Disclosure of second marriage no ground for questioning validity of MLA's election: HC

MUMBAI: The Bombay high court on Monday rejected a petition challenging Shiv Sena MLA Rajendra Gavit's election from the Palghar assembly constituency on the grounds that he had violated rules by disclosing he had a second wife while filling his nomination form. A single-judge bench of justice Sandeep Marne ruled that the petition failed to show how Gavit's voluntary disclosure about his second marriage materially affected the election result. The bench added that the Shiv Sena leader had candidly and honestly disclosed the information relating to his second marriage, which could not be a ground for challenging his election.
Sudhir Brijendra Jain, a social activist, had filed an election petition in the high court, claiming that Gavit's win in last year's Maharashtra assembly polls was void because the Shiv Sena leader disclosed he had a second wife in his poll affidavit. Jain argued that under the provisions of the Hindu Marriage Act, 1955, a second marriage, while the first is still legally valid, is illegal.
Jain also contended that Gavit had violated the Conduct of Election Rules, 1961, by tinkering with the format of the nomination form to add details about his second marriage. 'There is no provision for making any declaration of a second spouse. Therefore, the additional column in respect of the second spouse is in violation of the election rules,' he said.
Subsequently, the court issued a summons to Gavit in January. The 57-year-old filed an application seeking the petition to be rejected, stating that merely adding a column in the form for making correct disclosures cannot be a ground for seeking the declaration of his election as void. 'There is no prohibition or restriction on any candidate from making any voluntary disclosure of information,' he added.
Submitting that the declaration of a second marriage had not materially affected the election in any manner, Gavit's lawyer, advocate Nitin Gangal, urged the court to reject the petition. He also informed the court that Gavit belongs to the tribal Bhil community, which does not come under the mandate of the Hindu Marriage Act. The tribe also does not prohibit a second marriage, he claimed. 'In fact, there is a custom of polygamy in the Bhil community,' Gangal added.
On this point, Jain's lawyer, senior advocate Neeta Karnik, argued that Gavit had declared his second marriage deliberately to influence voters from his community. 'The [Palghar] constituency was reserved for the ST (Scheduled Tribe) community and Mr Rajendra Gavit has largely benefited on account of this disclosure from local tribal voters,' she said.
However, the court upheld Gavit's election, observing that the addition of a column in the form, which deals with details such as PAN and the status of filing income tax returns by the candidate, their spouse, their family and dependents, would neither render the nomination form defective nor amount to a violation of the provisions of the Election Rules.
'There may be cases where a candidate belonging to a particular religion, in which polygamy is not prohibited, has contracted multiple marriages. If the contention of the petitioner about impermissibility to add a column is accepted, such a candidate would never be able to contest any election,' the bench said.
It further noted that there is no material averment in the memo of the petition to demonstrate falsity in Gavit's declaration. It held that the contention raised by Jain about the impermissibility to have a second marriage during the subsistence of the first marriage is 'purely inferential' and does not constitute making a false statement by the candidate in the nomination form.

Moreover, all the information on the dashboard is available in Marathi,' the above-mentioned official said. Prior to the first cabinet, the state general administration department had organised a training session for the secretaries of all departments. Ministers were shown how the e-cabinet process mirrors the traditional process. Typically, before a proposal is put up before the cabinet, it first goes to relevant individuals for their comments. It is then sent for comments to the concerned departments. Most proposals are also sent to finance, planning and law and judiciary departments before finally landing on the chief secretary's desk. The chief secretary decides whether to put up the proposal before the cabinet. In the e-cabinet system, ministers can see a trail of what every individual and department has said on the proposal. Municipal Corporation of Gurugram (MCG) commissioner Pradeep Dahiya on Tuesday issued firm directions to all departments to ensure prompt redressal of public grievances, enhance transparency, and take strict action against encroachments across the city. The directives were issued during a high-level review meeting with senior civic officials. Dahiya reiterated that accountability, transparency, and strict monitoring would be central to strengthening service delivery and civic order in Gurugram (HT Photo) 'Every problem has a solution if approached with the right process and dedication. Public grievances cannot be ignored under any circumstances,' said Dahiya, stressing that resolving citizen complaints must remain the civic body's top priority. The meeting reviewed complaints received from multiple platforms, including the GMDA Integrated Command and Control Centre (ICCC) portal, PM Window, CM Window, Sameer Portal, Social Media Grievance Tracker (SMGT), and the Swachh City Portal. Dahiya directed that once complaints are resolved, the status must be promptly updated on the respective portals to ensure accountability and build public trust. Joint commissioners and the chief engineer have been assigned to monitor compliance. The commissioner instructed zonal and enforcement teams to conduct regular field inspections to identify unresolved complaints and prevent civic violations. 'Many complaints are recurring, especially regarding sanitation, potholes, and unauthorised street vendors. Teams should be proactive in identifying such issues before they are formally reported,' he added. Dahiya reiterated that accountability, transparency, and strict monitoring would be central to strengthening service delivery and civic order in Gurugram. Highlighting enforcement, the commissioner also called for zero tolerance towards encroachments. 'Encroachments cause inconvenience and compromise public safety. There will be no leniency towards illegal structures or encroachers,' he said, directing that footpaths, roads, markets, and public spaces be kept encroachment-free. Further, officials have been asked to prioritise grievances raised during Jan Samvad events, Samadhan Shivirs, SMGT, and CM Window initiatives. 'These platforms serve as direct channels for citizens to communicate their concerns. Prompt resolution not only improves administrative efficiency but also enhances citizen satisfaction,' Dahiya said.

The Prime Minister accused the then-Indira Gandhi government of placing democracy 'under arrest'. "It was as if the Congress Government in power at that time placed democracy under arrest," he said. Modi also attacked the 42nd Amendment to the Constitution passed during the Emergency period, calling it a prime example of the Congress's 'shenanigans' that imposed the emergency. The amendment made extensive changes to the constitution and was partially reversed by the subsequent Janta Party government in 1977 and 1978 through the 43rd and 44th amendments. He added that the poor, marginalised and downtrodden were particularly targeted, including their dignity insulted." The Indira Gandhi government declared an emergency on June 25, 1975, citing 'internal disturbances'. It continued until March 21, 1977, after which fresh elections were called. Gandhi and the Congress lost their first general election after the Emergency and were replaced by the Janata Party coalition, which also contained the Bharatiya Jan Sangh, the predecessor to the current BJP.
