Menendez Brothers' Attorney Seeks Recusal of District Attorney From Resentencing, Citing Bias

The Menendez brothers' battle for freedom is bringing their attorneys to court in Los Angeles again for a Friday hearing as the the incarcerated duo, who have been behind bars for over 30 years after being found guilty of the shocking 1989 Beverly Hills double murder of their parents, seek to boot the L.A. District Attorney's Office from the case entirely, citing the new D.A.'s bias and a conflict of interest.
Friday's court hearing will be the latest in a series regarding the potential resentencing of Erik Menendez, 54, and his older brother, Lyle Menendez, 57. It comes a month after Los Angeles County Superior Court Judge Michael Jesic refused District Attorney Nathan Hochman's request to toss out his predecessor George Gascón's request that a resentencing for the brothers be considered.

The brothers were not allowed to use their 'imperfect' self-defense argument in their second joint trial, or any evidence that they'd been abused sexually and emotionally by José Menendez for most of their lives. Recent compelling evidence that indicated the brothers were telling the truth about the abuse they suffered has caused a sea change in how their extended family and the public at large view the case.
Hochman, who said he spent a great deal of time poring over the case since taking office last year, is not one of those compelled by the new evidence and has stated that the brothers can not be released until they admit their motivation was greed, not self-preservation. His office's assessment points to 16 'unacknowledged' lies that they say the brothers have told about the murders; Hochman has shown a staunch refusal to acknowledge any form of abuse was talking place in the Menendez home and like the prosecutors in their second trial, views the murders as a cold-blooded money grab from the boys from a wealthy family.
Because Hochman does not consider the new evidence in the case valid, he refuses to consider resentencing for the brothers; he believes that they have not 'accepted complete responsibility for their actions.' This and other factors are why, in a recent court filing, the Menendez brothers' attorneys wrote, 'absent recusal, a conflict of interest would render it likely that the defendants will receive neither a fair hearing nor fair treatment through all related proceedings.'
Defense attorney Mark Geragos has also said a prosecutor in the case violated Marsy's Law by showing a crime scene photo during a hearing. The shock of seeing this sent one of the Menendez brothers' relatives to the hospital from the courthouse hearing last month. There's also the removal, by Hochman as he overtook the L.A. D.A.'s office, of two prosecutors who worked under Gascón on the Menendez case and supported their resentencing. Both are suing D.A. Hochman after they were quickly moved out of the department where they looked at cases for potential resentencing, saying they were demoted in retaliation for their support of the Menendez resentencing bid. In addition, Hochman has hired an attorney who had represented a Menendez family member who opposed their resentencing.
Erik and Lyle Menendez are serving life prison sentences without the possibility of parole for the Aug. 20, 1989, shotgun killings of their parents, José and Mary Louise 'Kitty' Menendez. White their claims of abuse and threats to their lives from their parents were it to be revealed led to the killings were not admitted in their second joint trial, a letter Erik wrote to his late cousin surfaced decades later that confirmed the abuse and around the same time, a former member of the Puerto Rican boy band Menudo came forward to claim he was also abused by the Menendez patriarch, who had led RCA Records in the 1980s and signed the group to a $30 million deal.
'Erik and Lyle Menendez are entitled to a fair resentencing process,' the brothers' attorneys wrote in their motion to see Hochman removed from the case. 'José and Kitty Menendez's family members — regardless of what position they take as to resentencing — are all entitled to a fair sentencing process. The public is entitled to a process that appears fair.'
The D.A.'s office has refuted the attorneys' claims of bias, writing, 'Other than the fact that they do not agree with, or like, the current legal position of the District Attorney's Office, the defense has completely failed to articulate any legitimate conflict of interest which would create a likelihood that the defendants would be treated unfairly.'
The California Attorney General's Office wrote in a filing this week that it agrees with Hochman's office and that the moving around of the two prosecutors and hiring the attorney who worked with a relative doesn't create a 'disabling conflict of interest.'
A statement from the Menendez family-led initiative focused squarely on the D.A, stating that recusal is 'about accountability and ensuring [District Attorney] Nathan Hochman's office stops crossing ethical lines and starts respecting our rights as victims under Marsy's Law.'
Also to be discussed Friday is the state parole boards' assessments of the Menendez brothers vis-a-vis their clemency request. Separate hearings will be held on June 13 for the brothers, and then the reports will be sent to California Gov. Gavin Newsom for a possible clemency decision from the term-limited state leader. Newsom has signaled that he supports the brothers regaining their freedom but has been meticulous and by-the-book in moving forward the process at the state level.

A nine-part series which sees the grouchy Detective Carl Morck (Matthew Goode) assigned to a police department in Edinburgh, where he is tasked with the assignment of solving the cryptic disappearance of prosecutor Merritt Lingard (Chloe Pirrie) who has been missing for four years. Created by American screenwriter, director and producer Scott Frank (Godless, The Queen's Gambit), the series is based on the book series by Danish writer Jussi Adler-Olsen. If like us, you've finished the series already and are keen to know more about the series' potential return for season two, keep on reading below. FIND OUT MORE ON ELLE COLLECTIVE While season two of the series is still yet to be confirmed, a number of the show's cast members have expressed that they'd be more than on board for returning for another round of Dept. Q, which of course, is always a promising sign. In a recent interview with The Hollywood Reporter, Goode revealed wasted no time sharing his thoughts, 'It's begging for it,' he said, of the series' potential return. Elsewhere, he told Yahoo that there is hope of a second season. 'I was saying to Scott [Frank] the other day, what we really need to do is a season two, and we need to get Alexej into eight weeks of Krav Magar training so the fight scenes in season two can be amazing. It's going to be a sort of Syrian Bourne.' Meanwhile, Frank told the BBC that while the previous seasons that he has worked on were 'meant to be one and done,' Dept. Q has the potential for more. 'There was no more to say but I'd love to do more with this and the next book in the series is even more interesting and relevant.' At the beginning of the season, we see Carl and his former partner James involved in an on-duty shoot-out, which ends in a young police constable dying, his partner paralysed, and Carl scarred for the foreseeable. We have not yet seen who shot Carl but is quite possible that it could be revealed in season two to give more context to his trauma. After Carl saves Merritt's life, the two are unable to properly meet due to Merritt barely being conscious after the ordeal. When she wakes up, she asks to meet Carl to thank him, however, she is told that he is taking time off of work. The two do end up meeting - but not realising who the other is - when they bump into one another by an elevator. Carl does not reveal his identity to Merritt, so she does not realise the significance of their brief encounter. As the series has not been confirmed and Scott has provided little information it's hard to say. However, if he plans on following on with the sequence of the Adler-Olsen's books, the second season would be centred around the second book, The Absent One (the first being Mercy). This would see Carl go on to solve yet another case, whereby he is tasked with solving the double murder of a brother and sister, which occurred two decades ago. While one of the suspects is already in prison for the crime, Carl is not convinced that the case has been adequately settled. Harvey Weinstein will not testify as part of his criminal trial, though the former mogul wanted to take the stand. On May 29, Arthur Aidala, Weinstein's attorney, told reporters Weinstein was 'seriously contemplating' taking that stand, but that his team would make a 'game-time decision.' The team confirmed Monday that he would not take the stand, as it opens up Weinstein to undue risk, but said that Weinstein had still wanted to share his side of the story. Jurors will then get the case. The court is not in session Monday. Weinstein is being retried on a criminal sexual charge and a rape charge related to respective claims from a former production assistant on Project Runway, Miriam Haley, who alleges he forced oral sex on her at his Manhattan apartment in 2006, as well as from aspiring actress Jessica Mann, who alleges she was raped by Weinstein in 2013 in a Manhattan hotel. Those charges were part of the 2020 trial, but Weinstein's conviction was overturned in April 2024. Former model Kaja Sokola is the new accuser to this trial and has alleged Weinstein forcibly had oral sex with her in a hotel in 2006. The back-and-forth about Weinstein testifying mirrors the events of his 2020 trial. Talent agent and manager Thomas Richards Lozano was called as the last witness by the defense Friday, in a repeat of the previous New York trial, when Lozano was also called as the last witness by the defense, according to news reports from that time. Weinstein testifying was also a question at that time, but he did not take the stand then. Lozano gave similar testimony to 2020, saying that he had traveled to New York with Jessica Mann, a friend, at the time of the alleged rape, in March 2013, and that he had breakfast with Mann and Weinstein in the DoubleTree Hotel in Manhattan immediately after the alleged rape is said to have occurred. He called the breakfast 'a friendly conversation' and said he did not notice anything amiss. Several of the events of this trial have been a repeat of 2020, sometimes word-for-word. Earlier in the day Friday, two court reporters read out loud the transcript of Talita Maia's testimony from when she took the stand on Feb. 10, 2020, as Judge Curtis Farber said Maia was located outside the state and could not be brought before the court this time. In the testimony, Maia, a friend of Mann's, had testified to initially meeting Weinstein with Mann in 2013 and then attending pre-Oscars and Oscars parties with her and observing as they kept in touch. 'She seemed to really like him as a person,' the testimony read. One court reporter acted as Maia while another acted as the defense attorney and then the prosecutor on cross-examination. King of the Hill voice actor Jonathon Joss has died after a shooting outside his home in Texas at age 59, the San Antonio Police Department has confirmed to The Hollywood Reporter. According to a police report, officers at the SAPD were called to a home at 200 Dorsey Drive in San Antonio at just after 7 p.m. on Sunday evening to respond to an apparent shooting. 'Once the officers arrived at the location, the victim was found near the roadway of the location. The officers attempted life saving measures until EMS arrived. EMS pronounced the victim deceased,' the report said of Joss dying from injuries sustained after multiple gun shots. Tragically, 3 of Jonathan's dogs also perished in the blaze, adding immeasurable emotional pain to an already heartbreaking situation,' the fundraising page states.
