'Judicial corruption weakens trust': CJI Gavai amid Yashwant Varma case

Chief Justice of India (CJI) BR Gavai has warned that corruption and misconduct within the judiciary can seriously undermine public trust, posing a threat to the credibility and integrity of the entire justice system, Bar and Bench reported.
His remarks come amid allegations against Allahabad High Court Justice Yashwant Varma, who is facing scrutiny after a substantial amount of burnt cash was recovered from his official residence in Delhi on March 14.
Speaking at a roundtable conference at the Supreme Court of the United Kingdom on 'Maintaining Judicial Legitimacy and Public Confidence', Justice Gavai said every system, no matter how robust, is susceptible to issues of professional misconduct. 'Sadly, there have been instances of corruption and misconduct that have surfaced even within the judiciary. Such occurrences inevitably have a negative impact on public confidence, potentially eroding faith in the integrity of the system as a whole.'
He said. 'However, the path to rebuilding this trust lies in the swift, decisive, and transparent action taken to address and resolve these issues. In India, when such instances have come to light, the Supreme Court has consistently taken immediate and appropriate measures to address the misconduct.'
Defending the collegium system
CJI Gavai also defended the collegium system, which governs appointments to the higher judiciary. He noted that before 1993, the executive branch had the final say on appointments to the Supreme Court and high courts.
'During this period, the executive twice superseded the senior-most judges in appointing the CJI, which went against established tradition,' he said.
While acknowledging criticisms of the collegium system, Gavai insisted that any solution must not compromise judicial independence. 'Judges must be free from external control,' he said.
Justice Gavai stressed that the judiciary must not only deliver justice but also be seen as a credible institution capable of holding power accountable. He explained that judicial legitimacy and public confidence are deeply connected and vital for the system's strength. 'Legitimacy and public confidence are not secured through coercion of command but through the credibility earned by courts. Any erosion of this confidence risks weakening the judiciary's constitutional role as the ultimate arbiter of rights. Transparency and accountability are democratic virtues,' he said.
Concerns over post-retirement jobs
CJI Gavai addressed concerns over judges accepting post-retirement jobs, warning that such roles could raise doubts about judicial impartiality. 'Another point of discussion is post-retirement jobs taken by judges. In India, judges are subject to a fixed retirement age. If a judge takes up another appointment with the government immediately after retirement, or resigns from the bench to contest elections, it raises significant ethical concerns and invites public scrutiny,' he said.
He added that the timing and nature of such roles might create a perception that judicial decisions were influenced by future government posts or political ties. To safeguard judicial independence and public trust, Justice Gavai said that he and many of his colleagues have pledged not to accept any post-retirement roles or government positions.
All-party consensus for impeachment motion
The Union government is planning to move an impeachment motion against Justice Yashwant Varma of the Allahabad High Court during the upcoming Monsoon Session of Parliament. As part of the process, it has begun efforts to build an all-party consensus on the move.
Parliamentary Affairs Minister Kiren Rijiju confirmed to The Hindu that he has already started speaking to political parties to garner their support. 'I have started reaching out to political parties as this is a non-political issue and would be better for all parties to be on board for the same,' he said.
Rijiju will be holding consultations with various political parties to build support for the motion. If successful, this would be the first-ever impeachment of a High Court judge in India.

President Donald Trump's administration on Friday asked the Supreme Court to pause a court order to reinstate Education Department employees who were fired in mass layoffs as part of his plan to dismantle the agency. The Justice Department's emergency appeal to the high court said U.S. District Judge Myong Joun in Boston exceeded his authority last month when he issued a preliminary injunction reversing the layoffs of nearly 1,400 people and putting the broader plan on hold. Joun's order has blocked one of the Republican president's biggest campaign promises and effectively stalled the effort to wind down the department. A federal appeals court refused to put the order on hold while the administration appealed. The judge wrote that the layoffs 'will likely cripple the department.' But Solicitor General D. John Sauer wrote on Friday that Joun was substituting his policy preferences for those of the Trump administration. The layoffs help put in the place the 'policy of streamlining the department and eliminating discretionary functions that, in the administration's view, are better left to the states,' Sauer wrote. He also pointed out that the Supreme Court in April voted 5-4 to block Joun's earlier order seeking to keep in place Education Department teacher-training grants. The current case involves two consolidated lawsuits that said Trump's plan amounted to an illegal closure of the Education Department. One suit was filed by the Somerville and Easthampton school districts in Massachusetts along with the American Federation of Teachers and other education groups. The other suit was filed by a coalition of 21 Democratic attorneys general. The suits argued that layoffs left the department unable to carry out responsibilities required by Congress, including duties to support special education, distribute financial aid and enforce civil rights laws. Trump has made it a priority to shut down the Education Department, though he has acknowledged that only Congress has the authority to do that. In the meantime, Trump issued a March order directing Education Secretary Linda McMahon to wind it down 'to the maximum extent appropriate and permitted by law.' Trump later said the department's functions will be parceled to other agencies, suggesting that federal student loans should be managed by the Small Business Administration and programs involving students with disabilities would be absorbed by the Department of Health and Human Services. Those changes have not yet happened. The president argues that the Education Department has been overtaken by liberals and has failed to spur improvements to the nation's lagging academic scores. He has promised to 'return education to the states.' Opponents note that K-12 education is already mostly overseen by states and cities. Democrats have blasted the Trump administration's Education Department budget, which seeks a 15% budget cut including a $4.5 billion cut in K-12 funding as part of the agency's downsizing.

India, Denmark join hands to set up Centre of Excellence in Green Shipping

Copenhagen [Denmark], June 6 (ANI): Union Minister of Ports, Shipping and Waterways Sarbananda Sonowal met Denmark's Minister of Industry, Business and Financial Affairs Morten Bodskov in a bilateral meeting here on Friday. The meeting resulted in the establishment of the Centre of Excellence in Green Shipping, to be established in India. Both leaders reaffirmed the Green Strategic Partnership and exchanged views on bilateral maritime collaboration. An MoU was signed between the two countries. It is intended to improve the quality and efficiency of maritime activities while promoting the green transition of the maritime sector in India. The ministers underscored this as a new milestone in India-Denmark maritime collaboration with the establishment of a Centre of Excellence in Green Shipping, as outlined in the bilateral Memorandum of Understanding (MoU) on maritime affairs signed in 2024. Union Minister, Sarbananda Sonowal said, 'Under the visionary leadership of Honourable Prime Minister Shri Narendra Modi ji, India is now the 4th largest economy and undertaking several transformative initiatives under our Maritime Amrit Kaal Vision 2047. These include efforts in port infrastructure, green shipping, shipbuilding, and digitalisation.' 'We seek Denmark's participation and investments in these transformative initiatives, where your expertise and leadership in sustainable maritime practices can make a significant impact. We are keen to develop both domestic and international green shipping corridors with Denmark. Identifying suitable routes, developing supportive policy, and building infrastructure will be key,' Sonowal added. The two ministers reaffirmed the Green Strategic Partnership, as mutually agreed upon by Prime Minister Narendra Modi Denmark counterpart, Mette Frederiksen. The Ministers highlighted the importance of the bilateral Memorandum of Understanding on maritime affairs signed in 2024, which encompasses establishing the Centre of Excellence (CoE) in Green Shipping. The ministers highlighted alignment with targets set out in the Government of India's Amrit Kaal Vision 2047, including India's ambitions to become a green shipping hub for the international maritime sector. A Letter of Intent (LOI) was signed between the National Maritime Heritage Complex (NMHC), Lothal, and the Maritime Museum of Denmark, Elsinore, to increase collaboration in the preservation and valorisation of cultural heritage related to maritime heritage. The LOI established a framework for cooperation to study, exchange, or showcase common maritime heritage, share technical know-how, and conduct joint research on common maritime heritage. Adding further, Sarbananda Sonowal said, 'We appreciate Denmark's engagement through the Joint Working Group on Shipping and the India-Nordic Summit. The Joint Action Plan on Green Strategic Partnership provides a strong framework to drive all this forward. Our maritime cooperation is built on mutual trust, shared values, and a common vision for a sustainable and future-ready maritime sector. Our joint efforts will also contribute meaningfully to global maritime sustainability and innovation.' Both sides discussed possible ways and means to deepen bilateral maritime relations spanning green shipping, decarbonisation, maritime training and education, green fuel and technology collaboration, and ship recycling. India has proposed that the National Centre of Excellence for Green Port and Shipping (NCoEGPS) and the Danish Maritime Authority (DMA) begin joint work on certifications and launch collaborative research focused on energy efficiency technologies. It also proposed that the Indian Ports Association (IPA) coordinate with the Port of Aarhus to develop smart port solutions. These innovative models can later be adapted and scaled across ports in India to enhance operational efficiency and sustainability. 'Digital transformation is a shared goal between us. Denmark's use of technologies like blockchain for ship registries and automation in port operations is closely aligned with our Maritime India Vision 2030 and Amrit Kaal Vision 2047,' added Sarbananda Sonowal during the meeting. The CoE is intended to improve the quality and efficiency of maritime activities while promoting the green transition of the maritime sector in India. Both parties identified the Maersk McKinney Moller Center for Zero Carbon Shipping (MMMCZCS) and the National Centre of Excellence for Green Port and Shipping (NCoEGPS) as key institutions to formulate a specific project plan for the development of a Green Corridor. Indo-Danish CoE will contribute to the development of green corridors through a pre-feasibility study. The study will serve as a preliminary assessment of the main components of possible green corridors in India and outline the most promising ones. (ANI)

The discussions focused on deepening cooperation between the two countries, particularly in the areas of counterterrorism and economic partnership. Both sides reaffirmed their commitment to strengthening cooperation and democratic values. Both sides emphasised the need for global cooperation to combat terrorism, with Nouripour highlighting India's experience with terror attacks and the importance of standing together against extremism. Terrorism is a global curse, and India's efforts to give security to its people are appreciated. Globally, we need to work together in the field of terrorism, and also, there needs to be good economic cooperation between these two great countries.
