We asked Fresno police chief about traffic stops and race. Here's what she said
Police disproportionately stop Fresno commuters who are people of color for reasons based on administrative or equipment violations rather than unsafe driving — a practice critics say is outdated.
Advocates say it's a misuse of public money and a burden on communities of color.
Law enforcement officials say making pretextual stops is an important tool in policing and ensuring public safety.
Fresno's Black drivers are stopped for non-moving or administrative issues two times more often than white drivers based on the number of stops per 1,000 residents, according to data produced annually from the Racial and Identity Profiling Act of 2015.
Hispanic drivers make up 53% of Fresno police stops, which is higher than the number of people in the community. Fresno is half Latino, according to the U.S. Census.
Non-moving violations could include having illegally tinted windows or a bumper in need of repairs. Administrative violations, for example, include an expired registration.
That kind of violation can also be the reason for 'pre-text stop,' when an officer stops a commuter for one of those less serious violations but actually wants to investigate the driver further.
Critics argue non-moving and administrative stops are used in a discriminatory way, noting people of color are stopped at higher rates per capita. The stops are a common police practice that has come under scrutiny in some larger cities in recent years.
The most common traffic stop at 43% in Fresno is related to unsafe speed, a moving violation, according to the latest data.
Chief Mindy Casto argues Fresno police rarely use pre-text stops and are more likely to make an investigatory stop because officers have a reason to believe the car is connected to a crime.
'They're actually pulling the car over because they have a reasonable suspicion to detain for an important investigation,' she said. 'We've got a lot of proactive units in the city.'
Casto said she sees the imbalance in who gets stopped as a reflection of the areas of the city that have more crime, and are more likely to see officers patrolling. She also said that officers pulling over a driver most often do not know the racial background of the driver until after they've made the stop.
The RIPA data is based on the perception of the officers, and not necessarily based on how the residents describe themselves.
'I challenge you, when you're driving around tonight, particularly (if) you're behind a car, you don't know who's driving it,' Casto said. 'You pull the car over, then the RIPA data is based on your observations after the stop, not before the stop.'
Critics also note the disruption on drivers of color can have greater effects, which can be seen as harassment.
The average duration of a stop was 15.3 minutes, the report notes. White pedestrians and drivers averaged slightly shorter stops at 14.95 minutes, while Black residents waited 20.75 minutes and Hispanic residents waited 18.8 minutes.
'Interacting with a police officer could escalate to arrest warrants, use of force, profiling, all of that,' said Myanna Khalfani-King, an attorney and manager of Equity in Community Investments with Catalyst California.
San Diego-based nonprofit Catalyst California teamed up with Building Healthy Communities in Fresno for a report released in February using RIPA data. They say Fresno police should emphasize stops directly related to moving violations.
'What we see now is the historic practice and policies of the police have not done anything to really help build this feeling of safety or feeling of community,' she said.
It's not unheard of for municipalities to outlaw pre-text stops and require police to conduct traffic stops only for moving violations or when immediately related to public safety, which could include when police have a warrant for someone's arrest.
Washington state's constitution outlaws using stops for minor traffic violations to look for other crimes, and San Francisco outlawed pre-text stops last year.
Khalfani-King said ideally the city of Fresno would change policy to have someone other than a sworn police officer who would issue tickets for expired tags, tinted windows and other less serious violations.
The Catalyst California report argues the traffic stops are also a waste of money in a city where the police budget is $288 million.
There is a segment of Fresno's population who don't feel better when they see an officer. Carmen Galvez, 40, said she's afraid when she sees a patrol car in her rear-view mirror or on the street.
The resident of Fresno for about two decades said her children are even more scared.
'My kids tell me, 'Don't trust the cops,' ' she said in Spanish. 'Many times the police don't believe what you say.'
She said she has had run-ins with police that did not end in her getting into trouble, but the interaction induced fear.
There's the time she kept driving straight ahead and drove across town because she was afraid the officer behind her was looking for a reason to pull her over, or another interaction when an officer stopped her to ask her if she had been drinking while she was sober and headed to pick up a friend for their night shift at a packing plant.
Critics of the police say that kind of unpleasant interaction with an officer could be reduced if cops were not making traffic stops over administrative or non-moving violations.
Casto said officers use administrative and non-moving violations when they need to in proactive policing, and the Fresno Police Department tries to build community through engagement.
She pointed to the decrease in homicide and shootings in recent years in Fresno, saying proactive policing plays a part.
In Fresno, there were 30 intentional homicides in 2024, down from 35 the previous year. It was also a significant fall from the gruesome high of 74 in each of 2021 and 2020, according to Fresno Police Department figures. The crime has decreased nationally at the same rate.
Casto said she also believes the majority of Fresno residents want proactive policing.
'Proactive policing absolutely makes an impact on violent crime,' she said. 'Part of proactive policing is traffic stops of any variety.'

L.A. law enforcement leaders walk tightrope in missives about immigration crackdown
While publicly chastising groups protesting immigration raids, Los Angeles Police Chief Jim McDonnell has offered support to officers in his Latino-majority department who may have mixed feelings about the Trump administration's crackdown. In a department-wide missive sent out earlier this week as protests ramped up, McDonnell acknowledged some officers were "facing criticism from the community or wrestling with the personal impact," of recent events and needed support. "When federal immigration enforcement actions take place in communities that may reflect your own heritage, neighborhoods, or even your family's story, it can create a deep and painful conflict," he wrote. "You may be wearing the uniform and fulfilling your duty, but inside, you're asked to hold a complex mix of emotions." It was an unusual display of solidarity for a chief who has rarely waded into the contentious immigration debate. McDonnell has bristled over criticism about his relationship with the U.S. Immigration and Customs Enforcement while serving as Los Angeles County Sheriff during Trump's first term. At a City Council hearing Tuesday, he sparred with city leaders who challenged the department's relationship with federal authorities. Councilmember Hugo Soto-Martinez, who sits on the Council's public safety committee and represents an Echo Park-to-Hollywood district, said in a statement to The Times that he wasn't surprised that Latino police officers may be feeling conflicted. "Families are being ripped apart, and I'd bet nearly every one of them has a parent or relative who's undocumented, or were even undocumented themselves at some point," said Soto-Martinez. Art Placencia, a retired LAPD detective, recalled being a young cop on the job in the years when cops would arrest Latinos simply because they believed that they might be in the country illegally and deliver them into federal custody. The LAPD of today is vastly different than when he was on the job, he said. Prodded by lawsuits and consent decrees, the once-mostly white department has grown to become more than half Latino, which more or less mirrors the city's demographics. And while Latino officials are under-represented in the LAPD's upper echelons, they wield more political clout than ever, Placencia said. Placencia, the former president of an prominent association for Latino officers that once sued the LAPD for discrimination in promotion decisions, said McDonnell is caught in a bind of having to navigate the city's left-leaning politics while also backing up his rank-and-file officers on the front lines against hostile crowds. "He's gotta show that he's concerned about the officers and their feelings," said Placencia. "They're the ones that are out there, they're the ones that are getting rocks thrown at them." In past interviews, McDonnell has spoken proudly about his immigrant upbringing — both of his parents moved to Boston from Ireland a year before he was born — saying that he understands the struggle of trying to make a better life in America. But as sheriff he also came under fire by breaking ranks with many other area politicians by opposing a 'sanctuary state' bill that sought to prevent federal immigration agents from taking custody of people being released from California jails. The selection of McDonnell last November came as a disappointment among some within the department, who had hoped Bass would pick Robert Arcos, a third-generation Mexican American, who had the backing of some powerful Latino civic leaders and would have been the first Latino chief of a city that is more than 50% Latino. Ruben Lopez, a retired LAPD SWAT lieutenant, said he appreciated that McDonnell decided to address the internal moral dilemma that some officers face. Lopez remembers wrestling with similar feelings when, as a young cop, he was on the front lines of a massive protest over Proposition 187, a controversial law that would bar undocumented immigrants from receiving public school educations and a range of other state- and county-funded benefits. "I remember some of the command staff wanted to be more aggressive, and I felt these were just families and kids wanting to exercise their right to protest," he said. "Because if we don't have that trust in the community, including immigrant communities then we're not going to get that collaborative approach to police a city of this size." These were just some of the coast-to-coast rallies on Wednesday in the growing movement to oppose the U.S. government's immigration policies as ICE agents continue to carry out immigration raids across the country. Protests also broke out in Los Angeles, the epicenter of the country's attention, after unrest and curfews followed ICE raids in the city on Friday. More than 200 people have been arrested in Los Angeles this week, police said. Major rallies are also expected nationwide on Saturday to coincide with President Donald Trump's military parade. Many of the hundreds who attended the Las Vegas rally carried Mexican flags, some waved the Stars and Stripes, and others featured flags from Central and South America. In what appeared to be a tense standoff, police told protesters to move back while one video showed a long line of police firing what appeared to be tear gas. Las Vegas police said they declared the protest an 'unlawful assembly.' One video showed protesters surrounding the Lloyd D. George Courthouse and chanting, 'If we don't get it, shut it down.' In Spokane, Washington, Mayor Lisa Brown declared a state of emergency and imposed a curfew Wednesday from 9:30 p.m. to 5 a.m. local time, as footage posted to X showed police officers detaining people and tying their hands with zip ties. At least 30 people were arrested, according to local broadcaster KREM, and video showed authorities firing tear gas as people protested outside an ICE field office. In Seattle, at least eight people were arrested. Police said officers were peppered with fireworks, rocks and pieces of cement, while firefighters extinguished a dumpster fire. Videos and photographs of high-profile ICE raids on Wednesday showed people clashing with, running from and being arrested by immigration agents in California. In Los Angeles' historic Mexican neighborhood of Boyle Heights, two vehicles pinned a passenger car at an intersection in what the Department of Homeland Security called 'a targeted arrest of a violent rioter' who had allegedly punched an immigration officer. In Downey, another predominantly Latino city southeast of Los Angeles, officials from Downey Memorial Christian Church and others confronted a group of five armed men in plain clothes and tactical gear who 'swarmed' a man sitting under a tree in the church's parking lot, according to church pastor Al Lopez. 'When we said, 'We don't want this on our property,' this gentleman just shouted again: 'The whole country is our property,'' Lopez told reporters. His wife and senior pastor Tanya Lopez recalled telling the men — whom she said identified themselves only as 'police' — they weren't welcome on church property, and after she got closer, 'They did point their rifle at me, and they said, 'You need to get back.'' Acting ICE Director Todd Lyons appeared on Fox News on Wednesday night to defend federal actions to deport suspected 'criminals' and described the protests in L.A. as 'pure anarchy.' 'What the brave men and women of ICE, the brave men and women of the Department of Justice, all our federal partners, and the brave men and women of the Los Angeles Police Department, I have to think that all we're trying to do is our law enforcement mission, and we have to deal with this,' he said. In California, Trump has deployed thousands of troops, including 700 active-duty Marines, to Los Angeles to quell protests. The move has raised fears that Marines have not been properly trained for interacting with civilians. On Wednesday, the Department of Justice formally responded to California's lawsuit seeking to block the military from involving itself in immigration enforcement, calling it a 'crass political stunt' that is 'endangering American lives.' A court hearing is set for Thursday in San Francisco. California Attorney General Rob Bonta argued in a Tuesday court motion that the Trump administration's deployment violates the Posse Comitatus Act, an 1878 law that bars federal troops from participating in civilian law enforcement efforts. 'The federalized National Guard and active-duty Marines deployed in Los Angeles will engage in quintessential law enforcement activity in violation of the PCA,' the motion said. A military official with knowledge of the operation told NBC News that the Marines would not conduct arrests and would only transport and guard ICE agents. In San Antonio, Texas, Gov. Greg Abbott called up National Guard members in response to demonstrations. 'Texas is a law-and-order state, and we will use every tool that we can to ensure order across our state,' he said Wednesday. The city's outgoing mayor, Democrat Ron Nirenberg, said the governor wasn't asked to send in the guard and didn't give city leaders advance notice. Nirenberg urged peaceful protest and expressed confidence that the city 'knows how to do this right.' Demonstrations in San Antonio remained peaceful Wednesday night.
