Lincolnton vape shop accused of illegal sales opened near school just before city changed rules
LINCOLNTON, N.C. (QUEEN CITY NEWS) — There has been a push in North Carolina municipalities, including Lincolnton, to put zoning restrictions in place which ban new vape shops from opening near schools.
Queen City News started looking into the zoning regulations after a manager of a vape shop that was the scene of an armed robbery and shooting earlier this month in Lincolnton was charged this week with felonies including selling drugs to underage students.
Dave's vape shop is right beside Lincolnton High School on North Aspen Street. According to Lincolnton's assistant city manager, the business was allowed to open there under the city permit it received in November 2023.

State Alcohol Law Enforcement agents say they started looking into Dave's because they say they got more and more complaints about vape products confiscated from underage students.
A couple of businesses and neighbors don't like the vape shop being so close to Lincolnton High School. A two-lane street is all that separates them.
Neighbors remember the chaos three weeks ago.
'I heard the four gunshots, I immediately knew they were gunshots, so I grabbed my daughter, and I ran to the room,' said a neighbor, who did not want to be identified.
The neighbor didn't know where the shots came from at first and feared it was a school shooting.
'I initially was pretty spooked because I live close to the high school, so I thought they could come here to hide,' said the neighbor.
Right beside Lincolnton High at Dave's, police say three suspects robbed the store and got into a shootout with a worker there.
'It's pretty upsetting, especially in town here, we don't have a lot of violence,' said another neighbor, Dave Binderup.
Three weeks later, ALE officials and the Lincolnton Police Department announced that they charged Omari Cole, the manager of Dave's, with 20 charges, including a dozen felonies.
ALE agents say they found some of the business's Delta 9 products contained more than 0.3% THC, making them illegal.
'I don't have a problem with someone doing their business, whatever their business is, as long as it isn't detrimental to the kids at the school,' said Binderup.
He says Lincoln County officials should consider doing what one other county in North Carolina, Wake County, has done. There they've banned new vape shops from opening within 1,000 feet of a school in the unincorporated parts of the county.
'Especially with the heightened awareness on shootings at schools, we just really don't need any of that, we don't need the threat, we don't need the opportunity for a threat,' said Binderup.
The assistant city manager for Lincolnton says when Dave's opened in 2023, the business was allowed to open up based on the zoning.
But just months later, on Jan. 4 of this year, a new city zoning amendment was passed that bars new vape shops to open within 500 feet of a school.

Assistant City Manager Scott Clark sent Queen City News the following information on the requirements of the zoning amendment:
Smoke shop with the following prescribed standards:
1. Shall not be located within 500 feet of any K-12 public school or licensed child care facility;
2. Shall not be located within 1,000 feet of any other smoke shop;
3. Separation is required to prevent overconcentration, which is defined as three or more of these uses existing within a 1,000-foot radius of the business. Required separation distance shall be measured as a radius from the front door of one business to the front door of the surrounding business located within or outside the city's corporate limits; and
4. Must meet all sign regulations in the udo including but not limited to: (a) flashing signs or any signs with flashing or intermittent light or lights or reflective devices of changing degree of intensity or color are prohibited; or (b) a maximum of 10% of the wall area of any wall on the building.

16-year-old charged in connection to stolen vehicles in Rowan County
ROWAN COUNTY, N.C. (QUEEN CITY NEWS) — A 16-year-old has been charged after allegedly stealing multiple vehicles and injuring a deputy's patrol vehicle during a chase, according to the Rowan County Sheriff's Office. Around 12:15 a.m. on Tuesday, June 10, deputies were looking for a stolen Kia near East Ritchie Road after the car's owner said there was a tracking device on it and it showed to be in that area. Deputies were able to find the stolen Kia in a wooded area off the dead end of East Ritchie Road, along with two other Kias that were reportedly stolen. While processing the scene of those vehicles, deputies got a call about a blue Kia that ran a woman off the road in the direction of East Ritchie Rd. Earlier, deputies learned from officers in Salisbury that there was a stolen blue Kia that had yet to be found, officials said. Deputies saw the blue Kia pull up to the area with two juveniles inside. When the suspects saw the deputies, the driver quickly turned, crossing over a ditch, and almost hit the tow truck on the scene. Driver arrested after crash injures 3 children at lemonade stand in Burke County A pursuit began, and the suspects led officers on Old Concord Road towards Cabarrus County at speeds of 70-100 mph. Deputies tried multiple times to end the pursuit by executing a PIT maneuver (aka the Precision Immobilization Technique), but failed because the driver served and hit the deputy's patrol vehicle. A PIT maneuver was finally successful, ending the pursuit in Cabarrus County at the intersection of Old Concord Road and Irish Potato Road. The deputy's vehicle was damaged during the pursuit after a tire came off the suspect's vehicle. The two juveniles were the only ones in the vehicle and were taken into custody. Neither was injured; however, the passenger agreed to be taken to a hospital to get checked out. Deputies were denied a secure custody order when they asked the Department of Juvenile Justice about one for felony fleeing to elude arrest, and assault with a deadly weapon on law enforcement. According to the sheriff's office, due to the fact that the secure custody order was denied, and in the State of North Carolina, certain chapter 20, motor vehicle laws are not subject to Raise the Age and are handled in adult court. The 16-year-old driver was charged with felony flee to elude arrest and booked in a juvenile detention facility under a $50,000.00 bond. Authorities said the case is still under investigation and more charges are likely to be filed with juvenile court authorities. Driver arrested after crash injures 3 children at lemonade stand in Burke County
BURKE COUNTY, N.C. (QUEEN CITY NEWS) — A 24-year-old woman has been charged after a crash sent a vehicle off the road and into three young girls who were running a lemonade stand. The accident happened around 1:20 p.m. Tuesday, June 10, on Conley Road near Arthur Mull Road, just south of Morganton. According to the NC State Highway Patrol, Haley Erin McCorkle, of Hickory, was trying to turn left out of a driveway in a Chevrolet HHR when she pulled into the path of an oncoming Nissan Altima. The impact pushed the Nissan off the road and into a front yard, right where three girls, ages 7, 8, and 9, had set up a lemonade stand for the afternoon. All three were critically injured and rushed to nearby hospitals. Two were airlifted; the third was taken by ambulance. 'I was scared': Family of Morganton girl hit by car, along with two others, recounts the tragic moment None of the drivers involved were hurt in the crash. McCorkle is now facing charges for failure to yield the right of way, causing serious bodily injury. Troopers said there's no indication that speed or impairment played a role in the crash. Family members of the injured girls said the crash happened in an instant. 'I was right there, and it just happened so fast,' said Elizabeth, the sister of one of the girls. 'I just ran and got my mom.' The girls' parents described the scene as terrifying and heartbreaking. One father said he was traumatized after seeing what happened to the children. 'I can't blame anyone for the accident. Accidents happen. But I was upset about it. I've just had to pray about it.' The road was closed for about two hours while troopers investigated.
