Siti Bainun seeks to adduce new evidence, call Zayn Rayyan's mother as witness

PUTRAJAYA: The Court of Appeal was informed that the defence intends to call Ismanira Abdul Manaf, mother of Zayn Rayyan Abdul Matin, to testify regarding a police report she lodged implicating a prosecution witness in the case involving Rumah Bonda founder, Siti Bainun Ahd Razali.
Siti Bainun's counsel, Haijan Omar, on Monday (May 19) advised the three-judge panel, comprising Justices Datuk Azman Abdullah, Datuk Azmi Ariffin, and Datuk Dr. Choo Kah Sing, that the defence filed a notice of motion on May 7 seeking to admit new evidence in his client's final appeal.
"At the same time, the appellant seeks leave to call Ismanira to testify about the police report dated July 25, 2024.
"The appellant also seeks permission to recall the prosecution's fifth witness (PW5), Yasmin Nahar Mahmood, for further examination about this report,' he submitted during the appeal against the 12-year sentence imposed on Siti Bainun, 33, for neglect and abuse of a teenage girl with Down syndrome known as Bella.
Ismanira and her husband, Zaim Ikhwan Zahari, are currently standing trial in the Petaling Jaya Sessions Court on charges of neglecting their autistic son, with the ruling scheduled for July 21.
Deputy Public Prosecutor Datin Asmah Musa confirmed that the prosecution had received the notice of motion, following which the Court fixed June 3 for case management to set the hearing date for both the notice of motion and Siti Bainun's appeal.
In her supporting affidavit, Siti Bainun asserted that the fresh evidence had not arisen during the trial and is relevant to the grounds of her appeal.
On May 3, 2023, the Sessions Court sentenced Siti Bainun to 12 years imprisonment after finding her guilty on two charges of neglecting and abusing a 13-year-old girl with Down syndrome, Bella, ordering the sentence to be served immediately, rejecting her application for a stay of execution.
She was subsequently committed to Kajang Prison to begin serving her sentence.
The Court also ordered her to execute a five-year good behaviour bond with one surety and RM5,000 deposit, as well as perform 200 hours of community service within six months of completing her custodial sentence.
Her conviction and sentence were upheld by the High Court on May 2, 2024.
Siti Bainun was charged with neglect and abuse causing physical and emotional injury to the victim at a condominium unit in Wangsa Maju between February and June 2021, under Section 31(1)(a) of the Child Act 2001, which carries a maximum sentence of 20 years imprisonment, a fine of RM50,000, or both.- Bernama

MACC chief commissioner Tan Sri Azam Baki confirmed that the Tan Sri, who is believed to be a highway concession holder, had yet to give his statement due to recent medical treatment at a private hospital. 'A statement has not yet been recorded from the Tan Sri, but I have been informed that doctors have recently allowed him to be discharged. My officers will be con­tacting him soon to arrange an appointment,' Azam told Astro Awani when contacted on Satur­day. He added that while the indivi­dual is a key witness in the case, MACC has already recorded statements from 45 other witnesses, some of whom have been recalled to assist further in the investigation. 'He is indeed one of the indivi­duals we have yet to question, but we already have testimonies from other witnesses. I cannot confirm whether additional witnesses will be required after his statement,' Azam said. According to sources, MACC had earlier obtained medical confirmation from the treating doctor regarding the Tan Sri's condition before proceeding to plan for his interview. The investigation centres around the suspected misappropriation of sukuk bonds intended for the construction of a highway. On June 3 last year, MACC disclosed that it had seized assets valued about RM143mil from the individual as part of the probe. They included luxury vehicles and properties owned by the Tan Sri, both locally and abroad, inclu­ding in London and Switzerland. The seized assets comprised 14 personal bank accounts with RM4.5mil, eight company accounts with RM33mil, a luxury condominium and a parcel of land valued at RM24.5mil, nine luxury cars worth RM7.65mil, designer watches valu­ed at around RM25mil, handbags worth RM3mil, jewellery and diamonds estimated at RM6mil and four horses valued at RM400,000. Other seized items included high-­end alcoholic beverages worth RM3mil, foreign assets estimated at over RM15mil and gambling-related activities involving about RM20mil. A notice to declare assets has already been issued to the Tan Sri and related parties.

RANAU (June 11): A civil servant in her 30s lost RM13,000 after falling victim to a phone scam involving individuals posing as a police officer and a representative from the Ministry of Communications and Digital. Ranau district police chief Superintendent Mursalin Mahmud said the victim received a phone call from an unknown number on May 27. The caller claimed to be from the ministry and alleged that the victim's phone number was being used to spread fake messages related to investments, job offers and gambling. The call was then redirected to another individual who claimed to be a police officer from the Perak Police Contingent Headquarters (IPK). On May 29, the victim was instructed to transfer RM13,000 into an account under the name Muhammad Azlan, allegedly for the purpose of 'account protection.' 'The scammers also demanded that the victim send photos and personal information every three hours as a form of self-reporting,' Mursalin said. After realising she had been scammed, the victim lodged a police report at the Ranau police station on June 10. The case is being investigated under Section 420 of the Penal Code for fraud. 'I urge the public not to panic if they receive suspicious calls from individuals claiming to be police officers or representatives of government agencies,' Mursalin advised. 'Do not disclose personal information such as bank account details or identification documents, and never carry out financial transactions based solely on phone instructions.' He also reminded the public to verify any such calls with the nearest police station or district police headquarters and remain alert to the tactics used by fraud syndicates to avoid becoming victims.

KOTA KINABALU: Four suspects have been charged at the Sessions Courts here for allegedly allowing their bank accounts to be used for scams and non-existent investment schemes. Their actions allegedly caused a childcare centre owner in Penampang over RM2mil in losses from transactions made in 2024, the court heard on Wednesday (June 11). No pleas were recorded from the four accused: Vincent Chia, 20; Maggie Neoh, 39; Wilson Anak Penchen, 40; and Nurul Mazidah Badrol Hisham, 34. Their charges were read before Sessions Court judges Marlina Ibrahim, Hurman Hussain, Amir Shah Amir Hassan and Elsie Primus. According to the facts of charge, Chia was involved directly in transactions amounting to RM135,000 in his personal account between Dec 10 and Dec 18, last year. Neoh was accused of committing the same offence where she allegedly received RM39,000 on Dec 14, while Wilson received RM111, 668 from Dec 25 up to Jan 7, this year, and Nurul RM19,000 on Dec 17. They were all charged under Section 424C (1) of the Penal Code for engaging in transactions using one's own payment instrument or financial account without lawful purpose. If convicted, they could be jailed between three and 10 years and fined at least RM10,000 or up to RM150,000, or both. The court set July 10 for case mention for Chia, July 8 for Neoh and July 10 and July 31 for Wilson and Nurul, respectively. Earlier, the court heard that the victim lost over RM2mil after joining an investment scheme which she saw on a Facebook advertisement on Nov 26, 2024. She had contacted the representative of the so-called investment company and was attracted to the scheme. She made her payments and topped up her investments in a total of 53 transactions totalling more than RM2.17mil throughout her involvement in the scheme. She received RM6,600, a cellphone and several gold plates weighing 15g and 50gr as investment returns. The woman realised she had been scammed when her requests to withdraw a large amount of her 'profit' were denied, while she was compelled to top up her investments multiple times if she wished to withdraw. Police are still pursuing other members of the syndicate involved in similar scams.
