest that occurred in July 2021. The SAHRC concluded that the timing of the events of the July unrest 'coincided' with Zuma's jailing and, therefore, 'it could not find evidence to link the two events'. Walter Sisulu University murder case: Magistrate accused of bias after employee granted R10k bail
The presiding officer reportedly adjourned proceedings in the middle of delivering the bail ruling. The Walter Sisulu University (WSU) residence manager accused of fatally shooting a student has been granted R10 000 bail. Manelisi Mampana appeared at the Mthatha Magistrate's Court on Tuesday to learn the fate of his bail application. The accused is facing charges of murder, attempted murder and possession of an unlicensed firearm and ammunition. The charges are linked to the death of WSU student Sisonke Mbolekwa. It is alleged that Mampana shot and killed Mbolekwa on 15 April, during protests at the university's Mthatha campus, with an unlicensed firearm. Two other students, Ntando Gqetywa and Lizwa Ndzumo, were also injured in the incident. Bail judgment in Walter Sisulu University murder case Magistrate Sibusiso Xolo handed down the decision after hearing arguments from both the state and the defence. Ncedo Kolanisi, spokesperson for the Mbolekwa family, expressed their disappointment. 'We are quite shocked,' Kolanisi told the media outside the court. 'We saw signs of the judge or the magistrate being biased. I don't know why, but my suspicions are certain friends of the accused have gotten to him. 'It is unprecedented for when a judgment is being handed down, a note comes to the judge and then the judge all of a sudden adjourns; then goes out and comes back.' No address Kolanisi also criticised the magistrate's lack of consideration of key issues, including Mampana's residential status. 'He is able to intimidate and deregister students as and when he pleases. He ignores the fact that he doesn't have an address. 'It is unprecedented for a person to be released without an address.' 'So it means that all the lawyers that are coming in now that are here to stand in for people that have done all sorts of crimes, that they can use this judgment and say that in the matter of Manelisi Mampana versus the state, he was granted bail even though he did not have an address. 'I can kill somebody and come back tomorrow in court and say that I have a safe house that even the investigating officer doesn't know about,' Konalisi added. Walter Sisulu University launches internal investigation Mampana was placed on precautionary suspension by the WSU's council, while an investigation into whether the manager is guilty of misconduct continues. The council also resolved to establish a commission of inquiry into the events that took place at the Mthatha campus. Retired Constitutional Court Judge Chris Jafta will chair the inquiry, with advocate Bayethe Maswazi acting as evidence leader. The commission's mandate is to investigate and make recommendations on the circumstances surrounding the shooting on 15 April. An interim written report, containing preliminary findings and recommendations, is expected within one month of the commission's appointment. The South African Human Rights Commission (SAHRC) has also initiated a formal inquiry into the lawfulness of the use of force by law enforcement and private security during student protests. The SAHRC is in the process of finalising its report, which will include its findings and will be released in the coming months.
