Iowa legislative session heads to overtime

Two major roadblocks remain before Iowa lawmakers can pass the state's budget and end the 2025 legislative session — pipelines and paraeducator pay, among a few other spending priorities.
Iowa lawmakers will not receive most session per-diem payments after Friday — a milestone meant to spur legislators to approve budget bills and end the session. While Republicans hold a trifecta of control at the Statehouse, there are still disagreements between the two chambers on funding and policy proposals. One of the major pieces of policy that remains up for discussion is the use of eminent domain in carbon sequestration pipeline projects.
On Wednesday, a group of 12 GOP senators sent a letter to Senate leadership demanding debate on House File 639, legislation passed by the House and approved through the Senate committee process.
'We believe addressing eminent domain is more important than the budget or any other priority for the 2025 session and pledge to vote against any remaining budget bill until a floor vote occurs on the clean HF639 bill,' the letter states.
Bills need a constitutional majority, at least 26 votes, in order to pass the Senate. If the 12 Republican senators who signed the letter and all 16 Democrats vote against a bill, the measure will fail.
The lawmakers who signed onto the letter were Sens. Kevin Alons, Doug Campbell, Rocky De Witt, Lynn Evans, Dennis Guth, Mark Lofgren, Mike Pike, Dave Rowley, Sandy Salmon, Dave Sires, Jeff Taylor and Cherielynn Westrich. These senators and others have spoken on the Senate floor about the need to pass a bill on eminent domain and pipelines during 'points of personal privilege' following debate in the past two weeks.
Sen. David Rowley, R-Spirit Lake, said Senate discussion on the use of eminent domain in pipeline projects has 'been a long time coming' as Senate discussions on similar measures have failed to advance for the past three years.
'We had a lot of pushback over the years and and we felt this year, it was getting strung out as well, so we took this measure to do everything we can to bring it to the floor,' Rowley said.
The measures brought up in 2025 and during previous legislative sessions largely focus on the proposed Summit Carbon Solutions pipeline, which would span more than 1,000 miles in Iowa transporting liquid carbon dioxide from ethanol plants to underground storage facilities in North Dakota. Rowley said he has had many discussions with landowners who would be affected by the Summit project, many of whom are concerned about the potential health risks posed by a CO2 pipeline on their property.
'It's horrible to think that the government could come in and force them to have that pipeline on their property,' Rowley said. 'And even though Summit's done a great job I think, working with people or trying to, it's still — it's not enough. It can't be enough.'
The bill brought up in the letter is a measure the House advanced in March to prohibit carbon sequestration pipelines from using eminent domain in Iowa. Floor debate at the time included concerns over the Senate's avoidance of eminent domain bills over the past several years.
The proposal combines a number of bills previously proposed in the House aimed at hindering the Summit Carbon Solutions pipeline. The bill would increase insurance requirements for pipeline operators, limit permits to one 25-year term and adjust the definition of a common carrier that would eligible for eminent domain. The bill also requires a member of the Iowa Utilities Commission be present at all hearings, limits the commission's ability to impose sanctions on Iowans who intervene in the proceedings and allows affected Iowans, including lawmakers, to intervene.
Sen. Mike Bousselot, R-Ankeny, proposed a major amendment to the bill that would remove the eminent domain ban and broaden the scope of the bill to include all eminent domain projects in the state — such as roads or utility lines — not just liquid hazardous pipelines. The amendment, which can only be officially adopted on the floor, would allow projects to find voluntary easements outside of the original project corridor, which Bousselot said during committee hearings would allow projects to 'avoid' eminent domain.
His amendment would also require an IUC decision on a permit within one year and strikes almost all of the House language, keeping only the IUC attendance requirements and portions of the insurance requirements.
Sen. Kevin Alons, R-Salix, proposed a strikethrough amendment to Bousselot's proposition. Another amendment, proposed by a group of largely the same GOP lawmakers who signed onto the letter, would limit the definition of public use projects in Iowa Code related to eminent domain for the construction of 'hazardous liquid pipelines for the transportation or transmission of liquefied carbon dioxide.'
Salmon, R-Janesville, said in an interview with the Iowa Capital Dispatch the letter was sent as public pressure has been building for Iowa lawmakers to take action on this issue.
'By and large, the public has become quite aware of it now, and and really don't see the need for eminent domain to be used for this project,' Salmon said. 'It's a private project. It's for private use. It's not a public use project, and our Constitution requires it be a public use in order to have eminent domain used.'
The fact that South Dakota now has a law banning the use of eminent domain for carbon dioxide pipeline has also helped 'build the momentum to put the same type of prohibitions on CO2 pipelines here in Iowa,' Salmon said.
Senate Majority Leader Jack Whitver said in a statement that 'a number of Republican Senators are working on policy surrounding eminent domain and pipeline issues and I am optimistic we will find a legislative solution.'
The senators' plan to block legislation from moving unless eminent domain legislation comes to the floor is not the only item keeping lawmakers from advancing budget bills.
On Monday, the governor and Senate Republicans said in a news release they had reached a 'budget compromise.' The same day, House Republicans released their own targets for the state's fiscal year 2026 budget.
In the following days, appropriations subcommittees and committees passed budget bills. But as of Thursday, the chambers have not reached resolutions on the line items that remain a conflict between the two chambers. House Appropriations Committee Chair Rep. Gary Mohr, R-Bettendorf, asked lawmakers on the Appropriations Committee Thursday to 'stand ready' for future meetings, but did not lay out a timeline for when the committee will advance the remaining budget bills.
The difference between the two budget targets comes down to $36 million, a relatively small amount when comparing the$9.453 billion in the House proposal and $9.417 billion in the agreement reached between Gov. Kim Reynolds and Senate Republicans. However, Reynolds said in an interview on the WHO AM Simon Conway show this amount was still important during a time when the state needs to be 'fiscally responsible,' as it faces lower revenue from income tax cuts and federal financial uncertainty.
'Somebody said, 'Well, it's not that much money, it's only $36 million difference between the two,' — well, it is a lot of money,' Reynolds said in the interview. 'Ask Iowans how much money that is. And every time, it's that kind of mentality, it's that kind of thought process that grows government and gets you in trouble in the first place.'
But House Speaker Pat Grassley told reporters Thursday the differences between the two budgets largely entail spending for which House Republicans will have trouble compromising.
One of the largest pieces, $14 million, provides continued funding to raise the pay for paraeducators and other school staff. The measure was first approved in a 2024 law that also made changes to Iowa's Area Education Agencies. Grassley said this spending was included in Reynolds' original budget proposal for fiscal year 2026 and then removed in negotiations with the Senate.
'At no point did we think that that wasn't going to be something that we were going to be able to fund,' Grassley said. 'And I will be honest with you, that's one of the pieces right now that I would say is one of the biggest sticking points. Our caucus feels extremely strongly that if we're going to provide that level of support that we did with that bill last year, that we're not going to go back and just cut that, and leave our schools in a situation to find the difference.'
Reynolds said Thursday in an interview with Radio Iowa that 'nothing was mentioned about the $14 million' in earlier negotiations on education spending related to the State Supplemental Aid package passed in early April.
Other spending components in House Republicans' package that differ between the two chambers are an $8 million bump for community colleges compared to the Senate proposal, and a $9 million difference in funding for certain nursing facility reimbursement rates.
Grassley said it is not out of the ordinary for the governor and Senate Republicans to be in closer alignment on budget goals than House Republicans.
'With 67 members representing every county across the state, we try to have a very open situation when it comes to our budget, take as much feedback and fund those priorities. And again, our goal is when we leave here (that) we fund the commitments that we've made to Iowans, as well as make strategic investments.'

California liberals welcomed Gov. Gavin Newsom's speech condemning President Trump, but some remained skeptical of the governor. Republicans, meanwhile, saw his address as opportunistic and blamed him for the state's turmoil. For months, Californians weren't sure what to make of Gov. Gavin Newsom. There was the new podcast on which he interviewed right-wing influencers and said he felt trans athletes shouldn't participate in women's sports. There was the meeting in February with President Trump in the White House. And there were occasional snipes at Republicans, but nothing like those Mr. Newsom had dished out in years past. Then came a blistering nine-minute speech on Tuesday in which Mr. Newsom warned Americans that Mr. Trump was destroying democracy and acting as an authoritarian who would eventually send the military to states across the country. Many liberals in California cheered Mr. Newsom, finally seeing in him the leader of the resistance that they had been missing. Those feeling confused and fearful since Mr. Trump started his second term were looking for someone to stick up for them and said they appreciated Mr. Newsom's forcefulness. 'In a time of rising fear and growing threats to democracy, he spoke not just as a governor, but as a moral leader,' said Representative Lateefah Simon, Democrat of California. 'He named the danger plainly.' But others, while supportive of his message, were not entirely convinced. They said testing the political climate ahead of a potential run for president. 'Even if you're late to the party, you know, welcome to the fight,' said Hugo Soto-Martinez, a progressive City Council member in Los Angeles, who appreciated what Mr. Newsom said but wished the governor had stood up to the president sooner. Adrian Tirtanadi, executive director of Open Door Legal, a nonprofit which provides free legal representation for immigrants and others, said he liked all of the words in Mr. Newsom's speech. But, he said, he wondered why the governor was not backing up the rhetoric with more financial support for immigration lawyers who could fight deportation. Big talk without much action, Mr. Tirtanadi said, is often the California way. Still, others appreciated that Mr. Newsom had demanded that Mr. Trump stop workplace raids and filed lawsuits seeking to block the deployment of National Guard troops and Marines in Southern California. That has given some hope to immigrants who have felt powerless. When David Campos was 14, he and his family traveled by foot and by bus, across deserts and over mountains, to California from their home in Guatemala. They scurried under a border fence and settled in South Central Los Angeles without legal papers. The family eventually obtained citizenship through his father's carpentry job. Mr. Campos went on to Stanford University and Harvard Law School, served on the San Francisco Board of Supervisors and is now the vice chairman of the California Democratic Party. Mr. Campos said he was glad that Mr. Newsom, the former San Francisco mayor with whom he sometimes clashed, took a defiant stance toward Mr. Trump. 'I'm glad he's rising to this moment,' Mr. Campos, 54, said in an interview. 'The governor reminded us that if the president can do this in California, he can do it anywhere in this country. That's how a democracy can die.' Republicans in California, many of whom have aligned with President Trump, said they were decidedly unimpressed with the governor's speech. Senator Brian Jones, the State Senate minority leader, said that the governor seemed to have been filming an early campaign commercial with his speech, from the way the flags were set in his backdrop to the suit he was wearing. 'It doesn't do anything to lower tensions in L.A.,' Mr. Jones said. 'When he says we all need to stand up, is he encouraging more people to show up to the riots and participate?' James Gallagher, the Republican leader of the California State Assembly, called the governor's address 'self-righteous political posturing.' Mr. Gallagher said California's policy of preventing local law enforcement from working with federal immigration officials created the current tension. He said he found it funny that Mr. Newsom was accusing Mr. Trump of being authoritarian when the governor ordered Californians to close their businesses, stay home from church, attend school on Zoom, wear masks and get vaccinated during the Covid-19 pandemic. 'He was a total tyrant, and he has no business talking about authoritarianism because he is exhibit A,' Mr. Gallagher said. Mr. Newsom's speech, as well as his sharp-tongued retorts to Republicans on social media this week, won some plaudits from younger influencers. Dwayne Murphy, Jr., a 34-year-old content creator who lives in Downey, Calif., and said he votes Democrat, said he appreciated that the governor 'seems to be hyper-focused on standing up for this state at a time like this, and I feel like that's what people are very encouraged by.' Inkiad Kabir, 20, a pop culture content creator who lives in the Inland Empire region of California, said that Mr. Newsom was the rare Democrat willing to go on the attack, calling him 'basically liberal Trump, in a way.' Mr. Kabir created a popular TikTok video this week in which he called the governor 'Daddy Newsom' and likened the governor to a 'toxic ex that you promise you're not going to go back to, but you always go back to.' For now, it seems, Mr. Kabir has gone back.

Democrats look for reinvention and a new playbook against Trump in key committee race

WASHINGTON -- House Democrats are quietly engaged in a behind-the-scenes race for a key committee position, the second time in as many months that the party has had to fill one of the most prized positions in Congress. Four Democrats are running to be the ranking member on the House Oversight Committee, an investigative panel with public clout, subpoena power and an expansive portfolio. The position is open due to the death last month of Rep. Gerry Connolly of Virginia. While Democrats in the minority have little power to shape the committee's work, the ranking member position comes with an enormous platform — and the possibility of becoming chair if the party wins back the majority in next year's midterm elections. Whoever wins will immediately be squaring off against Republicans as they prepare for splashy hearings this summer on immigration enforcement, LGBTQ rights and former President Joe Biden's age and mental condition while in office. As they hear from the candidates, Democrats are weighing many of the factors that were in play late last year, when Connolly, a veteran member of the committee, fended off a challenge from Rep. Alexandria Ocasio-Cortez of New York. A look at how the race is shaping up: The debate over Biden's age coincides with a reckoning over seniority and generational change happening across the Democratic Party. Four House Democrats are running for the position: Stephen Lynch of Massachusetts, the acting ranking member; Jasmine Crockett of Texas, a viral sensation; Robert Garcia, a former Los Angeles County mayor who has pitched colleagues on a government reform agenda; and Kweisi Mfume of Maryland, former president of the NAACP and civil rights advocate. While Lynch is the most senior of the four, Democrats broadly said they are more open to breaking from seniority than they were in December, when Connolly, then 74, beat out Ocasio-Cortez, 35, for the job. Democrats are interested in how the candidates would communicate with the public, how they would help support lawmakers in battleground districts — and of course, how they would challenge President Donald Trump and his administration. Crockett, 44, has pitched herself as the candidate best able to compete with Trump's pugnacious and attention-grabbing style. Democrats, Crockett has argued, often fail to connect with voters and explain why the president's actions may be harmful. She believes she can. 'It's a matter of bringing that in, having a hearing and making sure that we are translating it and amplifying it,' Crockett told MSNBC in an interview. 'Communications has to be a full-on strategy.' Garcia, 47, has focused on government reform and effectiveness, a key issue for Democrats after the Trump administration's blitz across federal agencies and mass firings of federal workers by billionaire Elon Musk's Department of Government Efficiency. Mfume, 76, has attracted support from members impressed by his longtime stewardship of the nation's oldest civil rights group. He returned to Congress after decades leading the NAACP following the death of a previous Democratic Oversight chair, the late Congressman Elijah Cummings, a fellow Baltimore Democrat. Lynch, 70, has styled himself as the acting chair and the lawmaker best positioned to take on the committee's chairman, Republican James Comer of Kentucky. 'There are some members who speak to a very narrow audience, and that's great,' Lynch said. 'We want them to be energized and animated. But that same person is not going to go to the Rust Belt with people that are farmers, moderates, conservatives,' Lynch told The Associated Press. 'You need different voices to appeal to different constituencies.' 'I think I have a better chance of bringing back the blue-collar working people, and I have less of a chance of appealing to very younger people who are intensely invested in social media,' Lynch said. The vote for Oversight ranking member is scheduled for June 24 and will be conducted by secret ballot. All four candidates are speaking before multiple caucuses this week, including the New Democrats and the progressive caucus, the Congressional Black Caucus, the Congressional Hispanic Caucus and the Congressional Asian Pacific American Caucus. While many Democrats are undecided, others have made up their mind. Some who are privately stumping for their candidate believe it will be a tight race. That makes the public forums and private pitches even more crucial in the run-up to the vote. House progressives are divided over their preferred choice. Three members of the Congressional Progressive Caucus — Crockett, Garcia and Mfume — are vying for the ranking member seat, which makes it unlikely the caucus will back a single candidate. 'We're looking for folks that could expose this kind of corruption and hold Trump and his billionaire donors accountable,' said Rep. Greg Casar of Texas, the Progressive Caucus chair. Rep. Brad Schneider, chair of the centrist New Democrat Coalition, said he's weighing two factors: which candidate could best help Democrats win the 2026 midterm elections and whether they can successfully lead investigations into the Trump administration and 'try to repair some of the damage that's been done.' 'The committee can be a flash point, or it can be a very effective place for us to make our point, and we want to know who's going to do best in that role to make sure the committee works to help us secure 218 (members) next November,' Schneider said. Some Democratic caucuses have traditionally prized seniority as a clear and reliable way for lawmakers of color to rise through the ranks. There has never been a Hispanic Oversight chairman and only one Black chairman, Elijah Cummings. 'The CBC has always stood for seniority,' said Rep. Hank Johnson of Georgia. But Johnson noted that the Black Caucus has at times 'deviated' from that norm. He said many in the caucus are open to a conversation about age. 'So, Steve Lynch, I think, is the next senior member. And but as I said, other factors have to be considered and I'm sure that, along with myself, other CBC members are going through that process,' Johnson said. 'Since I've been here, seniority has had weight,' said Rep. Gregory Meeks of New York, who said he was undecided on which candidate to back. 'But seniority is not the only thing. And there are times and circumstances where the person with the most seniority has not won. Whether that's one of these times or not is what we're going to see.'
