Environment, social justice groups withdraw support for governor's key groundwater protection bill

Groups that helped champion one of Gov. Tina Kotek's key groundwater protection bills this session are withdrawing their support and asking the Legislature to let it die for now, following a last-minute amendment they say effectively neutralizes the intent of the legislation.
Senate Bill 1154 as first proposed in February would provide long overdue updates to the state's Groundwater Quality Protection Act first passed in 1989, giving state agencies more authority to coordinate and to intervene early in Oregon's contaminated groundwater areas.
Since 1989, three critical groundwater management areas have been identified in Oregon. They are all still considered to be in critical condition due to nitrate contamination, almost entirely from agricultural fertilizers and animal manure, and none have seen vast improvement in the last two to three decades.
Groups heavily involved in addressing water contamination issues in northeast Oregon — including the nonprofits Oregon Rural Action, Center for Food Safety, Food & Water Watch of Oregon, Columbia Riverkeeper, and Friends of Family Farmers — consulted with Kotek's environmental advisers on the bill and offered testimony supporting it in recent months.
But in advance of a public hearing and vote on Monday in the Senate Committee on Rules, the groups released a statement saying they could no longer support it. They wrote that a proposed 39-page amendment posted late Friday at the request of state Sen. Kayse Jama, D-Portland and committee chair, 'revealed the extent to which the Governor's office had allowed powerful industrial lobbies to influence the bill late in the session.' Lawmakers have to wrap up voting on all bills by June 29.
At a news conference Monday Kotek said she was not aware of the proposed amendment.
'I think the bill is in good shape, and I know some folks would like it to be stronger, but I think it significantly strengthens what we do in the state, and I support the bill in its current state,' she said.
Several environmental and social justice groups that have supported the bill continue to do so with the amendment, according to Anca Matica, a Kotek spokesperson. They include the Portland-based nonprofit Verde, Oregon Environmental Council and Beyond Toxics.
The amendment strikes earlier provisions in the bill that would have required state agencies to provide regular reports to the Environmental Quality Commission, the governor and the Legislature in order to receive funding to execute their local voluntary implementation plan. It also strikes part of the original bill that would have allowed the state to modify existing permits for wastewater reuse and confined animal feed operations if doing so could curb pollution.
One big change the amendment brings to the original bill, according to Kaleb Lay, policy director at Oregon Rural Action, is eliminating the requirement that the Oregon Department of Environmental Quality and the Oregon Water Resources Department work together to figure out whether new requests for groundwater permits, or requests for new uses of groundwater, might contribute to pollution.
Representatives from the Oregon Farm Bureau and Water for Eastern Oregon, a nonprofit industry group representing northeast Oregon food processors and agricultural industries, said the amendment makes improvements to the bill, specifically ones that require third-party analysis of state hydrogeology and well-testing data.
'The bill has come a long way. And again, the problem is identified,' Oregon Farm Bureau Executive Director Greg Addington told lawmakers on the Senate Rules Committee. 'We want to avoid groundwater contamination. We can all understand that, and we can all get behind it.'
Kristin Anderson Ostrom, executive director of Oregon Rural Action, said in the multi-group statement it would be better to abstain from voting on the bill now and to work on it for the next Legislative short session in 2026.
'Governor Kotek showed great initiative in putting this bill forward to learn the lessons of the
LUBGWMA (Lower Umatilla Basin Groundwater Management Area) in eastern Oregon, but this legislation doesn't go far enough to put those lessons into practice,' she wrote. 'Polluters continue to get whatever they want, while the communities directly impacted by pollution are denied what they need and have been asking for – to enforce the law and stop the Pollution.'
The Lower Umatilla Basin Groundwater Management Area, designated as critically impaired in 1990, has gotten worse under state supervision. A volunteer committee established in 1997 to tackle problems has had little to no impact.
Thousands of residents in Morrow and Umatilla counties — mostly Latino and low-income — have been drinking from contaminated wells, which is dangerous because nitrates consumed over long periods can increase risks for cancer and birth defects. In September, Kotek and state agency officials released a comprehensive plan for curbing nitrate pollution in northeast Oregon that 'will take decades' to achieve.

House Republicans draft competing budget as Senate nears deal with Hobbs
Photo by Jerod MacDonald-Evoy | Arizona Mirror Arizona lawmakers are at odds again, but this time it's the Republicans in the House of Representatives and Senate who can't agree on how to forge the state budget. Creating the state budget — deciding how much to allocate to departments, projects and initiatives or whether to fund them at all — is the most important job that legislators do each year, and the only thing they are constitutionally required to complete. Before the group of bills that will become the state budget becomes law, it must be approved by a majority in both the Arizona Senate and House — which are both controlled by Republicans — and garner a signature from Democratic Gov. Katie Hobbs. In recent history, budget negotiations in Arizona have occurred behind closed doors among the governor and legislative leaders in the House and Senate. But this year is different, with Hobbs and Republican leaders in the Senate nearing a deal after weeks of negotiations. GOP leaders in the House, who haven't been involved in those talks, have responded by drafting their own budget, which was introduced late Wednesday afternoon. SUBSCRIBE: GET THE MORNING HEADLINES DELIVERED TO YOUR INBOX 'This is a sound, disciplined budget that delivers safe communities, strong families, and a government that lives within its means,' House Speaker Steve Montenegro said in a Wednesday evening statement. 'We're raising pay for our state law enforcement officers, reducing tuition at public universities, fully funding school choice, fixing critical infrastructure and roads, and protecting taxpayers. Our budget reins in government and puts it back to work for the people it serves.' But the spending package, which is chock-full of proposals that are unlikely to pass muster with Hobbs, will never become law. Instead, it is better viewed as a way for House Republicans to lay down a marker in order to force Hobbs and the Senate to move closer to the House's proposal. Republican political consultant Barrett Marson said House GOP leaders are hoping to demonstrate that the chamber can pass a spending plan in order to get leverage in the negotiations. 'Sometimes there's just gotta be movement to unstick a sticky situation,' he said. 'The House has an equal voice. And unlike previous years when one or both chambers had a go-it-alone ethos, the House isn't looking to be draconian or anything. They want something more responsible.' Marson said a major point of contention between the House and Senate is what to do with the budget surplus. While the Senate and Hobbs have settled on copying the novel process from 2023, in which each lawmaker was given a pot of money from the surplus that was used to fund whatever initiatives they wanted, the House wants to negotiate all of those details and not surrender control of that money to individual legislators. During a House Rules Committee meeting earlier Wednesday afternoon, House Minority Leader Oscar De Los Santos, of Laveen, said he was disappointed in the way the budgeting process was happening this year. 'We should not be moving forward with a House Republican-only budget that is destined to fail,' he said. 'This will not get signed by the governor. I don't even think it's going to pass out of the Senate.' De Los Santos even questioned whether the proposal would get enough votes to pass through the House, where Republicans hold 33 of the chamber's 60 seats. 'What we do know is that this is not a negotiated, bipartisan deal in good faith,' he said. 'House Democrats are at the table negotiating in a bipartisan way with the executive, with our (Senate) counterparts across the courtyard. That is the way to get things done in shared government.' But Republican Rep. Neal Carter, of San Tan Valley, replied that the work of governing should be done transparently, instead of in private — and that it should allow for input from the public. 'As a Republican, I stand for full transparency and not for back-room deals or negotiated budgets with parties that are somehow outside of this public process,' Carter said. The House Republican budget, introduced by House Appropriations Committee Chairman David Livingston, proposes significant changes in how federal money allocated to the state, but not restricted to specific uses, is controlled. The billions in unrestricted federal funds, currently controlled by the governor, would shift to legislative control and could only be spent on essential government services. The House GOP's budget proposal would also place new restrictions and monitoring requirements on entitlement programs, like the Arizona Health Care Cost Containment System — the state's Medicaid program — and the Supplemental Nutrition Assistance Program, formerly called food stamps. Both programs would be monitored on at least a quarterly basis for participants who don't qualify, to be kicked off. And any participants who win $3,000 or more through gambling or playing the state lottery and don't report those winnings would become ineligible. It would also give the Arizona Department of Economic Security the authority to screen recipients of Temporary Assistance for Needy Families for illegal drug use and would ban anyone who tests positive for drugs not prescribed to them from the cash assistance program for a year. House Republicans also intend to increase the percentage of money spent in K-12 classrooms, as opposed to on administration; to decrease tuition for students attending the state's three public universities; and to ban those universities from using public or private money to give scholarships to students without legal immigration status. Hobbs introduced her budget proposal, which includes a much different list of priorities, back in January. Shortly after that, Livingston and Rep. Matt Gress, R-Phoenix, panned her proposal for leaving out projected cost increases for programs like AHCCCS. Hobbs spokesman Christian Slater told the Arizona Mirror on Wednesday that Livingston and Gress were to blame for the House's lack of collaboration on the budget. 'This is DDD all over again,' Slater said via email, referring to a fight earlier this year over funding for the Department of Developmental Disabilities. 'It's another circus led by the Speaker, David Livingston, and Matt Gress where they have refused to participate with any caucuses, including their Republican counterparts in the Senate, in a meaningful manner and are once again just trying to score some political points even though they know their plan is going absolutely nowhere.' Livingston and Gress, a former budget director for Republican Gov. Doug Ducey, were both key players in the fight over an extra $122 million in emergency funding for DDD that put vital services for the developmentally disabled in jeopardy. 'Rather than being productive, the House Republican leadership continues to show they are in over their head and unserious about governing,' Slater said. Rep. Luna: China is dangerous, behind funding of protests
(NewsNation) — Florida Rep. Anna Paulina Luna, a Republican, announced the House Oversight committee will be calling China-based billionaire Neville Singham to testify regarding the funding of a group that organized protests in Los Angeles. 'If he refuses to appear, he will be subpoenaed, and if he ignores that, he will be referred to the DOJ for prosecution,' Luna said in a post on social platform X. She alleged that the Party for Socialism and Liberation, a Communist political party to which Singham has previously donated, is also receiving funding from the Chinese Communist Party. The committee will be looking into links between Singham and the CCP, as well. Luna joined NewsNation's 'CUOMO' on Wednesday to discuss the investigation. She said she believes Singham and the CCP are purposely trying to create division within the United States. Hogg forgoes reelection for DNC vice chair 'I do believe the Chinese government knows what they're doing; they're smart and they're dangerous,' Luna said. She added that she believes they are creating a ruse with the protests and making Hispanic-Americans think the unrest going on is all about the recent ICE raids. Luna said during the Biden administration, then-Sen. Marco Rubio and Sen. Lindsey Graham asked then-U.S. Attorney General Merrick Garland to investigate Singham over Foreign Agents Registration Act violations and ties to China, but the administration did not follow up. 'It's not just me, but the entire Oversight committee in Congress,' Luna said. 'This is a different administration. We are not playing games. Critical minerals give China an edge in trade negotiations
GANZHOU, China (AP) — China's dominance over critical minerals in global supply chains was a powerful bargaining chip in trade talks between Beijing and Washington that concluded with both sides saying they have a framework to pursue a deal. China has spent decades building the world's main industrial chain for mining and processing such materials, which are used in many industries such as electronics, advanced manufacturing, defense and health care. Mines and factories in and around Ganzhou, a key production hub for rare earths, underpin China's control over the minerals. Many residents grew up collecting rocks containing the valuable minerals from the forested hills surrounding the southern city and today make a living from mining, trading or processing them. Critical minerals as a trade issue Responding to ever higher tariffs and other controls on advanced technology, China told exporters of certain key rare earths and other critical minerals to obtain licenses for every shipment abroad. Approvals can take weeks, leading to supply chain disruptions in the U.S. and other countries. President Donald Trump said Wednesday that China would make it easier for American industry to obtain much-needed needed magnets and rare earth minerals, clearing the way for talks to continue between the world's two biggest economies. In return, Trump said, the U.S. will stop efforts to revoke the visas of Chinese nationals on U.S. college campuses. But details remain scarce. Beijing has not confirmed what the negotiators agreed to, and Chinese President Xi Jinping and Trump himself have yet to sign off on it. The Chinese Commerce Ministry said Saturday it had approved a 'certain number' of export licenses for rare earth products, apparently acknowledging Trump's personal request to Xi during a phone call last week. And on Wednesday, the Ganzhou-based rare-earth conglomerate JL MAG Rare-Earth Co. confirmed it had obtained some export licenses for shipments to destinations including the U.S., Europe and Southeast Asia. Experts say, however, Beijing is unlikely to do away with the permit system enabling it to control access to those valuable resources. The only scenario in which China might deregulate its critical minerals export is if the U.S. first fully removes tariffs imposed on Chinese goods as part of the trade war, said Wang Yiwei, a professor of international affairs at Renmin University, echoing the Chinese government's earlier stance. 'Without that,' he said, 'it will be difficult to blame China for continuing to strengthen its export controls.' An industry built over decades with government support In 1992, Deng Xiaoping, the leader who launched China's ascent as the world's biggest manufacturing power, famously said 'the Middle East has oil, China has rare earths,' signaling a desire to leverage access to the key minerals. Several generations later, Beijing has made its rich reserves of rare earths, a group of 17 minerals that are abundant in the earth's crust but hard, expensive and environmentally polluting to process, a key element of China's economic security. In 2019, during a visit to a rare earth processing plant in Ganzhou, Xi described rare earths as a 'vital strategic resource.' China today has an essential monopoly over 'heavy rare earths,' used for making powerful, heat-resistance magnets used in industries such as defense and electric vehicles. The country also produces around 80% of the world's tungsten, gallium and antimony, and 60% of the world's germanium -– all minerals used in the making of semiconductors, among other advanced technologies. The risks of dependency on Chinese suppliers first came into focus in 2010, when Beijing suspended rare earths exports to Japan due to a territorial dispute. The ban was lifted after about two months, but as a precaution, Japan invested in rare earths processing plants in other countries and began stockpiling the materials. Beijing's across-the-board requirement for export licenses for some critical minerals has put pressure on world electronics manufacturers and automakers. Some auto parts makers in Europe have shut down production lines due to delays in supply deliveries, according to the European Association of Automotive Suppliers. In the U.S., Tesla CEO Elon Musk said a shortage of rare earths is affecting his company's work on humanoid robots. China's critical minerals resources are dwindling In the drab industrial hub of Ganzhou, cradled by the scenic Dayu Mountains, the U.S.-China trade war is still a distant stressor. Miners and small mineral traders interviewed by The Associated Press said they are more concerned about depleting the mountains' once-abundant resources. Zhong, a tungsten factory manager in Ganzhou who would only give his last name, worked his way up to manager from a miner, but he's unsure there is a future for him and others in the industry. 'I find growing difficulties to source tungsten these days,' he said, adding that smaller mines and trading companies are slowly disappearing as the resources are dwindling. Tungsten is an ultra-hard metal used in armor-piercing ammunition, nuclear reactors and semiconductors. At least five tungsten mines have closed in the area in recent years, according to state media. Remaining reserves are deeper and harder to extract and process after decades of exploitation, said Li Shangkui, chairman of the Ganzhou-based Jiangxi Yuean Advanced Materials Co., Ltd. Processing factories in Ganzhou now routinely source materials from other provinces or other countries. Zhong's plant imports some raw materials from places like Africa and Cambodia. Major state-owned and private companies in Ganzhou are also ramping up investments abroad. Tungsten producer Ganzhou Haisheng, for instance, announced last year a $25 million investment in a new tungsten plant in Thailand. Whatever the challenges in procuring raw materials, China likely will seek to maintain its dominance in critical minerals, said Fabian Villalobos, an engineer and critical minerals expert at the RAND think tank. The U.S. lags far behind China on critical minerals Between 2020 and 2023, the U.S. imported at least 70% of the rare earth compounds it used from China, according to the U.S. Geological Survey. It has diversified its sources in recent years, but still mainly relies on China. Since beginning his second term in office, Trump has made improving access to critical minerals a matter of national security. But the U.S. has an incredibly long way to go to catch up with China, experts say. The sole operational U.S. rare earths mine, in Mountain Pass, California, is unable to separate heavy rare earths. It sends its ore to China for processing. The U.S. Defense Department has provided funding to the mine's owner, MP Materials, to build new separation facilities. It will take months to build and still only produce a fraction of what is needed. Friction over the issue has opened the way for government-backed financing that was unavailable before, said Mark Smith, who ran the Mountain Pass mine in the early 2010s and now leads NioCorp. It's seeking about $780 million in financing through the U.S. Export-Import Bank to build a processing facility in Nebraska for critical minerals including rare earths. The Defense Department has committed $439 million to building domestic rare earth supply chains, but building a complete mining and processing industrial chain like China's could take decades. 'There are going to be some real issues here unless we can figure out how to get along with China for a period of time while we're developing our own resources and our mainstream processing,' Smith said. The spotlight on critical minerals also provides opportunities for smaller miners to invest in extracting and processing some critical minerals, such as tungsten, considered 'niche' because they are needed in relatively small amounts in key industries, said Milo McBride, an expert on sustainability and geopolitics at the Carnegie Endowment for International Peace. 'For many of these companies, the business strategy hedges on a scenario where the U.S. and China become more confrontational and where trade relations become more uncomfortable,' McBride said. 'And all of a sudden, what was once an uneconomic project somewhere outside of China starts to make more sense.'
