Calgary may speed up building new neighbourhoods if it doesn't require upfront costs

A city committee endorsed a move to fast-track approvals for new communities on Calgary's outskirts, but only if they don't require capital investments from the city.
Currently, developers submit applications throughout the year to build new subdivisions, but a final decision from city council only comes once a year, during budget deliberations in November.
According to city administration, this is because applications are reviewed to determine the capital costs required to enable construction, which could include roads, utilities and water, as well as emergency services like fire stations.
However, city administration says some of the applications for new neighbourhoods only require operating investments for the city services and not new capital costs, as they leverage previously installed infrastructure.
On Wednesday, the city's Infrastructure and Planning committee unanimously endorsed a proposal that would speed up approvals for new subdivisions, provided they only require operating costs.

'We talk about removing red tape, and this is an opportunity to remove red tape,' said Ward 1 Coun. Sonya Sharp, who chairs the committee.
As part of the proposal, administration is also recommending city council approve six new subdivisions.

Operating costs, which are supported by property taxes, for the neighbourhoods are $140,000 per year to expand Calgary Transit service to the areas.

But the city's report on the proposal warns council's approval of a new community commits the city to future long-term operating and capital investments 'as a community develops and services are provided to future residents.'

City administration estimates at full buildout, the six new subdivisions will require $3 million in tax-supported funding annually for city services.
The communities will also eventually require $609 million of capital investment, with $189 million supported by taxes, $109 million coming from off-site levies and development fees, and $311 million coming from utilities to be repaid by user fees.
'When you look at full buildout you have to look at the return on investment and how much those houses and that area will bring money back into the city as revenue generation,' Sharp said when asked about the potential future costs.
The move is getting support from the development industry with representatives from BILD Calgary Region noting the current process can create delays.
'It better aligns approvals with infrastructure readiness, reduces uncertainty for investors, and supports a more responsive approach to Calgary's growing housing needs,' Deborah Cooper with BILD Calgary told committee. 'That small shift helps manage costs and risk more effectively and supports a more reliable housing supply.'
However, it follows a slew of spending commitments from city council outside of budget talks, including $20 million in surplus Enmax dividends for city facility upgrades, and $15 million to retrofit Calgary Transit buses with improved shields to protect operators.
'There are times that you have to look at making decisions that are outside of the budget cycle in the best interest of the people you serve,' Mayor Jyoti Gondek said.

'When we are trying to deliver on housing, sometimes those ideas need to come forward ahead of a budget cycle.'
The six new communities as well as proposed change to the approvals process will now go to city council as a whole for a final decision later this month.

LONDON (AP) — Lawyers have cited fake cases generated by artificial intelligence in court proceedings in England, a judge has said — warning that attorneys could be prosecuted if they don't check the accuracy of their research. High Court justice Victoria Sharp said the misuse of AI has 'serious implications for the administration of justice and public confidence in the justice system.' In the latest example of how judicial systems around the world are grappling with how to handle the increasing presence of artificial intelligence in court, Sharp and fellow judge Jeremy Johnson chastised lawyers in two recent cases in a ruling on Friday. They were asked to rule after lower court judges raised concerns about 'suspected use by lawyers of generative artificial intelligence tools to produce written legal arguments or witness statements which are not then checked,' leading to false information being put before the court. In a ruling written by Sharp, the judges said that in a 90 million pound ($120 million) lawsuit over an alleged breach of a financing agreement involving the Qatar National Bank, a lawyer cited 18 cases that did not exist. The client in the case, Hamad Al-Haroun, apologized for unintentionally misleading the court with false information produced by publicly available AI tools, and said he was responsible, rather than his solicitor Abid Hussain. But Sharp said it was 'extraordinary that the lawyer was relying on the client for the accuracy of their legal research, rather than the other way around.' In the other incident, a lawyer cited five fake cases in a tenant's housing claim against the London Borough of Haringey. Barrister Sarah Forey denied using AI, but Sharp said she had 'not provided to the court a coherent explanation for what happened.' The judges referred the lawyers in both cases to their professional regulators, but did not take more serious action. Sharp said providing false material as if it were genuine could be considered contempt of court or, in the 'most egregious cases,' perverting the course of justice, which carries a maximum sentence of life in prison. She said in the judgment that AI is a 'powerful technology' and a 'useful tool' for the law. 'Artificial intelligence is a tool that carries with it risks as well as opportunities,' the judge said. 'Its use must take place therefore with an appropriate degree of oversight, and within a regulatory framework that ensures compliance with well-established professional and ethical standards if public confidence in the administration of justice is to be maintained.'

The City of Edmonton is moving into the second of three phases of its accelerated roadwork this summer, to make room for the 14-kilometre second leg of the Valley Line LRT from the downtown core to the west end. There will be a partial closure upcoming at Stony Plain Road and 142 Street. As the project enters Phase 2, that means some construction will wrap up shortly in the intersections under Phase 1. Traffic is expected to flow through the intersection of Stony Plain Road and 124 Street sometime next week ,after being closed for seven weeks. 'Thanks to favourable conditions, we're able to open the 124 Street intersection on schedule,' Marigold Infrastructure Partners construction manager Jonathan Cox said in a statement. 'We recognize this closure had a significant impact on the businesses in the area, and we sincerely appreciate their patience during this important construction period.' The three-phase accelerated plan began in April and is expected to wrap up by the end of November, resulting in significant traffic restrictions at key intersections and along busy corridors. In a news conference Friday morning, both the city and Marigold said closing down whole intersections is a strategy they hope to adopt in future projects. If there's something we can do to a location that's similar that has the same results, then absolutely,' Latte said. 'This performed exactly as we expected,' Cox explained. 'I think, maybe, some members of the public had some skepticism — which was justified, based on previous projects in the city and previous performance. But, this is the new normal, I think for us, and we can deliver in these time frames.' The work along the 104 Avenue corridor between 106 Street to 121 Street will remain ongoing throughout all three phases. By the end of 2025, the city said Marigold aims to have all of the roads around the LRT in their final configuration. Major construction began in 2021, and so far, the line is more than 40 per cent complete. Marigold projects that roughly 60 per cent of the project will be complete by the end of the year. The entire west leg of the Valley Line LRT is expected to be complete in 2028. The Valley Line is a public-private partnership being built by Marigold Infrastructure Partners, which is made up of a team from French civil engineering and construction firm Colas and American technology-focused defense, intelligence, and infrastructure engineering firm Parsons. The opposition is raising new questions after the province hired Dr. Tim Stainton's consultancy to review Community Living B.C. Stainton was one of the people who helped create the Crown corporation tasked with caring for some of B.C.'s most vulnerable people. 'Having an expert like Dr. Vigo come and provide advice to government and undertake a very methodical and studious examination of the data that is out there, looking with legal experts at the Mental Health Act … this is not something that can be replicated inside government,' she said. 'It is really important at this point in time that we have this expert advice. And the recommendations that Dr. Vigo and his team have put forward to government are actions we are already seeing underway.' As a part of Vigo's work, the province has now opened 28 beds in two involuntary care facilities, one at the South Fraser Pretrial Centre and one at the Alouette Homes in Maple Ridge, for people who are not in contact with the criminal justice system.
