The Supreme Court on Thursday refused to entertain the plea of a cardiologist convicted of sexually assaulting his seven-year-old daughter, dismissing his request to suspend the sentence. A bench of Justices B V Nagarathna and Satish Chandra Sharma heard the matter and said the offence was serious and no relief could be granted, a PTI report stated.During the hearing, the bench noted the doctor had committed the assault while under the influence of alcohol. The court observed, "Man becomes a beast after having a drink. We should not say this, but we are the most liberal bench. If we are not giving bail, there are reasons."The judges also said, "See, the kind of things he has done to the child. You do not deserve any relief. The child has made statements against your client. He is a perverse guy, not entitled to any suspension. They were drunk."The bench pointed out that the girl had testified against her father and withstood cross-examination. The judges stated, "You can't do this to your own daughter. Why will she testify against father. She is a small girl who has withstood cross examination."The doctor's lawyer argued that the child's testimony was tutored and pointed to the delay in appeals due to a backlog of over 12 lakh cases in the Allahabad High Court. The lawyer said this delay meant the appeal might not be heard soon.However, the top court said the pendency of cases could not be a reason to suspend the sentence. Following this, the lawyer withdrew the plea and the court dismissed the matter as withdrawn.According to the First Information Report (FIR), the child's mother accused her husband of sexually assaulting their daughter. She lives in Varanasi, while her estranged husband stays in Haldwani, where he runs a nursing home.On March 23, 2018, the doctor took the child to Haldwani. A week later, on March 30, he called his wife to take their daughter back. The girl later told her mother that her father had touched her inappropriately.(Inputs from PTI)

A man at Mumbai's Chhatrapati Shivaji Maharaj International Airport, after arriving from Thailand, was caught carrying 48 venomous snakes and five turtles, a customs official said. The passenger was intercepted by customs officials on Saturday night after he got down from a Bangkok-originated flight, news agency PTI reported. After discovering the 48 highly venomous viper snakes and five turtles, a team from Resqink Association for Wildfire Welfare assisted in the identification and handling of these species, he added. Among these snakes were three Spider-tailed horned vipers, highly venomous and targeting only small prey like birds, as well as five Asian leaf turtles, an AFP report said. As per the provisions under the Wildlife Protection Act, the Wildlife Crime Control Bureau ordered that the reptiles be sent back to the country from which they were brought. Snakes are comparatively an unusual seizure by customs in Mumbai, as officials more often catch gold smuggling, cash, or drugs swallowed by passengers. Earlier in February, a smuggler with five Siamang gibbons, a small ape native to the forests of Thailand, Indonesia, and Malaysia, was caught by customs officials at Mumbai airport. Customs officials said that those small creatures, which are designated 'endangered' by the International Union for Conservation of Nature, were "ingeniously concealed" in a plastic crate inside the passenger's suitcase. Just weeks ago, Mumbai customs officials seized gold and foreign currency worth nearly ₹1 crore at the airport. The gold weighed 0.247 kg, valued at ₹21.96 lakh, and foreign currency equivalent to ₹76.23 lakh. A release from the Finance Ministry said that one passenger was also arrested under the Customs Act, 1962. The seizures were made across two cases. Based on profiling, custom officers intercepted two passengers arriving in Mumbai from Bahrain and Daman, recovering a 24-karat gold bar having a net weight of 247 grams. Another passenger was leaving from Mumbai for Bangkok and just while he was leaving, customs officials caught him with foreign currency USD 90,000 equivalent to ₹76.23 lakh.

The Supreme Court has set aside the cognisance of a prosecution complaint (equivalent to a chargesheet) taken by a lower court in a money laundering trial involving M/s Rathi Steel and its top executive, who were booked by the Enforcement Directorate (ED) in connection with a coal allocation case . A division bench comprising Justices AS Oka (who retired last month) and Ujjal Bhuyan set aside the cognisance order dated November 20, 2024, solely on the ground of "non-compliance" with new provisions under the Bharatiya Nagarik Suraksha Sanhita (BNSS). These provisions require trial courts to issue a show-cause notice to an accused before summoning them to face trial. Clarifying that it had not expressed any opinion on the merits of the ED's complaint, the bench directed executive Kushal Kumar Agarwal to appear before the trial court on July 14, "so that he can be given an opportunity of being heard in terms of the proviso to sub-section (1) of Section 223 of the BNSS." The order also stated, "We make it clear that no further notice shall be issued by the Special (trial) Court to the appellant (Agarwal)." Section 223 of the BNSS applies specifically to "complaints" and not to cases investigated by the police or the CBI. Advocate Vijay Aggarwal, representing the petitioners, argued that under Section 223, accused persons are entitled to be heard before being summoned by the trial court. He emphasized that this section stipulates that "no cognisance of an offence shall be taken by the magistrate without giving the accused an opportunity of being heard." In response, ED's counsel argued that under the new BNSS provision, the hearing granted to the accused is limited to determining whether a case is made out to proceed based solely on the complaint and its accompanying documents. The ED further contended that cognisance is taken of the offence-not the offender. Thus, once cognisance is taken, it need not be taken again when supplementary or further complaints are filed. "Therefore, at that stage, there will be no occasion to give the accused the opportunity to be heard," the ED's counsel argued. Addressing these arguments, the Supreme Court stated in its order that the ED's submissions "need not be considered, as the same do not arise in this appeal at this stage." However, it added, "We make it clear that the said contentions are expressly kept open and can be raised before the Special Court."
