DVA and MoT equipment company 'terminate contract by mutual consent'

Concerns have been raised that the new Hydebank MoT centre, which was initially due to open in 2022, is unlikely to be operational before 2026.
UTV can exclusively reveal that the Driver and Vehicle Agency (DVA) has reached agreement with the vehicle testing equipment company that was due to kit out the site to 'terminate its contract by mutual consent'.
Worldwide Environmental Products Inc (WEP), a US-based company with strong European ties, entered a legal dispute with the DVA in late 2024 after it had received a notice of termination with immediate effect.

The DVA told UTV that a new procurement process is under way and it hopes to 'be in a position to award the new contract later this year'.

She said: "The legal process is now over and there has been some agreement reached however what that will mean in practice still has to be realised.
"Whenever you look at procurement, whenever you look at tender processes, that takes time.
"Realistically, we are looking at a further delay in terms of the test centre being open.
"We are potentially looking now at 2026, but again that detail has to come forward from the Department."
There are currently 15 MoT vehicle test centres across Northern Ireland. Two more centres are in the pipeline - Hydebank and Mallusk. Both have faced numerous delays.
Once the new centres are open, it's expected that they will increase capacity within the MoT system to offer around 200,000 extra vehicle tests each year.
Hydebank MoT centre was granted planning permission back in 2019.
In the same year WEP Inc secured a contract to supply and install vehicle testing equipment with the DVA.
In February 2022, the DVA attempted to end that contract however the company successfully challenged the move in court.
A second attempt to end the contract came on 9 October 2024 when the DVA issued WEP Inc with a notice of termination with immediate effect.
The then Infrastructure Minister, John O'Dowd, informed his department's scrutiny committee of the move through a written briefing paper in which he accused WEP Inc of 'failing to properly install and commission the equipment in accordance with the contract' - something which the company strenuously refutes and denies.
After receiving the notice of termination, WEP once again launched legal proceedings against the DVA.
UTV can reveal that the DVA has confirmed that both parties have now agreed to 'terminate the contract by mutual consent'.
In a statement, the DVA added: 'An open procurement competition for a new Vehicle Testing Solution has been advertised and it is estimated the DVA will be in a position to award the new contract later this year.'
UTV asked the DVA what, if any, financial agreement had been reached with WEP Inc in the termination process. The DVA did not respond.
UTV has also contacted WEP for comment.
While work is ongoing to open the new test centres, the DVA has reduced the backlog in MoT testing from around 100 days to around 30 days.
It's achieved this in a number of ways, including employing more staff and offering tests on Sundays and Bank Holidays.
The biggest mitigation, however, has been the DVA's removal of around 10% of cars from the system through the introduction of one year Temporary Exemption Certificates (TECs) for cars aged 5 and 7.
A move which has in part enabled the DVA to achieve record breaking testing rates according to the latest data.
The Department for Infrastructure recently held a 12-week consultation on the possibility of introducing biennial testing which closed on 16 April 2025.

A dry airway produces thicker mucus, which can trap allergens and irritants close to sensitive tissue. Over time, this may trigger coughing, a scratchy voice, or clogged sinuses that linger through the day' (Picture: Getty) He added that the airflow from the fan could stir up dust from bedding and flooring, and these particles of lint, dander and pollen could reach deeper into your airway as you sleep. People who also have asthma or mild allergies may find themselves with extra chest tightness or sneezing after having the fan on (Picture: Getty) But it's not only your sinuses that could be affected. Dr Ali explains that your muscles exposed to cool air for seven or eight hours can cause a drop in temperature in your tissues, which can lead to stiff neck and aching shoulders upon waking. Dr Ali suggested that if running a fan is the only solution for sleeping comfortably then you should try having it on a timer. He recommends to set the timer to last the first sleep cycle which is 90 minutes, so that it switches off after you fall asleep (Picture: Getty) He suggests that you should direct the airflow toward the opposite wall instead of it being aimed straight towards the bed. You should also have a glass of water beside the bed in case your mouth goes dry. He said: 'Replacing bedroom filters and washing sheets weekly will reduce airborne dust. QMU's Autism&Uni Toolkit offers guidance and practical tools to support autistic students before, during, and after their transition into university life, helping to break down barriers and promote confidence, independence, and academic success. The resource is also relevant for other neurodivergent students regardless of whether they have a formal diagnosis. Advertisement Hide Ad Advertisement Hide Ad Developed as part of the European-funded Autism&Uni initiative which aims to improve educational opportunities for autistic people across Europe, QMU is one of the first universities in Scotland to officially launch the toolkit as part of its widening access ambitions. Disability Services at QMU QMU's new site will include: Testimonials from autistic students sharing their experiences; Insights from university staff, including autistic staff members; Campus information including visual guides to help students familiarise themselves with the building layout; Approaches to help handle stress and maintain wellbeing; Guidance on academic expectations and resources, and strategies for adapting to new routines and environments; An outline of QMU's policies that allow for adjustments to accommodate diverse learning needs, such as offering online teaching alternatives. Leading the development of QMU's Autism&Uni Toolkit is a small team representing people across the university. One team member, Dr Donald Maciver is a lecturer in occupational therapy at QMU and is passionate about this project and strongly believes in the neurodiversity paradigm. He said: "Too often, the university experience can be less positive for autistic students, due to the sensory environment, social expectations, and a lack of tailored support. The Autism&Uni Toolkit is one way of changing that. We hope it will increase awareness about autistic people in the university and will equip students and lecturers with practical strategies and help more autistic students succeed and stay in higher education. Autistic people are at the centre of the project and involved at every stage. The university invites educators, students and stakeholders to explore the toolkit and provide feedback to enhance its effectiveness for our community of students. She said: "I really wish this kind of toolkit had been around when I was studying at university. We are so grateful to them for giving their time, energy and expertise to help us develop these resources." A full, independent investigation into the killings of Palestinians attempting to collect food for their family, and accountability for their deaths, is essential. But no investigation is needed to establish that Israel is ultimately responsible, by starving people and then implementing a food-collection scheme that cannot solve the humanitarian crisis, and which is known to be dangerous. The US, which promoted that scheme, is complicit. Health officials in Gaza say that at least 27 people were killed by Israeli fire as they awaited food on Tuesday – the third such incident in three days. (The Israeli military said troops fired at people 'moving towards [them] … in a way that posed a threat'.) Officials previously said that Israeli forces killed more than 30 Palestinians on Sunday, and another three the following day; the military said they did not shoot civilians, but fired 'warning shots'. The Gaza Humanitarian Foundation (GHF) – the American private organisation running the scheme – suspended operations on Wednesday for 'update, organisation and efficiency improvement work'. No update can fix this: the food scheme itself is the problem. The UN and aid agencies feared that it breached international law and refused to work with the GHF; the founding director resigned, saying that GHF would not be able to deliver aid while adhering to humanitarian principles. Senior Israeli military officials reportedly raised concerns. Many people cannot reach the sites. Those who do face a greater risk of having meagre supplies snatched by other desperate people. Essential non-food goods such as medications are not included. The risk of shootings was clear: armed American contractors run the three sites and Israeli troops control the surrounding areas. Palestinians are forced to choose – risk their lives or watch their children starve. After 11 weeks of total siege, followed by a trickle of supplies, Gaza is the hungriest place on Earth, says the UN. It was never plausible that this scheme could feed it. It is a fig leaf for Israel's continued starvation of civilians, and helps displace them to an ever smaller area. The far-right minister Bezalel Smotrich has said that Gaza will be 'entirely destroyed' so that its population will 'leave in great numbers to third countries'. In short, ethnic cleansing. The use of food as a weapon comes in addition to strikes on schools being used as shelters, the destruction of hospitals and the killing of tens of thousands of civilians. Israel's war crimes have caused public support to plummet in western Europe and fall markedly in the US. Yet politicians are lagging. Sir Keir Starmer calls the situation 'intolerable', but until the UK acts decisively it is, in reality, tolerating it. The UK, France and Canada warned of 'concrete measures' and must follow through. The US could stop this conflict tomorrow, but the European Union, Israel's biggest trading partner, also has real power. It is now reviewing its trade agreement with Israel; it should suspend it. Improving aid is a necessary but not sufficient demand. The need is created by the war. The real solution is still a ceasefire and release of the hostages seized by Hamas on 7 October 2023. As Mirjana Spoljaric, president of the International Committee of the Red Cross, has warned, international law itself is being hollowed out – with profound implications for conflicts to come. As long as Israel enjoys impunity, more Palestinians die and human lives everywhere are cheapened. It must be held accountable.
