Disposable vape ban and strict advertising rules begin - What you need to know

Here's what you need to know about changes to vape sales and advertising.
The distribution, manufacture, sale and supply of disposable vapes is being banned from Tuesday.
"We are getting rid of vapes that are most popular among young people, and that can only be positive," Associate Health Minister Casey Costello
said in announcing the changes last year
.
The
2023/24 NZ Health Survey
found 10.5 percent of people aged 15 to 17 vaped daily.
However, pod-style vaping devices will still be sold. They contain pre-filled pods which are swapped out to refill the vape.
Also as of Tuesday, vaping devices, products and packaging can no longer be displayed at general retailers. Specialist vape stores must not display products in any way that makes them visible from outside their place of business - that includes advertising, display in online stores and in vending machines.
There are also many new restrictions on advertising to promote or encourage the use of vaping products, including to existing customers. The new raft of advertising restrictions mean businesses could face a $2000 infringement fine.
For instance, the government says it would violate the new regulations if a shop is advertising or posting about vaping products on social media platforms such as Facebook, Instagram, Twitter or Google business listings.
"From the 17th June we will no longer be able to show images of the products," one online vape retailer says on its website.

Also as of Tuesday, vaping specialist retailers can no longer use various promotional techniques such as giving away free vaping products, discounts, offering rewards, cash rebates or gifts for the purchase of vaping products, or offer lotteries or games to people who buy vaping products.
Vape stores can no longer display their products in a way that's visible outside their business.

Yes, as part of the
series of changes to the Smokefree Environments and Regulated Products Act 1990
last year. The new changes are the second line of alterations which began coming into effect in December.
As of December, fines for selling to minors and publishing prohibited advertisements were increased, and new vape speciality stores were forbidden from opening within 100 metres of early childhood education centres. There were already
location restrictions
saying speciality vape stores had to be at least 300 metres from schools or marae.
In introducing the amendments to smoking regulations last year,
Associate Health Minister Casey Costello said
, "New Zealand was too slow to effectively regulate vaping, and youth vaping rates are too high".
"We have collectively agreed that, we have recognised that, and we know that we can do better. We have to stop young people from taking it up as a habit."
The ban on disposable vapes was put off for six months to allow retailers to prepare for the changes.
Jonathan Devery, chair of the Vaping Industry Association of New Zealand, said the group does support the disposable vapes ban, with a few caveats.
He said while VIANZ "supports the intent behind the policy - to reduce youth access and address the environmental impact of single-use products - the association is urging caution about the potential unintended consequences".
University of Otago public health professor Janet Hoek, a leading researcher into vaping, said whether or not the ban will make a difference will depend on enforcement and product innovation by the industry.
"I would expect [the ban] to reduce youth vaping given young people are very price sensitive," Hoek said. "However, if the industry responds, as I think it is likely to do, by introducing cheaper pod vapes, the impact will be much less limited than we might hope."
"They're not a straightforward replacement," Devery said. "There's a real risk that removing the most convenient smoking cessation option could drive consumers back to cigarettes."
Hoek said many manufacturers may look for loopholes they can exploit with bans.
"Disposable vapes are typically inexpensive [i.e., may cost less than $10 a device], so the vaping industry may respond by introducing new lower priced reusable vapes," Hoek said, saying she had seen pod starter kits - without pods, which cost extra - being advertised for under $10.
"We saw this behaviour among tobacco companies as they tried to undermine the impact of increased tobacco excise taxes [they 'shifted' the tax to higher priced brands, away from lower priced brands and introduced entirely new brands to create a new 'super value' partition within the market]."
Devery of VIANZ said it's possible some vape sales may just go underground.
"There are also serious concerns about enforcement," he said. "Early warnings from the UK, where a disposable vape ban came into effect on 1 June, suggest black market sales are likely to increase."
Hoek said there is a lot of concern that manufacturers may find ways around disposable bans - she pointed to 'Big Puff' high-capacity throwaway vapes that
have drawn concern in the UK with their own disposables ban.

"We have consistently called for a full ban on disposable vapes, rather than incremental technical fixes, and we welcome the environmental benefits it will bring," Devery said. "But the transition must be managed carefully to avoid driving consumers back to smoking or into unregulated markets."
The industry group feels that some of the advertising restrictions may ultimately harm consumers and make it harder for retailers to interact with them.
"Many retailers, especially online, have relied on clear product information and guidance to help adults make informed choices," Devery said. "New restrictions will limit what can be communicated, making it harder for consumers to understand available options or find support to switch."
"Retailers are still recovering from last year's rushed regulations that left them with unsellable stock and high compliance costs - from updating websites to in-store signage," he said.
Many retailers have discounted their products heavily before the bans take effect.
Hoek said she thought the new measures would help cut youth vaping, but more strategy was needed.
"There are many omissions from the measures (e.g., the high concentration of vape stores in lower income communities; the location of vape stores right next to schools). I would favour a more proactive strategy that reduced the appeal, availability, addictiveness and affordability of vaping products."
One of the key complaints about disposable vapes have been the waste they generate, Devery said.
"Removing disposables will help cut vape-related e-waste by over 80 percent according to our industry estimates, but more must be done," he said. "VIANZ recommends expanded take-back schemes like VapeCycle, producer-responsibility regulations, and better consumer education on safe disposal."
"I would favour a 'polluter pays' model, where vape companies are responsible for the costs their products create," Hoek said.
"Vape companies have been given clear rules to follow, and yet some are already looking for loopholes," Asthma and Respiratory Foundation chief executive Letitia Harding

Back in 2011, New Zealand's government
set the goal of a Smokefree New Zealand
by 2025. There have been
concerns that goal is falling short
, with particular worries about Māori and Pasifika smoking rates.
Costello has maintained the government's changes will continue work toward the target.
"We do not want our young people vaping," Costello said in Parliament. "We do not want them taking up this habit. We do not want them to be nicotine addicted. We also don't want anybody taking up tobacco and smoking."
The current
smokefree goal
aims to have less than 5 percent of the population smoking by December, but the latest data reveals there are still
about 300,000 daily smokers
- 6.9 percent of adults - across the country.
"VIANZ urges the government to closely monitor the ban's impact on smoking rates, particularly among priority groups, and ensure regulations don't inadvertently harm those most vulnerable," Deverey said.
"Vaping regulation must be viewed in the context of the devastating harm caused by smoking, which kills two out of every three users."
"Strong rules and environmental responsibility are essential, but the broader goal must remain to reduce smoking and improve public health outcomes."
Hoek said it's important vaping retailers were brought along on that goal.
"People who sell vaping products should be able to help people switch successfully from smoking to vaping," she said.
"We also need to let people know that, once they have switched completely to vaping and no longer think there's a risk they would return to smoking, they should stop vaping.
"That latter message isn't [for obvious reasons] communicated by vaping companies or retailers."

Luxon arrives in China intent on building on positives amid global conflicts

Photo: RNZ / Craig McCulloch [b Prime Minister Christopher Luxon has touched down in China early on Wednesday, kicking off his first visit there as prime minister - a trip analysts say will seek to consolidate the relationship rather than reinvigorate it. The RNZAF Boeing 757 arrived in Shanghai at about 3:30am (NZT) after departing Auckland's Whenuapai Airbase more than 20 hours earlier. Luxon will spend roughly two days in Shanghai, touting New Zealand's wares, and one in Beijing, holding high-level meetings with the Chinese administration. To aid him in those goals, the PM has brought with him Tourism Minister Louise Upston, Ethnic Communities Minister Mark Mitchell, and a team of officials and business leaders. Addressing the delegation before departure, Mitchell quipped it was like "getting the old band back together" after a trade mission to India in March. He said the China visit was important right now given the immense global uncertainty. "Probably never seen the amount of conflict that's going on… old alliances that are being challenged a bit," Mitchell said. "Hopefully, touch wood, the 757 gets us up there." Upston said New Zealand had a "long and deep relationship" with China but there was more to be done. "Particularly from a tourism and hospitality perspective, we're kind of lagging - so we've got a bit of serious heavy-lifting to do up there to make sure we can resurrect those very deep relationships and ensure the China market knows we're open for business." The 28-strong business delegation is chaired by Dame Therese Walsh, chair of Air New Zealand and ASB Bank. Among the companies represented are Fonterra, Zespri, A2 Milk, and Silver Fern Farms. Also of note are education providers Te Pūkenga, Victoria University of Wellington, and UP Education, as well as both Auckland and Christchurch airports. Photo: RNZ / Craig McCulloch In a sit-down interview with RNZ before departure, Luxon used a range of adjectives to describe the bilateral relationship: strong, mature, complex, considered, predictable. "It's an important relationship. We're being consistent and steady with it," he said. "We've got a good rapport with the leaders, and there's a lot more for us to build and develop within this relationship." Earlier this month, a group of former political leaders - including Helen Clark, Sir Geoffrey Palmer, Sir David Carter, and Don Brash - criticised the coalition's approach to China as being needlessly "adversarial" . But Luxon dismissed the warning as incorrect and "a bit simplistic". "We've been very consistent that where we have differences, we raise them, we do so publicly or privately, we call it out. And that's a sign of a good mature relationship." RNZ asked whether he would directly raise those differences, whether on human rights or militarisation in the Pacific, during his meetings this week with President Xi Jinping and Premier Li Qiang. "I don't talk about what I'm going to raise in those meetings in advance," Luxon said. "But suffice to say, I've been pretty consistent with how we how we run them." He encouraged RNZ to "maybe listen a little less to former politicians" and said he was "not at all" concerned about a potential relationship breakdown. "It is a more volatile world out there, and New Zealand can navigate those volatilities incredibly well," Luxon said. "Yes, that comes with some challenges from time to time, but I'm very confident we can do that." Contemporary China Research Centre director Jason Young said it was crucial for the government to get its messaging right on this trip: keeping the relationship "sustainable and stable" without raising expectations too much. "Often within China, things can't really sit still. They have to keep moving," Young said. "From a New Zealand end, it's more a question of demonstrating that the relationship is valuable and wanting to maintain the growth within that relationship at a sustainable level." Young, who is an associate professor of international relations at Victoria University of Wellington, said the relationship had become "more strained" given the shifting geo-strategic environment. He said there were plenty of differences that would have to be navigated: the recent Cook Islands deal, China's growing military power, and stability across the Taiwan Strait. "As with any great power - and particularly a great power with a very different political system, a different view of geopolitics and their role in the world - there are always potholes that New Zealand could fall into," Young said. "New Zealand is not immune from the broader geopolitical challenges, and navigating those challenges is going to be one of the hardest things that New Zealand does over the next couple of decades." Professor of political science at the University of Canterbury Anne-Marie Brady told RNZ Luxon would use the visit to highlight positive areas of cooperation to protect the trading relationship. But she expected Luxon would also voice his support for the "multilateral rules-based order" which was under threat from China. "Both President Xi and Premier Li have pleaded with New Zealand to return to the old rubric for NZ-China relations, which was the 'relationship of the first' where New Zealand was going to jump in on every initiative that China launched. "New Zealand doesn't use that language anymore. It uses the relationship of common points and difference."

Should Kiwis pay the high price for NZ dairy that overseas buyers will?

Photo: Margaret Jaszowska for Unsplash New Zealanders are paying high prices for milk, butter and cheese because of what people are willing to pay offshore, Fonterra's boss says - but is that fair? The most recent food price data showed milk prices were up 15.1 percent annually last month, to $4.57 per two litres, butter was up 51.2 percent annually to $8.42 per 500g and cheese was up 30.1 percent to $13.04 per kilogram. In May, Fonterra chief executive Miles Hurrell told RNZ prices were driven by global demand . "We're a collection of 8500 small farmers and our job is to deliver for each of them," Hurrell said. "The international market is pushing these prices very high at the moment and our job is to reflect that in the returns that we give back to our farmer owners." University of Auckland economics professor Robert MacCulloch said it was a surprising comment. "It raised my eyebrows. For a CEO to talk that way, I thought for want of a better word was dumb. "He's laying down what's known as the law of one price, or purchasing power parity. Similar goods are expected to be priced the same around the world. "He's saying that applies to dairy and we can sell it anywhere in the world so when the world price goes up, Kiwis pay more and that's the end of the story. "This is a nice theory, but it's not always true in practice. A lot of goods and services do sell for different pries [in different countries]. "He's saying we don't have any sense of social responsibility at Fonterra, which I thought was ill-judged - even though we're using farm land in the country and we've got the emissions and everything, we're ruthless profit maximisers, all we care about is maximising returns." He said BMW offered cheaper vehicles to Germans and a similar model could be used for dairy products in New Zealand. Child Poverty Action Group spokesperson Isaac Gunson said Finance Minister Nicola Wilis had referred in speeches to the fact that New Zealand fed 40 million people "with levels of efficiency and sustainability that are the envy of many". "At the same time, more than a quarter of our children experienced food insecurity in the year ended June 2024. While we feed the world, our child poverty rates are lagging behind many other countries, especially in Europe. "When milk powder sells high in Shanghai or Brussels, whānau in Aotearoa pay more for their Weet-Bix and milk - despite the fact we can grow all of the ingredients right here, and get them where they need to go.... It's a system that rewards exporters, but punishes households already doing it tough. "In a world worried about food security, it is New Zealand children who bear the brunt of that worry - and who are literally paying for it." But Gareth Kiernan, chief forecaster at Infometrics, said there were only two ways that goods could be sold for a lower price domestically than internationally: By regulating the price or paying subsidies to farmers to make up the difference. "On its own, this regulation would result in farmers making less product available to the domestic market, potentially leading to shortages. Therefore it is likely that the government would need to also mandate a minimum percentage of product to be sold domestically. "However, the lower overall return to farmers would be likely to lead to reduced production levels because squeezing out that last drop of milk would not be as profitable." He said it would also lead to lower GDP and lower incomes per capita for the country as a whole. Subsidies to farmers would need to be paid for somehow, so more tax would have to be collected. "If the revenue came from taxing higher-income households, then it is likely that some lower-income households would be better off, but higher-income households would be worse off despite their milk and butter being cheaper. "With any tax/welfare policy, there is some deadweight loss from the policy due to the administrative costs of government, as well as the less efficient allocation of resources. In this case, the less efficient allocation of resources comes from the consumer side, where people spend more than would be sensible on dairy products because they don't face the full costs." He compared it to metered or unmetered water. "If water is metered and people have to pay for their usage, then they will use it more carefully and efficiently, reducing demand and production costs. It means that local councils can then use some of the resources they would have needed to provide water to provide other goods and services instead. In the case of farmers with domestic subsidies, demand for their product would be overinflated, leading to too much of the economy's resources being devoted to farming, when there would be other more productive uses if people faced the full cost of their dairy products and therefore demanded less. Again, the outcome is lower GDP and lower incomes per capita for the country as a whole." He said there had been "egregious" examples of subsidisation in petrol prices in the Middle East. Iran, which sells petrol at about US36c a litre, had been dealing with fuel smuggling problems as people tried to get petrol out to neighbouring countries with more expensive prices. "The difficulty with these arguments is that people see the direct cost or benefit to them in terms of dairy prices, but they don't see the indirect costs of higher taxes and/or lower GDP per capita because the transmission paths are so long and opaque." Murat Ungor, a senior lecturer in the University of Otago department of economics, agreed if New Zealand detached itself from international pricing, it would undermine the incentive to efficiently produce and export and affect farmer incomes. "Typically, US butter comprises 80 percent butterfat, while European and New Zealand products offer a higher 82 percent content. This variance not only influences pricing structures but also shapes trade opportunities. European and Kiwi butter, with their richer content, cater more readily to international markets demanding premium quality. "Domestic consumers compete with international buyers, meaning local prices are influenced by global market rates rather than just local production costs. NZ dairy processors sell at international market rates, leaving little incentive to discount locally. Fonterra's dominance and supermarket duopoly reduce pressure to lower retail prices." Bay of Islands cruise ship numbers set to plummet

Photo: NZME The Bay of Islands $23.34 million cruise ship industry will be hit hard next season with the number of visiting ships set to plummet. Bookings for the tourist mecca's 2025/2026 cruise season have almost halved from the peak two years ago. A cruise ship representative blamed the decline on a number of factors affecting New Zealand's cruise industry, including tougher biofouling rules along with compounding cost increases from central government, ports and regional authorities. There are just 47 cruise ships scheduled to visit the Bay of Islands for the coming season. This compares with 92 cruise ships booked for the peak 2023/2024 season. The coming season's numbers have reinforced the annual bookings decline in the Bay of Islands since the peak. Bookings for the 2024/2025 season were almost 20 percent down on 2023/2024. Seventy-four ships were booked. New Zealand Cruise Association chairperson Tansy Tompkins said the drop in numbers had many in the industry deeply concerned about the future. "New Zealand's booking momentum, has slowed significantly, and while final itineraries are still being confirmed, current projections indicate a major downturn," Tompkins said. The decline from the peak was "sobering", Tompkins said. She said the forecast for the coming season put New Zealand back to 2017/2018 season levels. Tompkins said the risk of cruise ships being refused entry into New Zealand because of dirty hulls was one of several key reasons for the decline. The risk threatened New Zealand cruise ship destination brand. Tougher biofouling rules for visiting cruise ships came into force for the Bay of Islands and the rest of New Zealand in October 2023, just as the 2023/2024 season got underway. Eighty-seven cruise ships arrived in Bay of Islands' 2023/2024 season - meaning five vessels did not turn up. Four cruise ships did not turn up in the 2024/2025 season - including the last two for the season due on 30 May - due to weather, according to Far North Holdings chief operating officer Robert Binney. All cruise ships entering New Zealand must have no more than a thin layer of slime and goose barnacles on their hulls when they arrive. Biofouling can introduce foreign marine species. These can threaten the environment, economy, and cultural values. It happens when too much sea life - including foreign algae, barnacles and other marine growth and may include shrimps and crabs - builds up on ship hulls. Tompkins said unpredictability around the introduction of new regulations also contributed to the decline. Cruise companies had to deal with the outcome of this when passengers booked up to two years in advance. And New Zealand was now the world's most expensive place for cruise ships to visit with significant compounding cost increases including from central government, ports and regional authorities. This was putting New Zealand at a competitive disadvantage. She said senior cruise line executives had a perception New Zealand was difficult to operate in and an unwelcoming destination.
