Kerala high court stresses need to ensure dignity and privacy of children in custody battle

Kochi: Children should be summoned to the court with great caution, and in such instances, every effort must be made to ensure they are treated with utmost dignity and privacy, and are not made to wait unnecessarily,

A bench of Justices Devan Ramachandran and M B Snehalatha made the ruling while considering a petition by the mother of a nine-year-old boy challenging a
family court order
, which altered its previous order and granted the custody of the child to his father. After being summoned, the boy showed extreme unwillingness to leave his mother, and he explained that he abhors going to the courts and further that he even 'hates' the court for having 'summoned' him again. Additionally, he stated that he feels dehumanised and stigmatised, being paraded in front of people as a virtual chattel in a dispute between his parents.
The bench directed that when it comes to the place of exchange of the child for interim or final custody, the use of court premises be avoided, unless exceptional reason is recorded; and a neutral place be thought of since this will, to a large extent, reduce the strain of the children and their fear, which they unfortunately endure on account of being forced to submit themselves to processes, over which they have no control on and which they did not seek.
The court further noted that the child appears to be more terrified and agonised, not on account of the proceedings between his parents, but because he has been caught in between and has been forced to appear in courts. The records of the boy reveal that he is suffering from 'attention-deficit/hyperactivity disorder' (ADHD), and that he is obtaining professional assistance for the same. In addition to this, the trauma and stigmatisation that he had to endure all these years have made his condition tenuous and very sad.

The bench additionally noted that it is a classic example of the harrowing and torturous trauma that a child suffers when his parents are litigating over his custody. "His tears that rolled down his cheeks; the call for deliverance which he made before us in his innocent tenor; and his remonstrance in being called into courts, to be dehumanised every time, surely, requires us to sit up and take notice," HC said. Subsequently, the bench quashed the impugned order of the family court, which altered its earlier directives.

1 2 3 Kolkata: Suspending a student before conviction for a crime is like holding him/her guilty and punishing him/her before any court pronounces it, the Calcutta High Court cited from a Rajasthan High Court judgement while allowing a Bengal medical student accused of impersonating in NEET UG 2024 to sit for a supplementary examination on June 9 and 10. A student of Raiganj Medical College in North Dinajpur was suspended based on National Medical Commission's direction of April 1, 2025. Justice Raja Basu Chowdhury clarified that the student's exam result cannot be published without the court's leave. The matter will be listed in July. The student was booked by Tilak Marg PS in New Delhi for allegedly appearing on behalf of another candidate in the NEET UG exam by impersonating the actual candidate on May 5, 2024. There was a mismatch found in the admit card as well. However, he was granted bail by the Additional Sessions Judge, New Delhi district on June 3, 2024. It was the student's case that he was meritorious and cracked NEET UG to get admitted to Raiganj Medical College. He passed the first year but got a backlog in the second year in pathology. The judge noted that a criminal proceeding may take years to complete. He cited the Rajasthan HC verdict wherein a few students were suspended by their college. They too were accused of impersonating others in an examination. In the judgement, it was highlighted that the Public Examinations (Prevention of Unfair Means) Act of 2024, which deals with malpractices in public examinations, though provides for punishment, does not contain any provision for suspension. Moreover, it was highlighted that suspension presupposes the initiation of an inquiry but in the case of impersonation done outside the college where the accused is studying, no inquiry is possible as the matter is with the police and not the college. Hence, conducting an inquiry would essentially be a futile exercise. "Unless such a finding is recorded and petitioners are held guilty, their future cannot be kept in suspended animation for an indefinite period... " the Calcutta High Court cited from the Rajasthan HC judgment.

Patna: An irate mob blocked the road near Ajanta Cinema at Ramchandrapur locality under Laheri police station area in Nalanda on Sunday, following the recovery of the body of a 22-year-old-youth. He was missing from his home since Saturday evening, and his body was recovered later in the night from Shivaji Nagar locality. The family alleged that he was killed by his friends. The youth was working in a paint company in Hyderabad and had recently returned home on May 20, police said. According to the police, the deceased was identified as Deepu Kumar alias Lala, son of Vijay Kumar Sharma, a native of Nischalganj village under Parwalpur police station area. Vijay has been selling sweets in Biharsharif for the past 30 years. Deepu's mother, Manju Devi, said he brought home a cellphone on Saturday evening, which his friends asked him to sell for Rs 5,000. "I refused to accept the phone and asked him to return it. He left but came back shortly. While I was scolding him about the phone, his friends called him outside," she said. Doctors reported that a nine-year-old girl found dead in the Dayalpur area of northeast Delhi arrived at the hospital without a pulse or heartbeat. They noted that her clothes were soaked in blood, and she was bleeding profusely from her private parts. The victim was initially taken to Dr. Aleena Nursing Home by family members before being referred to a higher-level medical facility. Dr Aleena Saifi, who examined the child, stated, "Around 8:15 PM, some people brought the girl to our nursing home. Her pulse and heartbeat were absent. We checked her for about one to one-and-a-half minutes and found bleeding from her private parts. There were no other visible marks of injury on her body.
