
Intimidating laws will be used against political rivals despite SC ruling
Slamming the authorities of gross misuse of state laws like the UP Gangsters and Anti-Social Activities (Prevention) Act, 1986, a Supreme Court bench, comprising Justices Vikram Nath and Sandeep Mehta, has made it clear that the Act was not an instrument to target individuals, who are guilty of involvement in a single incident of anti-social activity. While warning governments against invoking such stringent laws as a tool of harassment or intimidation, the bench asserted that it was tantamount to extreme abuse of the governing laws when such an Act is used as a means of oppression, especially when political motivations are suspected. In a veiled attack, the apex court has sent across a message loud and clear that they cannot be used to settle political scores. By definition, the Uttar Pradesh Gangsters and Anti-Social Activities (Prevention) Act, 1986, is designed to prevent and combat gangsters and related anti-social activities. It defines 'gangster' and provides for the punishment of individuals involved in organized crime, including imprisonment and fines, especially if the offence is committed against a public servant but not for staging demonstrations, when used as an expression of right to expression that had no other ulterior motives.
Mere involvement in a demonstration or protest after a communal clash cannot be reason enough to invoke the provisions of the Gangster Act, was made clear by the Supreme Court. Putting to rest many self-satisfactory interpretations about the provisions of the Act, most of which were invoked for serving political interests in violation of the law, the apex court drove home the point that the constitutional guarantee of personal liberty acquires greater emphasis when extraordinary legislation with stringent provisions, such as the UP
Gangsters Act, is invoked. In unequivocal terms, it stated, 'When a statute creates serious fetters on personal liberty, the evidentiary foundation for its invocation must be commensurately strong, supported by concrete, verifiable facts rather than vague assertions.' This, in essence, implies that the Act cannot be invoked to stifle voices and silence dissent. Quashing an FIR lodged on April 30, 2023 against an 'organised gang', based on a social media post that cried foul of a particular religion, which led to violent protests 'involving' the appellants Lal Mohd and others, the court maintained that the complaint provided no evidence to substantiate systematic planning or coordinated criminal activities against the group.
It discarded the FIR on the grounds that it was a conjectural statement by the complainant and one that was not corroborated with facts to establish 'provocative' motivations of those named in the FIR or to establish that it was a premeditated gang activity meant to create serious law and order disturbances. On their part, the appellants held that the allegations do not meet the threshold to justify invoking the UP Gangsters Act. The Supreme Court said that the accused were arrested and booked under provisions of IPC for vandalising a shop and wondered the need for lodging a second FIR by invoking Gangsters Act six months after the incident. However, the ground reality is that for decades together, many state governments have taken undue advantage of the loopholes that exist in certain laws as a means to harass political antagonists and their supporters. It is even more tragic that they get away even without coming up with any concrete proof to justify such acts of victimisation. Police and law and order are, after all, state subjects and hence none dares to beard the lion.

Sonepat DC's personal assistant held in graft case

The ACB has registered a case against the accused under various sections of the Prevention of Corruption (PC) Act. 'We have received a complaint from a clerk, who was recently transferred to ADC office that Shashank, who is personal assistant to Sonepat deputy commissioner had sought ₹ 5 lakh from him in lieu of transfer from ADC office to Rai Tehsil as revenue clerk when he met him to transfer him from ADC office. He had already paid ₹ 1.5 lakh in advance and now demanded ₹ 3.5 lakh to ensure his transfer. Even, the accused claimed that he had talked to the deputy commissioner for the transfer,' the spokesperson added. The ACB has registered a case against the accused under various sections of the Prevention of Corruption (PC) Act.

High Court notice to Goa govt over fees waved for land zone corrections
The High Court of Bombay at Goa Thursday issued notice to the state government, Secretary Town and Country Planning department, Town and Country Planning Department, Directorate of Vigilance and former chief town planner in a petition seeking directions to the authorities to recover the fees allegedly 'illegally waived' under a contentious provision of the Goa Town and Country Planning (TCP) Act. According to the petitioner, activist Swapnesh Sherlekar, the fees for correction of certain land zones was illegally waived under section 17 (2) of the Goa Town and Country Planning (TCP) Act on the 'specious' ground that 'deletion of proposed road fee is not applicable'. The section 17(2), which was introduced through an amendment to the TCP Act and notified in 2023, allows the conversion of privately owned plots in Goa's Regional Plan 2021, based on individual applications from such parties to 'correct inadvertent errors' and 'rectify inconsistent or incoherent zoning'. The government notified the fees for correction of zones under section 17 (2) of the Act on March 16, 2023. Subsequently, the revised fee for zone changes was notified through the supplement official gazette on March 28 last year. The HC read down the section in March this year. The petition states in the list of cases considered for correction of zone under section 17 (2) of the Act, several entries contained a notation 'deletion of proposed road fee not applicable' without any statutory basis for such exemption. The petition stated that among such cases were properties belonging to TCP Minister Vishwajit Rane, who is also a respondent in the petition, alleging that he 'benefited from an unauthorized exemption of fees'. The petition said there are 'numerous' cases of deletion of proposed roads since the Act was notified, which require scrutiny for similar unauthorised exemptions. It further said that there is no provision in the TCP Act or any rules, regulations or notifications thereunder that provide exemption of fees for deletion of proposed roads under section 17 (2) of the Act. The petition said the respondent authorities have acted with 'manifest arbitrariness, mala fide and abuse of power in exempting certain applications from payment of statutory fees without any legal basis or justification.' The petition further claimed that the respondent authorities have failed to discharge their duties in accordance with law and have instead acted in a manner that suggests collusion to confer undue benefit on certain individuals at the expense of the public exchequer. On Thursday, the High Court heard the submissions of the petitioners. In the order, the court said: 'At this stage, we deem it appropriate to issue notice to respondent 1 to 4 as well as respondent 6 in the capacity of chief town planner (planning)…' The Court also directed the respondents to file an affidavit in response within three weeks. The court said it has 'noted the specific pleadings in the petition, which revolve around the properties' belonging to Rane, but did not issue a notice to him.

'Around a week ago, my daughter, who was suffering from continuous fever, told me these men—all of whom worked nearby and frequented our home—assaulted her more than five times while I was at work and her eight-year-old sister was playing outside,' the distraught father said. 'They tied her hands, taped her mouth, and threatened her into silence,' the father added. The single father, separated from his wife for five years, said he was shattered. 'I never imagined my own friends could do this. People say gated societies are safe, but where does that leave poor families like ours?' Noida deputy commissioner of police Yamuna Prasad confirmed that police have recorded statements from all family members, including the victim's younger sister. No evidence so far suggests the eight-year-old was targeted. 'So far, nothing suspicious involving the younger child has come to fore. We're investigating the matter and will act stringently if any additional offences surface,' Prasad said. The three accused—a 35-year-old from Sector 123 who irons clothes, a 50-year-old security guard who lives in Sector 48, and a 55-year-old from Harola who is a driver—were arrested Wednesday after doctors at Sector 30 hospital alerted police that the girl's medical examination revealed evidence of sexual assault. Later, police recorded the statements of the minor before the magistrate and registered a case under Bharatiya Nyaya Sanhita (BNS) sections 137(2) for kidnapping, 74 for assault or criminal force to a woman with intent to outrage her modesty, and 65 for rape, along with relevant sections of the Protection of Children from Sexual Offences (Pocso) Act. .
