Reiss sued last year, alleging Amazon's audiobooks unit Audible violated antitrust law by charging higher distribution fees for independent and self-published writers who decline to participate in a program that makes Amazon the exclusive distributor for books on Audible for 90 days. The program offers self-published authors 40% royalties for book distribution, compared with 25% for authors who chose non-exclusive, competitive distribution. Amazon and Audible did not immediately respond to requests for comment. Amazon has denied any wrongdoing, saying the audiobook market is 'healthy and competitive.' Steve Berman, a lead attorney for Reiss, on Wednesday said they welcomed Rochon's order and looked forward to the next phase of the litigation. Audible is the world's largest audiobook retailer, accounting for more than 60% of domestic purchasing compared with about 20% for Apple, according to the lawsuit. Amazon, in seeking dismissal of the lawsuit, said Reiss had shown no evidence that Audible's program had induced any authors to sign an exclusive deal. Amazon also told Rochon that it was lawful for the company to spend more resources promoting its exclusive content than on other titles. The lawsuit seeks more than $5 million in damages and class action status for thousands of authors. The case is CD Reiss v. Ulta Beauty is offering massive discounts at its soon-to-be closed store in Illinois. The retailer is set to close its Chicago store in the Roosevelt Collection Shops area on Saturday after 12 years. Because of this closure, shoppers are rushing to purchase select items available for up to 75 percent off. The beauty chain has not said why this location is closing, but the company has admitted to not being 'immune' to economic pressures. 'Value is an increasingly important priority as they navigate ongoing wallet pressures,' Ulta Beauty CEO Kecia Steelman said in a statement. Factors playing a part of these financial challenges include the growth of online shopping, same-day delivery expectations, and tariffs imposed by President Donald Trump. The chain is also facing heavy competition with retailers like Sephora and Bluemercury and e-commerce giants such as LovelySkin and Amazon. Despite the challenges, Ulta Beauty will continue operating over 1,450 locations worldwide after the store closure. 'We believe our model uniquely positions us to win, and we will continue to focus on serving our guests while staying agile as we move through the year.' Some of the new enhancements that are part of the plan include C-suite appointments and various digital and store upgrades. Ulta Beauty is planning to grow and has managed not to experience mass closures this year. However, some popular retailers weren't so lucky. Torrid recently announced its plan to shutter up to 180 stores following its latest sales decline. Pharmacies have also been suffering financial challenges. Rite Aid is planning to permanently close 111 stores after filing for bankruptcy for the second time. Customers have also gotten makeup and various beauty products from Forever 21, the now-defunct chain that shuttered all stores by last month. Other retailers offering beauty products while hanging on by a thread include Macy's, JCPenney, and Neiman Marcus.
