Met Police cannot dismiss officers by removing their vetting clearance, High Court rules
The Metropolitan Police cannot dismiss officers by removing their vetting clearance, the High Court has ruled.
It comes after the court ruled against the force in what has been described as a "test case" that could have implications for the sacking of police officers accused of misconduct.
Sergeant Lino Di Maria, who had his vetting removed because of sexual assault and rape allegations, brought a legal challenge to the court claiming the process was unlawful.
Mr Di Maria had denied the allegations against him.
The challenge has been described as a "test case" in whether officers can be removed from duty if they cannot hold the minimum level of vetting.
On Tuesday, the High Court ruled that the vetting clearance decision regarding Sgt Di Maria be "quashed and reconsidered".
This means the UK's largest police force cannot dismiss officers by removing their vetting after the High Court ruling.
Metropolitan Police Commissioner Mark Rowley warned the ruling left policing in a "hopeless" position and said he would seek leave to appeal it.
He added: "We have no mechanism to rid the Met of officers who are not fit to hold vetting.
"Those who cannot be trusted to work with women, or those who cannot be trusted to enter the homes of vulnerable people.
"It is absolutely absurd we cannot sack them."
Sky News correspondent Matthew Thompson described it as a "potentially seismic" case.
'Significant implications'
Mayor of London, Sadiq Khan, said in a statement: "This decision has significant implications for the work the Met is now doing to clean up the force, raise standards and rid the police of all those unfit to serve.
"I have long been clear that there can be no hiding place for those who abuse their position of trust and authority within the police.
"Working alongside the Met Commissioner, I want no let-up in the vital work being carried out to raise standards and rebuild public confidence in the Met.
"No one who has failed vetting should continue to serve in the force and we will work closely with the Commissioner, the Home Office and partners to assess the implications of this ruling."
Operation Assure
The Met Police began reviewing the status of officers who were alleged to have committed sexually violent crimes under a system it called Operation Assure.
Assure was put in place after the Met suffered a series of scandals, including the murder of Sarah Everard, to try and clean up the police.
Some were removed after the emergence of serious accusations, including one officer who is thought to have tried to form a relationship with a 13-year-old girl in the United States, though authorities were unable to prove this.
Some officers had their vetting clearance removed, and were dismissed from the force, without proving whether the allegations against them were true.

As the nation's capital cleans up from the culmination of World Pride this past weekend, focus now shifts to a very different massive event — Saturday's military parade to honor the 250th birthday of the Army and the 79th birthday of President Donald Trump. Metropolitan Police Department chief Pamela Smith predicted 'major impacts to traffic' and advised attendees to arrive early and consider forgoing cars for the Metro. 'This is a significant event with a large footprint,' she said. 'We're relying on the public to be an extra set of ears and eyes for us.' The military parade has been designated a National Special Security Event — similar to a presidential inauguration or state funeral. That status is reserved for events that draw large crowds and potential mass protests. It calls for an enhanced degree of high-level coordination among D.C. officials, the FBI, Capitol Police and Washington's National Guard contingent — with the Secret Service taking the lead. The Army birthday celebration had already been planned for months. But earlier this spring, Trump announced his intention to transform the event — which coincides with his 79th birthday — into a massive military parade complete with 60-ton M1 Abrams battle tanks and Paladin self-propelled howitzers rolling through the city streets. Multiple counter-protests of varying sizes are planned for Saturday, with the largest being a mass march to the White House dubbed the No Kings rally. Officials say they are also on alert for signs that the immigration-related clashes between law enforcement and protesters currently roiling Los Angeles would spread. 'We're paying attention, obviously, to what is happening there. We'll be ready,' McCool said. 'We have a robust plan for civil disobedience.' Agent Phillip Bates of the FBI's Washington Field office, which is tasked with counterterrorism and crisis management, said there were 'no credible threats' to the event at the moment. Lindsey Appiah, the deputy mayor for public safety, told The Associated Press last week that the city had longstanding plans for the Army birthday celebration. But those plans 'got a lot bigger on short notice' when Trump got involved. Still, Appiah said the city has grown 'very flexible, very nimble' at rolling with these sort of changes. ____

Her five-year-old brother was also taken to hospital following the crash. Officers drug-tested Asolo-Ogugua at the scene, which he failed. The Met Police arrested him on suspicion of causing serious injury through dangerous driving and drug-driving. Asolo-Ogugua was today sentenced at Woolwith Crown Court for causing the nine-year-old's death. The court heard he fell asleep at the wheel, after having taken cannabis the night before. He mounted the opposite pavement as Ada was riding her bike with her family. Detectives from the Met's Roads and Transport team later trawled through CCTV evidence that revealed Asolo-Oguguathe first drove the bus out of the depot at around 8.45am. They were able to capture the exact moment he fell asleep, and saw the bus swerve cross the carriageway. Asolo-Oguguathe was charged in February earlier this year with causing death by dangerous driving while under influence of drugs as well as driving while over the drug limit. He admitted both offences at Woolwich Crown Court in April. Asolo-Ogugua, of Banfield Road, Southwark, was today jailed for four years. The 23-year-old has also been disqualified from driving for seven years. 'PILLARS OF STRENGTH' Detective Sergeant Sam Miles, who led the investigation, said: 'Asolo-Ogugua will have to spend the rest of his life regretting the night he chose to stay awake before getting behind the wheel of a bus with cannabis in his system. 'It's a night that has cost him his freedom and snatched away the life of an innocent little girl. 'Ada had her whole life ahead of her. 'She lived in the area and attended a local primary school where she was a popular and happy pupil. 'In a remarkable show of courage and humility, Ada's family chose to take her life forward to help others by donating her organs. 'I can only hope today's sentence brings some closure for Ada's family who have remained a pillar of strength throughout these proceedings.' FAMILY HEARTBREAK Ada's organs were donated and she went on to help six other people following her tragic death, her family said. They also previously shared two pictures of their daughter, including one that shows her having had her hair cut for donation. The nine-year-old was a Turkish-British national that lived in Bexleyheath with her family and attended a local primary school. In a heartwrenching statement shared by the Met Police, Ada's father, Bora, said: "The images of that horrific moment remain seared into my mind. That scene replays endlessly, a constant reminder of the day my world fractured beyond repair. "This tragedy happened on my watch, a father's ultimate failure. My world has been turned upside down, and with it, the foundations of my family have crumbled. "My darling Ada. Our thanks are not enough to show our gratitude for you. We will honour your name with acts of magnitude. You will never be forgotten. "We will make this story one of love and thanks that we owe everybody. Your presence, and passing, will leave a mark in this country and we will fight to make drug driving a part of its history." 'RECKLESS AND UTTERLY SELFISH' Senior Crown Prosecutor, Miranda Jollie, of the Crown Prosecution Service, added: 'Asolo-Ogugua was reckless and utterly selfish to get behind the wheel of a bus after consuming drugs and put many lives at risk that day. 'His actions have robbed a young girl of her entire life. Our thoughts remain with Ada's family and friends as they try to come to terms with their unimaginable loss "I hope his sentence today can help to bring some closure for Ada's family and highlight the devastating consequences of drug driving.'
