Oklahoma Man's Dream Car Turns Into Nightmare exposes lack of enforcement of Oklahoma's Lemon Law
OKLAHOMA CITY, Okla. (KFOR) – A Oklahoma man's plea for help after spending more than $120,000 on a luxury SUV says his purchase is now one big headache.
According to Kyle Brotherton, his luxury vehicle has been in the shop more than 40 days since purchase and is now insisting the dealership take it back.

'I remember as a kid, I, I went to see my mom's family in Germany, and I got to see the Mercedes factory. And I said, you know, one day I'm going to I'm going to be able to afford a Mercedes. And so finally, you know, 35, 40 years later, I was able to do that', said Brotherton.

Brotherton says, it was supposed to be a lifelong desire fulfilled but currently faces a daily disappointment after deliver of the vehicle at the end of July of 2023 came with a few issuesturned into problem after problem with multiple trips to the shop and word it was finally fixed.
'There were several issues, and the car was in the shop, uh, October, November and December.And it, they, they weren't able to fix the car. And so, we had to…I took the car back and took possession of the car again. And the car went back in the shop in February of 2024. So, since that time, the car's been in the shop over 365 days and for numerous reasons,' says, Brotherton.
After no longer feeling safe in the vehicle, Brotherton said, 'I think that Mercedes probably needs to consider the buyback a little bit differently now.' Days later Brotherton filed suit asking Mercedes to refund his money and take the car back, telling KFOR he'd asked Mercedes to do the same thing months earlier without legal representation in hopes Oklahoma's Lemon Law passed in 2009 would be on his side, but according to the lawsuit obtained by KFOR Mercedes-Benz U.S.A. denied that request, saying the SUV did not qualify under the States' Lemon Law citing they would not participate in the informal dispute resolution process because that's only available to residents in certain states and Oklahoma residents are not included.
News 4 reached out several times to Mercedes-Benz U.S.A, with no response. News 4 reached out to the dealership in Tulsa, where the vehicle was bought and were hung up on. News 4 alsocontacted the dealership in Oklahoma City where the car was serviced and refused comment due to ongoing litigation. News 4 reached out to the State Attorney General's Office regarding Oklahoma's Lemon Law and was told they are not responsible for enforcing the Lemon Law and discovered neither is any other state agency.
Joe Dorman, one of the authors of the Lemon Law told KFOR the enforcement falls on the Governor.
'It's up to the chief executive of the state, the governor, to make sure the agencies are following the law and complying with those things that are passed by the legislature and signed by the governor. So, when an agency is not listed specifically, the governor, and his team are charged with making sure an agency has that oversight and follows the law', says Dorman.

KFOR reached out to the Governor's Office and confirmed what's posted on the AG's website 'no state agency has enforcement authority of the Lemon Law' and the Governor's Office responded stating, 'If an Oklahoman feels like their rights have been violated under the Lemon Law, we encourage them to reach out to a private attorney.'
Brotherton says, he filed a complaint with the consumer protection unit of the Attorney General's Office and as of last Thursday, he and his attorney, along with attorneys for Mercedes, were in court looking to go to trial when attorneys for Mercedes reached out with a settlement offer proposing a full buyback of the vehicle. KFOR is told the details of the exact settlement are still in the works.

Abby Calhoun (@ posted a viral TikTok that's accrued over 1.8 million views documenting her shock upon learning of the vehicular catastrophe. Throngs of users were stunned to hear her story. However, her experience appears to point to a little-known maintenance practice that, if ignored, could have disastrous consequences. Totaled After Service Calhoun's video begins with her walking toward a white Mercedes crossover SUV. Upon cracking open the driver's side door of the car, the clip transitions to a messy sight. An open wiring box is resting on the foot of the car, displaying a series of bundled cables. Following this, she poses in front of the camera and speaks, but the music she appends to the video drowns out her dialogue. However, an on-screen caption explains her predicament. 'Imagine dropping your car off to get serviced at the dealership & then receiving a call that it's 'totaled' or will cost $27K to fix 5 wires so you have to go collect all of your belongings out of it before the insurance company picks it up the next morning at 8am,' she writes. The puzzling situation left Calhoun wondering what went wrong with her vehicle. 'Then you just walk away with so many unanswered questions.. & so confused about what just happened,' she said. According to the TikToker, the service department at the car dealership didn't exactly delineate why her vehicle was wrecked. Furthermore, she reveals that all of this happened after a routine fluid swap, writing: 'How did it happen?? You just wanted new oil, but now you have to get a new car.' Legal Ramifications A slew of commenters who saw Calhoun's video urged her to get the law involved, including one TikTok user who claimed to be a former car tech. According to them, there wasn't any reason for any mechanic to dig up all of those cords. Moreover, they pointed out that if a tech needed to diagnose the vehicle, the OBD port would suffice. 'Imma say this with love. Lawyer up because there's no wayyyyy. As an ex live tech there was absolutely no reason for them to be in your wires. Your obd port is accessible without all that," they wrote. Someone else remarked that they were in a similar situation, which prompted them to seek legal counsel: 'As someone who had this happen to them, get a lawyer. Do not speak to anyone (especially the dealership's insurance) before you speak to a lawyer.' And then there was this TikToker who helped Calhoun set some expectations for the dealership to satisfy as a result of the apparent blunder. They wrote: 'Get a lawyer, they'll get you out of the loan or get all your money back plus some.' Unfortunately, there were other users on the application who had personal car service horror stories to share. One BMW driver claims the dealership wouldn't even take responsibility for ruining her ride: 'Been in this situation. BMW was supposed to change my oil but they locked the engine. Called and said just come get a new car because we're not fixing this.' Car Water Damage? Additionally, there were throngs of people, Calhoun included, who wanted to know what went wrong with her vehicle. A caption for the clip denotes the likely problem: water damage. The TikToker appended the following remark to her clip: 'your reminder to drain your windshield & sunroof!' At least one user was shocked to hear that there are drain holes drivers can use to remove any excess water buildup in their cars. 'Where are there drain holes? And why in my 30 years of driving have I never heard of this? Never? Ever? Who is your mechanic cuz I have questions.' Calhoun replied to the aforementioned user, indicating that this was indeed the issue with her car. Consequently, vital internal components were fried, necessitating an insurance buyout. She penned: 'I've learned that this isn't something a lot of ppl know about or even heard of until A. It happens to them or B. Someone brings it to their attention.' 'That's why I wanted to share this experience in hopes to save someone from this nightmare!' she added. Next, she gave an overview of how folks can prevent this from happening to them: 'But basically anywhere there's a window on your car there's a small drain hole somewhere close to it. That has to be cleaned out so it doesn't clog up which would allow water to fill up in your car.' Do Cars Have Drain Holes? While commenters who replied to Calhoun's clip were incredulous as to the existence of drain mechanisms, they do indeed exist. Mechanic Base , for instance, highlights how all car doors are outfitted with these sluices. The same piece includes images of where they're typically located. Oftentimes, they're right on the bottom of doors. If these holes are clogged, water buildup can occur in a vehicle, resulting in condensation accumulation, mold, and rust. Oklahoma Lottery Commission looking to upgrade digital experience
OKLAHOMA CITY (KFOR) – The gambling and gaming landscape is evolving. It's not just at casinos, but on websites and on your phone. The Oklahoma Lottery Commission is hoping to keep up with the ever-changing gaming world and eventually create an 'iLottery' platform, contingent on lawmaker approval. Those who help people struggling with gambling addiction hope their clients will not be forgotten. LOCAL NEWS: Oklahoma A.G. warning residents about bail payment scam 'We just want guidelines,' said Wiley Harwell, the Executive Director of the Oklahoma Association of Problem Gambling and Gaming. Harwell said more than 6% of Oklahomans have a gambling disorder. One in four Oklahomans are at risk of developing one. 'Those are huge numbers. And that's one of the highest prevalence rates in the united states, is what we have here in Oklahoma,' said Harwell. Immediate rewards and accessibility feed the problem, like being in-person at casinos or online which is becoming more popular. However, Harwell said if you strictly play the lottery your chances of developing a problem are low, just like the bets. 'Most people that do other forms of gambling are also doing the lottery,' said Harwell. 'If you put it online and make it that much more accessible, then the tendency to continue to bet is there.' 'We want people to reach out for help to recognize that this is potentially addictive and to, you know, play safely,' said Harwell.
