A luxury resort in California recently banned kids. Is that legal?

Yahoo07-03-2025

ENCINITAS, Calif. (FOX 5/KUSI) — A luxury resort in northern San Diego County recently began banning guests under the age of 18 from staying overnight to create a 'tranquil' experience for adults.
The move by the Alila Marea Beach Resort, located in the city of Encinitas, has called into question whether making a hotel 'adult-only' potentially violates California civil rights laws that ensure equal access to businesses and public accommodations.
The hotel said on its website that the policy, which went into effect on Feb. 14, aims to create an experience 'tailored to adult travelers seeking relaxation, exploration and a peaceful stay by the beach.'

It mirrors other Alila Marea properties across the world, including two in California, that only accommodate adults on site. However, a spokesperson for the resort said kids are still welcome to attend events on-site or dine at its restaurants.
The policy is also not unique among short-term accommodations in San Diego County. Countless hostels have age restrictions in place, as well as other major resorts like a Vista health spa hotel and the two major casino resorts — Sycuan and Viejas.
So is Alila Marea Beach Resort's policy legal? Experts say it depends.
Whether or not these kinds of rules barring kids from their hotels are above board largely depends on the why.
California has rather broad protections against discrimination by businesses under a 1959 law called the Unruh Civil Rights Act. The law prevents enterprises from implementing policies that arbitrarily deny equal access to their services based on a person's characteristics, like race or sex.
According to the state's Civil Rights Department, unlawful policies could be akin to a doctor refusing to treat a patient who has been diagnosed as HIV positive, hosting 'ladies night' discounts at a bar, or preventing someone with a service dog from entering a store.
That's not to say businesses have to serve everyone. Legal experts explain there needs to be a legitimate, nondiscriminatory reason or compelling social interest to restrict its business to a subset of the public.
Examples offered by California officials include rental car agencies not renting to people under 25 years old, a funeral home excluding uninvited guests from a private service, or a restaurant refusing to serve a customer with a history of disruptive behavior.
As for hotels, there can be sound reasons for implementing age-restrictive policies, notably if allowing kids would violate other state laws — as in the case of San Diego's casino resorts due to the state's minimum gambling age of 21.
Bay Area lottery player wins $30 million
But beyond that, businesses like hotels are generally not allowed to adopt blanket policies prohibiting guests under a certain age, even if they are 'nosier, rowdier, more mischievous and more boisterous' than adults, as the California Supreme Court wrote in a 1983 opinion.
Whether Alila Marea Beach Resort's policy would hold up against legal snuff remains an open question, because it's unclear if maintaining a peaceful environment for adults is a compelling enough reason to exempt the civil rights law.
Violations of the law could hit the hotel with a $4,000 fine for each instance.
FOX 5/KUSI reached out to the hotel and Hyatt for comment but did not hear back prior to publication.

Staff at popular Atlanta restaurant say they were blindsided by sudden closing

The Brief Taco Mac's Midtown location abruptly closed Monday morning, leaving employees with no prior notice, according to one former worker. Former staff say they found out through text messages, social media and a sign on the door. The company declined to explain why it shut down Atlanta's last in-town location. ATLANTA - When Taco Mac's Midtown location suddenly shut down this week, workers say they had no warning. The owners announced the closure with a letter posted in the window of the restaurant that read "Permanently Closed." "It's frustrating because it's not knowing," Brandon Jovan Stephens, a former bartender at the Midtown location, said. "Just be honest. We bust our ass here." This was the only remaining in-town location of the Atlanta-based sports bar chain. A sign on the door said, "Our dedicated team members – the true heart of Taco Mac – will be offered opportunities at nearby locations." A spokesperson for the company declined to comment further. SEE ALSO: Taco Mac suddenly shutters 2nd Atlanta location in less than 2 months What we know Stephens said he worked over the weekend and saw no sign that the restaurant would be closing. "I worked over the weekend, Saturday and Sunday," he said. "Nobody told us anything." He said he first learned of the closure on social media and went to the restaurant to see for himself. "When I found out it was really true, was this sign. When the sign is gone and it's on the door permanently closed, that's it. That's all. Yeah. We have to bow out gracefully." The backstory The Peachtree Street location's closure comes less than a month after Taco Mac announced that it was shutting down its first location in Atlanta's Virginia Highland neighborhood after 46 years in business. "We built a clientele with our regulars, you know, but for this place to be shut down like this was, was just like a slap in the face to everybody," Stephens said. Just a few weeks ago, Taco Mac shut down its Virginia-Highland location — the original. The chain, which began as a single neighborhood bar in 1979, announced that the iconic corner of N. Highland and Virginia Avenue is transitioning to a new restaurant concept as the company focuses on future growth. It will be home to Jack Brown's Beer & Burger Joint. Another Taco Mac location on West Ponce de Leon in Decatur closed without warning in 2023. It had been in business for 22 years. "Lot of people had this as their only job," Stephens said. "You know, some people had kids." What's next Stephens said he's trying to stay optimistic about what's ahead. "It's frustrating to me and I'm standing up for it because it affected a lot of these people that worked here, worked here for a while," he said. "You got to think about it too, when one door closes, another one opens." The Source This article is based off of original reporting by FOX 5's Rob DiRienzo.

Scott Galloway sends strong message to Elon Musk about Bill Gates

Podcaster and New York University professor Scott Galloway is well-known for his provocative opinions and smart takes on business, finance and government. That fact includes Galloway's unconventional view on how Social Security ought to be run. It also involves some sharply critical words he recently spoke about Tesla CEO Elon Musk. Don't miss the move: Subscribe to TheStreet's free daily newsletter Galloway, who earns $16 million annually, contends that wealthy individuals, including himself, should not receive Social Security benefits. He advocates for means-testing to determine eligibility, ensuring that the program primarily supports those who depend on it for financial security in retirement. He highlights an imbalance in the system, pointing out that an employee at the company he owns, ProfG Media, earning $160,000 annually contributes $9,000 to Social Security, which amounts to 6% of their income. However, because Social Security taxes are capped at $160,000, someone earning millions - such as himself - still pays only $9,000, despite making exponentially more. Related: Scott Galloway warns Americans on 401(k), US economy threat Galloway sees Social Security as a safety net meant to prevent seniors from falling into poverty, rather than a mechanism for transferring wealth from younger generations to retirees who, collectively, are the most financially well-off generation in history. He argues that substantial reforms are necessary to reduce costs significantly. He believes that political leaders have avoided addressing the issue due to the risks involved, noting that older voters have managed to secure increasing financial benefits for themselves. Galloway asserts that this trend must end and that, by his math, approximately one-third of seniors should not be receiving Social Security. Appearing on a YouTube broadcast of Piers Morgan Uncensored, Galloway explained his view that a number of Musk's actions, such as spearheading the shutting down of USAID, were not to be respected. "Somehow we've decided in America that innovation and money replaces - or obviates, or excuses - depravity." Galloway said. "Or cutting off aid to HIV positive mothers, deciding what veterans should get benefits, cutting off SNAP payments, which have shown to have a positive net return when people run out of money for food at the end of the month." "I mean, I think one of the wonderful things about being an American and quite frankly, for me what it means to be a man and what I try to teach my boys, is the whole point of prosperity is such that you can protect people," he added. More on retirement: Dave Ramsey sounds alarm for Americans on Social SecurityScott Galloway warns Americans on 401(k), US economy threatShark Tank's Kevin O'Leary has message on Social Security, 401(k)s Galloway criticized Musk's behavior, arguing that wealth and success should not excuse problematic actions. According to Galloway, when someone publicly makes offensive gestures such as apparent Nazi salutes, is largely absent from their children's lives, or reportedly struggles with substance abuse, it raises serious concerns. He questions whether such a person should be considered an aspirational figure for young men. Galloway urges people to reflect on how money and status can distort public perception, noting that Musk's achievements - whether in aerospace or autonomous vehicles - are remarkable. However, he challenges the idea that these accomplishments justify moral failings, asking whether society should overlook unethical behavior simply because someone is a visionary or the richest person in the world. Related: Dave Ramsey warns Americans on Social Security Galloway discusses Musk's behavior and mentions billionaire Bill Gates as an example of an immensely wealthy person who is putting his money toward philanthropy and making the world a better place. "Does that mean unlike Bill Gates, he's not using his billions to help people?" Galloway asked. "He's not planting trees the shade of which he won't sit under. I think this is an individual who has literally come off the tracks ... and is using his immense power to get people elected." "Too many of us excuse what is abhorrent behavior," Galloway added. "I think his legacy is not going to be an EV or putting rockets into space. I think it's going to be unnecessary death, disease, and disability of the world's most vulnerable. That is not what it means to be an innovator. It's not what it means to be an American. It's not what it means to be a man."
